6 1. INTRODUCTION Galileo is a flagship programme in the space domain, enabling the European Union to increase its technological independence, stimulating European innovation and competitiveness. The objectives and priorities for 2012 clearly indicate that it will be an important year for the European satellite navigation programmes, EGNOS and Galileo. The successful launch on 21 October 2011 of the first two operational satellites of the Galileo system, for the first time on a Russian Soyuz rocket from Kourou, was an extremely important milestone for the future of space in Europe and its citizens. This milestone will be followed in 2012 by further key decisions and events for the programmes. The next launch, foreseen in 2012, of another set of two further satellites and their integration into the ground segment will complete the in orbit validation (IOV) phase forming the nucleus of the future constellation of 30 satellites. Since the definition of a European strategy concerning satellite navigation, a number of decisions have been taken which mean today Galileo is under control, on both programmatic and financial levels. The Commission is able to control development cost of the programme, mitigate the risks which are inherent to such a project and to realise significant savings. Owing to this rigorous management, it was possible on 21 October 2011 to launch a procurement procedure for additional satellites, underlining the political ambition of the Commission to accelerate the deployment of the Galileo system and to offer initial navigation services to citizens and users from Recent studies have shown that satellite navigation will generate economic benefits in the order of 130B cumulative over the period Efforts are also focused on optimising launch services procurement. In consultation with the European Space Agency and Arianespace, the Commission intends to participate financially in the adaptation of the Ariane 5 launcher. This will provide the programme with a double source for launchers, reducing the risk of a captivity situation. In addition to this should be added reinforced international cooperation for the implementation on a global level of the Galileo and EGNOS services assuring a complete interoperability between the different existing satellite navigation systems. In 2012, the programmatic elements will be accompanied by significant changes at the regulatory level with respect to the next Multiannual Financial Framework (MFF) for the period. In the context of the ordinary legislative procedure, work will continue on the Commission's proposal for a new GNSS regulation which will set the strategic objectives for the governance and long term exploitation of Galileo and EGNOS. The Commission will also put forward a proposal for the revision of 1 SEC (2011) 1446/ 1147 EN 6 EN

7 the European GNSS Agency (GSA) regulation in order to prepare the GSA to take on the new tasks and missions with which it will be entrusted. It is worth also recalling the key role played by EGNOS in the implementation of the European satellite navigation programmes. Operational and certified, the system is at the heart of a series of applications, improving the precision of GPS signals throughout Europe. The EGNOS Open Service, today used for personal navigation, goods tracking and also for precision agriculture, is available since October It was complemented in March 2011 by the Safety of Life service. The evolution of EGNOS and its integration with Galileo applications will show the practically unlimited opportunities offered by these cutting edge navigation systems. The improvement of the EGNOS system in Europe and the preparation for its extension to South Africa are the priorities for In addition, the Commission will continue to coordinate the EGNOS system roadmap in line with the EGNOS geostationary transponder roadmap. The launch foreseen in June 2012 of the first of two new geostationary transponders for EGNOS will be key to ensuring the continuity of the EGNOS services. * * The 2012 European satellite navigation Work Programme is ambitious. With EGNOS, the European Union has taken a first step towards its own navigation system and the successful launch of the first two Galileo IOV satellites shows the determination to ensure the European citizen benefits from earlier investments. Owing to a continuing control of costs and risks and an optimisation of the procurement policy, the Galileo programme is well on course to start offering services in the medium term, and in the long term ensuring European autonomy with respect to other satellite navigation systems. EGNOS and Galileo form an integral part of the European 2020 strategy, stimulating the European Union to be more innovative, supporting economic activity and, for example, facilitating humanitarian assistance and improving road traffic safety. 2. SCOPE OF THE 2012 WORK PROGRAMME This document covers the activities which will be launched or continued in 2012 to implement the European satellite navigation programmes EGNOS and Galileo (referred to hereafter as the programmes). Its legal basis is Regulation (EC) No 683/2008 of the European Parliament and the Council of 9 July 2008 on the further implementation of the European satellite navigation programmes (EGNOS and Galileo) 2 (referred to hereafter as the GNSS Regulation). In accordance with Article 15(3) of the GNSS Regulation, this document sets out the GNSS work programme to be adopted by the Commission in accordance with the management procedure defined in Article 4 of Decision 1999/468/EC, and reviewed on an annual basis. Pursuant to Article 13(1)(b) of the new Comitology Regulation 2 OJ L 196, , p.1. EN 7 EN

8 (EU) No 182/2011 3, the examination procedure referred to in Article 5 of that Regulation now applies in this respect. The document covers: 4 activities relating to the completion of the development and validation phase of the Galileo programme, including the achievement of Initial Operational Capability (IOC) and the transition between In-Orbit Validation (IOV) and Full Operational Capability (FOC); activities relating to the deployment phase, including actions to manage and monitor this phase, and preparations for the exploitation phase of the Galileo programme; activities relating to the operation of EGNOS, including operational maintenance; activities relating to the development of GNSS applications and services and international cooperation. These are the main sections: Chapter 2 sets out the scope of the work programme and chapter 3 recaps the status of the programmes and fixes the priorities for 2012; Chapter 4 outlines the context and the institutional set-up for the management of the GNSS programmes; Chapter 5 presents policy and the strategic objectives; Chapter 6 describes the measures to be implemented in 2012 with no significant financial implications and the measures that require the allocation of commitment and payment credits in 2012 and beyond; Chapter 7 focuses on the budget and financing aspects and provides a budgetary overview. 3. STATUS OF THE PROGRAMMES During 2011 major progress has been achieved in the European GNSS programmes at the levels of both policy and strategy, and programme implementation. Concerning policy and strategy, the Mid Term Review was adopted by the Commission in January. In Council conclusions adopted in March, Member States confirmed their commitment to the European GNSS programmes. This was then followed by the Commission budget proposal in June which included a total of EUR 3 4 OJ L 55, , p 13 Note that this document does not cover activities financed under the relevant budget lines financing the in-orbit validation phase or GSA's operational budget. 9 7B (2011 prices) for the next financial perspective Work also took place during 2011 on the development of a new draft European GNSS Regulation which was adopted by the Commission on 30 November , following an Impact Assessment approved by the Impact Assessment Board on 2 September considering the long term governance arrangements for the service provision phases of Galileo and EGNOS. Also during 2011, the Council and the European Parliament adopted Decision No 1104/2011/EU on the rules for access to the public regulated service provided by the global navigation satellite system established under the Galileo programme (hereinafter referred to as Decision on PRS access rules) in September and in October 2011 respectively. Concerning the European GNSS international strategy, the EU and China held a series of meetings in 2011 with a view to resolving long standing frequency issues. Negotiation of a GNSS cooperation agreement with Switzerland, allowing Swiss participation in the European GNSS programmes continued, and a meeting with the African Union Commission concerning the extension of EGNOS to Africa was held in April. The same month, a roadmap was agreed with South Africa concerning the extension of EGNOS to South Africa. During 2011, progress was made in defining the approach to the implementation of the Galileo services, including consolidation of the approach to be taken to the IOC and a first version of the PRS Service Implementation Plan, to be presented to the GNSS Security Board. With respect to Galileo programme implementation, the key milestone of the first IOV launch of two operational Galileo satellites was successfully achieved in October. This followed the Security Accreditation Board's Approval To Launch (ATL) certification and the establishment of the IOV security chain of command, including the Galileo Security Monitoring Centre Nucleus. Further for Galileo, the contracts for Galileo Work Package 2 (Ground Mission Segment) and Work Package 3 (Ground Control Segment) were signed in June for a total of EUR354.5M, completing the contract award of the main Galileo Work Packages for the FOC phase. In addition, the Commission launched an invitation to tender for the acquisition of additional satellites. The award decision is foreseen for the beginning of 2012, and the respective contracts for satellites and launchers were signed on 2 February With respect to EGNOS programme implementation, the key EGNOS milestone of the Safety of Life service declaration was achieved in March, with the service being successfully provided since that date. EGNOS Open Service continued to be provided successfully through Also noteworthy mentioning, during 2011 the Galileo children's drawing competition was launched and the first winners from Belgium and Bulgaria were selected to give their first names to the first two Galileo IOV satellites launched on 21 October COM (2011) 814 EN 9 EN

10 The Commission seeks, on a case by case basis, reinforced cooperation on technical issues with Member States, defined as the provision of specific technical analysis to the Commission. Concerning European GNSS programme implementation, the main objectives for 2012 will be to: Continue and reinforce the financial discipline; Accelerate the deployment of the Galileo constellation by procuring supplementary satellites and adapting Ariane5 ; Prepare the exploitation phase; Ensure a successful second IOV launch and closely monitor the implementation of the Galileo FOC work packages; ; Declare EGNOS coverage extension to a series of EU Member States and declare EGNOS Data Access Service availability; Continue provision of the EGNOS Safety of Life service and Open Service. European GNSS policy and strategy objectives for 2012 will be to: Achieve European Parliament and Council agreement on a new GNSS regulation, including long term governance arrangements for the exploitation phases of Galileo and EGNOS, but excluding budget; Submit a proposal for the revision of Regulation (EU) No 912/2010 setting up the European GNSS Agency 6 (hereinafter referred to as the GSA Regulation) in line with the proposed new GNSS Regulation; Present a proposal for an initiative on EU GNSS third party liability, accompanied by an extended impact assessment study (p.19) Establish, through delegated acts, a set of common minimum standards to support early PRS services (p.20) 4. MANAGEMENT OF THE PROGRAMMES This chapter sets out the management structure which is to ensure sound governance of the GNSS programmes and is for information purposes only. It provides the broader context of the commitment and payment appropriations planned for 2012, as described in chapter 6. 6 OJ L 276, , p. 11 EN 10 EN

11 A clear division of tasks between ESA, the GSA and the Commission shall be ensured in order to avoid duplication of efforts, reduce inefficiency and strengthen cost control. 4.1 Commission Article 12 of the GNSS Regulation confers on the Commission the responsibility to manage the GNSS programmes. Unless otherwise stated, the Commission 7 will implement the action points listed in chapter 5 and 6 below. Furthermore, the Commission will carry out tasks related to mission and system definitions, system implementation and project management of EGNOS and Galileo. This includes updating and managing the High Level Description Document (HLD) 8 that provides the context and high level requirements of the Galileo and EGNOS programmes as well as working on user requirements and standardisation (development of international standards for performance, services and user equipment in the different application sectors). 4.2 European GNSS Agency In 2012, the European GNSS Agency (GSA) will continue its work in support of the GNSS Programmes, on the basis of guidelines issued by the Commission. One focus of this work is on the security aspects that will continue to increase in 2012, covering in particular: All accreditation-related activities required for the three expected accreditation milestones in 2012 ("IOV Start" endorsement, "Authorisation To Launch 2" and "Authorisation To Launch 3") but also the PRS user segment accreditation activities; The operations of the GSMC nucleus and the preparation of the final GMSC operations; Specific tasks being delegated by the Commission to the GSA, in particular the procurement of PRS pre-operational receivers for the purpose of early test and validation with the interested Member States. The second focus of the actions of the GSA will be on market development to prepare the commercialisation of the systems. In that respect, the GSA shall manage under the delegation of the Commission, the FP7 programme for research and development. It shall also continuously monitor downstream market figures and perspectives, providing its contributions to the work of the Commission's DG ENTR, especially on the implementation and survey of the Action Plan for the development of the Applications of GNSS. It shall undertake any action required, in coordination with the Commission, for the implementation of this Action Plan, especially on awareness campaigns, representation of the Commission in conferences, liaison with stakeholders of the main markets identified by the Action Plan. More generally, it shall also undertake any other tasks identified by the Commission, including the 7 8 Wherever the Commission or its services are mentioned in this document, this includes the support of the GSA where relevant. 12 4.3 ESA promotion of European GNSS applications and training centres, in conformity with the applicable legal framework. These activities are detailed in the 2012 work programme of the GSA. In 2012, the GSA shall also manage the elements required for the operations of EGNOS as of Following the adoption of the Council Decision 2010/803/EU on the GSA seat 9, the GSA headquarters will move to Prague in the summer The Commission envisages assigning the task of the Programmes exploitation for the next programmatic period ( ) to the GSA. This is reflected in the new governance scheme set up under the proposed new GNSS Regulation for the further implementation of the European GNSS Programmes. In order to allow the GSA to build up its capacity and ensure a smooth transition period a delegation agreement entrusting the GSA with exploitation preparatory tasks for the period should be established, in accordance with the applicable legal framework and without prejudice to the decision taken with regard to the said proposal. While the Commission is responsible for managing the GNSS programmes, the European Space Agency (ESA) will continue to play an important role as implementing agency for the full operational capability of Galileo as procurement agent and overall system prime contractor. It is also the design authority for EGNOS system evolutions until The delegation agreement has been extended (1st amendment) until with a phase out phase of 6 months. To ensure strict division of responsibilities between the two parties, the Commission concluded multi-annual delegation agreements with ESA in 2008, covering delegated tasks and budget implementation to achieve full operational capability of Galileo, and in 2009, covering tasks related to EGNOS operational phase. These agreements lay down conditions for managing the funds entrusted to ESA, and more specifically the actions to be implemented, the relevant financing, management procedures and monitoring and inspection measures, measures applicable in the event of inadequate performance of contractors and rules regarding the ownership of tangible and intangible assets. At the request of the Member States the Commission agreed to bear the additional cost for the completion of the IOV phase in order to ensure the continuity of the programme and avoid the loss of industrial know-how and equipment already built. To this end a grant agreement was signed with ESA in 2009, amended in 2010 to take into account further financial needs of the IOV phase. However, while this decision had an impact on the financing of the FOC phase, it did not jeopardise the planning or the services. 9 OJ L 342, , p.15 EN 12 EN

13 4.4 Committees Galileo Inter-institutional Panel The Galileo Inter-institutional Panel (GIP) facilitates a close cooperation between the European Parliament, the Council and the Commission and allows the three institutions to monitor the GNSS implementation, international agreements with third countries, the preparation of satellite navigation markets, the effectiveness of governance arrangements and the annual review of the work programme. The Council and the European Parliament organise alternately the meetings of the GIP, and the Commission will continue to contribute to the preparation of the meetings of the Panel and, as appropriate, to provide detailed information at the request of the institutions European GNSS Programmes Committee In accordance with the GNSS Regulation and with the rules of the Union as to the procedures for the exercise of implementing powers conferred on the Commission, the European GNSS Programmes Committee (referred to hereafter as the GNSS Committee) assists the Commission in managing the GNSS programmes. In order to do so, GNSS Committee members are put in a position to obtain assurances that the entire programme is managed appropriately, in particular through reviews of progress by independent experts (referred to in paragraph 3.2 of the Strategic Framework 10 ) against the key decision points, as provided for by the GNSS Regulation. For this purpose, the GNSS Committee will meet three times in the course of 2012 to discuss the implementation of Galileo FOC, the operations of EGNOS and all related activities in which it is competent. As agreed in the context of the 2009 work programme discussions, Member State experts will be able to participate in the main technical reviews of the programme, at the invitation of the Commission. ESA and the GSA are observers to the GNSS Committee. Following the conclusion of the joint EEA-EU Committee Decision 94/2009, Norway participates as a nonvoting member of the GNSS Committee. Other third countries may be observers following an agreement to be concluded GNSS Security Accreditation Board (SAB) In 2012, the SAB is expected to take three major decisions for the programme: the IOV start endorsement and the authorisations to the second launch. The Commission will continue to support the work of the SAB and its technical panel, the GSAP, in order to ensure a proper programme interaction with the accreditation authorities. 10 Commission Decision of adopting the Strategic Framework of the GNSS Programmes, C(2008)8378. 14 4.4.5 GNSS Security Board In 2011, the GNSS Security Board held meetings on a regular basis. Two subgroups, the working group "national experts" and the working group on the "Public Regulated Service" are operational and are fulfilling a significant part of the tasks identified in the GNSS Security Board's security roadmap. Two task forces, the task force "Control" and the task force "Launch", have fulfilled the majority of their intended tasks and have been dismantled. The task force "PSI" has been converted into a full-fledged working group "Protection of Classified Information". In 2012, the GNSS Security Board will continue its work in accordance with its regularly updated roadmap with a focus on the adoption of the PRS common minimum standards requested by the Decision on PRS Access Rules Mission Evolution Advisory Group In 2011, the Commission set up a consultative group of GNSS experts called the "Mission Evolution Advisory Group" (MEAG) in order to pursue, on a long term scale, the refinement of mission requirements in accordance with evolving needs of the GNSS user communities as well as evolving technologies. This group aims at providing the Commission with independent advice and recommendations on potential evolutions of the mission objectives and the service definition for the European satellite navigation programmes. The outcome of its work shall contribute to the establishment of the Mission Evolution Roadmap. It will help to define the system requirements for the next generation of the European GNSS systems. In 2012, the MEAG will be requested to produce a first vision for the long term mission evolution for both EGNOS and Galileo. The main priority themes will be aligned with the programme needs and will likely focus on EGNOS evolutions, Galileo Safety-of-Life (SoL) re-profiling and Commercial Service definition. The MEAG will also be consulted on service provision elements in direct interactions with the users in order to refine the needs and expected functionalities. 5. POLICY AND STRATEGY OBJECTIVES 2012 This chapter describes the policy context which governs the GNSS programmes and sets out the strategic objectives for 2012, these being highlighted in summary boxes which precede each section. 5.1 Services and Exploitation strategy Initiate delegation of GNSS exploitation preparation activities to the GSA Publish updated High Level Documents including high-level service objectives 11 OJ L Decision No 1104/2011/EU of the European Parliament and of the Council of 25 October 2011 on the rules for access to the public regulated service provided by the global navigation satellite system established under the Galileo programme EN 14 EN

15 Publish high level exploitation plan Launch Commercial Service detailed technical study Define action plan leading to a Commercial Service demonstrator in Governance framework evolution The current governance framework for Galileo and EGNOS is set out in the GNSS Regulation and includes the Commission, ESA and the GSA. It was established for the Galileo development and deployment phase and the EGNOS initial exploitation and was developed for the period The governance framework for Galileo and EGNOS needs to be revised to take into account the lessons learned so far. The governance framework also needs to cover the provision of early Galileo services, although the Galileo deployment phase will be extended beyond The Commission has undertaken an Impact Assessment looking at GNSS governance which took as a number of starting points that: Best use should be made of existing structures as stated in the Council's conclusions on the Mid Term Review of the European GNSS programmes to minimise risk to EGNOS service provision and minimise disruption to the Galileo deployment phase. Considering EU ownership of the Galileo and EGNOS infrastructure and the full financing of the programmes through the EU budget, as confirmed in the Commission's Communication on the Multiannual Financial Framework 12, political supervision must remain with the Commission, representing the EU. Following further consideration of these principles and a detailed examination of the options available, the Impact Assessment subsequently concluded that the GSA is the most suitable candidate to fill the future role of exploitation manager. Without prejudging the final outcome of discussions on the new GNSS Regulation, but given the recommendation of the Impact Assessment Board and the urgent need to be able to ensure a smooth implementation of a new governance framework to support EGNOS service provision and early Galileo service provision, the Commission will delegate exploitation preparation activities for EGNOS and Galileo to the GSA in Update HLD The GNSS High Level Description Document (HLD) was last updated in February In the meantime, a number of important system modifications have been decided which have an impact on the HLD, including the re-profiling of the SoL service and the definition of the IOC service milestone. These changes need to be reflected in an updated version of the HLD as well as the MRD (Mission Requirements Document). 12 COM(2011)500 EN 15 EN

16 5.1.3 Commercial Service Mission requirements consolidation The Commercial Service (CS) is one of the 5 services identified in the GNSS Regulation and the Galileo High Level Description Document (HLD). Actions are required to consolidate the CS mission requirements and be in a position to launch development and procurement activities, leading to a CS demonstrator to be implemented at the introduction of early Galileo services. The CS demonstrator shall validate key technical concepts and pave the way for a fully operational Commercial Service. In order to achieve this goal, and because of the number of options to be analysed and traded off, the Commission will launch an open call for tender for two parallel "Phase A" technical studies in early These studies shall, on the basis of previous market and technical studies related to the Commercial Service, perform in depth trade-offs between the possible options taking into account the present Galileo infrastructure deployment realities. Required technical capabilities of the Galileo system to support the CS demonstrator shall be identified. These studies are expected to be completed within 6-8 months. Based on outputs from this activity, the Commission shall publish a Commercial Service SIS-ICD (Signal in Space Interface Control Document) by early Future Evolutions Publish European GNSS mission evolution roadmap Pursue interoperability between Galileo and GPS and Glonass Consolidate re-profiling of the SoL integrity concept for Galileo Decide on EGNOS evolution Overall European GNSS mission and services evolution The Commission holds the ownership of the Mission Requirement Documents (MRDs) for the European GNSS programmes EGNOS and Galileo and has been working in 2011 on a re-profiling of the Galileo Safety-of-Life (SoL) together with a consolidation of the Commercial Service (CS) Definition. Supporting Mission studies and/or demonstrations will have to be conducted during 2012 with the objective to refine the mission requirements for SoL and CS. In 2011, the Commission has set up the Mission Evolution Advisory Group (MEAG) with the main objective to provide independent advice on future evolutions of the GNSS user needs, to recommend updates of the mission profiles and to support GNSS research and development activities in view of a definition and consolidation of future EGNOS and Galileo services. The Commission will use this input for the establishment of the European GNSS Mission Evolution Roadmap which shall also serve as a reference document for coordination of GNSS research and development activities with the European Space Agency (ESA), i.e. the ESA GNSS Evolutions Programme (EGEP) and the Commission Framework Programmes. Coordination will also be continued with stakeholders in the aeronautical, maritime and road domain. EN 16 EN

17 5.2.2 Pursue interoperability between Galileo and other GNSS In 2012, the Commission will pursue the work undertaken in the context of the EU- United States of America (US) cooperation agreement in the area of next generation of GNSS (EU-US Working Group C). These main axes of work are anticipated: Development of interoperable solution for next generation of global safety of life service, notably with the objective to assess the feasibility of advanced RAIM (Receiver Autonomous Integrity Monitoring) solutions; Development of common standards for the provision of SBAS (Space Board Augmentation Systems) based on a dual frequency and multi-constellation configuration; Assessment of combined GPS-Galileo performance during the initial service phase of Galileo and development of guidelines for the publication of minimum performance for global satellite systems. Work on Glonass will be conducted in the context of the EU-Russia Space dialogue Consolidate re-profiling of the SoL integrity concept for Galileo The mission for Galileo had foreseen the provision of a Safety Of Life service on a global scale. The Galileo SoL service has been studied during the design phase of the programme and an integrity concept has been proposed that could meet the requirements. However, user acceptance of this concept is limited due to the lack of interoperability with other existing solutions and impact on the user terminals. In addition, it has been shown that the implementation of a safety of life service based on this concept would significantly drive the overall system complexity. This was considered a major risk driver for both programme schedule and cost to completion and therefore it has been decided to re-profile this service. As follows, work will be conducted in 2012 to support the definition of a re-profiled SoL service for Galileo. The main tasks shall include: Consultations with different user communities to confirm user needs and acceptability of different concepts. This will be conducted through direct interactions with user groups (e.g. SESAR Joint Undertaking (SJU) for aviation, the European Maritime Radionavigation Forum, the European Railway Agency, etc.) as well as through MEAG and the dedicated SoL experts group created with the support of the programme committee members; Interaction with international partners to develop interoperable solutions for the provision of safety of life services; Consolidation of study results on potential new integrity concepts. This shall be conducted in close cooperation with ESA. The work will be conducted with the support available from the mission support framework contract already in place and will rely on technical results available from EGEP studies launched by ESA. The GSA will be closely associated to this work. EN 17 EN

18 5.2.4 EGNOS Mission evolution For EGNOS, major tasks are foreseen in the area of mission evolution definition in This includes the following major axes: Definition of service improvements and extensions over additional EU territories and neighbouring countries (e.g. Ukraine) for the next release of the current EGNOS system. Consolidation of mission requirements for the next generation system (EGNOS version3). This shall address new service levels based on dual frequency and potentially a multi-constellation configuration, coverage area and definition of contingency services in case of failure. In this context, the decision on whether EGNOS should in the future also augment Galileo, in addition to GPS, will be consolidated in Definition of detailed requirements for EGNOS extensions over South Africa and ASECNA 13 responsibility area. The Commission will organize the necessary interactions with the different stakeholders and will prepare Mission Requirement Documents for each system configuration. An updated EGNOS SoL Service Definition Document will be issued mid The Commission will also continue to cooperate with ESA for the EGNOS Version3 study under the European GNSS Evolution Programme. It intends to reach a common vision of the future system roadmaps that will be implemented in the timeframe under the EU financing. 5.3 Legal and Regulatory Framework Achieve European Parliament and Council agreement on new GNSS Regulation Commission proposal for the revised GSA Regulation (Regulation (EU) No 912/2010) Ensure compliance with international convention on registration of satellites Define the implementation of a safety and quality management system for the two European GNSS programmes Prepare and sign the appropriate arrangements for Galileo sites (GSMC, GCC, GPEC, ULS, GSS 14, etc.).this action is required in order to safeguard the functioning of the EU's infrastructure Commission initiative on third party liability regime On 29 June 2011 the Commission presented a package of legislative proposals and related documents addressing policy challenges the European Union will be facing in Agence pour la Sécurité de la Navigation Aérienne en Afrique et à Madagascar GSMC (Galileo Security Monitoring Center), GCC (Galileo Control Center), GPEC(Galileo Performance Evaluation Center), ULS (Up-link station), GSS (Ground Sensor Station) EN 18 EN

Within the Multiannual Financial Framework, the Commission adopted its principal position on the Union's finances for the years As part of this process, on 30 November 2011 the Commission adopted a proposal for a new GNSS Regulation, i.e. the draft Regulation of the European Parliament and of the Council on the implementation and exploitation of the Galileo and EGNOS programmes. The regulation lays the ground for the financing and the governance of the programmes as from This proposal will be presented to and discussed with the European Parliament and the Council during The aim is to have this new legal basis for the programmes adopted by In 2012, the Commission will initiate the revision process of the GSA Regulation. It confers, amongst others, two tasks to the GSA, namely the security accreditation of the systems and the exploitation of the Galileo Security Monitoring Centre (GSMC). It further prescribes that both activities are to be run separately and independently. The GSA Regulation will be brought in line with the new tasks that are proposed to be attributed to the GSA for the period under the proposed new GNSS Regulation, and will affect the management of the exploitation. International law provides a number of rights and obligations in relation with the launch and the operation of satellites, e.g. the duty to register the satellites in the United Nations (UN) register of space objects and to bear the responsibility for them. The Commission, acting for the EU, owner of the Galileo satellites, will take the appropriate steps to ensure that international law is respected with regard to the Galileo satellites. In 2011, the Commission initiated works towards setting up an internal safety management system for both Galileo and EGNOS to fulfil its obligation as system owner. In 2012, the Commission will elaborate the principles against which such system will be implemented. Concerning sites hosting, arrangements will be established between the Commission and Member States which are hosting Galileo facilities on their territories. In 2012, an agreement is to be signed between the Commission and FR and UK as regards the hosting of the GSMC that will be operated by the GSA. The Commission will present in the fourth quarter of 2012 an initiative on EU GNSS third party liability, accompanied by an extended impact assessment study. This initiative will address in particular the concerns expressed by the EU legislator in Article 4(3) of the GNSS Regulation on the possible "financial obligations of the EU with regard to the exploitation phase deriving from its responsibility relating to the ownership of the systems". 5.4 International GNSS Strategy Cooperate with US, Russia and China Complete designs plan on EGNOS extension to South Africa Establish EU-AUC (African Union Commission) project team for EGNOS in Africa Conclude cooperation agreements with Argentina, Brazil and Chile Decide on action plan for the export of GNSS applications (pilot with Latin America) EN 19 EN

20 Conclude cooperation agreements with Russia and Switzerland Start negotiations with Cospas-Sarsat on EU s involvement Sign "Elements of Consensu with China" International activities focus on reducing political, technical and security risks to the European GNSS programmes, protecting Galileo frequencies and services and promoting the uptake of Galileo and EGNOS services worldwide. In 2012, the Commission will implement its updated international cooperation strategy issued in Bilateral cooperation will, in line with this strategy, focus on formalising relations, mainly through bilateral agreements, with key non-eu countries. Cooperation with other GNSS service providers, in particular the US, Russia and China, will continue. This includes technical work to support compatibility and security objectives of Galileo and EGNOS vis-à-vis third country systems, using the expertise of the Compatibility, Signal and Interoperability (CSI) Working Group. In 2012 the Commission will continue its work towards establishing an EGNOS based service over the African continent to be primarily used for civil aviation, maritime activities and land management. More particularly, an EU-AUC (African Union Commission) project team for EGNOS in Africa will be established and a design plan on the EGNOS extension to South Africa will be completed. In addition, the extension of EGNOS to the Ukrainian territory will be studied. The Commission intends to conclude cooperation agreements with Argentina, Brazil, Chile, and re-profile the current cooperation agreement with Israel and China. Actions will be undertaken to involve regions of the world where the adoption of European GNSS technologies and applications may help market development. In particular, an action plan for the export of GNSS applications will be proposed and a pilot project with Latin America will be launched. The Commission aims to conclude the negotiations on cooperation agreements with Switzerland and Russia will see the start of the discussions on the EU's involvement in Cospas-Sarsat. The Commission will continue supporting EU industry in particular through the monitoring of GNSS policies and regulations in third countries and the detection of possible or potential trade barriers. When required due to the development of their respective GNSS programs and their interest for a bilateral relation with the EU, enhance our cooperation with India and Japan. 5.5 Frequencies, Security and PRS Obtain results favourable to Galileo at World Radio Conference 2012 Conclude ITU agreements with GPSIII and GLONASS Agree PRS common minimum standards and publish PRS Signal-in-Space Interface Control Document EN 20 EN

21 Sign framework agreement with PRS pilot project Member States Conclude PRS agreements with several countries Facilitate the negotiation of the security of information agreement for the exchange of classified information between the GSA and ESA The World Radio communications Conference (WRC) in February 2012 will in particular decide on a possible new allocation in "S band" 15 that could be used by Galileo and other GNSS, which potentially aids compatibility of the large number of GNSS foreseen worldwide. The Commission will also be active on specific agenda items to ensure that possible new service allocations do not impair the use of current Galileo and EGNOS frequency plans, as well as monitoring proposals for future WRC topics that may be relevant. The Commission will fully participate in the WRC and coordinate Member States positions in advance and in-situ as developments occur. Concerning the ITU agreements with GPS and GLONASS, GPS III is not fully coordinated with Galileo yet, although no major issues are expected. The new signals of GLONASS, as well as the new EGNOS filings need to be coordinated. The Commission will perform coordination through existing working group channels under a mandate from the national frequency administrations 16. Those frequency administrations will sign the final agreement that will be communicated to the International Telecommunications Union (ITU). The Decision on PRS access rules allows the Commission to establish, through delegated acts, a set of common minimum standards to support early PRS service. In this regard, the Commission will carry out appropriate and transparent consultations well in advance, in particular with the designated Member States' experts, where so designated by the Member States concerned those represented in the GNSS Security Board. In this context, the PRS Signal in Space Interface document will be published and presented to Member States in The signing of a framework agreement with PRS pilot project Member States is foreseen in view of testing early PRS signals and emulating the PRS user segment chain. The Commission will propose to interested Member States a number of test and validation activities involving Member States participation to be defined in relevant bilateral agreements. The Decision on PRS access rules provide for the possibility to have non-eu PRS participants on the condition that a security agreement exists and an international agreement defining the conditions of access is negotiated. Both Norway and Switzerland have notified their will to become PRS participants and the Commission will therefore perform the necessary steps to conclude such agreements in line with the Article 218 of the Treaty on the Functioning of the European Union (TFEU). Others have manifested interest in knowing more about the conditions of access to PRS. The Commission will therefore inform the Council on MHz The "GLS" group EN 21 EN

22 the progress of such interactions which may lead to a request for a mandate in 2012, and, where appropriate, the European Parliament. As for the negotiation of the security of information agreement for the exchange of classified information between the GSA and ESA, currently the GSA is ensuring exchange of the classified information through the administrative arrangement which exists with the Commission and which allows GSA to receive and send information to/from ESA, through the Commission. In the future, and particularly in view of the move to Prague, a direct agreement shall be concluded. 6. PROGRAMMES IMPLEMENTATION OBJECTIVES Galileo Ensure successful second IOV launch Introduce agreed security requirements into existing contracts Accelerate the development of Galileo by procuring additional satellites Galileo programme implementation objectives The Commission will continue in 2012 to manage the following main programme implementation objectives: Complete the In-Orbit Validation (IOV) phase: the Commission aims at the launch of the Galileo satellites Flight Models 3 and 4 occurs duringthe summer It shall further qualify the deployed IOV system configuration and its associated operations and achieve the incremental system accreditation steps required to operate the system. The Commission shall also perform the in-orbit validation test campaign. Pursue the FOC deployment: the Commission will consolidate the IOC mission/system requirements, system design and deployment plan from IOC to FOC and shall introduce agreed security requirements 17. An upgrade and preparatory activities of the ground segment and operations for the launch of the first batch of FOC satellites are foreseen. Furthermore, the Commission will qualify the first FOC satellites and procure the next batch of FOC satellites. Prepare delivery of early services in 2014: the Commission shall consolidate the IOC mission requirements and ramp-up the preparation of the GSMC and SAR Ground Segment operations. The required documentation and operational interfaces with the Open Service, PRS and SAR users will be prepared Galileo IOV phase completion The In-Orbit Validation (IOV) phase should be completed to a very large extent in This activity will be articulated through: 17 "SSRS 3.9" EN 22 EN

23 The launch of the Galileo satellites Flight Models 3 and 4: those satellites will be launched from Kourou using a Soyuz vehicle. The satellites are identical to the first two IOV satellites, with however an active Search And Rescue (SAR) transponder which will allow to perform initial tests for preparing the SAR data service provision; The complete IOV system configuration will be progressively reached through successive upgrades of the Ground Segment, from the minimum configuration required to support the first launch to the "IOV" configuration which will be used to perform in-orbit validation tests. It will be in particular critical to deploy, with the support of the hosting member states, additional "fast-track" Galileo Ground Sensor Stations in order to be able to produce initial navigation messages and achieve an adequate level of performance validation; Following the progressive system deployment, three incremental system accreditation steps will be established: the approval for second launch, the authorisation to start the IOV test campaign and the initial authorization to operate; Finally, the IOV phase will be completed through the in-orbit validation test campaign, which will allow to test and validate "in the field" key performance parameters and will be concluded by the IOV-R review Pursue the Galileo FOC deployment Following the successful launch of the first two IOV satellite on 21 October 2011, the programme expects to conclude its IOV phase during the summer of 2012 with the launch of another two satellites. The IOC phase (reaching a constellation of 18 satellites in orbit) is currently at the stage of satellite production, with 14 satellites expected to be delivered between Q3 of 2012 and Q2 of 2014 and deployed in orbit between Q2 2013of 2013 and Q4 of The FOC deployment is expected to be achieved by 2019/2020. More specifically, the deployment of the Galileo system in order to support early service provision will continue in 2012, focussing on the execution of the following activities (performed through the EC-ESA delegation agreement for the FOC deployment phase): The procurement of a new batch of the first FOC satellites; The booking of supplementary Ariane 5 launchers together with a participation to the adaptation of Ariane 5; The consolidation of the IOC mission/system requirements, system design and deployment plan from IOC to FOC, through a delta System Critical Design Review (S-CDR); in particular the agreed security requirements have to be introduced into the existing contracts; EN 23 EN
