1 ADJOURNED MEETING OF THE GEARY COUNTY COMMISSION MINUTES December 28, 2010 Commissioners Present: Ben Bennett, Larry Hicks and Florence Whitebread Chairman Whitebread called the meeting to order and the Pledge of Allegiance was recited. Commissioner Bennett announced the MAC Office was moved last week. Sheriff Jensen presented the weekly report: Reported there are 89 prisoners in our detention center, with 97 being the highest. Reviewed his discussions with Harbin Construction regarding covering the walkway between the jail and courthouse. The estimated cost is $37,000. He reviewed the various methods of funding from non-property tax funds, including the money from the Protocall contract and commissary funds. The work would be done next year. The commission agreed the funds could be encumbered for the project. Commissioner Bennett inquired about New Year s Eve preparations. Sheriff Jensen reviewed his plans. Commissioner Hicks inquired about staffing levels. Sheriff Jensen reviewed the interviews they have held, offers made, and training sessions that are being set up. Lisa Eickholt, Human Resources and Dennis Cox, Public Works Administrator, arrived at the meeting. At 9:50; Commissioner Bennett moved for a 20 minute executive session, to end at 10:10, to discuss non-elected personnel with Sheriff Jensen, Mrs. Eickholt, and Mr. Cox. Commissioner Hicks seconded and all voted aye. At 10:10; Commissioner Bennett moved for an additional 15 minutes, to end at 10:25. Commissioner Hicks seconded and all voted aye. At 10:25; Commissioner Hicks moved for an additional 10 minutes, to end at 10:35. Commissioner Bennett seconded and all voted aye. The meeting resumed at 10:35 with no action taken. Sheriff Jensen, Mrs. Eickholt and Mr. Cox left the meeting. Connie Hall, Convention and Visitors Bureau, presented the monthly report: Reviewed the meeting with Carolyn Mayo, Interim Director of the Opera House, and her request for additional funds. She stated they reviewed their funds and recommended to the board and they approved a pre-payment of up to $15,000 of the 2011 funds to help them with their immediate cash flow problems. She stated that Mrs. Mayo has done a wonderful job with making corrections to their cash flow problems. Commissioner Bennett inquired about the county commission approval. Chairman Whitebread stated the commission approves their budget and monthly vouchers. Presented the convention/tours/shows calendar and noted the additions. She stated that they have taken over the weekly briefings at Fort Riley at the request of Denise Ott, Military Affairs. They present a video which highlights housing, schools and activities. Chairman Whitebread inquired if these are new soldiers to Fort Riley. Mrs. Hall said yes. Reviewed the Run for the Wall meeting and plans that are being made. Reviewed monthly and year to date figures as follows: o 765 requests for information. o 546 office visits. o 4,523 welcome packets distributed. o 28,297 visitor guides distributed. o 3,040 pocket guides distributed.

2 Minutes Page 2 o 114 conventions/tours/shows. Presented social media network totals: o Web site 2,561 hits on the web site, which is an average of 128 per day. Noted that 84.62% were new visitors. Top 5 in-state visitors: Junction City, Manhattan, Wichita, Pittsburgh and Olathe. Top 5 out-of-state: New York, New York; Moline, Illinois; Des Moines, Iowa; Clarksville, Tennessee, and Eugene, Oregon. o YouTube 212,384 views o Facebook 245 monthly active users o Flickr 59,285 photographs viewed o Twitter 85 followers Reviewed the multi media campaign survey results that were done in conjunction with the Chamber and EDC. Presented a packet on the Outdoor Writers who held their conference here this year. It included thank you notes and copies of articles that appeared in various newspapers about our area. Presented and reviewed the goals, promotions, and marketing plans for The Board is reviewing them and they will be approved at their next meeting. Stated that Albert J. Nahas has written a book entitled Warriors Remembered Vietnam Veterans Welcome Home. She noted that the CVB was given an acknowledgement in the book. Reviewed the schedule of travel shows they will attend in January. Mrs. Hall left the meeting. Chairman Whitebread reported the regional transportation bus system may be ready to start in mid-january. Steve Opat, County Attorney/Counselor, discussed the following: Chairman Whitebread informed him that the regional transportation system is moving forward and inquired about the status of the MOU. Mr. Opat stated that the agreement will have to be amended to reflect the language that KCAMP requires. Requested an executive session. At 11:42; Commissioner Hicks moved for a 10 minute executive session, to end at 11:52, to discuss legal matters with Mr. Opat. Commissioner Bennett seconded and all voted aye. The meeting resumed at 11:52 with no action taken. Mr. Opat left the meeting. The meeting recessed for lunch from 12:00 to 1:15. Mr. Cox returned to the meeting and presented the weekly report: Commissioner Hicks inquired about the stock pile of rock. Mr. Cox stated some got used last week, we have adequate supply, and more will be purchased after the first of the year with the new budget funds. Commissioner Hicks inquired about the status of maintenance work at Cloud County Community College Geary County Campus. Mr. Cox stated all work has been completed with the exception of an they received last week. It is about the door handles and the need for replacement. He stated they are also looking into a campus wide security system. Commissioner Hicks noted that he has been invited to serve on a

3 Minutes Page 3 committee about the campus growth. Mr. Cox stated he has also been asked to serve on the committee. Commissioner Bennett stated that the county attorney and the representative attorney s are discussing the expansion and more information will be forthcoming. Presented the November Transfer Station Operating expenses and revenue. He stated November was negative but it was due to repairs that were made to the tipping floor. There was a discussion about the fuel surcharge. He reminded the commission that the tipping fee will increase next week. Reviewed projects they did last week including: cleaning around guard rails and replacement of acoustic tiles in the office space in the Annex Building that the United Way will occupy. Stated that the carpet in the Annex Building will be cleaned and then it will be ready for occupancy. Commissioner Hicks inquired about the repair of the stairs at the courthouse. Mr. Cox stated they were repaired and discussed other concrete work they have done and that was previously reported. Reviewed the work they did due to the wet weather last Thursday and Friday. Commissioner Hicks asked how the year is closing out and what he anticipates for Mr. Cox stated the purchase of additional gravel due to the growth west of Junction City. He stated that he will bring some other ideas after the first of the year. He stated there is also a need for rock and that the federal transfer fund might be a funding resource. He discussed the fact there is not a new federal highway plan, which makes it difficult to make concrete plans. Chairman Whitebread discussed the effect that the state budget problems may have on the county and specifically to the transportation funds. Mr. Cox also discussed the importance of adding miles back into the chip sealing program, since we are not even doing half of what is optimal, due to budget constraints. He also reviewed the status of various bridge projects and that we have been using our obligation authority. Discussed the need to burn the burn pile once adequate moisture has been received. Mr. Cox left the meeting. Mr. Opat returned to the meeting and discussed the following: Presented various resolutions for adoption. There was a general discussion regarding the proposed consolidation of the Chamber, EDC, CVB and MAC. Commissioner Hicks moved to adopt Resolution A transferring Unencumbered Funds to the Noxious Weed Capital Outlay Fund. Commissioner Bennett seconded and all voted aye. Commissioner Bennett moved to adopt Resolution B Creating a Special Fire Protection Reserve Fund for Rural Fire District No. 1 and Transferring Unencumbered Funds to said Special Fire Protection Reserve Fund. Commissioner Hicks seconded and all voted aye. Commissioner Hicks moved to adopt Resolution C Transferring Unencumbered funds to the Equipment Reserve Fund. Commissioner Bennett seconded and all voted aye. These funds will be used for the Sheriff to upgrade radio equipment as required to meet federal regulations by Clerk Bossemeyer inquired about Resolution Mr. Opat stated there would not be a Resolution with that number.

4 Minutes Page 4 Presented the agreement with United Way for office space. Commissioner Bennett moved to approve the agreement. Commissioner Hicks seconded and all voted aye. Mr. Opat left the meeting. Rebecca Bossemeyer, County Clerk, discussed the following: Presented and reviewed financial reports: o Noted that there is still one payroll and one month of bills to be paid from 2010 funds. o Reviewed the general fund revenues and stated the estimate over budget is $193, Additional revenue is still expected from the following line items: interest and fees on delinquent tax; mortgage registration fees; officers fees; law enforcement fees; civil process fees; diversion/attorney/district court fees; prisoner board; district court record searches; juvenile detention; antique tags, and interest on idle funds. Chairman Whitebread noted that the interest on idle funds is much lower than budgeted. Clerk Bossemeyer stated that she is concerned too much is budgeted for 2011 in that category as well. It is budgeted at $100,000 and we have only received $42, to date. o Reviewed the expenditures, cash and 2011 carryover. She noted that all funds appear to have sufficient budget and cash for There are several funds that do not have the budgeted carryover for Presented updated information on the Chamber Annual Retreat. Presented the mailing from KAC regarding 2011 membership dues and other matters. She noted dues for 2011 is $5, Commissioner Hicks inquired what we paid for Clerk Bossemeyer stated it was $5, She noted it is higher because it is based on population and assessed valuation, both of which are higher for Presented the following from KCAMP: o Premium billing for Community Corrections coverage which the State of Kansas will not provide. The total bill is $33,257 and is split between the four counties in the 8 th Judicial District. Geary County s portion is $19, which is based on 59% of the total. Chairman Whitebread inquired about the budgeted amount. Clerk Bossemeyer stated it is in the general fund and is $20,957. o Premium billing for the county coverage is $178,270 compared to $178,321 for o Certificate of participation. o Public Officials Bond. Presented the Pawnee Mental Health Contract and noted it is the same as last year, except for the amount which is as budgeted. Presented a request from the Area Agency on Aging for appointment to the board. Commissioner Hicks moved to re-appoint Madelyn Brown to the North Central- Flint Hills Area Agency on Aging Board of Directors for the term of January 1, 2011 through December 31, Commissioner Bennett seconded and all voted aye. Reminded the commission of the need for an appointment of a board member and alternate to the Pawnee Mental Health Board. Presented Commission Change Orders. The press conference was held. Commissioner Bennett moved to approve Commission Change Orders through Commissioner Hicks seconded and all voted aye.

5 Minutes Page 5 Commissioner Bennett moved to approve the contract with Pawnee Mental Health for 2011 in the amount of $126,737. Commissioner Hicks seconded and all voted aye. Chairman Whitebread reviewed the Hospital Board of Trustees meeting that was held over the lunch hours and their need for additional equipment purchases. Clerk Bossemeyer presented the minutes. Commissioner Bennett moved to approve the minutes of December 20. Commissioner Hicks seconded and all voted aye. David Yearout, Planning and Zoning, stated that the MPC meeting has been moved from January 13 to January 20 because the mailings did not go out on time. The City of Milford plans to adopt their new codes on January 6. Mr. Yearout left the meeting. There being no further business to come before the board of county commissioners, the meeting adjourned at 4:00 p.m.
