Application of Rates and Services Schedule This Rates and Services Schedule (RSS) contains the descriptions, terms and conditions, and rates/charges applicable to interstate or state-to-state and international retail inmate communications services furnished by (f/k/a Embarq Payphone Services, Inc.), hereinafter referred to as the Company, between and among points within the United States, including U.S. possessions or territories. The services contained in this RSS are governed by the terms, conditions, discounts and provisions specified in a signed contract including expired contracts, in addition to the specific provisions set forth in this interstate and international RSS and in the Company s intrastate tariffs/price lists. This RSS also governs intrastate or in state long distance inmate communications service, except where (i) prohibited by law, (ii) it conflicts with tariffs that are effective with respect to intrastate inmate communications service, or (iii) a separate contract with CenturyLink applies to the intrastate inmate communications service; however at such time, if ever, that (i), (ii) or (iii) cease to apply, then this RSS will automatically and without further notice apply to such service. 7 Section 2 Effective: 11/14/13 Original Page 1 A. Definitions GENERAL TERMS AND CONDITIONS For purposes of this Rates and Services Schedule (RSS), the following definitions shall apply. Affiliate Any entity (including any natural person or entity such as a corporation or partnership) controlling, under the control of or under common control with another entity. Authorized User An individual, firm, corporation, or other entity authorized by the customer to utilize communications services provided by the Company. Automated Collect Call Calls billed to the called party that are completed through an automated call processing system. The automated system prompts the call originator and called party. The called party must accept charges for the call and is responsible for payment. Collect Calls Calls for which charges are billed not to the originating telephone number, but to the destination or termination telephone number. Company CenturyLink Public Communications, Inc., formerly known as (f/k/a) Embarq Payphone Services, Inc. Commission Refers to the Federal Communications Commission. Correctional or Confinement Institutions Refers to any type of confinement facility, including prisons, jails, work farms, detention centers or other facilities used for penalty or confinement purposes. Customer or End User The person, firm, corporation or other entity which uses the Company' service and is responsible for payment of charges and compliance with the Company's RSS. Domestic Calls made within the United States.

Definitions (Cont d) GENERAL TERMS AND CONDITIONS End User The calling party utilizing the services of the Company, and having responsibility for the payment of charges, unless that responsibility has been accepted by others, such as in the case of Collect calls. Inmates The jailed or confined population of correctional or confinement institutions. Inmate Telephone System (ITS) A secure telephone system provided by the Company to a correctional or confinement institution allowing controlled telephone communication between inmates and called parties pursuant to the rules established by the institution. InterLATA Communication between two different LATAs. Interstate Communication to and from locations between states. IntraLATA Communication within a LATA. Intrastate Communication to and from locations within a state. LEC Local Exchange Carrier Local Communication within a LATA that does not require a leading 1 when direct dialed. Local Access and Transport Area (LATA) A geographic region in the United States where a local exchange carrier (LEC) is permitted to provide interconnected telephone service. LATAs were defined by the United States Federal Communications Commission (FCC) as a result of the Modified Final Judgement (MFJ) of the division of the company AT&T on January 1, A LATA contains one or more local exchange areas, usually with common social, economic, or other interests.

Definitions (Cont d) GENERAL TERMS AND CONDITIONS Mainland United States The forty-eight (48) states within the continental United States of America and the District of Columbia. Subscriber The correctional institution which orders or uses the Company's service and is responsible for compliance with regulations. The Subscriber enters into an agreement with the Company for the provision of collect-only operator assisted telecommunications services for use by inmates. United States For purposes of this document, the term "United States" includes the Mainland United States of America, Alaska, Hawaii, Puerto Rico, U.S. Virgin Islands, Guam, American Samoa and the Commonwealth of the Northern Mariana Islands (CNMI) Usage Charge A charge assessed on a per minute basis in calculating a portion of the charges due for a completed Inmate Collect Call. User See end-user.
10 Section 2 Effective: 11/14/13 Original Page 4 B. General Terms and Conditions 1. Undertaking of the Company GENERAL TERMS AND CONDITIONS a. The Company's services and facilities are furnished for communications originating at correctional or confinement institutions between locations within the United States and foreign countries. The terms of this document apply to the Company's interstate calls. b. The Company provides for the installation, operation, and maintenance of the communications services provided herein in accordance with the terms and conditions set forth under this document. The Company may act as the Subscriber's agent for ordering access connection facilities provided by other carriers or entities, when authorized by the Customer, to allow connection of a Subscriber's location to the Company s services. The Customer shall be responsible for all charges due for such service arrangement. c. The Company's services and facilities are provided on a monthly basis unless otherwise provided, and are available twenty-four hours per day, seven days per week subject to restrictions imposed by the administration of the confinement/correctional institution. 2. Limitations a. The Company provides calling services to inmates of confinement/correctional institutions. b. Service is offered subject to the availability of the necessary facilities or equipment, and subject to the provisions of this document. c. The Company reserves the right to discontinue or limit service when necessitated by conditions beyond its control, or when the Customer is using service in violation of provisions of this document, or in violation of the law. d. The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors in transmission or for failure to establish connections. e. Service may otherwise be limited at the request of the confinement/correctional institution's administration or by rules of the Commission to decrease fraud and maintain security and control over the inmate population. 3. Use a. Services provided under this document may be used for any lawful purpose for which the service is technically suited, limited to the provisions of this document.

The Company shall not be liable for claim or loss, expense or damage (including indirect, special or consequential damage), for any interruption, delay, error, omission, or defect in any service, facility (including services and facilities involved in emergency calling activity) transmission provided under this document, if caused by any person or entity other than the Company, by any malfunction of any service or facility provided by any other carrier, by an act of God, fire, war, civil disturbance, or act of government, or by any other cause beyond the Company's direct control. b. The Company shall not be liable for, and shall be fully indemnified and held harmless by Customer, End User and Subscriber against any claim or loss, expense, or damage (including indirect, special or consequential damage) for defamation, libel, slander, invasion, infringement of copyright or patent, unauthorized use of any trademark, trade name or service mark, unfair competition, interference with or misappropriation or violation of any contract, proprietary or creative right, or any other injury to any person, property or entity arising out of the material, data, information, or other content revealed to, transmitted, or used by the Company under this document; or for any act or omission of the Customer, End User or Subscriber; or for any personal injury or death of any person caused directly or indirectly by the installation, maintenance, location, condition, operation, failure, presence, use, or removal of equipment or wiring provided by the Company, if not caused by negligence of the Company. c. The Company shall not be liable for any defacement of or damages to the premises of a confinement/correctional institution resulting from the furnishing of service which is not the direct result of the Company s negligence. d. Except when a court of competent jurisdiction finds that gross negligence, willful neglect, or willful misconduct on the Company's part has been a contributing factor, the liability of the Company for any claim or loss, expense or damage (including indirect, special or consequential damage) for any interruption, delay, error, omission, or defect in any service, facility (including services and facilities involved in emergency calling activity) or transmission provided under this document shall not exceed an amount equivalent to the prorata charge to the Customer or Subscriber for the period of service or facility usage during which such interruption, delay, error, omission or defect occurs.

All federal, state and local taxes (i.e., gross receipts tax, sales tax, municipal utilities tax) are listed as separate line items and are not included in the quoted rates. b. Federal Universal Service Fund (USF) Surcharge The FUSF (Federal Universal Service Fund) program was modified with the Telecommunications Act of The program provides financial support for high-cost lines, low-income households, schools, libraries and rural healthcare providers. The FCC requires the Company to pay into the fund and then allows the Company to recover its contributions into the fund from CenturyLink s customers. As a result, the following percentages will be applied to the end users total interstate long distance charges, and the FUSF surcharge will be itemized on the end user s bill. This surcharge is in addition to the rates for services further described in this RSS. The FCC Contribution factor is subject to change quarterly. The current factor can be found at c. Federal Regulatory Recovery The Company will assess a monthly Federal Regulatory Recovery fee for interstate and international charges for telecommunications services and is subject to change. This fee is not a tax or a government charge but recovers expenses the Company incurs in providing relay service for Special Needs customers and/or for expenses incurred with regards to federal regulation. Residence and business customers will be assessed a monthly charge equal to a percentage of their total net interstate and international charges, excluding taxes, discounts and credits. This fee is neither contributory to nor eligible to receive discounts, nor is it eligible to contribute to meeting minimum monthly or annual requirements. (C) (C) (M) d. Property Tax Recovery (N) The Company may asses a monthly Property Tax Recovery fee for interstate and international charges for telecommunications services. This fee is not a tax or a government charge but recovers amounts paid to various taxing jurisdictions and represents the interstate and international portion of property taxes imposed on the Company. Residence and business retail customers will be assessed a monthly charge equal to a percentage of their total net interstate and international charges, excluding taxes, discounts and credits. This fee is neither contributory to nor eligible to receive discounts, nor is it eligible to contribute to meeting minimum monthly or annual requirements. The Customer is responsible for payment of all charges for services and equipment furnished to the Customer or to an end user of the Customer by the Company. All charges due by the Customer are payable to the Company or to any agency duly authorized to receive such payments (such as a local exchange company). (T) (M) b. For charges billed through the Customer's local exchange carrier or through a billing vendor, notice from the Customer of disputed charges must be received by the Company within sixty (60) days after the date of the bill is issued. Otherwise, all charges will be considered correct and binding on the Customer. c. The Company will promptly investigate and advise all billed parties as to its findings concerning disputed charges. Adjustments to Customer's bills shall be made to the extent that circumstances exist which reasonably indicates that such changes are appropriate. (M) d. The Company reserves the right to assess a return check charge of up to $25.00 or the maximum permitted by law for checks returned for insufficient funds. The company s return check charge policy applies in accordance with state statutes, rules and regulations. e. The Company reserves the right to assess a late payment fee on any past due amount. The company will apply a late payment fee of 1.5% per month or the maximum rate permitted by law. The Company s late payment fee policy applies in accordance with state statutes, rules and regulations. 7. Deposits and Advance Payments a. The Company reserves the right to collect a deposit from customers whose credit history is unacceptable or unknown to the Company. Deposits, if collected, will be collected and maintained in accordance with state Commission rules. b. For services provided to inmates of confinement facilities, the Company may require a deposit from billed parties for charges which exceed a maximum credit amount predetermined by the Company based on the Customer's credit worthiness. The Customer may exceed this predetermined credit amount by first paying a deposit to the Company in an amount equal to the amount of additional credit authorization requested by the Customer. c. The Company reserves the right to require advance payments for service. However, for Customers whom the Company determines an advance payment is necessary, the Company reserves the right to collect an amount not to exceed one (1) month's estimated charges as an advance payment for service. This will be applied against the next month's charges and a new advance payment may be collected for the next month, if necessary. (M) Material moved from Page 6.
14 Section 2 Effective: 11/14/13 Original Page 8 B. General Terms and Conditions 8. Validation of Credit GENERAL TERMS AND CONDITIONS a. The Company reserves the right to validate the creditworthiness of Customers and billed parties through available verification procedures and to establish a maximum predetermined credit amount. Where a requested billing method cannot be validated or maximum credit amount established, the Company may refuse to provide service. b. Services provided by the Company are available to inmates of confinement facilities in accordance with facility-authorized programs. The Company may request that the confinement facility adopt, as part of its program, terms that enable the Company to collect the charges for all inmate calls, including without limitation, the blocking of calls by the Company to certain telephone numbers when the amount charged to such a telephone number exceeds a predetermined amount or becomes past due. 9. Adjustment to Rates and Charges The Company may adjust its rates and charges or impose additional rates and charges on its Customers in order to recover amounts it is required by governmental or quasi-governmental authorities to collect from or pay to others in support of statutory or regulatory programs. Examples of such programs include, but are not limited to, the Universal Service Fund (USF), and compensation to pay telephone service providers for the use of their pay telephones to access the Company's service. 10. Assignment and transfer All facilities provided under this document are directly or indirectly controlled by the Company. The limitations with which the Company contracts for service may not transfer or assign the use of service or facilities without the express written consent of the Company. All regulations and conditions contained in this document shall apply to all such permitted assignees or transferees, as well as all conditions of service. Such transfer or assignment, when permitted, shall only apply where there is no interruption of the use or location of the service or facilities. 11. Interconnection Service furnished by the Company may be connected with the services or facilities of other carriers. Such service or facilities, if used, are provided under the terms, rates and conditions of the other carrier. The Customer or Subscriber is responsible for all charges billed by other carriers for use in connection with the Company's service. Any special interface equipment or facilities necessary to achieve compatibility between carriers is the responsibility of the Subscriber.

The Company may refuse or discontinue service with proper notice to the Customer or Subscriber for any of the following reasons: 1) For failure of the Customer to pay a bill for service when it is due. 2) For failure of the Customer or Subscriber to make proper application for service. 3) For Customer's or Subscriber's violation of any of the Company's rules on file with a Commission. 4) For failure of the Subscriber to provide the Company reasonable access to its equipment and property. 5) For Subscriber's breach of the contract for service between the Company and the Subscriber. 6) For a failure of the Subscriber to furnish such service, equipment, and/or rights-of-way necessary to serve said Subscriber as shall have been specified by the Company as a condition of obtaining service. 7) When necessary for the Company to comply with any order or request of any governmental authority having jurisdiction. b. The Company may refuse or discontinue service without notice to the Customer or Subscriber for any of the following reasons: 1) In the event of tampering with the Company's equipment. 2) In the event of a condition determined to be hazardous to the Customer or Subscriber, to other Customers of the Company, to the Company's equipment, the public, or to employees of the Company. 3) In the event of a Customer's or Subscriber's use of equipment in such a manner as to adversely affect the Company's equipment or the Company's service to others. 4) In the event of fraudulent use of the service.

Inspection, Testing and Adjustment GENERAL TERMS AND CONDITIONS Upon reasonable notice, the facilities provided by the Company shall be made available to the Company for tests and adjustments as may be deemed necessary by the Company for maintenance. 14. Call Restrictions Calling capabilities may be restricted by the administration of the correctional or confinement institutions. The following types of calls will be blocked: directory assistance, 0-, 700, 800, 900, 976, 950, 10XXX, 1+ sent paid, third number billed, credit card and local direct. The confinement/correctional institution may block calls to specific telephone numbers and may limit calling service to pre-approved telephone numbers only. Call duration may be limited by the confinement/correctional institution. 15. Use of Recording Devices Subscribers who use recording devices do so at their own risk. Subscribers may use a recording device only in compliance with the requirements of local, state, and federal laws. C. Natural Disaster Relief For Customers In situations where customers telecommunications services are interrupted by natural disasters, the Company may offer alternative telecommunications services to customers in the immediate affected area, and waive otherwise applicable charges for those services. The availability and details of the offers, including, but not limited to, the maximum duration of the offer or waiver of any applicable charges, will be determined by the Company in each instance of natural disaster.

Description INMATE COMMUNICATIONS SERVICES The following descriptions, terms, conditions, and rates are specified by the type of contractual arrangement between the Company and the subscribers or customers, and represent the current standard terms, conditions and rates for those contractual arrangements. The Company may offer up to a 75% discount off the standard domestic rates and charges through a Customized Service Agreement. Customized Service Agreements (CSA) with individual case basis (ICB) pricing may also be available to customers based upon, but not limited to, network availability, quality of service, length of term or competitive bid for service. The pricing will be determined on a case-by-case basis. Individually negotiated contracts (ICB), are posted to the Company s Customized Service Arrangements (CSA) at: The Company offers domestic interstate operator assisted collect and prepaid collect-only calling services for use by inmates of prisons, jails or other confinement/correctional institutions. Inmate access to the Company's services may be restricted by the administration of the confinement/correctional institution served. The Company's services are available twenty-four hours per day, seven days a week. Customers are charged individually for each call placed through the Company's network. Charges may vary based on individual contracts between the Company and confinement/correctional institutions. Customers are billed based on their use of the Company's services and network. 2. Timing of Calls a. Billing for calls placed over the Company's network is based in part on the duration of the call as follows, unless otherwise specified in this document. b. For Collect Calls, charges apply only if the called party accepts the responsibility for payment. c. Chargeable time for each call ends when one of the parties disconnects from the call. d. Unless otherwise specified in this document, the minimum Initial Period for billing purposes is one (1) minute. e. Unless otherwise specified in this document, billing for Additional Periods (usage after the Initial Period) is in full one (1) minute increments. f. The Company will not knowingly bill for unanswered calls. When a Customer indicates that he/she was billed for an incomplete call, the Company will investigate the circumstances of the call and issue a credit when appropriate.
18 Section 3 Effective: 11/14/13 Original Page 2 B. Collect Operator Service 1. Description INMATE COMMUNICATIONS SERVICES a. The Company provides Collect Operator Service to inmates of confinement facilities. Service may be limited by the administrators of the confinement/correctional institutions as to availability, call duration or calling scope. Calls are billed to the Called Party. The Called Party must actively accept charges for the call. A per-call service charge applies to each call. b. Collect operator service allows inmates to make collect calls to terminating locations anywhere within the United States. An automated system prompts the caller and the called party through user - friendly instructions. The called party must accept responsibility for payment of the charges by dialing the designated digit for acceptance. If a call is not accepted the call is terminated. c. Use of the collect calling service is subject to the rules and regulations of the confinement/correctional institution's administrative restrictions.
19 Section 3 Effective: 11/14/13 Original Page 3 C. Prepaid Collect Service 1. Description INMATE COMMUNICATIONS SERVICES a. Prepaid Collect Services provide alternative payment arrangements for inmates in confinement institutions. This service enables end users to receive calls originating from confined persons and who cannot or who do not wish to have such calls billed through their own local exchange service provider, whose credit history is inadequate to receive collect calls, whose usage exceeds credit limits established for the confinement/correctional institution, or end users who wish to budget their monthly expense for collect calls. b. With Prepaid Collect Service, a prepaid account is set up by the Company for the Customer who receives collect calls from an inmate in a confinement institution. Once an account is established, all collect calls from the confinement facility to the telephone number (s) associated with the prepaid collect account are automatically processed as prepaid collect. The Company does not engage in direct monetary transactions with the inmate. Prepaid accounts may be replenished; the minimum initial deposit or replenishment amount may vary per confinement/correctional institution standard. c. The Company s ITS automatically informs the end user of the available usage balance remaining in the Prepaid Collect account prior to acceptance of the call. Network usage is deducted from the available usage balance in full minute increments on a real time basis as the call progresses. All calls must be charged against an Account that has sufficient available balance. Calls in progress will be terminated by the Company if the balance on the Account is insufficient to continue the call. For debiting purposes, call timing is rounded up to the nearest one (1) minute increment. Usage charges are computed and rounded up to the nearest penny on a per call basis. d. Initial or additional deposits to Prepaid Collect accounts may be made through selected retail outlets with which the Company may contract to receive Customer payments, or through Western Union, commercial credit card, debit card or e-checks. There is no minimum funding amount. Network usage for Prepaid Collect Calls is deducted from the available usage balance in full minute increments. For debiting purposes, call timing is rounded up to the nearest one (l) minute increment. Usage charges are computed and rounded up to the nearest penny on a per call basis. e. Payments for Prepaid Collect accounts and any available usage balance are refundable upon request, typically after release of the inmate from the confinement/correctional institution. The available usage balance expires six months from the date the last call is made on the Debit or Prepaid Collect account.

Access to telephone service by an inmate may be subject to time of day and usage restrictions imposed by individual confinement institutions. No minimum service period applies
21 Section 3 Effective: 11/14/13 Original Page 5 D. Prepaid Debit Service INMATE COMMUNICATIONS SERVICES 1. Description a. Prepaid debit service allows an inmate to purchase a card or deposit funds into an account. Debit cards or debit accounts may be funded in any amount subject to the requirements or restrictions of the confinement institution. The Inmate has the option to transfer funds from his/her commissary account to purchase a debit card or have calls paid for directly out of the Inmate's commissary or trust account. This is accomplished by the confinement/correctional institution or through a direct interface between the commissary/trust system and the ITS. To place a call, the inmate enters a specified Personal Identification Number (PIN) and dials the desired telephone number. The Company's system automatically informs the caller of the Available Usage Balance remaining in the Prepaid Account, and provides prompts to place the call by entering the destination telephone number. All deposits to the account are paid to and handled by the confinement/correctional institution. The Company receives payment from the confinement/correctional institution; it does not engage in direct monetary transactions with the inmate. Refunds of remaining balances in a Debit Card or Debit Account are refundable upon release. Available balances in the Debit Card or Debit Account are refundable, either through an interface to the confinement/correctional institution s inmate banking system, which includes an automated balance transfer upon release. The available usage balance expires six months from the date the last call is made on the account or card. d. Service is offered as a flat-rated telecommunications service.
