It is important that you review this entire package and either mail or drop off your documentation to our offices. PERSONAL INFORMATION /TERMS OF ENGAGEMENT AND T183 (pages 1-3) Please review, complete and sign the Terms of Engagement. Complete and sign a T183 for each taxpayer. DOCUMENT CHECKLIST (page 4) Complete the checklist. CANADA REVENUE AGENCY CONSENT FORM - T1013 (pages 5-6) Canada Revenue Agency will not discuss your tax information with us unless they have a signed consent form, Authorizing or Cancelling a Representative. I am enclosing two copies of the form. Both you and your spouse must each file a consent form. Please complete Section 1, sign and date the bottom of the form. FOREIGN REPORTING (pages 7-8) These reporting requirements are in respect of foreign assets owned after 1995 and the reporting deadlines vary. If you have any foreign assets such as shares of US companies, real estate, bank accounts etc., please read the attached foreign reporting schedule. Please contact me if you believe you or your business may have a filing concern. Please have each family member complete and sign the attached Foreign Reporting Declaration. If we do not receive a completed Foreign Reporting Declaration, we will prepare your return assuming that you have no reportable specified foreign property. Fees for our services will be at our standard hourly rates. We will bill you, after we complete the return(s), for time spent, plus out-of-pocket expenses. Invoices are due and payable upon receipt. Interest will be charged at the rate of 1.25% per month (15% per annum) on all accounts past due. Returns are subject to review by Canada Revenue Agency. In the event of any tax audit or request for additional information, Mark Feldstein & Associates will, upon request, represent you. Billing for such additional services is at our standard rates for the nature of the services performed. If the above sets forth your understanding of our engagement, please sign and date below. 10 FOREIGN REPORTING REQUIREMENTS STIFF PENALTIES 7. The following material is very technical. I have tried to simplify the tax rules for you. contact me for advice if you have any concerns about your reporting obligation. I recommend that you If you have a reporting obligation, failure to file may result in stiff penalties even if no income tax is payable. The penalties for failure to file may be $500 per month for the first 24 months ($12,000) or 5% of the total cost of the foreign property if more than 24 months. The penalties are more severe for gross negligence. Canadian residents must report their worldwide income on their income tax returns. Information returns regarding the ownership of foreign property must be filed annually, by the taxpayer s usual income tax filing due date. Specified Foreign Property The information return that will affect most taxpayers is the reporting requirement for Canadian tax residents who own, at any time in the tax year, specified foreign property with an aggregate cost in excess of $100,000. Please note that the lists below are not all inclusive, as they have been simplified. Specified foreign property of a taxpayer includes: - funds or intangible property held outside of Canada (ie: any money located outside of Canada) - tangible property situated outside of Canada - a share of the capital stock of a non-resident corporation (including shares of foreign public companies) - an interest in a non-resident trust - an interest in a partnership that owns or holds specified foreign property - an interest in, or right with respect to, an entity that is non- resident - a debt (eg. notes, bonds, debentures) owed to you by a non-resident - any property that is convertible into a specified foreign property. Specified foreign property of a taxpayer does not include: - personal-use property (e.g. a Florida condominium-only if it is used more than 50% for personal use, otherwise it would be considered as a specified foreign property) - RRSP's (Registered Retirement Savings Plans), RRIF's (Registered Retirement Income Funds), and RPP's (Registered Pension Plans) that contain foreign property - property that is used or held exclusively in the course of carrying on your active business - an interest in mutual funds registered in Canada (even if the fund holds foreign property). Signing the attached Terms of Engagement (pg. 1) signifies that you have disclosed all of your foreign properties or you are exempt from any foreign reporting requirements ( pg. 10) with Canada Revenue Agency. Other Foreign Reporting Requirements Special disclosure returns, with similar penalties, are required to be filed in the following circumstances: - A Canadian resident transfers or loans property to a non-resident trust or to a corporation that is a controlled foreign affiliate 1 of a trust. - A Canadian resident owns an interest in a foreign affiliate 2. - A Canadian resident receives a distribution of property from or becomes indebted to a non-resident inter-vivos trust. 1 A controlled foreign affiliate is a foreign affiliate that is controlled by the taxpayer, residents related to the taxpayer, or not more than four persons resident in Canada (who may not be related to the taxpayer). 2 A foreign affiliate of a taxpayer, is generally a non-resident corporation in which the taxpayer's equity is at least 1%, and the total equity percentages of the taxpayer and other related residents is at least 10%.
