Rate Limitations $ Billion $ Billion Factors limiting rates include: statutory maximums on voter and non-voter approved rates; the "yield control" statute that generally forces rate reductions in response to reassessment; voter approval requirements for (mostly) debt-service rates, and approval requirements for governing bodies when setting non-voter approved operating rates. The New Mexico Constitution prohibits the sum of rates imposed by governing bodies of various jurisdictions from exceeding 20 mills without voter approval. Statutes distribute the 20-mill authority as follows: municipalities, counties and school districts may impose up to 7.65 mills; mills, and.5 mills respectively -- via majority vote of governing bodies without voter approval. With voter approval, the State of New Mexico may impose debt service rates generating property tax obligations that total no more than 1 percent of statewide net taxable value. Municipalities and school districts may impose rates generating obligations totaling up to 4 percent of net taxable value with voter approval. Voter-approved rates for school districts may produce property tax obligations totaling 6 percent of net taxable value within boundaries of the associated district. -1-

Oil, natural gas and copper production properties are included in the nonresidential category shown above. Figure 4: Trends in Relative Shares of Residential and Nonresidential Net Taxable Value Percent of Total Residential A three percent limit on annual increases in assessed value of unsold residential properties was enacted in It appears to have decreased the long-term increase in net taxable value of residential relative to nonresidential property Nonresidential Tax Year Nonresidential percentages shown above include values of copper ad valorem production properties, but not oil and gas ad valorem properties. Oil and gas producing values are extremely variable and therefore excluded. Copper producing properties were not, until 1990, production based and are thus not included in the traditional nonresidential category after tax year

Highest rates -- over 39 mills -- for residential properties are in portions of Bernalillo County (Albuquerque). The state s lowest residential rates, paid by some residents of Taos County, total mills. Highest traditional, ( i.e., non ad valorem production) nonresidential rates are paid by property owners in Albuquerque (Bernalillo County) mills, Gallup (McKinley County) mills and Los Lunas mills. Lowest rates among traditional nonresidential properties are in portions of Catron County mills. Rates paid by owners of oil, natural gas and copper production properties range from almost 32 mills in a portion portions of San Juan and McKinley County to 14.6 mills in a portion of Roosevelt County. The statewide average unweighted average rate is the sum rates for each county divided by the total number of New Mexico counties. Weighted average rates are calculated for each county by multiplying rates in each tax district in a particular county by the fraction of taxable value in each associated tax district and summing the result. Statewide average weighted rates are are calculated by summing weighted average rates in each county multiplied by each county's share of total statewide net taxable value. Statewide Weighted Average Rates Excluding Bernalillo County Mills The rate picture shown above changes significantly when Bernalillo County rates are excluded from statewide totals.
