8 ABSTRACT KSERC Order dated on petition OP 17/2010 in the matter of Introduction of Power Restriction to all HT&EHT Consumers including Bulk Supply to other Licensees and LT Consumers of the State- Compliance- Orders Issued. KSERC order dated on petition No. OP17/ Note No. KSEB/TRAC/ Power restriction/ dated of the Chief Engineer (Commercial &Tariff) ORDER Kerala State Electricity Regulatory Commission (KSERC) vide the order read as 1 st paper above has approved to introduce power restriction to all HT&EHT consumers including Bulk Supply to other Licensees and LT consumers of the State on energy consumption w.e.f as follows: (i) (ii) (iii) (iv) (v) (vi) (vii) Impose 10% restriction on energy consumption to consumers of all Licensees except domestic, street lighting, agriculture and LT-VI (D). 90% of the base average consumption from May-2009 to February-2010 may be fixed as quota based on the guidelines given in the order. The consumption above quota shall be billed at Rs 7.25 per unit or the applicable tariff, which ever is higher. Domestic consumers- restriction is imposed to domestic consumers for consumption above 300 units per month and consumption over 300 units per months shall also be charged at Rs 7.25 per unit. Other Licensees are directed to remit the revenue from excess consumption to KSEB promptly on a monthly basis. KSEB and all other licensees shall indicate quota, excess consumption and rates charged for excess consumption separately in the bills issued to the consumers. Commission will review the power position on and take suitable decision on restrictions. (viii) KSEB shall submit all supporting data for the review by Further, KSERC has also issued following guidelines for fixation of quota for power restrictions. (a) (b) The quota shall be 90% of base average consumption for categories such as HT-EHT, LT IV, LTVI (except LTVID), and LTVII. For domestic category 300kWh per month shall be the quota. For estimating the base average consumption, consumption for the months of May 2009 to February 2010 shall be used. Base average consumption for HT/EHT consumers shall be arrived by excluding nil consumption as well as abnormal consumption having 30% variation on the monthly average consumption. 8

9 (c) (d) (e) (f) (g) (h) New consumers who started operation from March 2010, the base average consumption shall be fixed as 250kWh/kVA of Contract Demand for HT consumers, 400kWh/kVA of Contract Demand for EHT consumers and 105kWh/kW of connected load for LT consumers. Existing LT consumers (prior to ) who did not have adequate consumption or nil consumption in any period between May 2009 and February 2010, the base average shall be worked out similar to the method followed for HT-EHT consumers. However, if such average is below 105 units/kw, the norm of 105 units/kw of connected load shall be applied and quota shall be fixed accordingly. Fuel Surcharge is not applicable to excess consumption at marginal rates. The Consumption over the quota (excess consumption) shall be billed at Rs.7.25/kWh or the applicable tariff, which ever is high. If any portion of excess consumption is billed at normal rates (for eg. LTVII (B) more than 500 units), fuel surcharge shall be applicable to such consumption. There shall be no restriction on maximum demand. The Licensees other than KSEB shall follow the same principle as above in fixing quota and for power restrictions. Additional income from consumers at marginal rates shall be transferred to KSEB promptly on a monthly basis. 3. Chief Engineer (Commercial & Tariff) vide the note read as reference-2 has placed the order of the Commission before the Board for approval for implementation. Chief Engineer has also placed the procedures to be followed for speedy implementation of the order of the Commission. 4. Having considered the recommendation of the Chief Engineer (Commercial & Tariff), Board here by orders to: (i) (ii) (iii) (iv) (v) Implement the KSERC order dated on petition No. OP 17/2010 on Introducing power restriction to all HT&EHT consumers including Bulk Supply to other Licensees and LT consumers of the State. Special Officer (Revenue) in coordination with Deputy Chief Engineer Commercial) and Director (IT) shall fix the quota of all HT-EHT consumers and that of licensees as per the guidelines issued by the Commission as detailed under para-2 above. The excess consumption shall be billed at Rs 7.25/unit as ordered by the Commission. The distribution section/ subdivision offices shall fix the quota of LT-II, LT-IV, LT-VI and LT- VII categories of consumers. The Executive Engineers of the respective divisions are entrusted to address any dispute raised by the consumers in the fixation of quota. The excess consumption above quota shall be billed at Rs 7.25/unit or the applicable tariff, which ever is higher. Deputy Chief Engineer (Commercial) shall issue necessary guidelines for fixation of quota for LT-II, LT-IV, LT-VI and LT-VII consumers and to issue necessary clarifications to field offices whenever necessary. Deputy Chief Engineer (Commercial) is authorized to issue necessary direction to all bulk consumers and other licensees to impose the restriction as ordered by the Commission. Deputy Chief Engineer (Commercial) shall monitor the implementation of the restriction by the Licensees and also on transfer of revenue collected for excess consumption by licensees from their consumers to KSEB on monthly basis as ordered by the Commission. 10 (vi) (vii) (viii) (ix) (x) Deputy Chief Engineer (TRAC) is authorized to issue necessary billing procedures for implementation of the restriction to the domestic consumers, other bi-monthly billed consumers and other categories. Also, Deputy Chief Engineer (TRAC) through Chief Engineer (Commercial &Tariff) shall take up further clarifications on the implementation of the order, further details / clarification before the Commission on the implementation of the restriction from time to time. Deputy Chief Engineer (TRAC) is also authorized to compile the details of the excess consumption and furnish the same to the Commission. Director (IT) shall make suitable modifications in the billing software ORUMA to raise the bills of excess consumption. All the distribution Chief Engineers / Deputy Chief Engineers shall ensure the proper implementation of the restriction and billing as ordered by the Commission and subsequent guidelines and procedures issued from the Board. All the section offices shall keep the account of the excess consumption separately for each category. Distribution Deputy Chief Engineers concerned shall compile the details of excess consumption at circle level and communicate the same to Deputy Chief Engineer (TRAC) on monthly basis on or before 15 th of the succeeding month with a copy to the Financial Advisor. Special Officer (Revenue) shall also account the excess consumption separately and provide the details to the Deputy Chief Engineer (TRAC) on monthly basis on or before 15 th of the succeeding month with a copy to the Financial Advisor. 11 KERALA STATE ELECTRICTY BOARD ABSTRACT Fuel Price Adjustment Charges on all Consumers and Bulk Consumers/ Other Licensees to recover the Additional Financial Liability for the period from April 2009 to September Order issued by KSERC on Petition No. OP 14/ Compliance- Orders Issued. KSERC order dated on Petition OP 14/ Note No. KSEB/TRAC/Fuel Surcharge/ dated of the Chief Engineer (Commercial & Tariff) ORDER KSEB vide the petition dated had filed a petition before the Kerala State Electricity Regulatory Commission (KSERC) to pass on the additional liability of Rs crore incurred on Generation and Power Purchase during the period from April 2009 to September-2009 over the amount approved by the Commission vide the order on ARR &ERC dated 19 th April 2009 for the year KSERC vide the order read as 1 st paper above has approved the additional liability Rs crore for the period from April to September-2009 as against the KSEB petition for Rs crore. Out of the approved amount of Rs crore, Commission has ordered to pass on Rs crore to the consumers and retained Rs 6.59 crore for want of information on manufactures specification of station heat rate for BDPP and KDPP. KSERC has further ordered to realize the approved additional liability of Rs crore from all consumers categories for their consumption from April to 25 paise per unit. Commission has further directed that, (a) (b) (c) (d) (e) Fuel Rs 0.25 per unit may be imposed on all consumers. However domestic consumers with consumption up to 20 units per month and connected load less than or equal to 500W are exempted from fuel surcharge. The fuel surcharge shall be effective for the consumption from 1 st April-2010 for next six months or till an amount of Rs crore is collected, whichever is earlier. Fuel surcharge shall not be applicable for the excess consumption above quota fixed for April and May-2010 and billed at marginal cost of Rs 7.25 per unit. However, excess consumption billed at normal tariff also shall be charged at surcharge of Rs 0.25 per unit. The licensees other than KSEB shall collect the fuel surcharge from the consumers and maintain separate accounts and properly transfer the amount on monthly basis to KSEB with details. KSEB shall provide the details of surcharge collected from each tariff category on a monthly basis within 15 days from close of each month before the Commission, so as to ascertain the total amount of fuel surcharge collected. 3. Chief Engineer (Commercial & Tariff) vide the note read as 2 nd paper above has placed the order of the Commission before the Board for approval for implementation. 12 collection and monitoring of the fuel surcharge as ordered by the Commission. 4. Having considered the recommendation of the Chief Engineer (Commercial & Tariff), Board here by orders to: (i) Implement the order of the KSERC dated on petition No. OP 14/2010 on introducing Fuel Price Adjustment charges on all consumers and bulk consumers/other licensees to recover the additional financial liability for the period from April 2009 to September (ii) All the Distribution field units, Special Officer Revenue (SOR) shall raise the invoice for fuel Rs 0.25 per unit for the consumption from 1 st April (iii) Director (IT) shall make necessary modifications in the ORUMA software to raise the fuel surcharge for LT consumers w.e.f (iv) Deputy Chief Engineer (Commercial) shall monitor the implementation of the Fuel surcharge by other Licensees and prompt payment of surcharge collected from their consumers to KSEB as ordered by the Commission. (v) (vi) (vii) (viii) Deputy Chief Engineer (TRAC) is authorized to issue necessary billing procedures and other instructions to the field offices and take up the matter with Board through Chief Engineer (Commercial & Tariff). Deputy Chief Engineer (TRAC) is further authorized to compile the details of the fuel surcharge billed from field offices and SOR and furnish the same to the Commission on or before 15 th of the succeeding month. All the distribution Chief Engineers / Deputy Chief Engineers shall ensure the implementation of the fuel surcharge and billing as ordered by the Commission and subsequent guidelines and procedures issued from the Board. All the section offices shall keep the account of the surcharge separately for each tariff category. Deputy Chief Engineers, Distribution circles concerned shall compile and communicate the details of fuel surcharge collected in each month to the Deputy Chief Engineer (TRAC) on monthly basis on or before 15 th of the succeeding month with a copy to the Financial Advisor. Note to Full Time Members No. DPC1/Acc-01/2008 dated ORDER Kerala State Electricity Licensing Board vide 1 st paper informed that in the meeting held on , KSELB had decided to insist that the field officers of KSEB shall attest each entry in the work register (address, connected load details etc) while furnishing the completion report by the contractors and directed for immediate implementation. Board having examined the matter decided not to implement this condition now, since all Sections are overloaded and understaffed and this may add to their workload and field officers were intimated accordingly. Subsequently Kerala State Electricity Licensing Board vide 5 th paper informed that certain modifications were made to the earlier decision taken by KSELB regarding implementation of work register and requested to take necessary action as per the new decision. Chief Engineer (Distribution South) vide 6 th paper reported that a meeting was convened by KSELB on to discuss the issue regarding maintaining work register by the electrical contractors. The meeting was chaired by the Principal Secretary, Power Department of Government. In the meeting, the KSE Board Chief Engineers opined that insisting bringing of the work register to the office for registration of service connections will cause difficulty to the consumers. The consumer may have to bring the contractor to the office and it is probable that the consumer will have to meet the contractor s travel expenses also. As KSE Board is now trying to give the connection on the same day of the application, the non-availability of contractor etc., may also delay the process. The demand for bringing the work register was raised by the contractor s representatives in order to avoid certain contractors simply signing the completion report without any involvement in the work. Chief Engineer (Distribution South) reported that on discussion it was decided that the following methodology can solve the problem without making any difficulty to the consumers and the Chief Engineer recommended that the Board shall implement these suggestions: 1. Each contractor will maintain a work register. He shall enter all the works done by him assigning each work a registration number which shall be entered in each of the completion reports he signs. 14

15 2. The Assistant Engineer shall note down this registration number while registering the service. If possible, this number shall be entered in the computer also while making registration, so that the print out of the work register registration number of the applications can be made available to the Electrical Inspector, if necessary. The Electrical Inspector and / or the Assistant Engineer can verify the register at any time. Board having examined the matter decided to implement the above directives. 17 KERALA STATE ELECTRICTY BOARD ABSTRACT Accounting of Employee cost, Repair and Maintenance Expenses, A&G Expenses, Interest and Finance Charges, Depreciation etc for the Generation, Transmission and Distribution separately Sanctioned - Orders Issued. (FM) No.1031/2010/ (KSEB/TRAC/TF-08) Dated: Thiruvananthapuram, Read: Note No. KSEB/ TRAC/TF-08/309 dated of the Chief Engineer (Commercial & Tariff) ORDER Kerala State Electricity Regulatory Commission (KSERC) while issuing orders on ARR&ERC for the previous years had seriously remarked that the employee cost of KSEB is the highest among the power utilities in India and also had directed to put up necessary proposal on reduction of employee cost through productivity linked incentive schemes. In this matter, the Chief Engineer (Commercial & Tariff) vide the note as read above had pointed out the following facts before the Board for consideration and favourable orders. (1) The employee cost of the Board is inclusive of the salary and benefits of the serving employees and also that of pensioners. About 45% of the employee cost of KSEB is for the pensionary claims. (2) Since Board is continuing as a single utility, the employee cost of KSEB is yet to be separated among Generation, Transmission and Distribution Sector and therefore the employee cost in KSEB includes the total cost of employees working at Generation, Transmission, and Distribution and at Corporate office. (3) Further about 40% of the total capital cost of the Board is being implemented by the distribution sector. As per the accounting practices, the cost of employees engaged in capital works in distribution sector is to be capitalized every year. Also, about 90% of the total pension disbursement is made through distribution ARU s due to the geographical proximity of distribution offices from the residence of the pensioners. (4) As per the present practices followed by the Board, the cost of employees engaged in capital nature of works in the distribution sectors are not accounted separately, but only a small amount is being capitalized every year on normative basis. Accordingly the employee cost reflected in the Annual Accounts and ARR is inclusive of the capital nature of works. But, in the regulatory regime, it is difficult to appraise the regulators and other stake holders on the raising revenue expenditure such as employee cost, R&M expenses, A&G expenses etc. without supporting facts, and different from prudent utility practices etc. (5) In the present cost plus tariff approach, it is always advantages to account all the costs associated with capital nature of works including employee costs, A&G expenses, interest and finance charges etc related to capital works as part of the capital cost due to the following reasons. (i) The power utilities can claim a post tax return on 15.5% on the 30% of the total capital investment made every year continuously for the entire life of the asset. 18 (ii) The utilities can claim of the total amount capitalized every year for a period of 12 years. (iii) The utilities can claim interest for the 70% of the capital investment made every year. (iv) The Repair and Maintenance expenses, A&G expense etc. of the power utilities also allowed by the regulators as a percentage of the Gross Fixed Assets, i.e., the total capital employed. (v) The efficiency of a power utility is also considered based on the total capital investment made every year. (6) As per the present regulatory regime, KSEB has to arrive the cost of electricity at Generation end including all the costs inclusive of cost of generation, power purchase, R&M cost, A&G expenses, employee cost, interest and finance charges, depreciation etc of the generation sector. But as per the present accounting system, only the fuel related expenses of BDPP and KDPP only accounted under cost of generation. (7) Similarly, in order to determine the transmission charges, KSEB has to account all the expenses of the Transmission functional unit separately, but as per the present accounting system, it is difficult to segregate the revenue expenses of the transmission sector separately. The employee cost, R&M expenses, A&G expenses, depreciation, interest and finance charges etc shown in the Annual Accounts is the total of generation, transmission, distribution and also for corporate offices. But it has to be done precisely to appraise the regulator convincingly. Having considered the recommendations of the Chief Engineer (Commercial & Tariff), Board hereby orders that from the year onwards to: (1) Account all the capital related expenses of Generation, Transmission and Distribution sector including employee cost, interest and finance charges etc separately from the year and capitalize every year. (2) Account all the revenue expenditure in Generation, Transmission and Distribution Sector such as employee cost, interest and finance charges, R&M expenses, A&G expenses, Depreciation etc, separately from the financial year onwards. (3) Account the pension disbursement made through Distribution ARU s and other offices separately from The salary and benefits of the serving employees may only shown under the head of employee cost. (4) The Financial Advisor to issue necessary instructions to all field ARU s and other offices to account all the expenses as per (1), (2) and (3) above for the year onwards. Along with the application, he shall give an undertaking in stamp paper worth Rs.50/- that he shall avail power supply from the incumbent Licensee as and when the incumbent Licensee is ready with the infrastructure for giving supply as service connection. 2. The incumbent Licensee, on verifying the details furnished by the applicant is satisfied that the request of the applicant is genuine, shall issue a NOC without delay, at any rate within a period of 30 days from the date of receipt of the application along with the undertaking. 3. If the Licensee is not satisfied or for any reason is unwilling to issue the NOC, he shall give a written reply to the applicant within 30 days detailing the grounds for the refusal. 4. In cases where the incumbent Licensee fails to issue any communication either granting or refusing NOC within 30 days as specified in clause (2) above, the applicant may presume that the Licensee has no objection and approach the adjacent Licensee for the connection with an affidavit stating the position. 5. If the incumbent Licensee refuses to issue the NOC, the applicant can approach the Kerala State Electricity Regulatory Commission by filing a petition on plain paper and the Commission shall, after hearing the applicant and the licensee pass appropriate orders. No fees will be required for filing the petition. 6. On getting the NOC from the incumbent Licensee the applicant may apply to the adjacent 26

27 Licensee for electric connection and the adjacent licensee shall give the connection in the usual manner in line with the regulations prevailing in their licensed area.
