12 THE JALANDHAR CENTRAL CO-OPERATIVE BANK LTD. JALANDHAR B.O. :... AGREEMENT DEED OF OVERDRAFT FACILITY In consideration of The Jalandhar Central Co-operative Bank Ltd., B.O... (hereinafter called the bank) at the request of Sh... S/o Sh...residing at......(hereinafter called the borrower) having advanced / agreed to advance Rs... (Rupees...only) subject to the terms and conditions given hereunder, it is hereby agreed between the bank and the borrower that :- 1. The Borrower will execute Demand Promissory Note. 2. Overdraft facility shall be sanctioned for one year. But the Bank reserve the right to recall the balance o/s in the ODF A/c at any time by giving 15 days notice to the borrower. If the operation of the limit is satisfactory, it will be renewed on the request of the borrower. 3. The borrower shall pay intt. on the overdraft which shall be calculated on the outstanding daily balance on monthly basis and will be charged to the account half yearly on the last working day of Sept. and March every year and it will become the part of principal amount as per RBI/NABARD directives. 4. The borrower who want to borrow under the facility shall have to furnish in the form prescribed by the bank. 5. If the borrower does not repay the amount overdrawn in 30 days notice given by the bank or has not shown credit balance at least for 4 days continuously during the financial year, penal rate of 3% over and above the normal rate will be charged. 6. The borrower agreed to accept as conclusive proof of the correctness of any sum claimed to be due from him to the bank under this agreement, statement of account made out from the books of the bank and signed by the Accountant or duly authorized Officers of the bank without production of any other document. 7. The borrower undertakes that he will abide by The Punjab Co-operative Socs. Act 1961 and rules framed thereunder and bye laws of the bank including the arbitration clauses. 8. In case of any litigation the bank will be at liberty to sue the borrower at Jalandhar or any other place at its discretion. 9. The bank will always be at liberty to stop making advances under the overdraft limit at any time without any previous notice and without assigning any reason even though the said facility has not been fully availed of. 12

The Bank has the right to recover the balance amount of overdraft limit from the borrower or from his any moveable and immoveable property shown in his application which will remain hypothecated of the bank.
