However, the pages listed here are the ones that had the Sierra 253FF - 253JJ (5 sheets), Pacific Resources (or SPR) name embedded in the page somewhere, and that we had to 257AA change. This compliance filing is made to state in the OATT - specifically - that we have received waiver of Order No. 676-C requirements related to the standard for Transmission Loading Relief - Eastern Interconnection. The filing was accepted by the FERC on 2/18/2009 without changes. 10/15/2008 Attachment K-Transmission 253A-253CC 253DD-253KK OA /7/2007 7/16/2009 On July 16, 2008 the Commission accepted the changes filed in the December 7, 2007 Planning Process Compliance (29 sheets) (8 sheets) compliance filing subject to a further compliance filing. What was interesting about the Filing Compliance Order is that a single order was issued to cover the Attachment K filings of several utilities. The utilities were grouped together because of their membership in both the Southwest Area Transmission Planning group (SWAT) and WestConnect. This filing removes the requirement that a reserve sharing program be (5 sheets) Commission-approved, adds the language except for purposes of fulfilling obligations under a reserve sharing program to selected sections, and makes other language changes. The filing was accepted by the FERC on 11/14/08 without changes. 9/2/2008 General Rate Case Zone A 186,189 none ER /23/2007 1/15/2009 This was the actual filing of the uncontested settlement in this Zone A (SPPC) General Rate Change Settlement 190,244 Rate Case. When the FERC approves this filing, the new rates that take effect are the Agreement Compliance Filing (4 sheets) following: point-to-point and network rates on Sheet No. 186 (Schedule 7), Sheet Nos. 189 & 190 (Schedule 8), and Sheet No. 244 (Attachment H). The filing was accepted by the FERC on 10/10/08 without changes. 5/16/2008 Order 890 OATT Reform 26,27,53,58, 187A,257AA OA /1/ /10/2008 The final paragraph of the April 17, 2008 Order Conditionally Accepting Compliance Filing Compliance Filing 59,188,257A, (2 sheets) (for Sheets 26 & 27) ( Order 890 Compliance Order ) required the Nevada Companies to submit, within B,257C, days of that order, a compliance filing to make various changes outlined in the Order D,257E, 7/13/ /10/2008 Compliance Order. The areas addressed in the Order include making several changes to 257F,257G (for the remaining sheets) the Attachment L-Creditworthiness Procedures, make changes to unreserved use (13 sheets) penalties, file a new Attachment J-Procedures for Addressing Parallel Flows, and to return the rollover rights language to where it was prior to Order 890, pending acceptance of the Nevada Companies' Attachment K-Transmission Planning Process. The new Attachment J-Procedures for Addressing Parallel Flows was filed already on March 17, 2008 in conjunction with the Nevada Companies' Order 890-A OATT Reform Compliance Filing, so it was no longer needed to be filed with this compliance filing. The filing was made on April 11, 2008 and the changes were made effective that same date. On September 12, 2008 the Commission accepted the changes filed in the April 11, 2008 compliance filing without further modification. That closes this series of filings, which began with the original filing on September 11, 2007 which resulted from OATT reform Order /2/2008 Imbalance Penalty Revenue 177A,177B, none OA /2/2008 5/30/2008 Paragraph 12 of March 3, 2008 Order On Compliance Filing ( Imbalance Compliance Compliance Filing 196C,196D Order ) required the Nevada Companies to submit, within 30 days of that order, a (4 sheets) compliance filing to make the definition of non-offending customers less restrictive and to calculate penalty revenues on an hourly (rather than monthly) basis. We also made a correction to the language, changing the term "Hourly Energy Proxy" to "Transmission Provider's Incremental Energy Cost." 4 changes were made effective that same date. On May 30, 2008 the Commission accepted the changes filed in the April 2, 2008 compliance filing without further modification. That closes this series of filings, which began with the original filing on April 14, 2007, continued with a compliance filing on August 10, 2007 and then another (and final) compliance filing on April 2, /17/2008 Order 890-A OATT Reform 10,19,22,27, 28A,118A OA /17/ /15/2008 On March 17, 2008, the Sierra Pacific Resources Operating Companies filed with the Compliance Filing 28,31,31A,34, (2 sheets) FERC the OATT Compliance changes to the OATT stemming from FERC Order 890-A 46,47,56,64,64A,70,74,77, OATT reform. Order 890-A was issued December 28, In addition, the new 79,80A,93,94,109B,117, Attachment J-Procedures for Addressing Parallel Flows was filed which was originally to 118,187,188,191,202A be filed on July 13, 2007 as a result of the original Order 890-OATT Reform. However, FERC Auditor Bryan Dunn ( ) did find an error that was not big enough to deny acceptance, but he did request that we correct the error. Revised Sheet No. 56 contains the ordered revisions but shows an effective date of 7/13/2007 and a designation of "1st revised". However, the proper effective date should be 3/17/2008 and the designation should be "2nd revised". 12/7/2007 Attachment K - Transmission 253A 253B-253CC OA /5/2008 7/17/2008 On December 7, 2007, the Sierra Pacific Resources Operating Companies made an Planning Process (1 sheet) (28 sheets) OATT compliance filing of a new OATT Attachment K Transmission Planning Process as required in FERC OATT Reform Order 890. The proposed new OATT Attachment K is 29 pages in length and consists of modified Sheet Number 253A and new Sheet Numbers 253B through 253CC. The changes were made effective 60 days from the date of the filing-february 5, On July 17, 2008 the Commission accepted the changes filed in the February 5, 2008 compliance filing subject to a further compliance filing. What was interesting about the Compliance Order is that a single order was issued to cover the Attachment K filings of several utilities. Schedule 1 rates on Sheet 165: 11/16/2007 The original proposed effective date for these changes was November 15, On November 13, 2007, the Commission issued an Order which accepted the rate for Schedule 1 effective November 16, 2007 (subject to refund), and postponed the effective dates for the remaining schedules until April 15, 2008 (which will also be subject to refund) pending a settlement and/or hearing. 5 That settlement was accepted by the FERC on 1/15/09 without further changes. 9/14/2007 CBNS-Update 126,130D,130E 130D.01 ER /13/ /28/2007 On September 14, 2007, the Sierra Pacific Resources Operating Companies made a (3 sheets) (1 sheet) compliance filing as directed by the FERC in their Capacity Based Network Service ( CBNS ) order to make several selected modifications to the new CBNS in consultation with their transmission customers. Those proposed modifications are contained in OATT Sheet Numbers 126, 130D, 130D.01 (a new sheet), and 130E. As directed in the FERC CBNS Order the changes were made effective July 13, On November 28, 2007 the FERC accepted the compliance changes as filed. 9/11/2007 Attachment C - ATM Calculations 205, A - 206L OA /11/2007 3/12/2008 On September 11, 2007, the Sierra Pacific Resources Operating Companies made an (2 sheets) (12 sheets) OATT compliance filing of a new OATT Attachment C Methodology to Assess Available Transfer Capability as required in FERC OATT Reform Order 890. The proposed new OATT Attachment C is 14 pages in length and consists of modified Sheet Numbers 205 and 206 and new Sheet Numbers 206A through 206L. As provided for in that order, the changes were made effective on the same day as the filing: September 11, On 3/12/08 the Commission conditionally accepted our Attachment C subject to us making a compliance filing within 30 days (on Friday, April 11, 2008) to make requested changes. These changes are to correct certain items and to add certain clarifications and explanations. We made that filing - which changed or added 22 tariff sheets - on April 11, /29/2007 Loss Compensation Schedule , A ER /1/ /4/2007 This change to OATT Schedule 10 - Loss Compensation Service provides an alternative (2 sheets) (1 sheet) settlement option to Transmission Customers who would prefer to settle Real Power Losses financially as opposed to supplying via Physical Delivery the Real Power Losses necessary to compensate the Transmission Provider for such losses. Thus, there are now three settlement options in the OATT for Real Power Losses: 1) supplying losses via physical delivery, 2) arranging for a third party to supply losses via physical delivery, or 3) financial settlement, which is the new option available with this filing. That filing was accepted by the FERC on 10/4/07 without change. 8/10/2007 Imbalance Penalty Charges 177A,196C 177B,196D OA /13/2007 3/3/2008 Paragraph 12 of July 13, 2007 Order Conditionally Accepting Proposed Variations From Compliance Filing (2 sheets) (2 sheets) The Pro Forma Open Access Transmission Tariff designated Docket No. OA ( Imbalance Order ) required the Nevada Companies to submit, within 30 days of that order, a compliance filing proposing a mechanism for crediting imbalance penalty revenues to all non-offending customers and to the Nevada Companies on behalf of their own customers in accordance with the requirements of Order No On 3/3/08 the Commission conditionally accepted those changes, subject to us making a compliance filing within 30 days (on Wednesday, April 2, 2008) to, among other things, make the definition of non-offending customers less restrictive. The Optional Implementation FPA Section 205 filing guidelines and Para. 139 Schedule 9 Generation C of the Final Rule allow previously approved variations to remain in effect subject to a Imbalance Service (7 sheets) demonstration that such variations continue to be consistent with or superior to the revised Final Rule pro forma OATT. This compliance filing preserved with minor modifications to update them for Order 890 requirements the Companies existing schedules as follows: - Schedule 4 Energy Imbalance Service, and - Schedule 9 Generation Imbalance Service.
