2 BACKGROUND In 2013, China has launched a number of policies and measures to stimulate economic development. On the policy side, the policies and measures are concentrated on tax relief and procedure simplifications; on the measurement side, it is mainly reflected in the rise of several regional investment hot spots. Special policy areas, such as Free Trade Zone in Shanghai, have brought unprecedented opportunities for the development of many enterprises. However, the regional policy differs with uncertainty, the prospect is with ambiguity, and the details are to be determined. All of these have brought about great challenges to the enterprise. She is also specialised in the tax and transfer pricing advisory in the real estate, infrastructure and Energy and Natural Resources industries. Jean commenced her tax profession in Sydney, Australia in Prior to relocating to China in June 2001, Jean specialised in indirect taxes in Australia. During the last 12 years in China, Jean has acquired rich and solid experience in advising multinational clients on taxation and business regulations in respect of business activities in the PRC and cross-border transactions. Lu Chen. SZ Session Senior Manager, ITS-Transfer Pricing Services, EY Ms. Lu Chen is a Senior Manager of the transfer pricing practice at the Shenzhen office. Prior to joining E&Y, Lu had worked at another big four firm s transfer pricing practices both in the United States and in China. Lu has led various types of transfer pricing engagements including transfer pricing documentation, planning, risk assessment in an M&A or IPO context, advance pricing arrangement (APA), and transfer pricing audit defense, for clients in the consumer market, financial services, communications hardware and software, automotive, retail, food, and chemicals industries. These clients include renowned multinationals as well as some of the leading Chinese domestic companies with outbound investments. She also gained valuable experience in transfer pricing controversy cases encompassing contested issues such as service fee charges and license royalty, valuation of intangibles, and cost sharing arrangements. SZ Session Senior Manager, Transfer Pricing, EY Before joining EY, Mr. Lin has been working for 13 years in Transfer Pricing ( TP ) investigation and management department
10 of Shenzhen Local Tax Bureau, which acted as the Pioneer of China Anti-Tax Avoidance progress. Mr. Lin has participated in the investigations of many significant typical cases and also experienced the development of Anti-Tax Avoidance progress. Mr. Lin has managed and assisted around 100 cases in TP investigations for many years, including well-known cases with largescale amounts and complicated TP-typical cases. He has accumulated profuse experiences in the area of TP investigations and negotiations. He used to be the backbone of Anti-Tax Avoidance team of SAT, with his strong TP cases handling skills and comprehensive knowledge on the SAT s appeal and perspective. In the field of BAPA, Mr. Lin has assisted the Anti-tax avoidance department of SAT in many well-known bilateral negotiation cases, such as the first BAPA case of Wal-Mart between U.S and China, cost allocation agreement for Laid, BAPA cases of Fuji Xerox, Toshiba, Tiger, and Brother between China and Japan, and etc. Therefore, Mr. Lin also is skilled in handling BAPA and negotiation with Foreign Tax Bureaus. He holds LL.M in Taxation and Master Diploma of Economics. He is council member of China CTA Committee, International Fiscal Association and China Fiscal-Tax Law Institute. He is also researcher of Central University of Finance and Economics International Tax Centre. Prior to joining CTAC, Mr. Song was the head of a Big Four Transfer Pricing (TP) group in charge of its TP service in north of China. Mr. Song commenced his professional tax career at the SAT Shandong Office where he worked for over 10 years. BJ Session Senior Tax Manager, KPMG Shirley started her career with professional accounting firms in Australia since 2004 and has experience in various disciplines including tax and accounting. Before joining KPMG in 2007, she has been working in tax department of another Big Four for two years. Shirley has rich experience in industry market and energy industry. She has been providing tax health check, tax provision review, tax due diligence, structuring and planning advice to major multinational and domestic clients. She is also now actively involved in the VAT reform in China by assisting the Legislative Affairs Office of Budgetary Affairs Commission of National People s Congress and the Ministry of Finance. Shirley is a key member of KPMG s Indirect Tax, Center of Excellence and has been involved in many VAT reform projects for MNCs and SOEs. SH Session Partner, Shanghai Qin Li Law Firm (Part of the Deloitte global network) Clare has more than 15 years experience in providing tax and legal services. Travis started his career with China tax authorities in 1993 and joined a Big Four firm in He joined Ernst & Young in 2005 and worked with Ernst & Young tax practice in Shanghai and New York, respectively. SH Session Senior Partner, CTAC Group Mr. Allan Jiang is a senior partner of CTAC and he has more 19 years of experience in tax compliance, and tax advisory work in China, especially in relation to the taxation of foreign enterprise. He was the chief-in-charge of Chongqing State of Taxation Bureau s audit division prior joining BP China as a tax manager. Damon is also a member of the AMCHAM Shanghai Customs Task Force. Frank Wu. SH Session Senior Manager, PwC Frank is a Senior Manager of PwC Worldtrade Management Services based in Shanghai. Frank has over 12 years experience in the field of customs and international trade. Prior to joining PwC, Frank was Section Chief of Shanghai Customs and responsible for legal affairs and administrative penalty. Frank also used to work in Legal and Policy Division of
14 Shanghai Customs, Legal Division of Anti-Smuggling Bureau (ASB) and subordinate port customs totally for 10 years. Frank worked in the Functional Division of Shanghai Customs for a long time, provided legal advice and operation opinion to other Divisions within Shanghai Customs and subordinate port customs, and had managed and supervised numerous administrative penalty cases. Frank joined PwC in Frank provided advisory service to various type of MNCs in respect of market access feasibility research, regional distribution center set-up, Customs valuation, Customs audit/investigation defense, tariff classification, FTA, origin, processing trade, bonded warehouse management, duty-exemption equipment, etc. His industry experience includes industrial manufacture, automotive, pharmaceutical, medical device, chemicals, retail, high technology, electronics, mining and other industries. Frank obtained a Master of Law, majoring in international economic law. Frank obtained the National Bar Certificate and has been acting as a government lawyer for 8 years. Frank has a lot of experience on legal issues and drafted the customs rules, notification and other internal documents, including GAC Order 182, Regulation of PRC on Guarantee for Customs Affairs, etc. Frank has collaborated in writing various publications, including Customs Law and Relevant Law and The Standard and Criterion of Custom Operation and Enforcement. He has delivered legal training for each level official of Shanghai Customs. Frank also attended the National Legal Knowledge Competition on behalf of Shanghai Customs and was awarded as one of six best legal professionals by the General Administration of Customs nationwide.
