2 DENVER INTERNATIONAL AIRPORT PIKES PEAK PARKING RESTORATION CONTRACT NO ADDENDUM NUMBER ONE Scope of this Addendum Addendum Number One includes modifications to the following Contract Documents issued November 8, These modifications are deemed necessary by the City and County of Denver. PART ONE, VOL. 1 - CONTRACT DOCUMENTS Contract documents are amended as follows: REQUIRED FORMS CHECKLIST Federal forms are not required. Updated checklist is provided. IB-9 BASIS FOR SELECTING THE APPARENT LOW BIDDER The selection of the Apparent Low Bidder will be made on the basis of the lowest responsive bid by a qualified Bidder whose bid complies with all of the requirements prescribed herein. The lowest Bidder shall be determined by the total of the Base Bid and the Alternate Bid combined amount. This selection shall be subject to the approval of such resulting contract in accordance with the Charter and ordinances of the City and County of Denver. SC-5 CONTRACTOR PERFORMANCE: SUBCONTRACTING With respect to General Condition 501, no more than 65% of the work may be subcontracted. If it is determined to be in the City s best interest, this percentage may be modified throughout the course of the project by the SVP-AIM INSURANCE REQUIREMENTS Insurance requirements are attached. 3 DENVER INTERNATIONAL AIRPORT BID FORMS CONTRACT NAME: Contract No.: Bid Letter BIDDER Chief Executive Officer City and County of Denver Business Management Services (Procurement) Office Airport Office Building, Room 8810 Denver International Airport 8500 Peña Boulevard Denver, Colorado This letter is in response to the Notice of Invitation for Bids first published on November 8, 2018, for Contract No , Denver International Airport,. This contract is for the rehabilitation of the Pikes Peak Parking Facility which consists of a 65- acre (314,600 square yard) asphalt and concrete pavement parking facility with bus and vehicle traffic loading (8215 linear foot of bus lanes, 8,950 parking spots and 17 bus stop islands with shelters). The lot has surpassed its 20-year design life cycle. This rehabilitation project will address the heavy surface cracking, heaving, pot holing, joint separation and sub surface damage. The restoration of the Pikes Peak Parking Facility will result in lower maintenance activities, reduced safety concerns, limited lot disruption/reduced closures, pleasant driving conditions and increased safe access that align with the ADA requirements. The contract Base Bid project includes the removal of sub grade and lime treated base materials, miscellaneous drainage items under the concrete bus lanes, stop islands, ramps, shelters, striping and sign resets. An under-drain system will be placed throughout the bus lane construction area and piped to the existing storm drain. As per the design, all bus lanes will be resurfaced with 10" Portland Cement Concrete Pavement (PCCP) (doweled and tied). The project will also be placing new shuttle islands, shelters, signing, striping, replacement of existing high mast lights to LED bulbs, conduit for all electrical services and future charging stations. All construction, associated traffic control, signing, parking shut down area controls will be completed in two (2) phases, splitting the lot in a north and south direction. The contract Alternate Bid will mill the existing Hot Mix Asphalt (HMA) parking surface area (~ 60% of lot) and place a 5" unbonded concrete overlaid pavement. In addition, misc. perimeter chain link fencing, curb and gutter, snow pad/equipment storage areas will be replaced or rehabilitated as required by the plans. All parking space signing and striping will be placed per the design plans. All construction, associated traffic control, signing, parking shut down area controls will be completed in two (2) phases, splitting the lot in a north/south direction. The existing project concrete and Hot Mix Asphalt surface materials will be milled and recycled back into the proposed sub-grade and/or into the Portland Cement Concrete Pavement mix (use of Contract # November 2018
4 recycled concrete aggregate to promote DEN's sustainability program) throughout either construction bid package. The undersigned Bidder declares that it has carefully examined the location of the proposed work and has carefully read and examined all of the contract documents which include, but are not limited to, the Contract Drawings, Technical Specifications, Construction Contract General Conditions, Special Conditions, Instruction to Bidders, and EEO provisions, and hereby proposes to furnish all labor, materials, equipment, tools, transportation and services, and to discharge all duties and obligations necessary and required to perform and complete the Work as required in the contract documents which are provided herewith and by this reference made a part hereof for the prices shown in the bid forms and totaled below: TOTAL BASE BID AMOUNT: ($ ). 5 The undersigned Bidder hereby agrees to appear at Denver International Airport, Business Management Services Office, Room 8810, Airport Office Building, at any time within five (5) calendar days from the date of a written notice from the CEO to do so, mailed, ed, or faxed to the business address of Bidder and at that time the Bidder shall: (1) deliver an executed Contract which conforms with this bid; (2) furnish the required performance and payment bonds in the sum of the Total Contract Bid Amount shown above, executed by a surety company acceptable to the CEO; and (3) furnish the required insurance documents. Enclosed herewith is a bid guarantee, as defined in the Instructions to Bidders, in the amount of which bid guarantee the undersigned Bidder agrees is to be paid to and become the property of the City as liquidated damages should the bid be considered to be the best by the City and the undersigned Bidder notified that it is the apparent low bidder and it fails to enter into contract in the form prescribed and to furnish the required performance and payment bonds and evidences of insurance within five (5) calendar days as stipulated above. Attached and incorporated herein are the proposed Schedule of Prices and Quantities and Bid Data Forms. All of the forms must be completed. Bidder acknowledges that the City may incorporate, at its option, any or all of the data submitted by the Bidder into a contract arising out of this Bid. The undersigned Bidder acknowledges the right of the City to waive informalities in the bids, to reject any or all bids submitted, and to re-advertise for bids. ADDITIONAL COVERAGE Excess/Umbrella Liability Minimum Limits of Liability (In Thousands): Umbrella Liability Non-Controlled Area Each Occurrence and aggregate $1,000 The policy must provide the following: 1. Coverage must be written on a follow form or broader basis. 2. Any combination of primary and excess coverage may be used to achieve required limits. 3. If operations include unescorted airside access at DIA, then a $9 million Umbrella Limit is required. Professional Liability, Design, Engineering and Construction Supervision Minimum Limits of Liability (In Thousands) Per Claim $1,000 Aggregate $1,000 The policy must provide the following: 1. Coverage shall extend to cover the full scope of all cost estimating work performed under the insured's contract with City. 2. Coverage shall apply for three (3) years after project is complete. 3. Coverage is to be on a primary basis, if other professional coverage is carried. Builders' Risk Insurance or Installation Floater Minimum Limits of Liability (In Thousands) Special Completed Value Basis The policy must provide the following: 1. The insurance must be in the amount of the initial Contract Sum, plus value of subsequent modifications, change orders, and cost of material supplied or installed by others, comprising total value of the entire Project at the site on a replacement cost basis. 2. The insurance shall be written on a Special Completed Value Covered Cause of Loss form and shall include theft, vandalism, malicious mischief, collapse, false-work, temporary buildings, transit, debris removal, demolition, increased cost of construction, flood (including water damage), earthquake, and if applicable, all below and above ground structures, piping, foundations including underground water and sewer mains, pilings including the ground on which the structure rests and excavation, backfilling, filling and grading. 3. The Policy shall remain in force until formal acceptance of the project by the City or the placement of permanent property insurance coverage whichever is later. 4. The Builders Risk shall include a Beneficial Occupancy Clause. The policy shall specifically permit occupancy of the building during construction. Contractor shall take reasonable steps to obtain consent of the insurance company and delete any provisions with regard to restrictions within any Occupancy Clauses within the Builder s Risk Policy. 5. Equipment Breakdown Coverage (a.k.a. Boiler & Machinery) shall be included as required by the Contract Documents or by law, which shall specifically covers insured equipment during installation and testing (including cold and hot testing). III. ADDITIONAL CONDITIONS It is understood and agreed, for the benefit of the City, that the following additional conditions shall apply to all coverage specified herein: 1. For Commercial General Liability, Auto Liability and Excess Liability/Umbrella (if required), Contractor and subcontractor s insurer(s) shall include the City and County of Denver, its elected and appointed officials, employees and volunteers as additional insured. 2. All coverage provided herein shall be primary and any insurance maintained by the City shall be considered excess. 3. For all coverages required under this Agreement, Contractor s insurer shall waive subrogation rights against the City. 4. The City shall have the right to verify or confirm, at any time, all coverage, information or representations contained herein, and the insured and its undersigned agent shall promptly and fully cooperate in any such audit the City may elect Page 2 of 3 Certificate of Insurance for Aviation Aviation General Revised 2015
10 to undertake. 5. The required insurance shall be underwritten by an insurer licensed or authorized to do business in Colorado and rated by A.M. Best Company as A- VIII or better. 6. For claims-made coverage, the retroactive date must be on or before the contract date or the first date when any goods or services were provided to the City, whichever is earlier 7. No changes, modifications or interlineations on this document shall be allowed without the review and approval of the Risk Administrator prior to contract execution. NOTICE OF CANCELLATION It is understood and agreed that should any Policy issued hereunder be cancelled or non-renewed before the expiration date thereof, or sustain a material change in coverage adverse to the City, the issuing company or its authorized Agent shall give notice to the Department of Aviation in accordance with policy provisions.
