OUR SUPPLY OF PRODUCTS AND SERVICES When you purchase our products and/or services and book travel arrangements on this Website your agreement is with Global Vacation Inc and if not we will make it clear to you that Global Vacation Inc is acting as an agent for another travel provider. When you book any products or services from us, you will do so subject to these Website Terms and Conditions, our Booking Terms and Conditions and such further terms and conditions as may be applied by the hotel or cruise ship where you will be staying (together, the "Conditions of Contract"). These Conditions of Contract constitute the entire agreement and understanding between you and Global Vacation Inc in relation to their subject matter. By proceeding with a booking, you acknowledge that you have read and understood all of the Conditions of Contract and agree to be bound by them. However, if you do not or cannot accept our Conditions of Contract in full, you must stop using our Website immediately. These Conditions of Contract may vary

5 from time to time. By browsing this Website you accept that you are bound by the Conditions of Contract current at the time when you browse or book. Please note that Global Vacation Inc may provide accommodation, transport from a wide range of third party accommodation providers and carriers including airlines and ships. The provision of these arrangements will be subject to the terms and conditions of each provider or carrier. BOOKING TERMS AND CONDITIONS Travel Insurance The Client accepts that the cost of our services/products does not include insurance. It is mandatory that all passengers obtain travel insurance while travelling with Global Vacation Inc covering personal injury, medical, repatriation, and evacuation expenses. Passengers must be able to provide proof of adequate insurance cover purchased if requested by the group leader or a Global Vacation Inc representative. It is strongly recommended that your insurance coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the passenger. Global Vacation Inc will not accept liability for loss, theft of, or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the passenger in public lounges or other public areas, whether on board a vessel, train, bus, or other mode of transportation, publicly owned or operated by Global Vacation Inc or elsewhere, are not reimbursable. Losses due to ordinary wear and tear or acts of God are not reimbursable. Global Vacation Inc will not accept responsibility for, and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Global Vacation Inc such as hotels, vessels, expedition vehicles, or any other mode of transportation. When obtaining travel insurance the passenger must ensure the insurer is aware of the type of travel to be undertaken. PAYMENT Deposits Payment of a deposit enables Global Vacation Inc to hold a reservation for you but does not guarantee the price. The price of the service/product can only be guaranteed once Global Vacation Inc receives the full payment and other travel documentations have been issued, subject to any terms and conditions. We will advise you as to when full payment is required. Upon provision of your payment information, you are authorising us to make any payment arrangements with any third party suppliers. Payment Methods We accept the following methods of payment: 1. Wire transfer; 2. Debit card and/or credit card; and

6 3. Banker s draft. Payment All payments must be made in full on or prior to thirty (30) days prior to the use of our service/product. In the event that any sums are not paid when due, then without prejudice to any other remedies of Global Vacation Inc, we may at any time: (a) suspend all or part of the provision of the product/services to the Client; and/or (b) charge interest on all overdue sums at a rate of 4.25% per month until paid; and/or (c) cancel (without any liability to the Client or to any passengers) any bookings for Global Vacation Inc made on behalf of the Client in respect of which payment is outstanding, with any cancellation/administrative fees incurred as a result thereof being for the account of the Client. By Global Vacation Inc Our aim is to operate all tours, products/services as advertised except that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions or any other reason. Global Vacation Inc reserves the right at any time to cancel or change any of the facilities, accommodations, products/services or prices described online and to substitute alternative arrangements of comparable monetary value or charge a supplement locally if alternative arrangements cannot be made, without compensation to the Client and accepts no liability to the Client whatsoever for costs or loss of enjoyment as a result of these changes. Where a major change is made prior to departure, the client will have the choice of either accepting another tour of equivalent or superior standard, or a choice of specified travel arrangements of a lower standard to those who previously booked together with a refund of the difference in price, or cancelling the tour and obtaining a full refund. The definition of the major change is a change that is reasonably required but will depend on the individual tour and circumstance. It may be necessary, sometimes at short notice, to make changes to an itinerary due to weather, traffic or road conditions. Regrettably, coaches, buses, or other modes of transportation do occasionally suffer mechanical or technical problems, or certain facilities on board a coach, bus, or other vehicle may become faulty. Every effort will be made to rectify such issues as quickly as possible. In some instances, it may be necessary to replace the vehicle which cannot be repaired. We are not liable for delays caused by any form of breakdown, mechanical or technical issues. We reserve the right to terminate any provision of services/products at any time and without refund to the Client. We have no control over airline or cruise liner schedule changes and we accept no liability for losses or additional costs which may arise as the result of such changes.

7 By You the Client On issuing you your booking confirmation, if you wish to cancel your booking or any part of it, we will require your authority in writing to do so. Our cancellation charges will apply (see the table 'cancellation charges' below). These are calculated with reference to the date on which we receive your authority in writing. You will not be given a refund for any deposits, administration charges, insurance premiums or any other fees or charges made by us and paid by you relating to your holiday in the event of cancellation by you. We incur costs from the time you make your booking and you agree that if you cancel your booking you will compensate us for our losses and expenses, as per the table below. Our cancellation charges increase the nearer the cancellation is made to your departure date as we may not be able to resell your holiday without making significant price reductions, or at all. (a) Death or Incapacity. Where you or any member of your party is prevented from travelling for any reason (including death, illness or jury service) we will attempt to transfer your booking to any other person satisfying all the requirements relating to your holiday once you notify us in writing in a reasonable time prior to your due date of departure. (b) Other Changes. If you wish to make any other change to your booking at any time after our booking confirmation has been issued, we will attempt to meet your request, however this is not guaranteed. On some occasions, if members of a group booking withdraw, there are fixed costs which means that the remaining travelling party must pay more per person. We require your authority in writing before we can make any change. In the event that any change is requested in relation to a group booking we require the authority in writing of the lead name before we can make the change. (c) Administration Fee. In each of the above circumstances, an administration charge will be payable of Fifty Dollars United States of America Currency (USD $50.00) per person where your request is received by us thirty one (31) days or more prior to your date of departure and/or the use of our product/services and Hundred and Fifty Dollars United States of America Currency (USD $150.00) per person where the request is received less than thirty (30) days prior to your date of departure and/or the use of our product/services. This charge is non-refundable. (d) Treatment of Changes by Our Suppliers. Many of our suppliers, do not permit us to make changes to bookings less than thirty (30) days prior to the provision of their applicable services and impose full cancellation charges. We will pass these on to you in addition to our administration charge, where applicable. NO REFUND No refunds shall or will be offered, where a service is deemed to have begun and is, for all intents and purposes, underway, or book/contracted in less than thirty one (31) days. Payment Protections

8 Due to our jurisdiction, Global Vacation Inc is not legally required to and does not hold an Air Travel Organiser's Licence (ATOL) and is not ATOL protected. We are also not legally required to be and we are not a member of the Association of British Travel Agents (ABTA). PASSPORTS AND VISAS It is your responsibility to ensure that you have the correct passport or entry visas, health certificates and / or any other documentation required to enter the country where the excursion or activity will take place. HEALTH AND SAFETY AND BEHAVIOUR Global Vacation Inc advises as follows: It is your responsibility to declare any health issues that may prevent you or any party member from partaking in the excursion/activity/attraction or that may cause potential risk to yourselves or others. Some excursions/activities/attractions may have certain restrictions based on age, health, weight and/or height, which have been imposed by a third party supplier. For your own safety, we urge you to abide by those restrictions. If you commit any illegal act whilst on an excursion/activity/attraction or in our reasonable opinion or the reasonable opinion of a third party supplier your behaviour is disruptive, threatening or abusive, causes or is likely to cause danger and/or is detrimental to or incompatible with the interests, comfort, well-being or harmony of the rest of the supplier s group and/or others, or damages another s property, the supplier may require you to withdraw from the excursion/activity/attraction at any time. It is your responsibility to ensure that you and your party read all literature carefully for details of the level of the excursion/activity/attraction and the necessary experience (if any) and/or ability required. Some excursions/activities/attractions may carry an element of risk and it is your responsibility to ensure that the excursion/activity/attraction is suitable for you and/or your party and that you are fit enough to participate. It is your responsibility to declare any material facts including known medical conditions to your insurers, as failure to do so may result in a claim being reduced or declined. If you wish to make a special request, you must do so at the time of booking. We will try to pass any reasonable requests onto any relevant third party supplier but we cannot guarantee that requests will be met. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. Note that some of the accommodation, resorts and transportation featured may lack even the simplest facilities, such as ramps for wheelchairs, elevators etc., it is important that, when booking, you advise us of any disabilities and special requirements to make sure that our service to you tries to meet your specific needs.

9 GLOBAL VACATION INC LIABILITY Packages and Other Arrangements We will not be liable for any injury, illness, death, loss, damage, expense, cost or other claim of any description whatsoever which results from: (a) The act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your arrangements and which were unforeseeable or unavoidable or Force Majeure as defined above. (b) We limit the maximum amount we may have to pay you for any claims you may make against us. (i) The maximum amount we will have to pay you where we are found liable for loss of and/or damage to any luggage or personal possessions (including money) is One Hundred Dollars United States of America Currency (USD $100.00) per person affected unless a lower limitation applies to your claim under this clause. (ii) For all other claims which do not involve death or personal injury, the maximum amount we will have to pay you if we are found liable to you on any basis is twice times the price (excluding insurance premiums and amendment charges) paid by or on behalf of the person(s) affected, unless a lower limitation applies to your claim. This maximum amount will only be payable where you received no benefit at all from your holiday. (c) We will not accept responsibility for services or facilities which do not form part of our agreement or where they are not advertised on our Website. For example, any excursion you book whilst away, or any service or facility which your hotel or any other supplier agrees to provide for you. Excursions, tours, activities or other events that you may choose to book or pay for through our concierge service or whilst you are on holiday ("Local Events") are not part of your package holiday provided by us and these Terms and Conditions do not apply. For any Local Event your contract will be with the supplier of that Local Event and not with us. We are not responsible for the provision of the Local Event or for anything that happens during the course of its provision by the supplier. Please note that this position also includes all hazardous activities. (E) The services and facilities included in your holiday will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply, or, if there are no applicable local regulations, if they are reasonable when compared to the local standards in practice. GENERAL These Terms and Conditions do not affect your statutory rights.

10 Complaints At Global Vacation Inc, we strive to provide outstanding service, however, in the unfortunate event that you have any reason to complain or you experience any problems with our services we ask that you immediately contact us at or global_vacation@yahoo.com Force Majeure Force Majeure means any circumstances which are unusual and/or unforeseeable which are beyond the control of Global Vacation Inc, the consequence of which could not have been avoided even if all due care had been exercised, including (but not limited to) war or threat of war; riot; civil strife; hostilities; political unrest; government action; industrial dispute; natural or other disaster; nuclear incident; terrorist activity; weather conditions; closure of airports; fire; flood; drought; re-scheduling or cancellation of flights or alteration of the airline or aircraft type by an airline and technical problems with transportation and all similar events outside our control. Updates and Changes We may remove or make changes to the products, information, content, materials, tools and features on this Website at any time without liability and without notice to you. We also reserve the right to immediately terminate or suspend your use of or access to this Website at any time and without notice if we consider that you have breached any of our Terms and Conditions. We may also change or modify all or any provision(s) of our Terms and Conditions at any time and such changes or modifications shall be effective immediately upon their publication.
