1 Rental Agreement-2013 PAYMENT Due at time of booking. Booking is not confirmed until Agreement has been signed and returned to and payment is received. In addition to the Rental Rate, the following charges are added and will show on the electronic invoice. Payment can be via credit card or personal check. If paid via personal check, the check must clear prior to check in.. (1) TAXES 12.75% Rutherford County charges 5% occupancy tax and North Carolina state tax is 7.75%. (2) SECURITY DEPOSIT (refundable) We collect $300 security deposit for the Family Cabin and $150 security deposit for the Cowboy Cottage that is refundable back to you within 10 days of your departure. This Security deposit is used to cover theft, misuse of property, damage to contents within the property, early cancellations and no-shows. CANCELLATION POLICY: Cancellations 90 days or more from the date of arrival will be refunded 100%. Cancellations earlier than 90 days prior to arrival are subject to be refunded at the discretion of the owner. If cancelled dates are able to be re-booked with another guest, 100% refund will be issued. If cancelled dates are not able to be re-booked, no refund will be issued. A credit will be kept for the cancelled guest 12 months from date of cancelled arrival. HOUSEKEEPING Housekeeping is provided by a licensed third party service who works hard to If there is an issue with the condition of your cabin please call Cindy with Housekeeping at If we do not hear from you upon check-in, we will presume your Cabin is acceptable for occupancy. Housekeeping Fee (paid when you leave) Housekeeping charge is due the day you depart. There will be an envelope with your amount due. Cash or checks are accepted but cash is preferred. If you forget to pay this fee, it will be deducted from your security deposit. The basic charge for housekeeping for the Family Cabin is $50 plus $25 for each bedroom used. Our rates are set up to be fair based on the size of a party and the time it takes housekeeping to clean each room and do laundry. The total charge for housekeeping for the Cowboy Cottage is $50. NO-SMOKING POLICY smoking is not permitted inside the Family Cabin; however, smoking is permitted on the front porch and side porch and on the grounds as long as cigarette butts are completely extinguished and disposed of in the trash. There is no smoking at all in the stables at the Cowboy Cottage. Hay is extremely easy to catch on fire (makes good starter for the fire pit!) 2 MAXIMUM OCCUPANCY The maximum number of overnight guests at the Family Cabin is 8. Unauthorized use of the cabin(s) and grounds for parties or events that exceed the maximum occupancy will result in immediate eviction process and an instance reported to GuestChecker.com. Maximum occupancy for the Cowboy Cottage is 2 adults, or 1 adult and 1 child. Additional overnight guests over this allowed maximum occupancy will be charged $100 against your deposit. KEYLESS ENTRY To enter either Cabin, you will use a unique 4-digit code assigned to you once your invoice has been paid. This keypad ensures that only you (or others you give this code to) will have access to your Cabin. AMENITIES - You will find many extras at the cabins for your convenience such as coffee, creamer, sweeteners, toilet paper, paper towels, toiletries, propane for the grill and basic kitchen staples. There is dishwashing detergent, soap, shampoo and conditioner and other toiletries provided free of charge. We provide 1 roll of toilet paper per bathroom. This is enough to last you until you can make it to the store. PARKING Parking on Calhoun Trail is prohibited. Parking anywhere other than the cabin driveway is prohibited. Parking at the other cabin is prohibited unless you are renting both cabins. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. WELL WATER The cabins are on fresh spring water. The water is very good, but sometimes the pressure will decrease if there is multiple water usage. There is a PUR filter on the kitchen sink if you prefer to drink filtered water. To turn on the filter, flip the switch to activate the filter. If you aren t comfortable with drinking the local water, bring bottled water. SEPTIC SYSTEM Each cabin has its own septic system that works very well. However, because septic systems cannot break down anything except waste and toilet paper, do not flush any feminine products down the toilet. The septic tank is located next to the deck in the front yard at the Family Cabin and in the yard in front of the kitchen window at the Cowboy Cottage. Please do not park any vehicles over these 2 areas. BAD WEATHER / ROAD CONDITIONS - Mountain roads can be muddy, snowy, curvy and steep. We recommend four wheel drive and/or chains if the weather is predicting snow storms. We do not refund due to road conditions. ACCIDENTS/INCIDENTS is not responsible for any accidents, injuries, mishaps or illness occurring during your stay. We are not responsible for the loss of personal belongings or valuables of the guest. By signing this Agreement, you acknowledge that you are responsible for your party and your party s actions and agree not to misuse the property. Any harm to the property, or any harm to anyone in your party due to gross negligence and/or bad judgment will not hold the owner responsible and could result in damages assessed against your damage deposit. CHILDREN We are happy to open the cabin to families and provide some entertainment for all ages. But we cannot stress enough that you are out in the woods and there are snakes, spiders, insects, poison ivy, poison oak and poison sumac that are on the property. Take this time to explore the property with the children and show them where to play and where not to play. We are expecting that your children will be supervised to a reasonable extent and still be allowed the freedom to enjoy the countryside too! We acknowledge there may be transients passing through the neighborhood so please remember that your children are your responsibility. Please use your best judgment when allowing your children to roam the property unsupervised, especially the pond. There is NO SWIMMING ALLOWED in the pond. The floating duck house is off limits to guests. This area is also a neighborhood, and other neighbors also have fishing ponds, so please ensure that your children are not trespassing onto other neighbor s property and to respect these boundaries. You are responsible for ensuring that your children understand and abide by these rules. PET POLICY Because we are pet-friendly, we are GLAD you brought your pet! We welcome well-behaved pets inside as long as they are housetrained. Any damage to furniture, flooring or carpets other than normal wear and tear will cause a damage against your damage deposit. We realize accidents can happen so there is cleaner at the cabins so you can wipe up any mess immediately. 3 roosters. Our mascots have no self-defense and sadly we have had dogs attack and/or kill our ducks and roosters in the past. Please make sure that your pets do not run the neighborhood or venture in the woods without your supervision. You are in the woods, and there are other wildlife who can harm small pets so please make sure your pets do not roam the neighborhood or play outside unsupervised. HORSES If you are bringing horses, please note that we only have 2 stables at the Cowboy Cottage, and cannot accommodate any trailers larger than a small 2-horse trailer at this time. If you need to bring a larger trailer, please contact the Owner to discuss alternative parking options for your trailer. TELEPHONE We provide a landline at the Family Cabin ( ) and the Cowboy Cottage ( ). We provide free local and long distance on these phones and if you cannot get reception, it may be due to weather or other unforeseen circumstances. We are not responsible for calls that you may miss or need to make with the landline. CELL PHONE Your cell phone may or may not work well; depending on the service you subscribe to, or the type of phone you have. Blackberries and I-pods get very good reception; more basic units may not. If you need to make a cell phone call, you can try walking around in the yard until you see a bar or two. Remember that you are in the woods and not having cell phone reception can be expected. We are not responsible for any calls you miss or have to make on your cell phone. We periodically call AT&T to find out when a new cell phone tower will be built and we are told that a tower is 2 miles away and should handle the signal from most phones. TELEVISION We provide a new flat screen tv at each cabin and subscribe to a well-known satellite service. Due to circumstances beyond our control, sometimes we lose the signal or reception may not be good. Normally the signal comes back on quickly and programming is resumed without much delay. However, if there are storms in the area, the satellite will lose its signal. We apologize in advance if you experience a loss of signal due to circumstances beyond our control. INTERNET The internet is free of charge and is wireless at the Family Cabin. At the Cowboy Cottage, internet is available via a plug that will fit any electric outlet. The wireless network is called prestonsthicket. The password is NC.742Calhoun. This internet service is faster than dial-up, but is slower than High-Speed Internet. Currently we use HughesNet because it is the only internet service available. This service is adequate for internet surfing and uploading photographs, but is not adequate for video streaming and once bandwidth is used up, internet will be down for 24 hours. We recommend you do not use the internet for any video streaming. If you have trouble with internet reception, please contact us and we will contact HughesNet for resolution. We are not responsible for any interruption of internet service beyond our control such as forces of Nature or unforeseen circumstances. ELECTRIC SERVICE Should you experience an electrical storm while you are at, you may lose power for a short time. Candles are located in drawers in the china hutch in the kitchen. There are lighters and matches in various drawers in the kitchen. Please use extreme care when using candles and ensure they are completely extinguished when not in use. The breaker box is located in the washing room if a breaker happens to trip. EARLY DEPARTURE If you decide to leave before your scheduled departure date, there is no pro-rating of your rent or no refunds. BORROWED and STORED ITEMS Items at the cabin are considered cabin property and will remain on the property. Prior to Guest departure, any item(s) that have been stored or rearranged must be placed back in its original location. CABIN DÉCOR/REARRANGING FURNITURE: The cabin décor is for your enjoyment. We ask that you do not remove and use any of the décor. If you rearrange furniture, please put these items back before you leave. Many of the décor items are for display purposes only and not meant to be used. Any damage to the décor items will result in a claim against your security deposit. 4 EXTERIOR GROUNDS You are responsible for ensuring that any items moved and brought outside, especially fishing equipment, are put back into place and all trash thrown away. We will charge $50 for every half hour Housekeeping spends outside cleaning up the grounds after your departure. This is a reasonable request; please put things back where you found them; grill cover back on, firepit area straightened up, wood not used stacked back in the wood area, etc, trash placed in garbage bins. NOISE LEVEL We want you to enjoy your stay, but remember that you have neighbors all around you. Please be conscious of your neighbors and use your best judgment when it comes to noise that can be heard by the neighbors after 10pm. We don t want your stay to be spoiled by a sheriff knocking at the door from a complaint from a neighbor! WHEN DEPARTING: All trash needs to be bagged and placed in the garbage cans. We provide 5 large garbage cans in a bin out by the road clearly marked Trash Only. We encourage you to recycle and provide several bins at the roadside as well as bins at the BBQ pit area at the Family Cabin. Don t worry about sorting; the pickup crew will do that for you. Trash and recycle pick up on Wednesdays. Please load up the dishwasher if you are in the Family Cabin and turn on before you leave. Please wash your dishes and leave to dry in the dish drain if you are in the Cowboy Cottage. Throw away or take with you any perishable food items. If you have unopened items you don t want to take with you, we gladly accept donations for the next guest! Strip the beds and leave sheets on the floor in the washing room. Torn, soiled or lost linens will result in a $50 for each set of sheets we have to replace. Place any dirty towels, washcloths and kitchen towels in laundry room if you are in the Family Cabin or in the bathroom if you are in the Cowboy Cottage. We will charge your damage deposit $10 per towel if they are taken or damaged beyond reasonable usage. Please turn thermostat to 80 (a/c) or 50 (heat) before you leave. The waterfall is activated by a breaker marked Pond in the breaker box in the washing room. Please turn this breaker off as you leave. Check for all personal belongings; especially phone chargers left plugged in. If you used the garden hose or extension cords, please place neatly back to its original location. Driveway gate can remain open.. FALSIFIED RESERVATIONS Any reservation obtained under false pretense will be subject to immediate eviction process if premises are occupied; prior to arrival, party will not be permitted to check in. Any misrepresentation of the number of guests, or number of pets will result in a charge of $100 per additional guest against the security deposit. Any additional pets will be charged an additional $50 against the security deposit. If you need to add an additional guest or pet, and you are within the maximum allowable number, please let us know and we will invoice you: $25/per pet, guests are no charge as long as the maximum number stays at 9 or under). is a member of GuestChecker.com and we reserve the right to report any bad guests to this site as well as any others we deem appropriate for reporting bad guests. I understand that if I cancel less than 90 days, that is the owner s discretion whether to return my monies paid or keep a credit on the books.
