1 University of Wisconsin-Madison College of Agricultural and Life Sciences Short Course Halls - Jorns & Humphrey Halls Terms and Conditions for Housing Farm & Industry Short Course Student Agreement INTRODUCTION This document and those referred to within it constitutes the Board of Regents of the University of Wisconsin System, operating as the University of Wisconsin-Madison, College of Agricultural and Life Sciences (the College ) Short Course housing services contract for single housing (the Agreement ). The housing a n d f o o d services described in this Agreement are being offered to you under the terms and conditions stated herein. Your acknowledgment on the Housing Request form indicates that you have read, understand and agree to be bound by all of the terms and conditions of this Agreement. This Agreement will become legally binding on both parties when the required damage deposit is received. You and College expressly agree that no lease or landlord-tenant relationship is formed by this Agreement. 1. Eligibility You must be an enrolled student at the University of Wisconsin-Madison or otherwise determined eligible by the Assistant Director. The College reserves the right to terminate your Agreement if you are registered for or reduce your credit load to less than full-time status. As a condition of eligibility, Wisconsin law [SS36.25(46)] requires you to affirm whether you have received vaccination against meningococcal disease and hepatitis B, and to provide dates of vaccination, if any; this information must be provided electronically to University Health Services. 2. Agreement Term This Agreement is for the entire Academic Year Fall occupancy will be from October 28, 2018 to December 21, Spring occupancy will be from January 20, 2019 to March 16, You may not occupy your room later than 24 hours after your last instructional period/exam of the semester without prior approval from the Assistant Director. Jorns and Humphrey Hall will remain open during Thanksgiving break. The halls will close for the following breaks: Winter Break: Halls close at Noon on December 21, 2018 and open at 9am on January 20, College Agrees The College agrees to provide you with housing in the Short Course Halls (Humphrey or Jorns Halls), and food service if applicable, under the terms and conditions of this Agreement. 4. Resident Agrees By executing this Agreement you agree to comply with all applicable provisions of Federal and State law and the University of Wisconsin System Administrative Code, and all applicable College rules, policies, regulations, and administrative procedures and you agree to make full payment of all fees specified in the payment section of this Agreement. University and College policies, rules and regulations are presented in the publication "Short Course Student/Community Expectations", which all students are notified of at check-in, is available on the program website and which is specifically incorporated into this Agreement by reference.
2 5. Rates Projected rates are provided on the website. 6. Payment and Obligations: a. Payment will be made in accordance with the quarterly/term billing schedule provided on website. Housing bills will be sent electronically to the resident s UW- Madison wisc.edu ing address. The College reserves the right to assess a $50.00 late payment for each quarter/term that payment is not made by the due date. b. A deposit of $ must be made when submitting the Agreement Acceptance Form. This deposit is held on the principle of "good faith", recognition on your part that you are occupying facilities belonging to the citizens of Wisconsin provided for your temporary use and that the property must remain in good condition for other users who will follow you. The deposit will be returned to you in total at the termination of this Agreement unless you are deemed responsible for damages as outlined below, fail to maintain reasonable housekeeping responsibilities, or fail to make any payments when assessed. c. You agree to pay for any damages, lost property or unnecessary service costs caused by you to the Short Course Halls. Any/all damage costs will be deducted from your deposit. Any outstanding balance after damage deposit is depleted will be billed for assignable damage to the building and for damaged or missing furniture or equipment. Such charges must be paid within 15 days after billing. a. Where two or more students occupy the same room and responsibility for damage or loss in the room cannot be ascertained by the College after having given the students an opportunity to explain the damage or loss, the cost of damage or loss will be divided and assessed equally between or among the occupants of the room. b. When damage is done in common area spaces, if the responsible person is not held accountable the total cost of the damage(s) will be divided out amongst all floor members and will be deducted from the damage deposit. 7. Release, Forfeiture and Refund Policies You may apply in writing, electronically or by letter, to the Assistant Director of the Farm and Industry Short Course Program to cancel your Agreement. The Assistant Director retains the right to grant or deny any cancellation request. The College may consult with another University office or department regarding your cancellation request. Approved agreement cancellations will be subject to a $ forfeiture charge. A cancellation request is given priority if you: a. Are not attending or are no longer an enrolled student at the University of Wisconsin- Madison; b. Participate in an internship, research or study abroad program that requires living away from Madison; c. Demonstrate serious extenuating circumstances when, in the College s judgement, living elsewhere is warranted. Forfeiture charges will not be assessed if your cancellation request is granted for one of the following reasons: a. Being officially dropped from the University for academic reasons. b. Substantial and unanticipated financial hardship since signing the agreement. c. Complete withdrawal from the university. d. Graduate at the end of fall semester. Approved Agreement cancellations made by the Assistant Director will result in full housing charges up to the day you complete an appropriate checkout procedure as outlined in Section 17 of this Agreement. You will be refunded any unused housing fee payments on a prorated basis.
3 8. Termination of Agreement: The College may terminate or temporarily suspend performance of any part of this Agreement without notice in the event of an exigency which would make continued operation for student housing not feasible. The College reserves the right to decline to enter into or terminate an Agreement if you: a. lose eligibility as defined in this Agreement under Item 1, ELIGIBILITY; b. fail to properly complete or misrepresent information on the Agreement; c. fail to comply with any portion of this Agreement or a prior Agreement you held with the College; d. fail to satisfy in a timely manner all financial obligations accrued under this or a previous Agreement, including all required advance payments; e. have a record of past failure to meet financial obligations in a timely manner; f. violate rules or regulations listed or referred to in this Agreement and/or the University of Wisconsin Administrative Code, including chapters UWS 6: Complaints and Grievances; UWS 17: Student Nonacademic Disciplinary Procedures; and/ or UWS 18: Conduct on University Lands. If your Agreement is cancelled any time during the academic year for disciplinary reasons, the College reserves the right to decline to enter into or terminate your Agreement for any future academic terms; and/or g. have a proven criminal record and/or demonstrate behavior that indicates your presence in the halls may provide an unreasonable risk to yourself and/or to others in the University community, including students, faculty and staff. Upon termination you will receive written notification electronically and/or by letter which will provide a date by which you must vacate the halls. In the case of a serious violation, or a reasonable belief that a threat of such violation exists, you may be required to vacate within 24 hours or sooner. 9. Indebtedness Failure to satisfy the financial obligations accrued under this Agreement will result in eviction from the Short Course Halls, and may result in the denial of issuance/transfer of grade transcripts and/or future enrollment pursuant to University policy. 10. Assignment Policy The College will not discriminate in room or hall assignment on the basis of race, sexual orientation, color, gender identity/expression, disability, familial status, political affiliation, veteran s status, age, religion, national origin or ancestry. The College reserves the right to make room and hall assignments, to assign roommates and to consolidate vacancies by requiring residents to move from single or double occupancy of rooms whenever necessary to make the most efficient use of the space available. 11. Room Changes When there are personality conflicts among roommates or when for other good and valid reasons a room change is desired, a resident should contact their House Fellow. The room occupants along with the House Fellow will review the roommate agreement or if one has not been done, one needs to be completed. After that point, a further request for a room change should be made to the Assistant Director. Depending on the circumstances the Assistant Director may approve or deny the request. Unauthorized room changes or failure to move to consolidate space on request of the Short Course Assistant Director will likely result in disciplinary action pursuant to the provisions of UWS 17, and/or Agreement termination. 12. Roommate The College will share your name, postal and addresses, and telephone number, which are all considered public directory information, with any assigned roommate(s) unless a FERPA restriction is placed on this data. Students wishing to restrict some or all directory information should log on to the Student Center in the My UW portal.
4 13. Agreement Assignment This Agreement cannot be reassigned by you to any other person. You may not sublet any part of the premises. 14. Liability And Insurance Board of Regents of the University of Wisconsin Systems, its officers, employees and agents have no legal obligation, nor any ability to provide reimbursement for your personal property resulting from loss, theft, water damage, vandalism, or any other perils, unless damage results from the negligence of a specific University employee. Accordingly, you agree to hold harmless and indemnify the Board of Regents of the University of Wisconsin System, the College and its officers, employees and agents, for damages sustained by you or others, as a result of your acts or omissions, relating to any changes or modifications made by you to your room or furnishings, such as the configurations of loft beds, bunk beds, bookshelves, partitions, or other structures. This means you are financially responsible for injury to another party, or damage to their property, as a result of any equipment or items you have constructed, created, purchased or used improperly, and that you will pay any resulting claims on behalf of the University. Because the College does not provide private property insurance, residents are encouraged to secure their own personal property insurance. 15. Dining Service All Farm and Industry Short Course students are eligible to use monies placed on their Wiscard to purchase foods through the University of Wisconsin University Housing Dining and Culinary Services. 16. Vacating You must vacate the premises within 24 hours after termination of this Agreement, discontinuance as a student, or 24 hours after you have had your last instructional period/exam of the semester/term. If you are graduating from the university you may remain in your room until commencement day. 17. Check-in and Check-out Upon moving into your room, you will complete, sign and turn in a room inventory sheet which will be an accurate and complete record of the contents and condition of the assigned room. This inventory will serve as the basis for check-out charges, if assessed. You agree to follow the proper check-out procedure when vacating the premises which includes removing waste and debris and leaving the room and furnishings in an acceptable, clean condition. A room inspection by College personnel will serve as the basis for any room charges. Should extra cleaning by College personnel be required because of poor housekeeping by residents, a service charge may be assessed. 18. Room Entry Authorized personnel may enter your room for reasons of health, safety, general welfare, or to make necessary repairs to room equipment. Insofar as possible, advance notification will be given. College employees are required to report any violations of University regulations and/or terms of this Agreement observed when in your room. 19. Use of Information Technology You are required to comply with University and Short Course Halls guidelines for acceptable and fair use of University computing and information technology resources. You may not tamper with, alter or otherwise change parts of the data, voice or video network. Because of the limitations of the network, you are not to operate servers or services that make high demands upon the available shared bandwidth. If your bandwidth negatively impacts others, you will be expected to modify your content and/or cease
5 the service. Residents who engage in the behavior of hacking or attempting to disrupt computer networks at the University are subject to disciplinary action by the College and/or University and may be prosecuted to the fullest extent of the law. 20. Signatures/Entire Agreement: This Agreement may be executed by electronic or facsimile means and in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument. This document constitutes the entire agreement regarding the subject matter hereof between the parties and supercedes all prior agreements.
