1 392 EC CRIMINAL CODE OF CANADA TERMS AND CONDITIONS FOR THE ISSUANCE OF LICENSES FOR THE CONDUCT AND MANAGEMENT OF LOTTERY SCHEMES AMENDMENT LOTTERY SCHEMES ORDER Pursuant to section 207 of the Criminal Code of Canada R.S.C. 1985, Cap. C-46, Council made the following regulations: 1. (1) Subsection 3(3) of the Criminal Code of Canada Lottery Schemes Order (EC884/84) is revoked and the following substituted: (3) Where, in respect of a year, (a) the total value of prizes offered for a bingo is in excess of $250 but less than $45,000; and (b) the gross receipts of the bingo are less than $100,000, a license fee in respect of the year is payable to the Minister of Finance, Energy and Municipal Affairs of $25. (2) Section 3 of the order is amended by the addition of the following after subsection (3): (4) Where, in respect of a year, (a) the total value of prizes offered for a bingo is in excess of $45,000; or (b) the gross receipts of the bingo are $100,000 or more, a license fee in the amount equal to 2% of the total value of the prizes offered is payable to the Minister of Finance, Energy and Municipal Affairs. 2. This order comes into force on August 17, Total prize value for bingo more than $250 Total prize value for bingo more than $45,000 EXPLANATORY NOTES SECTION 1 sets a $25 fee for bingos with prize limits over $250 but less than $45,000 and with gross receipts of less than $100,000 per year. Also the section sets a fee equal to 2% of the prizes for bingos with prize limits of more than $45,000 or with gross receipts of $100,000 or more per year. SECTION 2 provides for the commencement of this order.

2 393 EC CRIMINAL CODE OF CANADA TERMS AND CONDITIONS FOR THE ISSUANCE OF LICENSES FOR THE CONDUCT AND MANAGEMENT OF LOTTERY SCHEMES AMENDMENT LOTTERY SCHEMES ORDER Pursuant to section 207 of the Criminal Code of Canada R.S.C. 1985, Cap. C-46, Council made the following regulations: 1. The Criminal Code of Canada Lottery Schemes Order (EC884/84) is amended by the addition of the following after section 4.4: 4.5 (1) In this section (a) high stakes bingo event means a bingo event, as defined in the Schedule to this Order, at which the total value of the prizes offered or paid by the licensee operating or conducting the event exceeds the maximum amount otherwise permitted by section 18 of the Schedule to this Order; and (b) licensee means the holder of a subsisting license issued under section 2 that authorizes the holder to conduct and operate a high stakes bingo event. Definitions high stakes bingo event licensee (2) The Minister of Environment, Labour and Justice is authorized, under section 2, to issue a license to the Abegweit Band Charities Inc. to conduct and operate a high stakes bingo event on the date or at the gathering or session indicated on the license. (3) A license fee in the amount of 2% of the total value of the prizes offered for the bingos conducted during a high stakes bingo event held under the license is payable to the Minister of Finance, Energy and Municipal Affairs. License, eligibility Fee (4) Sections 4.1 to 4.3 of this Order and sections 8 and 18 of the Schedule to this Order do not apply in respect of any bingo conducted and operated by the licensee at the high stakes bingo event indicated on the license of the licensee. Application of provisions of Order (5) The total values of the prizes offered or paid at a high stakes bingo event conducted or operated by the licensee under a license shall not exceed $125,000. Prize limit (6) Where the licensee engages a third party service provider to conduct and operate the high stakes bingo event authorized by the license, the service provider is not entitled to charge for services rendered in excess of 20 per cent of the gross receipts of the licensee for the high stakes bingo event. (7) It is a term and condition of any license issued by the Minister of Environment, Labour and Justice for a high stakes bingo event that no person under the age of 18 years shall play in a bingo, or be awarded a prize in a bingo, conducted and operated during a bingo event by the licensee. 2. Section 4.5 of the Order is revoked. 3. (1) Subject to subsection (2), this Order comes into force on August 17, (2) Section 2 comes into force on July 1, Restriction on service charge Persons under age of 18 years EXPLANATORY NOTES SECTION 1 permits the issuance of a license to the Abegweit Band Charities Inc. to conduct and operate a high stakes bingo event on the date or at the gathering or session indicated on the license. The current

3 394 maximum amount of the total prizes offered or paid by a licensee at a bingo event is $5,500. This amendment will permit the licensee to offer a bingo event with a total prize value of up to $125,000. SECTION 2 provides for the revocation of this high stakes bingo event amendment. This revocation will be effective on July 1, SECTION 3 provides for the commencement of this order. EC EXECUTIVE COUNCIL ACT MINISTER OF ENVIRONMENT, LABOUR AND JUSTICE AND ATTORNEY GENERAL AUTHORITY TO ENTER INTO AN AGREEMENT (SPECIALIZED SERVICES AGENT FOR PROCEEDINGS PURSUANT TO SECURITIES ACT) WITH THE NEW BRUNSWICK SECURITIES COMMISSION Pursuant to clause 10(b) of the Executive Council Act R.S.P.E.I. 1988, Cap. E-12 Council authorized the Minister of Environment, Labour and Justice and Attorney General to enter into an agreement dated January 30, 2013 and amending agreements dated March 28, 2013 and May 6, 2013, to set out terms and conditions whereby the New Brunswick Securities Commission will serve as agent acting in the capacity of solicitor for certain proceedings pursuant to the Securities Act, R.S.P.E.I. 1988, Cap. S-3.1, such as more particularly described in the draft agreement. EC GASOLINE TAX ACT REGULATIONS AMENDMENT Pursuant to section 9 of the Gasoline Tax Act R.S.P.E.I. 1988, Cap. G-3, Council made the following regulations: 1. Subsections 4(7) to (9) of the Gasoline Tax Act Regulations (EC283/72) are revoked and the following substituted: (7) The fee to be charged for the issuance, under subsection 8.1(3) of the Act, of a Single Trip Fuel Permit is $ Fee for Single Trip Fuel Permit (8) The fee to be charged for the issuance of a license or fuel permit in accordance with an agreement entered into under section 7.2 of the Act is $25. (9) The fee to be charged for the issuance of each set of two decals in accordance with an agreement entered into under section 7.2 of the Act is $25. (10) The prescribed issuance fee for a Marked Gasoline Permit is $10. (11) The prescribed issuance fee for both a Marked Gasoline Permit and a Marked Diesel Oil Permit is $10 in total where the two permits are applied for at the same time. 2. These regulations come into force on August 17, EXPLANATORY NOTES SECTION 1 fixes a consolidation and subsection numbering error. Subsequently, another amendment to section 4 of these regulations added two further provisions to section 4 with the same subsection numbers as were used in the 1995 amendment. SECTION 2 provides for the commencement of these regulations. EC HOLLAND COLLEGE ACT SALE OF PROPERTY APPROVED Council, having under consideration the recommendation of the Treasury Board and pursuant to subsection 3(3) of the Holland College Act R.S.P.E.I. 1988, Cap. H-6, approved the sale of 223 Water Street, Summerside (Provincial Property No ) and three adjacent parcels of undeveloped land (Provincial Property Nos , and ) to P.E.I. Inc. Council noted that the sale was approved by the Holland College Board of Governors on July 17, EC INTERPRETATION ACT LIGHTNING ROD ACT REGULATIONS REVOCATION Pursuant to subsection 33(3) of the Interpretation Act R.S.P.E.I. 1988, Cap. I-8, Council made the following regulations: 1. The Regulations (EC583/72) made under the Lightning Rod Act R.S.P.E.I. 1988, Cap. L-12 are revoked. 2. These regulations come into force on August 17, EXPLANATORY NOTES SECTION 1 revokes the Regulations made under the Lightning Rod Act which has been repealed. SECTION 2 provides for the commencement of these regulations.

5 396 EC ISLAND INVESTMENT DEVELOPMENT ACT FINANCIAL ASSISTANCE REGULATIONS PAN AMERICAN PROPERTIES INC. AUTHORIZATION Pursuant to subsection 2(3) of the Island Investment Development Act Financial Assistance Regulations (EC ), Council authorized Island Investment Development Inc. to advance a term loan in the maximum amount of eight million and ninety-four thousand dollars ($8,094,000.00) to Pan American Properties Inc. to finance redevelopment of the former Kays Bros. Building at 43 Queen Street (Phase I) and construction of a retail/office complex at 31 Queen Street (Phase II) on terms and conditions satisfactory to the Board of Directors of Island Investment Development Inc. Order-in-Council EC of July 17, 2012 is hereby rescinded. EC VENESSA BACKMAN Pursuant to section 4 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Venessa Backman of Belle River, Prince Edward Island to acquire a land holding of approximately twenty-five (25) acres of land in Lot 61, Kings County, Province of Prince Edward Island, being acquired from Donald Hewitt and Tarry Brown Hewitt, both of Milltown Cross, Prince Edward Island PROVIDED THAT the said real property is identified for non-development use pursuant to the Land Identification Regulations (EC606/95) made under the said Act. EC NATHAN HAMBLY AND JENNIFER HAMBLY Pursuant to section 4 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Nathan Hambly and Jennifer Hambly, both of Fort McMurray, Alberta to acquire a land holding of approximately fifty-three (53) acres of land in Lot 23, Queens County, Province of Prince Edward Island, being acquired from Ian Steeksma and Jennifer Steeksma, both of Hunter River, Prince Edward Island. Further, Council noted that the said land holding, being Provincial Property No , was previously identified for non-development use in accordance with section 2 of the Land Identification Regulations (EC606/95) made under the said Act. Identification continues to apply.

6 397 EC WILLIAM WEBER AND CHRISTINA WRIGHT Pursuant to section 4 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to William Weber and Christina Wright, both of Alix, Alberta to acquire a land holding of approximately one hundred and fifteen (115) acres of land in Lots 34 and 35, Queens County, Province of Prince Edward Island, being acquired from Marjorie MacLauchlan of York, Prince Edward Island PROVIDED THAT the said real property is identified for non-development use pursuant to the Land Identification Regulations (EC606/95) made under the said Act. EC WILLIAM WEBER AND CHRISTINA WRIGHT Pursuant to section 4 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Arsenault Pondside Inc. of Wellington, Prince Edward Island to acquire a land holding of approximately zero decimal nine six (0.96) acres of land in Lot 16, Prince County, Province of Prince Edward Island, being acquired from Wellington Construction Co. Ltd. of Wellington, Prince Edward Island. EC BIRKENTREE HOLSTEINS INC. Pursuant to section 5 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Birkentree Holsteins Inc. of North Rustico, Prince Edward Island to acquire a land holding of approximately eight-five (85) acres of land in Lot 24, Queens County, Province of Prince Edward Island, being acquired from Wayne Dickieson and Flora Dickieson, both of North Rustico, Prince Edward Island. EC CARDIGAN FEED SERVICES LTD. Pursuant to section 5 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Cardigan Feed Services Ltd. of Cardigan, Prince Edward Island to acquire a land holding of approximately zero decimal two one (0.21) acres of land in Lot 52, Kings County, Province of Prince Edward Island, being acquired from Eric Grant of Cardigan, Prince Edward Island.

L-5 Council granted permission to Cardigan Feed Services Ltd. of Cardigan, Prince Edward Island to acquire a land holding of approximately six decimal four eight (6.48) acres of land in Lot 52, Kings County, Province of Prince Edward Island, being acquired from Eric Grant of Cardigan, Prince Edward Island SUBJECT TO the condition that the said real property not be subdivided. The condition preventing subdivision shall be binding on the said Cardigan Feed Services Ltd. and on all successors in title. EC CARDIGAN FEED SERVICES LTD. Pursuant to section 5 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Cardigan Feed Services Ltd. of Cardigan, Prince Edward Island to acquire a land holding of approximately zero decimal one seven (0.17) acres of land in Lot 52, Kings County, Province of Prince Edward Island, being acquired from Eric Grant and Mary Grant, both of Cardigan, Prince Edward Island. EC CARDIGAN FEED SERVICES LTD. Pursuant to section 5 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Cardigan Feed Services Ltd. of Cardigan, Prince Edward Island to acquire a land holding of approximately one hundred and sixty decimal eight (160.8) acres of land in Lot 40, Kings County and Lot 48, Queens County, Province of Prince Edward Island, being acquired from PigCo Genetics Inc. of Morell, Prince Edward Island. Further, Council noted that the said land holding, being Provincial Property Nos and , was previously identified for non-development use in accordance with section 2 of the Land Identification Regulations (EC606/95) made under the said Act. Identification continues to apply.

9 400 EC CARDIGAN FEED SERVICES LTD. Pursuant to section 5 and section 9 of the Prince Edward Island Lands Protection Act R.S.P.E.I. 1988, Cap. L-5 Council granted permission to Cardigan Feed Services Ltd. of Cardigan, Prince Edward Island to acquire a land holding of approximately nineteen decimal five (19.5) acres of land in Lot 53, Kings County, Province of Prince Edward Island, being acquired from Ployer Farms Ltd. of Martinvale, Prince Edward Island PROVIDED THAT the said real property is identified for non-development use pursuant to the Land Identification Regulations (EC606/95) made under the said Act. EC WALSH FARMS LIMITED (TO RESCIND) Council, having under consideration Order-in-Council EC of July 9, 2013, rescinded the said Order forthwith, thus rescinding permission for Walsh Farms Limited of Georgetown, Prince Edward Island to acquire a land holding of approximately eight (8) acres of land at Georgetown, Kings County, Province of Prince Edward Island, from John Walsh and Mary Lou Walsh, both of Georgetown, Prince Edward Island. EC PROPERTY NO , LOT 61, KINGS COUNTY IDENTIFICATION FOR NON-DEVELOPMENT USE AMENDMENT (TO RESCIND) Having received confirmation that subdivision of Provincial Property No has not occurred and on receipt of a request from current registered owners Christopher Clarke and Chantal Clarke, both of Edmonton, Alberta, Council hereby rescinds Order-in-Council EC dated June 2, 2009, thereby rescinding approval to amend the condition of non-development use on approximately eighty-five (85) acres of land in Lot 61, Kings County, formerly owned by Dennis Dyck and Kathleen Calligan, both of Summerside, Prince Edward Island.

10 401 EC PROVINCIAL COURT ACT JUSTICE OF THE PEACE APPOINTMENT Under authority of section 14 of the Provincial Court Act R.S.P.E.I. 1988, Cap. P-25, Council appointed Cindy A. Stewart of Charlottetown, Prince Edward Island, as a Justice of the Peace in and for the Counties of Prince, Queens and Kings in the Province of Prince Edward Island for the period August 21, 2013 to October 10, Further, Council ordered that should the said Cindy A. Stewart cease to be employed by the Province of Prince Edward Island in her present capacity with the Provincial Court, that her appointment as Justice of the Peace shall terminate coincident with the date her employment terminates.
