SECTION 8: TERMS AND CONDITIONS / DECLARATION 8.1 DURATION OF RE-REGISTRATION CONTRACT This registration contract applies only to the modules registered for the academic year (2017). A registration for every new academic year is required and the registration and module fees apply to such annual registration. 8.2 ACCREDITATION OF PRESTIGE ACADEMY (PTY) LTD Prestige Academy (Pty) Ltd is registered with the Department of Higher Education and Training as a Private Higher Education Institution under the Higher Education Act of 1997 (Registration Certificate No. 2001/HE07/005). All qualifications are registered with the South African Qualifications Authority (SAQA). 8.3 CHANGES TO SYLLABUS Prestige Academy (Pty) Ltd has the right to make changes to the programme syllabus and admission requirements at any time, without prior notification and without furnishing reasons therefore. Changes will be communicated on our website or through written communication to the student as soon as the changes have been approved by the academic committee. 8.4 APPLICATION DATE The closing date for applications/registrations is 8 December Computer Software versions and Textbook editions: Computer software versions change yearly, and in some cases the versions of textbooks may also change. Students are responsible to purchase their own textbooks. After registering for a module a textbook list will be supplied to you. Any additional notes or electronic tutorials will form part of the re-registration fee. Students, who registered for modules in the ISS and ITNIS programmes, must also purchase their own textbooks if the version changed. If the curriculum changed and the module is not available anymore, the student register for the replacement module and purchase the textbook if applicable. Once the student registered for these modules, NO cancellation will be accepted. 8.6 ADDITIONAL FEES: Student Pack and Graduation The second and third year student pack fee only includes a year book. If the student is in his/her final year of study, the graduation fee is R and payable on 1 February If the student paid his/her graduation already in 2016, but did not pass, a credit would have been passed on your account and the new fee will be invoiced again. The Student Pack Fee is R payable by 1 February 2017 and is compulsory. 8.7 ADDITIONAL FEES: Transport, excursion & entrance fees No transport, accommodation, food or entrance fees relating to any official excursions or social events are included in the fees. 8.8 REDUCTION IN FEES The student shall not be entitled to any reduction of fees whatsoever in the case of not attending classes. 8.9 NON-PAYMENT OF FEES: Barring from Classes / Disciplinary Steps The undersigned parties accept that should payments according to this contract not be made for a period of two consecutive months, the student will be barred from attending lectures (receive tuition). Late interest will be charged. The undersigned parties accept that Prestige Academy (Pty) Ltd reserves the right to disallow a student from sitting for an examination, receiving his/her Certificate/Diploma or Degree or attend classes due to outstanding accounts. If a student has been barred from lectures due to non-payment or disciplinary steps taken, the actual amount due will not be reduced RIGHTS TO CANCEL/TERMINATE THIS CONTRACT If the student has enrolled for a two/three year qualification but only completed part of the programme (e.g. only one year of study), no qualification will be issued. The undersigned parties agree that the student and payer(s) will be held liable for the full annual tuition fee in the event of the student not completing the entire academic year, irrespective of the amount of days/weeks/months in class. It is agreed by the parties that this clause will only be waived in the case of the student passing away in which case the pro-rata fee based on semester fees will apply INCIDENTAL CREDIT ARRANGEMENT, INTEREST & ADMINISTRATION CHARGES All fees are payable in full by 01 February If the fees could not be settled by 01 February 2017, the student/payer(s) may approach Prestige Academy (Pty) Ltd in order to negotiate in respect of the provision of credit and the terms of such incidental credit arrangement. The usual preferred terms of such an arrangement would be based on payment in 10 (ten) monthly instalments and at an annual interest rate of 18% (fees list quoted at 18%). The annual interest will be invoiced in February If the payer(s) settle the account in full before the 10th instalment being 1 November 2017, the interest will be re- calculated and a part thereof credited to the account. The quoted instalment which includes the annual interest rate of 18% will change if the prime rate increases. In the event that instalments are not paid on due date, late interest in terms of the Prescribed Rate of interest Act, will be applicable Administration fees such as warning/suspension letters, debit orders/cheques returned unpaid from the bank, telephone/cell phone and SMS charges will be charged and will vary between rates of R 3,00 to R 100,00 depending on the cost involved.

4 8.13 METHOD OF PAYMENT & CASH DEPOSIT FEES It is compulsory to all students paying off their account at Prestige Academy (Pty) Ltd, to make use of the debit order system. No cash over the counter at the bank or the Academy (Pty) Ltd will be accepted due to large cash deposit fees and security reasons. We reserve the right to charge the prescribed Absa Bank cash handling fee which will be debited to the account. additional fees must be paid via EFT, or per cheque at the bank counter. All payments made at the bank must reflect the student number for reference purposes INDEMNITY We hereby waive all claims against Prestige Academy (Pty) Ltd and employees for any damages or loss suffered while the student is, or as the result of being, a student of this Institution resulting in death, mental harm or arising from physical injury, or illness suffered by me (the student) or any other person. Such consequences include any loss, destruction of or damage to any property belonging to me (the student) or any other person, howsoever the damage or loss is caused by, but is not limited to, the negligence of Prestige Academy (Pty) Ltd or any official employee or representative of this institution IMPORTANT NOTICE The student and undersigned payer(s) understand, accept and agree: that Prestige Academy (Pty) Ltd shall have the right to summarily terminate the student s programme and expel him/her from Prestige Academy (Pty) Ltd should the undersigned breach and aforesaid undertakings or by reason or disciplinary action taken. The student, sponsor/principal payer(s) declare that they have studied the student pack and kit pricelist as well as fees not included in the tuition fees, and accept these additional fees SURETY AND CO-PRINCIPAL PAYERS The student and account payer(s) bind themselves to Prestige Academy (Pty) Ltd, jointly and severally, as co-sureties and co-payers for the payment of all fees and other charges due by them to Prestige Academy (Pty) Ltd in terms of this contract. The Academy shall be entitled to institute any legal proceedings that may arise out of or in connection with this contract in any Magistrates Court having competent jurisdiction in respect of the surety s person, notwithstanding the fact that the claim or value of the matter in dispute might exceed the jurisdiction of such Magistrates Court in respect of the cause of action. Costs: Legal costs to be awarded to any party to this contract in the event of legal proceedings in respect of a cause of action arising from this contract, will be calculated on the attorney and client scale of fees and will include collection and tracing charges in enforcing the obligations of any of the parties to this agreement. In terms of this contract we take note that late interest as laid down by the prescribed rate according to the Interest Act may be charged, on any outstanding amounts from the date of which it became due for payment. Administration fees such as warning/suspension letters, debit orders/cheques returned unpaid from the bank, telephone/cell phone and SMS charges will be charged and will vary between rates of R10.00 to R depending on the cost involved. I/We authorise Prestige Academy (Pty) Ltd to draw the administration fees from my/our debit order instruction, without further notification. In the case of an unpaid debit order, the payer authorizes Prestige Academy (Pty) Ltd to debit his/her account on any date as Prestige Academy (Pty) Ltd may choose and/or to double debit his/her account with the next payment date.
