ADOPT the Staff Report. 2. DETERMINE that this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2.f of the Los Angeles City CEQA Guidelines. 3. APPROVE the designation of the attached list of Capital Improvement Program and Landside Access Modernization Program construction projects for coverage by the Project Labor Agreement Page 1
2 4. AUTHORIZE the Executive Director, or their designee, to provide notification as per the Project Labor Agreement of such coverage. DISCUSSION: 1. Purpose Designate the attached list of Capital Improvement Program (CIP) and Landside Access Modernization Program (LAMP) construction projects to be covered by the Project Labor Agreement (PLA). 2. Prior Related Actions August 17, Board Resolution 20765, The Board of Airport Commissioners (BOAC) authorized the Office of the City Attorney, Los Angeles World Airports (LAWA) management and consultants to develop procedures for the implementation of a PLA for construction projects. November 19, 1999, a PLA was entered into by Parsons Constructors, Inc. (Agreement Coordinator), and the Building and Construction Trades (AFL -CIO), the Building and Construction Trades Council of California, the Building and Construction Trades Council of Los Angeles and Orange Counties, and the Building and Construction Trades Council of San Bernardino and Riverside Counties and its affiliated unions. May 1, Board Resolution The PLA was accepted by the BOAC. July 7, Board Resolution The BOAC designated Phase I CIP projects for coverage by the PLA. December 6, Board Resolution No The BOAC designated Phase II CIP projects for coverage by the PLA. December 6, Board Resolution The BOAC accepted the extension of the PLA to December January 14, Board Resolution No The BOAC designated additional CIP projects for coverage by the PLA. 3. Current Action Timely and successful completion of construction projects is critical to LAWA's safe and efficient movement of passengers and cargo and an improved guest experience. It is essential that work on these projects be performed in a timely and economical manner that maximizes airport security and safety, without interruption. Labor management stability and cooperation are critical to this. The PLA helps to insure timely completion of projects and increases participation of local residents in Los Angeles International Airport (LAX) development. Page 2
3 The PLA: Establishes a project -wide code of fair and safe employment Creates labor stability by the effective resolution of disputes between labor and management, and the prohibition of strikes, work stoppages or lock -outs Provides access to qualified construction personnel Increases participation of local residents in employment and training Encourages participation by all qualified contractors and construction employees, whether they are union or non -union Establishes fair wages and working conditions of projects Opens communication between labor and management Both parties to the PLA understand that there is no obligation for LAWA to deliver the construction projects on the attached lists, but that if and when they are built by LAWA the projects will be covered by the PLA. Action Requested At this time, the BOAC is requested to designate the attached list of CIP and LAMP construction projects as covered by the PLA and authorize the Executive Director, or their designee, to provide notification of such coverage. Fiscal Impact The PLA is administered by an agreement coordinator. The costs for those services will be allocated to WBS Elements associated with the specific BOAC -approved construction projects and will be recovered through landing fees and /or terminal rates and charges, as appropriate 4. Alternatives Considered Take No Action If these projects are not covered by the PLA, it may affect the timely and economical completion of major construction projects at LAX and Van Nuys Airport and thus potentially worsen the guest experience. This use of the PLA ensures labor harmony throughout the period of development at LAX and Van Nuys Airport. Page 3
4 APPROPRIATIONS: No appropriations are requested for this item. STANDARD PROVISIONS: 1. This action, as a continuing administrative activity, Is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2.f of the Los Angeles City CEQA Guidelines. 2. This action does not require City Attorney approval of document as to form. 3. Actions taken on this item by the Board of Airport Commissioners will become final pursuant to the provisions of Los Angeles City Charter Section This action is not subject to the provisions of the Service Contractor Worker Retention and Living Wage Ordinances. 5. This action is not subject to the Small Business Enterprise Program. 6. This action is not subject to the provisions of the Affirmative Action Program. 7. This action does not require a Business Tax Registration Certificate number. 8. This action is not subject to the provisions of the Child Support Obligations Ordinance. 9. This action is not subject to the insurance requirements of the Los Angeles World Airports. 10. This action is not subject to the provisions of Charter Section 1022 (Use of Independent Contractor). 11. This action is not subject to the provisions of the Contractor Responsibility Program. 12. This action is not subject to the provisions of the Equal Benefits Ordinance. 13. This action is not subject to the provisions of the First Source Hiring Program. 14.
