Kennelly JOINT STATUS REPORT FOR MAY 19, 2016 CASE MANAGEMENT CONFERENCE The Court directed counsel to file this joint report regarding the status of the parties discussions, agreements and disagreements on the proposed agenda items for the May 19, 2016 case management conference. I. Product Liability Cases A. AbbVie Corporate Witnesses 1. Status of custodial files: To date, AbbVie has produced 57 custodial files for corporate witnesses (versus sales representatives) and has made supplemental productions for 14 of these witnesses. There are still 10 of 67 custodial files that were requested in November 2015 and January and March 2016 for which AbbVie has not yet certified its production as complete. The remaining 10 files have all been collected, processed, and are currently under review and expected to be produced on a rolling basis starting May 27, 2016 and completed in June On May 4 th, the PSC identified 9 additional custodians for production of their files, and requested 1 supplemental production. AbbVie has informed the PSC that 4 of the witnesses do not have files for a variety of reasons (for one of those 4 AbbVie does not have any indication that the witness worked for Solvay, Abbott or AbbVie so the PSC is attempting to provide additional 1

AbbVie is in the process of collecting these files and do not currently anticipate any issues producing them within the required 45 days of the PSC s request. 2. Status of Depositions: To date, Plaintiffs have deposed 17 AbbVie corporate witnesses, however, only one deposition will be conducted in May (it was conducted last week). There are 6 additional depositions scheduled: 3 in June, 2 in July, and 1 in October (which involves a former employee who retired in August 2015). Plaintiffs have requested an additional 3 witnesses for deposition, all of whom are former employees. AbbVie is in the process of contacting and/or working with these former employees to identify potential dates. The parties are hopeful that some of these will proceed in July. B. Production of Pharmacovigilance Data The PSC has requested additional pharmacovigilance data from AbbVie. The parties have met and conferred on the issue and believe it is one that will require court intervention. The PSC will likely be filing a motion to compel shortly. C. Report on Bellwether Process The bellwether discovery process is moving forward as contemplated and with the new dates as set forth in Third Amended CMO 14. The PSC, AbbVie, and where applicable individual bellwether counsel continue to meet and confer over issues as they arise. A summary of the work and status to date is as follows: 2

3 Case: 1:14-cv Document #: 1302 Filed: 05/17/16 Page 3 of 10 PageID #:18863 To date, 22 of 24 plaintiff depositions have been taken, 1 2 are scheduled for June 1 st and June 10 th. As such, the parties expect to complete all plaintiff depositions during this core discovery phase by June 10, To date, 5 of approximately 50 treating/prescribing doctor depositions have been taken. Another 6 treating/prescribing doctor depositions are currently noticed. Although the parties have exchanged dates regarding approximately 10 additional doctor depositions, those depositions have not yet been noticed. The remaining 29 doctors are in various stages of either having their depositions scheduled or in the process of being contacted by both parties. The parties continue to try to work cooperatively to select mutually convenient dates. To date, 14 of 41 AbbVie sales representatives who have been requested are currently scheduled (with the first one scheduled to occur on May 19, 2016). Bellwether plaintiff counsel will likely be requesting more sales representative depositions, but have not yet done so, awaiting the production of sales representatives files (which should hopefully be complete by May 27, 2016). So the remaining sales representatives that are requested for deposition will be requested shortly after that time and as plaintiffs continue to review the ongoing and recently produced sales representative custodial files. The PSC has been requesting deposition dates for AbbVie sales representatives over the past 30 days. With respect to the remaining 27 requested (16 of which are former Solvay, Abbott or AbbVie employees), AbbVie has offered dates for 6 of them and is in the process of working with 21 of them (most of whom are former employees) to identify potential dates. The parties will try to work cooperatively to select mutually convenient dates/time/locations for both the witnesses and counsel. 1 Two bellwether cases involve deceased plaintiffs and AbbVie has opted not to depose the estate representatives at this time. 3

4 Case: 1:14-cv Document #: 1302 Filed: 05/17/16 Page 4 of 10 PageID #:18864 To date, AbbVie has produced all of the initially promised 41 sales representative files. One additional file will be produced on May 27 th since the sales representative only recently returned from being out on leave. In addition, based on newly discovered information, 77 new sales representatives were identified. Of those newly identified representatives, AbbVie has informed plaintiffs that it has files for 24 of them. AbbVie prioritized these files given the July 6, 2016 deadline for core discovery and therefore, AbbVie produced 3 of the 24 files on May 13 th and expects to produce an additional 12 representative files on May 20 th, and the remaining 9 representative files on May 27 th. Of those for whom a file does not exist (currently 53 sales representatives), the PSC reserves its rights to discover, inquire and investigate the reason(s) for their non-existence. D. Besins Update Following the entry of the Court s ruling, the PSC served written discovery requests on AbbVie, Besins Healthcare, S.A., and Besins Healthcare Inc. to which those defendants responded in part and objected in part. Additional follow up has resulted in the PSC requesting Rule 30(b)(6) depositions of both AbbVie and Besins Healthcare, SA. The Besins Healthcare, SA designee will be outside the United States. In addition, the parties believe some of the information sought from AbbVie can be obtained from upcoming fact witness depositions. Pursuant to this Court s minute order on April 13, 2016, the parties have agreed to complete the 30(b)(6) depositions by the second week of July. Following the depositions, the remaining schedule will depend on whether the PSC finds it necessary to seek any additional written discovery based upon the information gained during the course of said depositions. In an effort to expedite the schedule, the PSC has agreed to serve any additional written discovery requests, if necessary, within seven (7) days of the last 30(b)(6) deposition. Defendants have agreed to 4

If the PSC believes a motion to compel is necessary after that, it will file it within two (2) weeks. Pending resolution of that motion and any further discovery compelled, the parties will be prepared to file supplemental briefing on the motion to dismiss for lack of personal jurisdiction. The parties anticipate that that briefing should be completed by the early fall at the latest. Should any of the potentially contemplated discovery not be necessary, the parties will accelerate the schedule for completing the substantive briefing. E. Update on Other Defendants 1. Auxilium The PSC and counsel for Auxilium have agreed to a joint proposed amended CMO 19 (which will be styled as CMO 19-A) that will be submitted at or prior to the Status Conference on May 19 th, as it pertains to timeline for discovery relevant to defendant Auxilium. The proposed schedule takes into account the desire of the PSC to cooperate with the discovery being conducted in the Superior Court of Pennsylvania, Philadelphia County, and to have discovery conducted in time to satisfy the schedule that will be entered by in that venue. To date, the PSC and the Philadelphia litigation have worked cooperatively and the parties expect that to continue. 2. Pfizer Pursuant to the Court s direction at the April Case Management Conference, Plaintiffs and the Pfizer Defendants ( Pfizer ) have met and conferred and will file a proposed CMO 19B, which reflects a proposed schedule for additional discovery and Pfizer s anticipated motion for summary judgment, in advance of the Case Management Conference. 3. Eli Lilly Pursuant to the Court s direction at the April Case Management Conference, on May 16, 2016, the PSC provided counsel for the Lilly defendants with a proposed CMO 19-C, addressing a bellwether selection and discovery plan. The parties have agreed to 5

Actavis The PSC and counsel for Actavis will work towards submitting a proposed amended CMO 19-D, as it pertains to timeline for discovery and relevant to defendant Actavis by the June, 2016 case management conference. 5. Endo Pharmaceuticals The PSC and counsel for Endo Pharmaceuticals will work towards submitting a proposed amended CMO 19-E, as it pertains to timeline for discovery and relevant to defendant Endo Pharmaceuticals, by the June 2016 case management conference. F. Dismissal Lists Pursuant to the Court s direction, the parties have attached CMO 26 and 9 Dismissal Lists as Exhibits A and B respectively. The parties are informed that there are no outstanding objections from the previous or current lists that would warrant counsel presenting their disputes at the May or June Case Management Conferences.
