22 72-INCH PIPELINE FAILURE INFORMATION PROVIDED TO HOMEOWNERS August 30, 2018 (Thursday) A. The Executive Director and other senior staff canvassed the area impacted by the water main break. Residents of the impacted area were asked if they received water damage and/or were affected by power outages. B. Upon consultation with Members of the Executive Committee, a memo to Residents of the Knolls at Breckinridge, dated August 30, 2018, was provided to available residents or taped to the front door. In part, the memo provided the following: NTMWD would reimburse residents for temporary lodging, transportation and meals for the next few days. Recommendation for residents to contact their homeowners insurance. August 31, 2018 (Friday) A. The Executive Director and other senior staff revisited the impacted area, seeking additional information regarding the extent of damages. B. A second memo, dated August 31, 2018, to Residents of the Knolls at Breckinridge, provided the following: Information regarding Texas Water Conservation Association Risk Management Fund (TWCARMF), NTMWD s third party administrator, and Reimbursement procedures for temporary lodging, meals, transportation and other related expenses. 22
23 72-INCH PIPELINE FAILURE INFORMATION PROVIDED TO HOMEOWNERS, continued September 1, 2018 (Saturday) A. Senior staff coordinated with TWCARMF personnel to review contact information and claims processing procedures for residents impacted by the water main break. September 2, 2018 (Sunday) A. Senior staff coordinated with TWCARMF personnel to ensure that voic messages were being checked regularly and return calls were being coordinated. September 3, 2018 (Monday-Labor Day) A. The Executive Director and other senior staff continued to meet and visit with homeowners, addressing concerns and encouraging homeowners to file claims against their homeowners insurance and also with the TWCARMF. September 4, 2018 (Tuesday) A. The Executive Director and other senior staff revisited the impacted area. B. A third memo, dated September 4, 2018, to Residents of the Knolls at Breckinridge, which provided detailed additional TWCARMF and NTMWD contact information. 23
24 72-INCH PIPELINE FAILURE INFORMATION PROVIDED TO HOMEOWNERS, continued September 7, 2018 (Friday) Following TWCARMF s direct contact with residents that filed a claim, NTMWD provided a similar notice via to those residents from the impacted area. In part, the notice included the following explanations: 1. NTMWD, as a Texas governmental entity, has governmental immunity from claims, unless the damages experienced were caused by certain limited conditions identified in the Texas Tort Claims Act. 2. Under the Texas Tort Claims Act, a governmental entity can only be liable for property damage caused by the wrongful act or negligence of an employee acting within the scope of his employment, and such damage must arise from the operation or use of a motor-driven vehicle or motor-driven equipment. 3. A governmental entity may not use public funds to pay private claims where it is immune. 4. Homeowners are encouraged to continue working with their insurance provider to seek coverage. 24

Prior to the meeting, speakers must complete and submit a Public Comment Registration Form. The time limit is five (5) minutes per speaker, not to exceed a total of thirty (30) minutes for all speakers. The Board may not discuss these items, but may respond with factual or policy information.
