Energy sector consumption makes important share of EU s GDP, equivalent to 2 trillion euros annually of public buildings in building stock is considerable average energy performance of existing buildings stock, incl. public buildings efficiency not systematically integrated in procurement processes

3 EU PROCUREMENT PROVISIONS (1).Public Procurement Directive (2004/18/EC) Update agreed last December (explicitly allowing to base procurement on labels and to apply life-cycle costing).green Public Procurement (Communication COM (2008) 400) far reaching requirements covering a lot of products/services entirely voluntary.clean Vehicle Directive (2009/33/EC) requires procurers to take into account in technical specifications and a number of criteria (ia. CO2 emissions, NOx emission); if life-cycle costing is applied a given methodology has to be observed for the moment limited impact

4 EU PROCUREMENT PROVISIONS (2).Energy Labelling Directive (2010/30/EC) article on public procurement exists but it is not too mandatory ("MS shall endeavour to procure ").Energy Star Regulation (106/2008/EC) obligation to purchase a given level of efficiency but only central government level subject to cost-effectiveness/technical suitability etc. only for contract above the thresholds in the PP Legislation (2004/18/EC) which currently stand at 130,000 Scattered legislation No mandatory provisions

More Model EED proposals 5: Purchasing by public bodies Member States shall ensure that public bodies purchase only products, services and buildings with high energy efficiency performance, as referred to in Annex III. of standards in EPBD, ecodesign etc. to buy highest efficiency class, if economically feasible & technically possible systematic use of Energy Performance Contracting contracts for energy performance contracting in the public sector
