Washington, D.C Re: Big Sandy Pipeline, LLC, Docket No. RP Dear Ms. Bose: Pursuant to Section 4 of the Natural Gas Act 1 and Part 154 of the rules and regulations of the Federal Energy Regulatory Commission ( Commission ) promulgated thereunder, 2 Big Sandy Pipeline, LLC ( Big Sandy ) hereby submits for filing as part of its FERC Gas Tariff, First Revised Volume No. 1 ( Tariff ), the tariff section listed in Appendix A, reflecting an effective date of September 1, STATEMENT OF NATURE, REASONS AND BASIS Big Sandy is making this filing pursuant to Section 28 of the General Terms and Conditions of Big Sandy s Tariff in order to reflect a negotiated rate transaction that it has entered into with Nytis Exploration Company LLC ( Nytis ) for firm transportation service under Rate Schedule FTS. The tariff section identifies and describes the applicable negotiated rate transaction, including the exact legal name of the shipper, the negotiated rates, the rate schedule, the contract terms, and the contract quantities. The proposed tariff section includes footnotes where necessary to provide further details on the transaction listed thereon. Big Sandy has entered into a negotiated rate agreement with Nytis, consisting of a onepage letter agreement and a pro forma Statement of Negotiated Rates (see Appendix B). The one-page letter agreement has the sole purpose of indicating the parties agreement to the negotiated rate provisions on the pro forma Statement of Negotiated Rates attached to the letter agreement. The substantive provisions of the tariff section are identical to the pro forma Statement of Negotiated Rates attached to the letter agreement. PROPOSED EFFECTIVE DATE Big Sandy proposes that the tariff section filed herein become effective on September 1, Big Sandy respectfully requests a waiver of the notice requirement contained in Section of the Commission s regulations, 18 C.F.R , and any other waivers that may U.S.C. 717c (2006). 18 C.F.R. IMPLEMENTATION Pursuant to Section 154.7(a)(9) of the Commission s regulations, 18 C.F.R (a)(9), Big Sandy moves to place the tariff section filed herewith into effect at the expiration of any suspension period set by the Commission, provided that it is approved as filed and without condition. In the event that the Commission does not approve this tariff section as filed and without condition, Big Sandy reserves the right to file a later motion to place such tariff section into effect. COMPLIANCE WITH REGULATIONS In compliance with Section 154.4(c) of the Commission's regulations, 18 C.F.R (c), all contents of this filing are being submitted as part of an XML filing package in conformance with the Secretary of the Commission's instructions.
