1 AFFINBANK WORLD MASTERCARD FLIGHT & TRAVEL PERSONAL ACCIDENT INSURANCE 1. The Principal AFFINBANK World MasterCard Cardmember (hereinafter referred to as Cardmember ) shall be covered by the Flight & Travel Personal Accident Insurance when an airfare is fully charged to the Principal AFFINBANK World MasterCard (hereinafter referred to as Card ). The insurance is underwritten by AXA AFFIN General Insurance Berhad. 2. Insured Person shall mean the Cardmember or any one of his Family Members as defined herein: a. Cardmember who is between 21 and 65 years of age. b. Family Member shall mean, the Cardmember legally married spouse who has not been legally separated or divorced from the Cardmember and who has not attained the age of 65 years and the Cardmember s legal children who have attained the age above 1 year but have not attained the age of 23 years and are unemployed and unmarried, provided that all such members are residing in the same household and in the same country of residence as the Cardmember. 3. Schedule of Benefits The insurance coverage for the Insured Person shall operate only when he is taking a trip during the period of insurance on a scheduled flight as a fare-paying passenger and when the entire air fare for travel on such scheduled flight has been fully charged in advance to a Card maintained by the Cardmember with the Bank. a. Travel Personal Accident Insurance In the event the Insured Person suffers bodily injury as defined, AXA AFFIN General Insurance Berhad shall pay compensation as follows: Benefits Total Sum Insured (RM) Accidental death 1,000,000 Loss of both hands or both feet 1,000,000 Loss of one hand and one foot 1,000,000 Loss of entire sight of both eyes 1,000,000 Loss of entire sight of one eye and one hand or one foot 1,000,000 Loss of one hand or one foot 500,000 Loss of entire sight of one eye 500,000 b. Inconvenience Event(s) i. Flight Delay If the Insured Person s confirmed scheduled flight is delayed for 4 hours or more or cancelled due to strike/industrial action, adverse weather conditions or mechanical breakdown/derangement of the aircraft as a result of mechanical or structural defect, as confirmed by the airline and no alternative onward transportation is made available to the Insured Person within 4 hours, AXA AFFIN General Insurance Berhad will indemnify up to the maximum limits of indemnity. 1

Insured Person Total Sum Insured (RM) Cardmember 1,000 Family Member 2,000 Missed Flight Connection If the Insured Person s confirmed onward connecting scheduled flight is missed at the transfer point due to the late arrival of the Insured Person s incoming confirmed connecting scheduled flight and no alternative onward transportation is made available to the Insured Person within 4 hours of the actual arrival time of his incoming flight, AXA AFFIN General Insurance Berhad will indemnify the actual additional expenses necessarily and reasonably incurred for hotel accommodation and restaurant meals or refreshments, up to a maximum limit as specified in the schedule of benefits provided that the Insured Person shall be at the airport at the time of such missed flight connection. Luggage Delay If the Insured Person s accompanied check-in flight luggage is not delivered to him within 6 hours of the Insured Person s actual arrival at the schedule destination point of his scheduled flight, AXA AFFIN General Insurance Berhad will indemnify the actual additional expenses necessarily and reasonably incurred within 4 days at such schedule destination for emergency purchase of essential clothing and requisites, up to a maximum limit as specified in the schedule of benefits, provided that such flight luggage had been checked in by an authorised official of the air carrier with which the Insured Person was travelling at the time of the occurrence. Loss of Luggage If the Insured Person s accompanied check-in flight luggage is not delivered to him within 48 hours of the Insured Person s actual arrival at the scheduled destination point of his scheduled flight, such luggage will be presumed to be permanently lost and AXA AFFIN General Insurance Berhad will indemnify loss of luggage (including clothing and personal effects) up to the maximum limits as specified in the schedule benefits provided that such luggage has been checked in by an authorized official of the air carrier with which the Insured Person was travelling at the time of the occurrence. 3 4. An Insured Person can only make one claim either for flight luggage delay or flight luggage loss. 5. The maximum for all losses paid to the Cardmember s spouse is limited up to 100% of the benefit amount as specified under the schedule of benefits. 6. In respect of the Cardmember s legally dependent children, the amount of benefit payable is limited to 25% of the benefit amount. 7. Exposure and disappearance. When by reason of an accident covered by the master policy, the Insured Person is unavoidably exposed to the natural elements and as a result of such exposure, suffers a loss for which benefit is otherwise payable hereunder; such loss shall be covered under the terms of the master policy. If the body of the Insured Person has not been found within 1 year of the disappearance, sinking or wrecking of the vehicle in which the Insured Person was travelling in at the time of the accident, it will be presumed subject to the terms of the master policy, that the Insured Person suffered loss of life resulting from bodily injury caused by an accident at the time of such disappearance, sinking or wrecking. If at any time after payment has been made by AXA AFFIN General Insurance Berhad for such claim, the Insured Person is found to be living, the Insured Person shall make full refund to AXA AFFIN General Insurance Berhad. 8. Maximum Indemnity The maximum indemnity for all losses to any one Insured Person shall not exceed RM1,000,000 and shall not exceed the benefit amount as specified above. AXA AFFIN General Insurance Berhad s maximum aggregate liability shall be RM20,000,000 for any one accident. In the event that an accident involves more than one Insured Person and if the said limit of indemnity is insufficient to pay the full amount of indemnity for each Insured Person, then the amount payable for each Insured Person shall be pro-rated accordingly. 3

4 AFFINBANK WORLD MASTERCARD PERSONAL ACCIDENT INSURANCE 1. The Principal AFFINBANK World MasterCard Cardmember (hereinafter referred to as Cardmember ) shall be covered by the Personal Accident Insurance in the event of accidental death or bodily injury(ies) caused by accident. 2. Insured Person shall mean the AFFINBANK World MasterCard Principal Cardmember who is 21 years old but has not attained the age of 65 years. 3. Schedule of Benefit Benefit Total Sum Insured (RM) Accidental death 100, Maximum Indemnity AXA AFFIN General Insurance Berhad s maximum aggregate liability shall not exceed RM20,000,000 for any one accident. In the event that an accident involves more than one Insured Person and if the said limit of indemnity is insufficient to pay the full amount of indemnity for each Insured Person, then the amount payable for each Insured Person shall be pro-rated accordingly. For avoidance of doubt, each Insured Person is entitled to a maximum indemnity of RM100,000 only. These clauses are an extract of and subject to the contents of the master policy. Any change, amendment or endorsement (including cancellation) of the master policy shall be binding on the Cardmember after adequate notice is given by AXA AFFIN General Insurance Berhad. The Cardmember shall observe the contents of the master policy in order not to prejudice any claim under it. No Cardmember shall have any right of recourse or action against the Bank. 4

Miscellaneous CARDMEMBER AGREEMENT In consideration of Affin Bank Berhad (25046-T) (hereinafter called 'the Bank') agreeing to make available to the Cardmember (Cardmember shall mean holder of the AFFINBANK World MasterCard) the facility offered by the Bank, the Cardmember irrevocably and unconditionally hereby agrees to the following terms and conditions. It is important for the Cardmember to read carefully and understand the terms and conditions printed below before using the Card. 1. DEFINITION In this Cardmember Agreement (hereinafter referred to as this Agreement ), the words and phrases referred to below are defined as follows: 1.1. "Authorised Merchant" shall mean any retail or other person, firm or corporation which pursuant to a merchant agreement agrees to accept or cause its outlets to accept the Card when properly presented "ATM" shall mean the Automated Teller Machine. 7

8 1.3. "Billing Period" shall mean the period in which all purchases of goods and/or services, Cash Advances, fees and charges incurred by the Cardmember are recorded by the Bank in the monthly Statement "Business Day" shall mean any day on which the Bank is open for business "Card" shall mean the AFFINBANK World MasterCard, Credit Card issued by the Bank "Card Account" shall mean the account of the Cardmember maintained with the Bank for the purpose of this Agreement "Cash Advance" refers to Cash withdrawals from the Card Account at designated Branches of the Bank, participating CRCs of MasterCard member banks or at designated Bank s ATMs and participating MasterCard member banks ATMs "Cash Advance Drafts" shall mean the relevant payment slips, forms or papers supplied by the Bank to the Authorised Merchants for the purpose of recording, confirming and evidencing Cash Advance by the Cardmember through the use of the Card to be charged to the Card Account Current Balance shall mean the previous balance and total purchases of goods and/or services, Cash Advances incurred by the Cardmember for which the Bank has purchased the Transaction Receipts and Cash Advance Drafts and any fees and charges charged by the Bank less any payment made by the Cardmember and credited to the Card Account during the Billing period "Credit Line" shall mean the limit granted by the Bank for the use of the Card Card-Not-Present Transactions refers to Card transaction payment where the physical Card is not physically present at the point-of-sale Due Date shall mean 20 days from the Credit Card Statement Date stated on credit card account Statement e-banking shall mean the provision of banking products and services through electronic channels, including via the internet, mobile devices, telephone, ATM and any other electronic channel "Finance Charges" means the Finance Charge referred to in Clause 13. 8

9 1.15. "Interest Free Period" refers to a period of 20 days from the Statement date of such transactions, provided there is no outstanding balance in the Cardmember s account "Minimum Payment Due" refers to the minimum amount required to be paid by the Cardmember by the Payment Due Date MasterCard International shall mean MasterCard International Incorporated, a membership corporation formed under the laws of State of Delaware, United States of America, having its office and principal place of business at 888 Eleventh Avenue, New York 10106, United States of America PIN shall mean the Personal Identification Number issued to the Cardmember to enable access to Card transactions through an ATM or at the Electronic Point-of-Sales Terminal Statement shall mean the periodic MasterCard Card Statement issued by the Bank to the Cardmember and/or Supplementary Cardmember which shows inter alia the amount so charged, the payment due date and the method of calculation of Finance Charges Statement Date shall mean the day the Statement is generated "Transaction Receipts" shall mean the relevant slips, forms or papers supplied by the Bank for the purpose of recording, confirming and evidencing purchases of services incurred by the Cardmember through the use of the Card to be charged to the Card Account Words importing the singular number include the plural number and vice versa Words importing the masculine gender include feminine. 2. ACCEPTANCE OF CARD 2.1. The use of the Card is restricted to the person to whom the Card is issued (the Cardmember ) who shall sign the Card immediately upon receipt thereof Upon receipt of the Card, the Cardmember shall contact the Bank to activate the Card for the purpose of effecting any Card transactions The Bank shall issue a PIN for the Card to a Cardmember for the purpose of effecting ATM transactions and at the Electronic Point-of-Sales Terminal By accepting the Card, the Cardmember is responsible to: a. abide by the terms and conditions for the use of the Card; b. take reasonable steps to keep the Card and PIN secure at all times, including at the Cardmember s place of residence. These include not: 9

10 i. disclosing the Card details or PIN to any other person; ii. writing down the PIN on the Card, or on anything kept in close proximity with the Card; iii. using a PIN selected from the Cardmember s birth date, identity card, passport, driving licence or contact numbers; iv. allowing any other person to use the Card and PIN; and v. act fraudulently. c. notify the Bank as soon as reasonably practicable after discovering that the Card is lost, stolen, an unauthorised transaction had occurred or the PIN may have been compromised; d. notify the Bank immediately upon receiving Short Message Service (SMS) transaction alert if the transaction was unauthorised; e. notify the Bank immediately of any change in the Cardmember's contact number; f. use the Card responsibly, including not using the Card for unlawful activity; and g. check the Card Account Statement and report any discrepancy without undue delay In the event that the Cardmember does not wish to be bound by these terms and conditions, the Cardmember shall cut the Card across the magnetic stripe and chip ensuring it is completely damaged and return immediately to the Bank, with a written notice that he/she is returning the Card for cancellation. Notwithstanding the cancellation of the Card, the Cardmember shall also continue to be liable for all obligations incurred prior to such cancellation as well as for any and all antecedent breaches of this Agreement. No refund of the annual fee and service tax any part thereof will be made to the Cardmember. 3. CARD FACILITY 3.1. The Card is issued for use in connection with facilities made available by the Bank from time to time at its absolute discretion including but not limited to the following: a. The payment for any purchase of goods and/or services from any Authorised Merchant, which payment may be charged to the Cardmember s account. b. Cash Advance withdrawal from any designated Authorised Cash Outlet and/or ATM. c. Any ATM transaction effected through the Cardmember s other accounts. d. Other facilities, subject to pre-arrangement with the Bank, if applicable The Cardmember shall obtain Cash Advance in such amount as may be acceptable to the Bank from time to time at its absolute discretion, by the following means: a. Presenting the Card at any Branch of the Bank or of any member institution of MasterCard International together with evidence of his/her identity and signing the necessary transaction record or enter his 6-digit PIN at the Electronic Point-of-Sales Terminal, or b. Use the Card at any ATM of the Bank or of any other bank or institution with whom the Bank has an arrangement for the use of ATM of the said bank or institution, or c. Any merchants determined by the Bank performing such facilities. 10

11 4. USE OF CARD 4.1. a. The Cardmember shall sign on a Transaction Receipt prepared by the Authorised Merchant/or enter his/her 6-digit PIN at the Electronic Point-of-Sales Terminal to effect a credit purchase using the Card. b. The Cardmember shall provide his/her relevant Card information as requested to complete an on-line transaction through the secured website. Where applicable, an authentication code or One-Time-Password (OTP) shall be sent to Cardmember s mobile number registered with the Bank to complete the on-line transaction. By providing such information for the purpose of performing on-line transactions, it s shall be deemed by the Bank to be a properly incurred Card transaction. c. To effect a Cash Advance, the Cardmember shall sign on a Cash Advance Draft/or enter his/her 6-digit PIN at the Electronic Point-of-Sales Terminal. Such Cash Advance Draft to be deemed by the Bank upon receipt as a properly incurred and duly authorised Card Transaction of the Cardmember. d. To effect a Cash Advance through the ATM, the Cardmember shall use the PIN to gain access to his/her Card Account. Recorded documentation arising from the Cardmember activation of PIN for the purposes of obtaining Cash Advance from an ATM shall be deemed by be deemed by the Bank to be a properly incurred Card Transaction The amount of each advance shall be limited to the available Card Account/Cash Limit The Cardmember shall comply with all requirements, directions, instructions and guidelines for use of the Card issued by the Bank from time to time in respect of all credit and banking facilities and services rendered to the Cardmember a. The Bank shall be entitled to treat its record of transaction effected by the use of the Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember; and b. The Cardmember agrees that the record of any transaction effected by the use of the Card shall be conclusive and binding on the Cardmember for all purposes; until a report of the loss or theft or unauthorized usage of the Card has been received by the Bank Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Card Number together with such other particulars as may be recorded on the Card and without the requirement of the Cardmember s signature/or PIN as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order. 11

12 5. CHIP AND PIN ( PIN & PAY ) - PIN AND THE USE OF THE CARD WHERE APPLICABLE 5.1. The Bank will allocate a Temporary PIN to the Cardmember via PIN Mailer. The PIN Mailer will be delivered to the Cardmembers registered correspondence address via normal mail The Cardmember upon receipt of the Temporary PIN shall change the Temporary PIN at the Bank s own ATMs and/or other secured channels permitted by the Bank If the Cardmember has forgotten his/her PIN, the Bank will issue the Cardmember with a new Temporary PIN upon the Cardmember s request In the event of lost or theft of the Card, or PIN number is revealed to to any other person, the Cardmember shall immediately submit a complete dispute form to the Bank if the Card was used for unauthorized transaction(s), A copy of police report must be submitted to the Bank within 7 calendar days from the date the unauthorised transaction(s) is discovered. A new Card and PIN will be issued upon request from the Cardmember. The Cardmember is not able to use his/her existing PIN with a replacement Card The Cardmember must keep his/her PIN secret and shall not disclose his/her PIN to any other person under any circumstances. In the event of the PIN being disclosed to any party, the Cardmember shall notify the Bank immediately In selecting the Cardmember s PIN, the Cardmember SHALL NOT select a PIN which is obvious or predictable, including those which:- a. represents his/her birth date; b. being an alphabetical PIN, is a recognisable part of his/her name; c. consists of sequential numbers (for example , etc); d. consists of all numbers being the same (for example ); or e. consists of repeated numbers (for example, , ) The Cardmember must ensure that the transaction amount is correct before signing any Transaction Receipts or transaction records and before entering the Cardmember s PIN at any Electronic Point-of-Sale Terminals which requires the entry of the Cardmember s PIN. By signing a Transaction Receipts or transaction record or entering the Cardmember s PIN or otherwise using the Cardmember s Card at any Electronic Point-of- Sale Terminals, the Cardmember is deemed to have agreed to the transaction and confirmed the amount is correct The Cardmember consents and agrees that the PIN will serve as a means of authenticating and verifying the Cardmember s transactions under these terms and conditions at the Electronic Point-of-Sale Terminal. 6. TELECOMMUNICATION INSTRUCTIONS 6.1. The Bank may at its discretion accept instructions from the Cardmember over the telephone to effect any transaction in relation to the Card including but not limited to the transfer that shall include the withdrawal or deposit of funds. 12

13 6.2. The Bank shall verify the Cardmember s identity and security password through a security process established by the Bank (which may be changed from time to time) The Cardmember shall keep the PIN and security password and shall not reveal the same to anyone The Bank shall be entitled but not be liable or responsible to the Cardmember for any loss or damage in following or omitting to follow such instructions The Cardmember shall acknowledge the following: a. The Bank may record all telephone conversations between the Cardmember and the Bank s representatives for the purposes of monitoring and reviewing in order to prevent any confusion from arising; and b. The Bank should not be responsible for the telephone conversation being over heard by unauthorised third parties Authorisation for Telephone, Mobile Phone, Telex and Facsimile Instructions. a. The Cardmember authorises the Bank to rely upon and act in accordance with any notice, instruction demand or other communication that may be given by telephone, telex or facsimile transactions by the Cardmember or on his/her behalf ("Instruction") and the Bank shall be entitled to treat the Instructions as fully authorised by the Cardmember and the Bank shall be entitled to take such steps in reliance upon the Instruction as the Bank may consider appropriate. b. Balance enquiry via Mobile phone service: i. The Cardmember authorises the Bank to send to his/her mobile phone, as registered by the Cardmember in the credit card application, through Short Message Service (SMS), the following information relating to his/her Card Account with the Bank: Outstanding balance; Available balance of his/her credit limit; Payment due date; Minimum payment amount. 7. RESPONSIBILITY AND LIABILITY 7.1. The Card shall remain the property of the Bank at all times and the Cardmember shall not transfer or otherwise part with the control or possession of the Card for any use or purpose unauthorised by the Bank In the event of loss and/or theft of the Card and/or disclosure of the PIN to any unauthorised person, the Cardmember shall immediately notify the Bank by telephone, telegram, telex, facsimile or written notification. A copy of police report must be submitted to the Bank within 7 calendar days from the date the unauthorised transaction(s) is discovered The Bank shall hold the Cardmembers liable for: 13

14 a. Card-present unauthorised transactions which require PIN verification, provided that the Cardmember has proven: i. acted fraudulently; ii. delayed in notifying the Bank as soon as reasonably practicable after discovering the loss or unauthorised use of the Card; iii. voluntarily disclosed the PIN to another person; or iv. recorded the PIN on the Card, or on anything kept in close proximity with the Card, and could be lost or stolen with the Card. b. Card-present unauthorised transactions which require signature verification or the use of a contactless Card, provided that the Cardmember has proven: i. acted fraudulently; ii. delayed in notifying the Bank as soon as reasonably practicable after discovering the loss or unauthorised use of the Card; iii. left the Card or an item containing the Card unattended, in places visible and accessible to others, except at the Cardmember s place of residence. Cardmembers are expected to exercise due care in safeguarding the Card even at Cardmember s place of residence; or iv. voluntarily allowed another person to use the Card. c. e-banking transactions, provided that the Cardmember has proven: i. acted fraudulently; ii. deliberately disclosing the access identity (ID) and passcode to any other person, via unsolicited s or on any website other than the official website of the Bank; iii. not taken reasonable steps to keep security device secure at all times; or iv. failed to carry out the obligation to report a breach of the security of a pass code or the loss of a security device to the Bank as soon as reasonably practicable, upon the Cardmember becoming aware of the breach or loss respectively. d. Card-not-present transactions, provided that the Cardmember has proven: i. acted fraudulently; or ii. failed to carry out the obligation to report any unauthorised transaction to the Bank as soon as reasonably practicable, upon the Cardmember becoming aware of the unauthorised transaction The Cardmember shall inform the Bank within 14 days from the Statement Date should the Cardmember be aware of any unauthorised transactions In the event of a lost or stolen Card, disclosure of PIN to any other person and/or any unauthorised use of the Card, the Cardmember shall contact the Bank immediately at (during office hours) or (after office hours) The Bank may at the request of the Cardmember but without being obligated under the law, replace the lost or stolen Card upon payment of replacement penalty of RM50 for any reported loss or theft of the Card. 14

The Cardmember shall cut the Card across the magnetic stripe and chip and return the Card to the Bank immediately upon cancellation, revocation or suspension (demand by the Bank) or upon discovery of the Card after notification of its loss and shall not have any further right to use the Card The Bank s record of any transaction effected by the use of the Card shall be conclusive and binding against the Cardmember The Cardmember shall be liable for all transactions charged to the Cardmember and his/her Supplementary(s) Unlawful Activities Cardmember is not allowed to use his/her Card for any unlawful activities such as illegal online betting. The Bank may at its discretion at any point of time with adequate prior notice can decide not to renew, cancel, revoke the Card or suspend or restrict the use of Card by the Cardmember and/or any Supplementary Card if the Cardmember is found to have used the Card for unlawful activities. 8. SUPPLEMENTARY CARD 8.1. The Bank shall issue Supplementary Cards only to immediate family members of Cardmember such as parents, spouse, children and siblings Supplementary Cardmember shall be liable for all charges incurred by the Supplementary Cardmember only under the Card Account The Cardmember shall be liable to ensure that his/her Supplementary Cardmember shall observe all terms, conditions and obligations imposed The Supplementary Card issued may be cancelled at the request of the Cardmember s notification together with Supplementary Card cut across the magnetic stripe and chip and returned to the Bank provided that such cancellation shall not effect the parties rights and entitlement, duties and obligations accrued before such cancellation Upon termination of use of the Card under any circumstances or at the request of the Cardmember the use of all Supplementary Cards shall also be terminated Unlawful Activities - Cardmember is not allowed to use his/her Card for any unlawful activities such as illegal online betting. The Bank may at its discretion at any point of time with adequate prior notice can decide not to renew, cancel, revoke the Card or suspend or restrict the use of Card by the Cardmember and/or any Supplementary Card if the Cardmember is found to have used the card for unlawful activities. 15

16 9. CARD ACCOUNT 9.1. All payments for purchases of goods or services effected by the use of the Card, annual fees, Finance Charges, late payment penalty or additional charges shall be debited to the Card Account and reflected in the monthly Statement Cash Advances, fees and charges incurred by the Cardmember including any payments or credits made are recorded by the Bank on the monthly Statement The records and entries of Card Account appearing in the monthly Statement shall be deemed to be correct and binding on the Cardmember unless notification by telephone, telegram, telex, facsimile or written notification accompanied with a police report received by Bank within 14 days from the Statement Date Upon receipt of such notification duly given by the Cardmember within the stipulated time, the Bank shall look into the Cardmember s Card Account to make the necessary adjustment and rectification, if any. The operation of this clause shall not in any way affect the Cardmember s obligation under Clause 11. provided that any money due to or from the Cardmember shall be credited or debited into the Cardmember s Card Account. 10. CREDIT LINE FACILITY The Bank shall assign an approved Credit Line to the Cardmembers at its sole discretion Where the Cardmember operates two or more Cards with the Bank, a combined Credit Line shall be assigned to the Cardmember representing the total Credit Line extended to cover the use of all Cards held by the Cardmember and his/her Supplementary Cardmember, if any Cardmember shall not exceed the Credit Line without the Bank s prior written approval and immediately repay the Bank upon receipt of the monthly Statement and/or to such other notices by the Bank showing such excess in accordance with Clause 11.1 (b) (ii). 11. LIABILITY OF PAYMENT The Cardmember shall make payment as follows: a. To pay the entire amount of the Current Balance on/or before the Due Date; b. Alternatively to make minimum payment as follows: i. Where the Current Balance is within the Credit Line, not less than 5% of the Current Balance, subject to a minimum of RM50. ii. Where the Current Balance is in excess of the Credit Line, the whole amount in excess thereof together with 5% of the Credit Line, provided the minimum payment shall include the amount past due (as shown on the monthly Statement). 16

17 12. INTEREST-FREE PERIOD FOR RETAIL TRANSACTIONS "Posting Date" shall mean the day where the transactions performed at merchants are being transferred to the Bank by the merchants The Interest Free Period refers to a period of 20 days from the Statement date of such transactions, provided there is no outstanding balance in the Cardmember s account. 13. FINANCE CHARGE Finance Charge is imposed on the outstanding Cash Advance transaction balance from the transaction date until full repayment Finance Charge is imposed on the outstanding non-cash balance that is not paid by the Due Date calculated immediately following the Statement Date in which the transactions were posted, calculated from that Posting Date until full repayment No Finance Charge is imposed on new non-cash transaction before the Payment Due Date provided there is no outstanding balance in the Cardmembers account by payment due date No Finance Charge is imposed if the non-cash transaction balance from the previous month s Statement is settled in full by the Due Date Finance Charge/Interest may be imposed using the following formula: F Sum (f) f = (B) x (P/D) x (R) F = Sum (f) f B P D R is the total Finance Charge imposed for the month. is the sum of all the Finance Charges computed on the different balances that may be imposed with finance charges over the applicable interest bearing periods during the month. is the Finance Charge for a particular balance B computed over the period of P days. is the balance that is imposed with Finance Charge. is the respective interest bearing periods in days on which the balance B is imposed with Finance Charge. is the number of days used as the base for the annual rate. is the nominal Finance Charge annual rate stated The Finance Charges shall be chargeable on a daily basis. 17

New retail transaction(s) before the Statement date will not be levied Finance Charges. c. For Cardmembers who make at least the minimum payment by the payment Due Date will receive a Finance Charge rebate equivalent to 8.01% per annum or 0.67% per month which shall apply for the affected month or months. d. For Cardmembers who pay less than full payment by the payment Due Date, Finance Charge on new purchases will be imposed from the day of transaction is posted to the Card Account If the Cardmember fails to pay the specified minimum payment by Due Date, a further charge of minimum RM10 or 1% of the total outstanding balance up to maximum of RM100, shall be imposed and may be varied at the sole discretion of the Bank Payments by the Cardmember shall not be considered to have been made until the Bank has received the relevant funds for value All payments by the Cardmember to the Bank shall not be subject to any deduction whether for counter-claim and/or set-off against the Authorised Merchant, Authorised Cash Outlet and/or the Bank whatsoever The Cardmember undertakes that he/she will make satisfactory arrangement for payments of his/her Card Account in accordance with these terms and conditions in the event of his absence abroad All payments by cheque must include the relevant inland exchange commission where applicable. Failure to include such inland exchange commission shall entitle the Bank to 18

19 debit the Cardmember s Card Account or exercise its right to set off as the Bank deems fit at its absolute discretion. Note: Non Cash Advance includes retail purchases, interest, fees and other charges. 14. AFFIN BONUS Bonus will be reflected in your Statement Applicable to minimum monthly spending of RM100 and more Bonus is applicable for retail purchases excluding petrol and government related transactions Total bonus accumulated will be credited into Cardmember s account monthly and reflected in the next monthly Statement AFFIN Bonus is capped at RM80 per month All bonus accumulated will be forfeited when the Card Account is delinquent for 90 days All bonus accumulated will be forfeited upon cancellation of the Card. 15. FEES AND CHARGES The Cardmember hereby irrevocably and unconditionally agrees to pay and authorises the Bank to debit his/her Card Account with the following fees and charges: Cash Advance: a. A fee of 5.3% on the Cash Advance amount subject to a minimum of RM21.20, whichever is higher for domestic Cash Advance, or 5% on the Cash Advance amount subject to a minimum of RM20.00, whichever is higher for overseas Cash Advance. b. A Finance Charge of 1.5% per month calculated on a daily basis from the date of withdrawal or transaction until full payment is received and credited to the Cardmember s Card Account Annual fees as prescribed by the Bank for a Principal Card and each Supplementary Card issued or renewed. The annual fees shall not be refunded Annual fees will be charged on Cardmembers should full settlement is not made upon the cancellation of Card Finance Charge as provided in Clause

20 15.5. Late payment as provided in Clause Card courier fees of RM5.30 within Malaysia and actual cost incurred for overseas destination shall be imposed A service fee of RM5.30 per copy in relation to any request for a duplicate copy of the Statement. However, this charge shall not be levied if it is subsequently determined that the error in processing arises from the Bank A service fee of RM10.60 per copy in relation to any request for a duplicate copy of the Sales Draft. However, this charge shall not be levied if it is subsequently determined that the error in processing arises from the Bank Card replacement penalty of RM50 for each replacement card issued Service Charge, the rate to be determined by the Bank from time to time at its sole discretion for services rendered and costs and expenses incurred by giving 21 days prior notice before the effective date of the revised charges or rate Legal fees (on Solicitor and Client basis) and other expenses incurred by the Bank in the enforcement of the Bank s right and entitlement and the recovery of monies owed by the Cardmember to the Bank under his/her Card Account Any other reasonable fees and charges imposed by the Bank from time to time for services and facilities rendered to the Cardmember upon giving the Cardmember 21 days prior notice to the effective date of the implementation Notwithstanding the above provisions, the Bank shall be entitled at its sole discretion to vary the rate or method of calculation of the annual fees, handling charges, additional charges, Finance Charges, the specified minimum payment and/or late payment penalty from time to time with 21 days prior notice to the Cardmember. 16. ERROR/DISCREPANCIES AND NOTIFICATION The Cardmember shall check the Card Account records carefully and promptly Cardmember s Statement will not be sent if the account has zero balance or if there are no new transactions from the last Statement date The Bank shall issue a letter or computer generated advice to the Cardmember for all funds transfer effected with the use of Card. 20

21 16.4. EXCLUSION OF LIABILITY The Bank shall not be liable for damage suffered or loss incurred due to Cardmember s or his Supplementary Cardmember s negligence The Bank shall not be liable for any loss or damage caused to the Cardmember arising from the act or omission of any Authorised Merchant of MasterCard International The Cardmember may handle any claim or dispute directly with the Merchant or MasterCard International but not to withhold any payment to the Bank on account. 21

22 18. RIGHTS OF PARTIES The Bank shall have the right: a. To restrict or limit the Cardmember s credit or refuse and otherwise withhold credit (in its absolute discretion and without giving notice or reason). b. The Bank shall have the right to check the credit standing of the Cardmember with external parties including but not limited to CCRIS and any other credit agencies at any time as and when it deem fit with prior notice to the Cardmember unless the Cardmember expressly objects in writings to such checking to be performed. 19. OVERSEAS TRANSACTIONS The Cardmember may use the Card outside Malaysia where there are Authorised Merchants and/or MasterCard International The Cardmember may use the Card for Cash Advance through designated ATMs and shall ensure that all inter-country transactions by the Cardmember via ATM shall not violate the laws existing in the country where the transaction is done Where the Cardmember uses the Card outside Malaysia, the transaction incurred will be converted to Ringgit Malaysia where the exchange rate is determined by MasterCard International at the date it is processed by MasterCard International plus 1% foreign exchange spread (previously known as administration cost) Wherever applicable, the Cardmember shall comply with the Foreign Exchange Administration Rules 2013 issued by Bank Negara Malaysia in respect of any overseas transactions The Cardmember shall be responsible for any violation or non-compliance of such regulations and any amendment thereto. 20. TERMINATION Not withstanding any provision to the contrary herein set out, the Bank may at its sole and absolute discretion with adequate prior notice, decide not to renew, cancel, revoke the Card, or suspend or restrict the use of the Card by the Cardmember and any Supplementary Card under his/her Card Account where upon all monies owing to the Bank under his/her Card Account shall become due and payable immediately in full upon the happening of the following events or any of them: a. The Cardmember failing to perform and/or observe any of the terms and conditions herein governing the use of the Card; or b. The Bank suspending, terminating or withdrawing the Cardmember s right to use the Card upon occurrence of any of the following: i. The Cardmember dies or becomes insolvent, committing an act of bankruptcy, or in the case of the Cardmember being a company, a petition is presented for its winding up or a resolution is passed for its voluntary winding up; or 22

23 ii. The Cardmember failing to pay any other indebtedness owed to the Bank when due; or iii. If in the opinion of the Bank, the Cardmember s line of credit with the Bank (including any other account the Cardmember may have with the Bank or any other institution) is or has not been operated satisfactorily and/or if the Cardmember commits or threatens to commit a default of any provision of any agreement, or security documents or both (as the case may be), relating to other accounts or loan facilities granted by the Bank or any other institution to the Cardmember or other party in which the Cardmember is a guarantor, or chargor or assignor; or iv. Any order for execution, writ of attachment, garnishment or any other legal proceeding is issued against the Cardmember; or v. An event has occurred or a situation exists which could or might in the sole and absolute opinion of the Bank: Prejudice the ability of the Cardmember to perform his obligations herein; or Prejudice the repayment of the line of credit or the repayment of the Minimum Repayment Due. c. or the Cardmember cancels the card Upon the termination of the Card or upon the revocation, suspension or restriction of the rights of the Cardmember or Supplementary Cardmember to use the Card aforesaid, the Cardmember shall, upon demand by the Bank, settle his/her Card Account in full as required by the Bank. The Cardmember will remain liable for any transaction effected through the use of the Card (whether before or after the termination of the Card), including transactions effected but not yet posted to the Card Account. 21. MISCELLANEOUS LAW This Agreement shall be governed by and construed in accordance with the Laws of Malaysia. The Cardmember hereby agrees to submit to the jurisdiction of the Courts of Laws in Malaysia. The Cardmember hereby agrees that service of any process may be effected by posting the same to the Cardmember in the manner set out in Clause WAIVER Time shall be the essence of this Agreement but no failure to exercise and no delay in exercising on the part of the Bank of any right power privilege or remedy shall operate as a waiver thereof, nor shall any single or partial exercise of any right power privilege or remedy preclude any other or further exercise there of or the exercise of any other right, power, privilege or remedy. The right and remedies herein provided are cumulative and not exclusive of any right or remedy provided by law. 23

24 21.3. PRESERVATION OF RIGHT AND ENTITLEMENT Notwithstanding anything in this agreement, the Bank s rights and entitlement under this Agreement shall continue to remain in full force and effect and shall survive any cancellation, revocation and suspension of the Card by the Bank VARIATION OF AGREEMENT The Cardmember agrees that the Bank may from time to time vary, add to or amend the terms and conditions herein set out by giving out 21 days prior written notice to the Cardmember. In the event the Cardmember is not agreeable to such variation, addition and/or amendment, the Cardmember surrenders the Card and return the same to the Bank cut in half across the magnetic stripe and chip. Otherwise, the Cardmember shall be deemed to have accepted such variation, addition and/or amendment DISCLOSURE The Cardmember hereby authorises the Bank to disclose or reveal any information relating to the Cardmember s account, Cardmember, the facilities whatsoever as required by law or any regulatory authority or as the Bank may deem fit for the performance of the contract: a. To any merchant, any bank or financial institution, MasterCard International and any member institution of MasterCard International or any interest party to facilitate the use of the Card. b. To any authority or body established by the Bank Negara Malaysia or any other authority having jurisdiction over the Bank, any guarantor(s)/security parties, and/or its lawyers or any other debt collection agent or service provider. c. For or in connection with any action or proceeding taken for the purpose of recovery of monies due and payable by the Cardmember to the Bank NOTICE AND COMMUNICATION TO THE BANK a. The Cardmember hereby undertakes to inform the Bank promptly in writing of any changes of the Cardmember s and/or Supplementary Cardmember s personal details, residential address, telephone numbers and/or employment or business and his intention to be absent from Malaysia for more than 30 days. b. Any Statement of account correspondence or notice to the Cardmember may be delivered by hand or sent by prepaid post to the Cardmember s address stated in the Bank s Card application form or to such other addresses notified by the Cardmember to the Bank from time to time and shall be deemed to have been duly received by the Cardmember within 7 working days of posting. Any failure on the part of the Cardmember to notify any change of his address resulting delay or return of any monthly Statement, correspondence and notice shall not prejudice the Bank s rights and entitlement under this Agreement. c. The last known address and contact number of the Cardmember shall be the correct address and contact number of the Cardmember in the absence of any acknowledged change of address and contact number by the Bank. Burden is on the Cardmember to prove that the Bank has acknowledged and effected the changes, if any. 24
