1 COMPANY TARIFF FOR THE MOTOR VEHICLE LIABILITY INSURANCE Tariff Provisions (ITALY) 1. Scope of Application For insurance contracts in Motor Vehicle Liability Insurance of private motor vehicles admitted to traffic in Italy for members and associated members according to the by-laws of United Services Automobile Association, San Antonio, Texas, USA, and insureds of USAA Ltd., London, England, these tariff provisions and the premium part tariff relevant to the insured risk will apply. 2. Duration of Contract/Effective Date for Tariff Changes a. The insurance contract will be concluded for the duration of one calendar year or for a shorter period of time (insurance period). b. For existing contracts, tariff changes will become effective only at the beginning of the next insurance period. 3. Insurance Tax(s) a. In case of incidence of insurance tax(s), same will be included in the premiums. b. The amount of insurance tax(s) will depend on the current insurance tax law. c. The insurance tax(s) may become due or increase or decrease due to future amendments of law, especially of the insurance tax law. 4. Principles of Classification of Risks According to Objective Risk Criteria a. Classification of private passenger types vehicles model year 1971 and later will depend on the type classes (Tariff Provision No. 7) (1) Standard Performance (2) Intermediate Performance (3) High Performance (4) Sports (5) Sports Premium and for model year 1970 and prior the type classes (1) Standard Performance (2) High Performance according to the vehicle description in the registration document or as an alternative in the vehicle title or other official documents as far as not determined otherwise in the tariff. b. If the vehicle registration or other official documents show an alternative use possibility, the premium will depend on the higher risk unless otherwise agreed upon. c. For classification of use of the vehicle, the towing vehicle and its trailer will be classified as a unit with the premium of the towing vehicle and its trailer depending on whichever is the higher classified risk. 733ITA(01) 9-03 Page 1 of 10
2 5. Principles of Classification of Risks According to Personal Risk Criteria a. For classification according to (1) Type Classes (Tariff Provision No. 7) (2) Annual Mileage (Tariff Provision No. 8) (3) Driver Groups (Tariff Provision No. 9) (4) Driver Training (Tariff Provision No. 10) (5) Good Student Discount (Tariff Provision No. 11) (6) Vehicle Use (Tariff Provision No. 12) (7) Convictions of Traffic Violations (Tariff Provision No. 13) (8) Auto Accidents (Tariff Provision No. 14) (9) Inexperienced Operator (Tariff Provision No. 15) (10) Two or More Vehicles (Tariff Provision No. 16) (11) Policy Level Class Plan (Tariff Provision No. 17) the risk criteria provided for in the tariff will be considered only for named operators. In case of transfer of the insurance contract there will be no right to have the policy criteria of the previous insured considered. b. The tariff rating will be effected by the criteria listed under 5.a. above on the day of commencement of coverage. If the vehicle is or will be registered to more than one person, the rating will be effected according to criteria of the person with the highest rating. c. The named insured is obligated to inform the insurer, without delay, of any changes in item 5.a. above. A change during the insurance period will be calculated pro rata. However, the classification shall not be changed mid-term because of the attained age of an operator, a change in driving record (except added operator) and good student classification. The premium will change as soon as the conditions for the change of the tariff criteria are proven. d. The insurer shall be entitled to amend the rules for risk criteria stated under section (1), Nos. 1-9 in order to achieve an appropriate relation between insurance premium and insurance benefits. The amendments must meet Statutory Accounting Principles. 6. Definitions for Type and Use of Vehicles a. Private motor vehicles subject to the tariff are vehicles registered as private passenger vehicles. b. Leased vehicles subject to the tariff are motor vehicles and trailers leased commercially without a driver and licensed for the lessor. c. Motor Homes are motor vehicles admitted to public traffic as other motor vehicles. Motor Homes are rated as private passenger vehicles. d. Motorcycles are all two or three wheel motor vehicles which require a license plate. 7. Type Classes a. The premium will depend on the type of vehicle. Decisive for classification of vehicles according to manufacturer and model will be the entries in the registration, alternatively in the vehicle title or in other official documents. The vehicle net weight will be considered in US-pounds avdp. (= kilogram) and its horsepower in U.S.h.p. (=.7435 Kilowatt). b. Model year 1971 and later will be classified as follows: 733ITA(01) 9-03 Page 2 of 10
3 Type Class Standard Performance Intermediate Performance High Performance Sports Vehicles Sports Sports Premium Definition Any non-sports vehicle with a net weight to horsepower ratio of greater than 16 to 1. Any non-sports vehicle with a net weight to horsepower ratio of 16 to 1 or less, but greater than 14 to 1. Any non-sports vehicle with a net weight to horsepower ratio of 14 to 1 or less. All vehicle series for which there is only twopassenger body types manufactured. Sports Vehicles do NOT include station wagon, sedan, pickup, utility, or van types. If a four seater (two-plus-two version) of a two-passenger body type is also manufactured, and if the two-plus-two version also meets the net weight to horsepower qualification, the two-plus-two version will be included in either the Sports class or the Sports Premium class. These vehicles have a net weight to horsepower ratio of 30 to 1 or less, but greater than 20 to 1. These vehicles have a net weight to horsepower ratio of 20 to 1 or less. (3) Model year 1970 and prior will be classified as follows: Type Class Standard Performance Definition An automobile that does not qualify under High Performance. High Performance Any automobile weighing 4,000 pounds (1, Kilograms) or less with a weight to horsepower ratio of 10.5 or less. 8. Annual Mileage An annual mileage discount will be deducted from the otherwise applicable adult operator class factor for annual mileage of 7,500 (12,000 kilometers) or less. 9. Driver Groups a. The premium for auto liability insurance contracts of private motor vehicles will depend upon age, sex, marital status, vehicle usage, and driver training and good student classification of the operators, as well as the rating as "Principal Operator" or "Non-Principal or Occasional Operator". "A Principal Operator" is the vehicle's primary driver, one who drives one vehicle more than any other resident operator. A "Non-Principal or Occasional Operator" is one who has access to all vehicles, but is not a registered owner, and does not customarily drive to work or school. Classification in one of the following operator classes will be based on the information provided by the named insured. 733ITA(01) 9-03 Page 3 of 10

The named insured is obligated to inform the insurer, without delay, of any changes in operator status including the addition or deletion of an operator. However, there's no need to report a "change in age". Your premiums will be adjusted to reflect such changes. c. The insurer will be entitled to verify the reported operator classification and to request confirmation or evidence at the expense of the named insured. If the named insured does not comply with such request within one month the premium will be rated in the next higher Operator Class to become effective at the beginning of the current policy period. d. If the policy was rated in a lower Operator Class or if this classification was upheld during the policy period due to intentional misrepresentation by the named insured, the premium will be rated retroactively according to the higher Operator Class to become effective at the date when the lower Operator Class requirements were no longer met. 10. Driver Training The applicable driver training classification applies to each operator under 21 years of age provided such operator has successfully completed a course meeting the following standards: a. A minimum of 30 clock hours of classroom instruction plus a minimum of 6 clock hours of actual driving experience per student. These requirements may be met in either of the following ways: (1) A minimum of 6 clock hours per student of actual driving experience exclusive of observation-time in the car. In this case, part of the required 30 clock hours of classroom instruction can be met by time spent in a simulated practice driving trainer authorized by the appropriate governmental department. (2) A minimum of 3 clock hours per student of actual driving experience exclusive of observation-time in the car and a minimum of 12 clock hours per student in an approved practice driving trainer. In this case only time spent in excess of 12 clock hours may be counted as part of the required 30 clock hours of classroom instruction and the use of the trainer must be authorized as in (1) above. b. The course was conducted by instructors certified by the appropriate government agency and was conducted by a school that had the approval of the appropriate government agency, or the course was conducted by a commercial driving school under the jurisdiction of the motor vehicle department, provided that by statute or regulation such school meets the same requirements as schools having official sanction from the responsible state educational agency. 733ITA(01) 9-03 Page 5 of 10
6 11. Good Student Discount Any male driver under age 25 and any unmarried female driver under age 25 who attend a high school, college, or university may qualify for this discount. The student must have a "B" grade average (or equivalent) for the completed semester immediately preceding the effective date of the policy. If the qualifications are met, a rate reduction is allowed on certain coverages. The student must then requalify annually. 12. Vehicle Use The auto liability premium will depend on the use of the vehicle. According to the information provided by the named insured the vehicle will be assigned to one of the following use classes: a. BUSINESS USE means use of the auto is customarily involved in the business duties of the applicant or other person customarily operating the auto. b. PLEASURE USE means no BUSINESS USE, but includes driving to or from work or school: (1) less than 3 road miles one way; or (2) 3 or more road miles one way, but less than 15 road miles one way for not more than 2 days per week or not more than 2 weeks in any 5 week period. c. WORK LESS THAN 15 MILES means no BUSINESS USE, but includes driving to or from work or school: (1) 3 or more road miles one way, but less than 15 road miles one way if such usage is more than 2 days per week or more than 2 weeks in any 5 week period; or (2) 15 or more road miles one way for not more than 2 days per week or not more than 2 weeks in any 5 week period. d. WORK 15 OR MORE MILES means no BUSINESS USE and driven to or from work or school 15 or more road miles one way if such usage is more than 2 days per week or more than 2 weeks in any 5 week period. 13. Convictions of Traffic Violations a. The auto liability premium will depend on the number and type of convictions of motor vehicle violations. Under the point system described below, drivers with no points receive the lowest premium. Higher premiums apply to those with conviction points. Points are assigned to the named insured or any other current resident operator. A conviction includes action under U.S. law such as a plea of guilty, or of nolo contendere or the determination of guilt by a court though no sentence has been imposed (prayer for judgement continued) or, if imposed, has been suspended, and it includes a forfeiture of bail or collateral deposited to secure appearance in court of the defendant, unless the forfeiture has been vacated. b. Within a period of three years immediately preceding the current policy period all acts will be considered. c. Points for convictions will be assigned to the named insured and any other current resident operator as follows: (1) twelve points shall be assigned for convictions such as: (a) (b) (c) manslaughter, homicide or assault arising out of the operation of a motor vehicle; or committing any other felony involving the use of a motor vehicle; or failure to stop and render aid or failure to report when involved in an accident; or 733ITA(01) 9-03 Page 6 of 10
7 (d) fleeing or eluding police. (2) ten points shall be assigned for convictions such as: (a) (b) (c) driving while intoxicated or under the influence of drugs; or refusing blood/chemical test; or highway racing or speed contest. (3) eight points shall be assigned for convictions of driving while license is suspended or revoked. (4) four points shall be assigned for convictions such as: (a) (b) (c) driving a motor vehicle in a reckless manner; or passing a stopped school bus; or driving while drinking, possession of open container of alcohol or minor in possession of alcohol in a motor vehicle. (5) two points shall be assigned for conviction such as: (a) (b) careless driving (failure to use due care); or failure to obey a police officer, fireman or person of authority. (6) one point shall be assigned for any moving traffic violation or conviction not meeting the criteria in the preceding items (a) through (e). d. Exceptions: Convictions for the following shall not be regarded as moving traffic violations and should not be considered for premium increase: (1) inadequate muffler or excess escape of exhaust products; or (2) improper lights or other equipment except brakes; or (3) failure to sign or display registration card; or (4) failure to display license plates; or (5) failure to have driver's license in possession, provided there is a valid one in existence; or (6) failure to display current inspection certificate; or (7) failure to wear seat belt; or (8) commuter lane violation. e. Period of chargeability: For convictions, the period of chargeability shall be the three years immediately preceding the effective date of the new or renewal policy. 14. Auto Accidents a. At-Fault auto accidents will be considered in the determination of your policy premiums. Under the point system described below, drivers with no accident points receive the lowest premium. Higher premiums apply to those with accident points. b. Two points shall be assigned for each accident for which the USAA Group paid in excess of $500, or the equivalent in another currency, under Property Damage and/or Collision Coverages involving the named insured or any current resident operator, while operating an auto. 733ITA(01) 9-03 Page 7 of 10

For new policies and newly added operators, two points shall be assigned for each accident involving the applicant or any current resident operator, while operating an auto that resulted in total damage to all property in excess of $500, or the equivalent in another currency, and where the previous insurer paid for the claim. d. Two points are assigned if, during the chargeability period, there are two or more accidents each of which resulted in damage to property but neither have been assigned a point under (2) or (3). e. Exceptions: (1) No points are assigned for accidents incurred by an operator demonstrated to be a named insured or a principal operator of an auto insured under a separate policy; and (2) No points are assigned for accidents occurring under the following circumstances: (a) (b) (c) (d) (e) (f) (g) (h) (i) f. Period of chargeability: auto lawfully parked (if the parked vehicle rolls from the parked position, then any such accident is charged to the person who parked the auto); or the applicant, owner or other resident operator is reimbursed by, or on behalf of, a person who is responsible for the accident or has judgement against the person; or auto is struck in the rear and the applicant or other resident operator has not been convicted of a moving traffic violation; or operator of the other auto convicted of a moving traffic violation and the applicant or resident operator was not convicted; or auto is struck by a "hit-and-run" vehicle and accident reported to the proper authority within 24 hours; or auto is damaged by animals; or auto is damaged by flying gravel, missiles, or falling objects; or using auto in response to an emergency as a paid or volunteer member of any Fire Department or law enforcement agency. This exception is not valid except during emergency; or accident results in payment under Comprehensive Coverage only. (1) For accidents for which the USAA Group has paid a claim, the period of chargeability shall be the three years starting with the effective date of the initial new or renewal policy prepared after date of payment by the USAA Group; or (2) For accidents where the previous insurer paid the claim, the period of chargeability shall be the three years immediately preceding the effective date of the new or renewal policy. 15. Inexperienced Operator Operator experience will be considered in the determination of your policy premiums. If the inexperienced operator of the auto has been licensed less than two years, two points shall be assigned. The period of chargeability shall be the two years immediately preceding the date the operator is added. 16. Two or More Vehicles The auto liability insurance premium will be reduced if two or more private passenger vehicles are afforded liability coverage and are kept at the same place of garaging. 733ITA(01) 9-03 Page 8 of 10
9 17. Policy Level Class Plan a. The auto liability premium will also depend on the characteristics of the policy. Policies are classified into one of the following mutually exclusive levels. The resulting factor in each level is the Policy Level Class Plan Factor. b. Classification of the policy will be under the following 3-digit codes: Codes Definitions First Level - Policy Characteristics Classification 0 Indicates 1, 2, 3 and 4 do not apply 1 Indicates there is 1 operator with 2 or 3 chargeable MRP points* and at least one other operator less than 23 years of age on the policy. 2 Indicates there is 1 operator with 4 or more chargeable MRP points.* 3 Indicates there is 2 or more operators with 1 or more chargeable MRP points.* 4 Indicates 2 or more Property & Casualty Insurance non-payment cancellations have processed in the last three years. (For Statistical Purposes Only). *This does not include inexperienced operator points. Second Level - Operators to Vehicles Classification 0 Indicates the number of operators equal the number of vehicles. 1 Indicates the number of operators are less than the number of vehicles. 2 Indicates the number of operators are greater than the number of vehicles. Third Level - Vehicle Characteristics Classification 0 Indicates no surcharge for high value/power vehicle. 1 Indicates a surcharge for high value/power vehicle. Note: Codes 4-7 will be reserved for future use. High value/high power vehicles are considered to be those that significantly exceed the average: i.e. vehicles that can accelerate from zero to sixty miles per hour in less than seven seconds, or vehicles with a Manufacture Suggested Retail Price (MSRP) of $100,000 or more. 733ITA(01) 9-03 Page 9 of 10
