1 288 AUGUST 18, 2014 A CALLED MEETING OF THE BRISTOL VIRGINIA CITY COUNCIL WAS HELD ON AUGUST 18, 2014, AT 7:00 P.M. IN THE COUNCIL CHAMBERS WITH MAYOR CATHERINE BRILLHART PRESIDING. VICE MAYOR ARCHIE HUBBARD AND COUNCIL MEMBERS WILLIAM HARTLEY, GUY ODUM, AND JIM STEELE WERE PRESENT. ALSO PRESENT WERE CITY MANAGER, TABITHA CROWDER, AND CITY ATTORNEY, PETE CURCIO. Mayor Brillhart called the meeting to order. Mayor Brillhart entertained a motion for the street closure requests in Agenda Items 1 through 3 to be considered collectively. Vice Mayor Hubbard made the motion to consider approval of the street closure requests in Agenda Items 1 through 3 collectively. Motion was seconded by Council Member Hartley and carried by the following votes: AYES: Hartley, Hubbard, Odum, Steele, and Brillhart 1. Consider Street Closure Request for the 27 th Annual Food City Family Race Night/Transporter Motorcade, Scheduled for Thursday, August 21, Consider Street Closure Request for the Cumberplunge Event, Scheduled for Saturday, August 30, Consider Street Closure Request for the 2 nd Annual Bristol Morning Rotary Club Summer s End 5K and Back to School Youth Mile, Scheduled for Monday, September 1, 2014 Mayor Brillhart entertained a motion for the approval of the street closure requests as presented. Council Member Steele inquired about liability for the Cumberplunge Event. City Attorney, Pete Curcio, advised that the event was covered under the City s liability insurance, the same as with all other events. Vice Mayor Hubbard made the motion to approve the street closure requests as presented. Motion was seconded by Council Member Odum and carried by the following votes: AYES: Hartley, Hubbard, Odum, Steele, and Brillhart 4. Public Hearing Regarding a Proposed Increase in the Real Estate Tax Rate and a Revision to the FY Budget Appropriation Ordinance Mayor Brillhart declared the public hearing open for discussion. Ms. Joyce Hensley spoke in opposition to the property tax increase. year. Ms. Sarah Williams asked that the tax increase be delayed until the next budget Ms. Anita Edens spoke about sewer disposal issues at four (4) homes located on Bristol View Drive. Mayor Brillhart asked the City Manager to follow up on the issue. Mr. Wayne Thurston spoke in favor of the tax increase. Ms. Nancy Marney advised that she was in favor of Option 2 as presented by Vice Mayor Hubbard. Ms. Tracey Mercier proposed increasing property tax by three cents ($.03) each year instead of the initial six cents ($.06) the first year followed by two cents ($.02) each additional year as proposed by Vice Mayor Hubbard. Ms. Melissa Warren voiced her concerns about budget cuts and level funding for the school system. Mr. Rex Gearheart thanked City Council Members for all they do for the City and asked for continued support and funding for the Bristol Virginia Public School System.

2 AUGUST 18, Ms. Beth Rhinehart asked that City Council reconsider the proposed plan and develop a comprehensive plan that addressed all the aspects of a comprehensive budget. Mr. John Iskra urged City Council to carefully consider all the underlying assumptions, in particular, property taxes which depended upon the value of the property. Mr. John Brewer voiced his concerns about property tax increases and how it would affect his rental properties and tenants. Mr. Roscoe Trivett voiced his concerns about the spending habits of the City and requested information on the City s debt. Mr. Michael Pollard voiced his concerns about the increase in property tax. Mr. Colin Cox addressed Mr. Roscoe Trivett s request regarding information on the City s debt and advised that the information was located on the City s website. Mayor Brillhart declared the public hearing closed. Vice Mayor Hubbard advised that the proposed plan included a six cent ($.06) increase in property tax for the first year only. He continued by stating that the additional property tax increases of two cents ($.02), as proposed for future years, would be implemented on an annual basis if needed. He advised that he was in favor of helping the schools work out the financial issues but that his plan did not address those issues. He further advised that it was not his intention for all City budgets to remain level funded for the next eight (8) years. He continued by stating that additional expenditures would have to be addressed with additional revenue streams. 5. Presentation of Treasurer s Delinquent Tax Collection Update City Treasurer, Ms. Angel Harris, gave a presentation on the delinquent tax collections. Vice Mayor Hubbard inquired about the fees for the tax collection service. Ms. Harris advised that the fees associated with the delinquent collections were paid by the tax payer. Council Member Hartley inquired about the trends in tax collections over the past few years. Ms. Harris advised that there had been an increase in the tax collections over the past few years and that she anticipated the trend would continue as the focus would be concentrated on the collection of delinquent personal property taxes. 6. Ordinance 1) First Reading of a Revised FY Budget Appropriation Ordinance Mayor Brillhart entertained a motion for the first reading of a revised FY Budget Appropriation Ordinance. Vice Mayor Hubbard made the motion for the first reading of a revised FY Budget Appropriation Ordinance. Motion was seconded by Council Member Steele and carried by the following votes: AYES: Hartley, Hubbard, and Steele NAYES: Odum and Brillhart City Attorney read the following Ordinance: REVISED BUDGET ORDINANCE FOR FY MAKING GENERAL FUND AND SOLID WASTE DISPOSAL ENTERPRISE FUND APPROPRIATIONS FOR THE FISCAL YEAR BEGINNING JULY 1, 2014 AND ENDING JUNE 30, 2015 IN THE AMOUNT OF $54,965,010 AND $5,642,245 RESPECTIVELY AND REGULATING PAYMENTS OUT OF THE CITY

3 290 AUGUST 18, 2014 TREASURY; AND ALSO FIXING THE TAX RATE ON REAL AND PERSONAL PROPERTY FOR FISCAL YEAR BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BRISTOL, VIRGINIA: SECTION 1: That the amounts named herein, aggregating $54,965,010 are hereby appropriated from the General fund for the use of the several departments of the City Government for the fiscal year beginning July 1, 2014 and ending June 30, 2015, as the same is set forth in the budget adopted pursuant to Section 3 hereof. That the amounts named herein, aggregating $5,642,245 are hereby appropriated from the Solid Waste Disposal Fund for the use of solid waste disposal operations for the 2015 fiscal year. This revision reflects a decrease in the tax on admission from 10% to 5%, a reduction in cigarette taxes from 20 cents per pack to 15 cents per pack and a reduction in trash collection fees from $15 per month to $13 per month. SECTION 2: That the rate of taxation on Real Estate Property be increased from a fixed rate at $1.01 (One Dollar and One Cent) to a fixed rate at $1.07 (One Dollar and Seven Cent) and on Personal Property, Machinery and Tools, be fixed at $7.00 (Seven Dollars and No Cents) on the hundred dollars assessed valuation for the fiscal year 2015, in order to secure the amount necessary to carry out the provisions of this budget. Ordinance 1) First Reading of an Ordinance to Repeal and Reenact Article IX Tax on Admissions Levy repeal and reenact Article IX Tax on Admissions Levy. Vice Mayor Hubbard made the motion for the first reading of an Ordinance to repeal and reenact Article IX Tax on Admissions Levy. Motion was seconded by Council Member Steele and carried by the following votes: AYES: Hartley, Hubbard, and Steele NAYES: Odum and Brillhart City Attorney, Pete Curcio, read the following Ordinance: ORDINANCE TO REPEAL AND REENACT Article IX Tax on Admissions Levy BE IT ORDAINED by the City Council for the City of Bristol, Virginia that Article IX Tax on Admissions Levy of the City Code should be and is hereby repealed and re-enacted as follows: Section Levy. A tax in the amount of five percent (5%) of any charge for admission to any place of amusement or entertainment where such charge is $0.50 or any amount in excess thereof

4 AUGUST 18, is hereby levied upon and shall be collected from each person who pays an admission charge of $0.50 or more to any place of amusement or entertainment. This levy shall apply to all admission charging events which are held wholly or partially within the jurisdictional area of the City of Bristol Virginia, regardless of point of sale for said admission. The rate change created by this ordinance shall become effective September 1, Second Reading: Adopted: 8. Ordinance 1) First Reading of an Ordinance to Repeal and Reenact Article III Cigarette Tax Imposition; Rate; Seller Liable repeal and reenact Article III Cigarette Tax Imposition; Rate; Seller Liable. Vice Mayor Hubbard requested that the Ordinance be changed to reflect a change to the tax from twenty cents ($.20) per pack to eleven cents ($.11) per pack. City Attorney, Pete Curcio, advised that, if the Ordinance was approved, the City Manager would have to revise the Budget Ordinance for the second reading. repeal and reenact Article III Cigarette Tax Imposition; Rate; Seller Liable, from twenty cents ($.20) per pack to eleven cents ($.11) per pack. Motion was seconded by Council Member Steele and carried by the following votes: AYES: Hartley, Hubbard, Odum, and Steele NAYES: Brillhart The Ordinance reads as follows: ORDINANCE TO REPEAL AND REENACT Article III Cigarette Tax Imposition; Rate; Seller Liable BE IT ORDAINED by the City Council for the City of Bristol, Virginia that Article III Cigarette Tax Imposition; Rate; Seller Liable of the City Code should be and is hereby repealed and re-enacted as follows: In addition to all other taxes of every kind, now or hereafter imposed by law, there is hereby levied and imposed by the City an excise tax on the sale of cigarettes equivalent to eleven cents (0.11) on each package containing thirty (30) or fewer cigarettes sold within the city. The tax shall be paid by the seller if not previously paid and collected in the manner and at the time provided for in this article, provided that the tax payable for each package of cigarettes sold within the City shall be paid but once. For purposes of this section, package means any container, regardless of the material, used in its construction in which separate cigarettes are placed without such cigarettes being placed into any container within the package. Packages are those containers of cigarettes from which individual cigarettes are ordinarily taken when they are consumed by their ultimate user. The rate change created by this ordinance shall become effective September 1, 2014.
