3 Stormwater Utility Credits and Incentive Policy 1 Background The City of Galesburg s stormwater utility will provide a dedicated method of funding the municipal stormwater management program. It will provide funding for activities related to stormwater management including: planning, engineering, operation and maintenance, as well regulatory compliance. The stormwater utility is funded through a flat rate fee for single family residential properties and a demand based fee for all others. The measure of demand for these properties is the amount of impervious surface on the property, as impervious surface retards the infiltration of stormwater into the soil thereby generating excess runoff. The selected billing unit for these impervious areas is equivalent to the typical amount of impervious area found on single family residential properties in the community, 3,100 square feet of impervious surface. Some properties actually lessen the City s cost of providing stormwater management through on-site stormwater management systems or their location relative to receiving streams. To acknowledge the impact that these activities or facilities have on the City s stormwater management program, the Department of Public Works has developed a system of credits and incentives for the stormwater utility. Both programs are designed to promote on-site and educational practices that will improve the function of the stormwater management program citywide. Credit programs reduce ratepayer s total stormwater fee on a recurring basis, while incentives are one-time disbursements promoting practices that reduce a property s demand for stormwater management. This document provides an overview of the City of Galesburg s stormwater utility credit and incentive policies. 2 Applicability of Incentives and Credits Credits and incentives have fundamental differences, while serving similar purposes. Credits are recurring discounts against stormwater utility fees that are granted because the ratepayer meets or exceeds on-site stormwater management criteria specifically identified as reducing costs to the City s stormwater management program such as those that cause a reduction in peak discharge, a reduction in stormwater runoff volume, a water quality benefit, or some combination of the three. Incentives are onetime disbursements that fully or partially compensate a property owner for partnering with the city to achieve a stormwater management objective. Credits will not be available for individual single family residential properties because it is difficult for these properties, individually, to have a measurable impact on a city s level and cost of service for stormwater management, unless stormwater detention or retention has been developed that treats the runoff for an entire residential subdivision development. Incentive programs that target homeowner control of stormwater runoff using sustainable practices are a reasonable alternative to credit eligibility for those individual ratepayers. 4 A property owner cannot get both a credit and an incentive for the same property. 3 Incentives 3.1 Single Family Residential Properties Incentives are being made available to single family residential properties that install specific practices on their property and maintain them for a minimum of 5 years. There is a maximum level of investment each year for this program and only qualified applicants will receive the incentives. The City will allocate $10,000 per year for its incentive programs. Awards will be made on a first come / first served basis. Depending on participation and demand, the City may allocate additional funds in the future. The types of on-site practices that will qualify for incentives are described below Rain Barrels Rain Barrels are structures designed to intercept and store runoff from rooftops. Typically a rain barrel is a 55 gallon drum (or similar) connected to a downspout. Stored water can provide irrigation for a garden or can be released slowly to a lawn. This is an effective stormwater control function if the stored water is emptied between most storms, freeing up storage volume for the next storm. The City will subsidize a one-time purchase of up to two (2) rain barrels per household at $25/barrel. The resident must provide a receipt for the purchase and will be reimbursed up to $25/barrel based on the actual cost of the barrel up to a maximum incentive of $ Other Incentives Single family residential properties would be eligible for incentives for installing and/or implementing sustainable practices that provide either a reduction in peak discharge, a reduction in stormwater runoff volume, a water quality benefit, or some combination of the three, such as installing a cistern or paving a driveway with permeable pavers. The property owner is required to submit their plan to the City for review and approval prior to construction. The amount of the incentive would be 25% of the construction cost for the activity up to a maximum incentive of $50. The City would pay the incentive to the property owner after construction has been completed and the installation is inspected and approved by the City. 3.2 Properties other than Single Family Residential Incentives for all other properties that are not Single Family Residential will be the same as listed for Single Family Residential Properties with the exception that the maximum incentive allowed shall not exceed $1,000. Incentive programs that target homeowner control of stormwater runoff using sustainable practices are a reasonable alternative to credit eligibility for those individual ratepayers. Should detention or retention be provided for an entire residential subdivision, the developer or homeowner s association will follow normal procedures, including providing proof of maintenance, to apply for any credits described in Section 4.2 on behalf of the entire subdivision. Credits will be applied to all of the properties in the areas treated by the stormwater management practice. 4.2 Properties other than Single Family Residential (Detention, Retention, Green Infrastructure) For properties other than single family residential there will be a credit program. Three categories of credits are available to this group of properties: 1) Rate reduction credits 2) Volume reduction credits 3) Direct discharge credits Because even properties with well managed stormwater runoff still have common impacts on the citywide system that is used by the entire community it has been determined that the maximum credit that will be available to any individual property will be 50%. The credits described in the following sections are cumulative if more than one type of credit pertains to the stormwater treatment, to a maximum of 50%. Small businesses and properties with multifamily residential structures may qualify for the incentives described in Section 3.2. 6 4.2.1 Rate Reduction Credit (up to 10%) Rate reduction credits are available to properties that reduce the rate of discharge from newly developed or redeveloped property to a level required by the City s Development Ordinance. Two levels of credit are available for these practices, as defined below a Rate Reduction Level 1 (up to 5%). To qualify for this credit the property will have to meet the stormwater detention requirements in of the City s Development Ordinance. Practices that may qualify for this credit include both dry and wet detention and some rainfall harvesting methods, such as bio-retention, pervious pavement, and other practices that include significant storage. This criteria requires that the runoff volume from the 50-year design storm be detained in a manner such that the maximum release rate does not exceed the pre-development discharge rate for the 5-year design storm. The maximum credit available for the Rate Reduction Level 1 credit will be 5%, based on the fraction of the impervious area that is being treated by the stormwater management practice. The credit will be granted if the applicant can demonstrate that the structures are designed and built to the referenced criteria, and if the applicant provides proof that the maintenance program for the facility is up to date. To remain eligible for this credit, the applicant must demonstrate continued adherence to the maintenance agreement through annual submission of documentation showing that scheduled maintenance has been performed. All drawings and calculations developed for this credit must be certified by a professional engineer registered in Illinois b Rate Reduction Level 2 (up to an additional 5%). To qualify for this credit the property will have to exceed the stormwater detention requirements in the City s Development Ordinance. This additional 5% credit will require that the detention volume be based on the runoff from the 100-year design storm and that a minimum of 1 foot of freeboard be provided above the storage elevation. Practices that may qualify for this credit include both dry and wet detention and some rainfall harvesting methods, such as bio-retention, pervious pavement, and other practices that include significant storage. The maximum credit available for the Rate Reduction Level 2 credit will be 5%, based on the fraction of the impervious area that is being treated by the stormwater management practice. Qualifying for this credit means that the ratepayer also qualifies for the Level 1 credit. The credit will be granted if the applicant can demonstrate that the structures are designed and built to the referenced criteria, and if the applicant provides proof that the maintenance program for the facility is up to date. To remain eligible for this credit, the applicant must demonstrate continued adherence to the maintenance agreement through annual submission of documentation showing that scheduled maintenance has been performed. 7 4.2.2 Volume Reduction Credit (up to 10%) Volume reduction credits are provided for those activities that reduce the total volume of runoff from a property. Volume reduction practices are primarily infiltration or reuse practices. Many of these practices are also referred to as rainfall or stormwater harvesting practices, as rather than allowing the rainfall to simply runoff into a drainage system or receiving water body, the rainfall or runoff is intercepted and stored for a beneficial use, such as irrigation of lawns or plantings, or for non-potable uses such as toilet flushing. Sustainable Practices Used for Volume Reduction Cisterns Pervious Pavement Biofilters Green Roofs Volume reduction practices can earn up to 10% credit, depending on the fraction of the total impervious area served and the equivalent depth of rainwater or runoff that is either infiltrated or reused. For stormwater runoff volume reduction approaches that are approved by the City, a 4% credit will be provided for every 0.20 inches of rainfall infiltrated or reused. All drawings and calculations must be certified by a professional engineer registered in Illinois. Volume reduction practices provide a considerable water quality benefit. A practice designed to capture 1.0 inch of rainfall in Galesburg would be capturing almost all runoff for approximately 90% of the annual rainfall events, meaning 100% capture of suspended and many dissolved stormwater pollutants for most events, and a significant capture and removal for events exceeding 1.0 inches of rainfall. Stormwater controls that are constructed with underdrains will not qualify for this credit Direct Discharge Credit (up to 50%) Properties that discharge directly to unincorporated areas exert a lower demand for service on the City s stormwater program than do properties whose runoff must be accommodated by drainage system capacity, planning, and floodplain management. In recognition of that reduction in demand, the City will provide up to a 50% credit to those portions of properties that are contiguous to unincorporated areas that discharge to unincorporated areas, provided that these discharges do not re-enter the City s corporate limits downstream. To receive this credit, the applicant must submit site plans for the property demonstrating which portion(s) of the parcel directly discharge to the unincorporated area. The credit will be based on the fraction of the impervious area that is discharging to the unincorporated areas. The drawings and calculations must be certified by a professional engineer registered in Illinois. The City of Galesburg stormwater management credit program is outlined in the following table. The incentive program will become effective on the first day of the stormwater utility s second year. b) Credit program effective date. The credit program will become effective upon the date when the stormwater utility rate is completely phased in, which will be the first day of the stormwater utility s third year. c) Right of entry. Application for and approval of a credit or incentive will require the ratepayer to acknowledge the city s right of entry for inspection. d) Indemnification. The ratepayer shall indemnify the city against all claims related to the design, construction, maintenance, and presence of the stormwater control. e) Maintenance requirement. Maintenance of stormwater controls is required to insure that they are performing as designed. Maintenance plans are required to be developed and submitted as part of the credit application. The plan must be appropriate for the stormwater control practice(s) for which credit is sought. The plan should specify which activities will be performed and how often. The plan activities should include inspections; routine maintenance such as mowing, litter removal, and plant maintenance and replacement; and periodic maintenance items such as sediment removal and structural inspection (if appropriate) by a licensed engineer. Proof that routine maintenance is being performed is required to be provided annually. Proof of maintenance shall include a transmittal letter signed by the ratepayer, a photograph of the stormwater control, and items such as receipts for landscaping or mowing services. f) Duration. Incentives must be maintained in use for at least 5 years. Credits will expire 5 years from their effective date unless certification by a professional engineer is received within 90 days of expiration confirming that maintenance is being performed and that the device is performing as designed. 9 6 Application Requirements The following process shall be followed to submit an application for a stormwater utility fee credit or incentive. a) Download current application forms from the City s website or obtain the forms from the City of Galesburg Public Works Department (55 West Tompkins Street). b) Prepare general application form. c) Prepare credit-specific or incentive application form(s). d) Prepare or locate required site drainage plan showing topography, drainage patterns, and contributing area to each stormwater management structure. e) Prepare technical calculations required to determine applicability of credit(s) or incentives. f) Prepare and submit a maintenance plan. g) Obtain appropriate signatures on forms. h) The fee for review of credit applications is $20.00, payable to the City of Galesburg. There is not a fee for review of incentive applications. i) Submit forms and required attachments to the Public Works Department. j) City will check to insure submittal is complete and notify the applicant. k) City will review application within 30 working days and notify the applicant of credit or incentive determination, including identification of deficiencies if the application is not approved. l) If the credit or incentive application is denied the applicant may address identified deficiencies and resubmit the revised application. m) If credit or incentive application is denied applicant may appeal the determination following the guidelines in Section 7. 7 Appeals Process Should disagreement exist between a ratepayer and the Public Works Department over a decision that is made relative to the disposition of either a credit / incentive application or an existing credit, the steps described in this section shall be followed to resolve the issue(s). The disagreements may include: 1. Denial of an application. 2. The amount of the approved credit or incentive. 3. Revocation of an existing credit. The following steps shall be followed in appealing a credit determination. A. Review the determination letter. The reason for denial of a credit or incentive application or for termination of an existing credit will be included in the letter informing the ratepayer of the decision. The ratepayer should thoroughly read this determination. B. Review the submittal. If you submitted an application for a credit or incentive, review the submittal to make sure that all required documentation and signatures were attached. If your credit was revoked, check your files to verify that the required annual maintenance certifications were submitted to the Department of Public Works. City of Galesburg, Illinois Page 8

10 C. Request a meeting. If you have performed steps A & B and feel a mistake has been made, call the Department of Public Works at to request a meeting. D. Send a written appeal. If resolution of the issue is still needed the ratepayer must send a written appeal to the following address: Department of Public Works 55 West Tompkins Street Galesburg, Illinois Attention: Stormwater Utility Any discrepancy over the method used or in the computations thereof shall be resolved by the Public Works Director or his designee within thirty (30) days after notification receipt of a written appeal outlining the discrepancies. If an additional appeal of determination is requested the request will be heard by the City Council of Galesburg. A written response will be mailed within thirty (30) days of its receipt by the Galesburg City Clerk. City of Galesburg, Illinois Page 9

Areas that prevent or impede the infiltration of stormwater into the soil. Common impervious areas include, but are not limited to; rooftops, sidewalks, walkways, patio areas, driveways, parking lots, storage areas, compacted aggregate (gravel) and awnings. Stormwater management program incentives are typically one time disbursements that either partially or fully compensate a property owner for partnering with the city to achieve a stormwater management objective, such as the installation of a rain garden or rain barrel. 12 Maintenance: Ratepayer: Underdrains Utility Fee: Cleaning, spraying, removal of obstructions or debris or sediment from, and making minor repairs in a drainage facility or BMP so that it will perform the function for which it was designed and constructed. The owner/occupant of land subject to the stormwater utility fee or her/his agent. A drainage system below or near the bottom of a stormwater infiltration unit whose purpose is to dewater the device by providing access to the local drainage system. This Agreement shall be disclosed upon transfer of real estate. At such time as the stormwater management facility / BMP shall cease to be so used, this Agreement shall immediately terminate.
