4 Public Law Because of their activities, different companies, entities and projects require State-related services. The Firm has significant experience in this field, having acted as an advisor to both State and private parties in such cases and disputes. The areas in which legal services are offered include: Constitutional Law and Political Consultancy Representation in the exercise of constitutional rights, through the various mechanisms foreseen in the Constitution of the Republic adopted in Normative assessment services regarding regulations pending approval or already approved, to verify their constitutionality and legality, and development of strategies to be followed after regulatory changes. Administrative Law Legal representation for submitting petitions, securing authorizations, defence of rights, contestations or administrative appeals lodged before any public entity, in relation to various business activities. Public Procurement Consultancy services on public procurement processes, both in the pre-contractual stage, in order to ensure the signing of the contract with the State, as well as in the respective negotiation, and finally in the contractual or execution phase until the completion of the order. Tax Law Consultancy services for corporations aimed at developing tax strategies, representation in processes for determining taxes as well as recovery of taxes wrongly paid or paid in excess to the various tax authorities, be they national, local, special or customs. Projects associated with Real Estate Assets Consultancy services in the structuring of real estate projects, both in legal as well as economic, financial and planning matters through allies of the Firm, in order to generate returns for the client, owner of such assets. 7 Relevant Cases Taxes Since 2007 we have been able to recover values for income tax and VAT wrongly paid to the IRS by several national and international clients. Approximate amount of the cases: 13.5 million dollars. Contract Negotiations In 2013 we conducted a successful negotiation on behalf of a contractor to provide services for oil operators. Approximate Contract Amount: $ 48 million dollars. Extrajudicial dispute resolutions Since 2010 we have successfully provided consultancy services on processes for alternative dispute resolutions for the termination of private contracts. Approximate amount of the cases: 3.5 million dollars. State Contracts Since 2010 we have provided consultancy services for domestic and foreign companies and organizations regarding contractual and pre-contract processes with public institutions involved in the energy and infrastructure fields, for the provision of various services. Approximate value of the contracts and processes: 500 million dollars. Intellectual Property Since 2010 we have provided consultancy services regarding the design and implementation of intellectual property strategies (trademarks, patents and copyrights) of two malls in Quito, one of them the largest in the country. Real Estate Management Since 2010 we have developed real estate regularization processes for public and private entities, intervening approximately 3000 properties. Approximate amount of cases: 30 million dollars. Legal Consultancy Since 2009 we have provided consultancy services for projects in various public and private entities, including: Municipalty of Quito: Production incentives policy (2010). Department of Hydrocarbons: Legal and Administrative structuring ( ). Constitutional Court: Jurisprudential Law, Theoretical Notes ( ). Management of Natural Gas EP Petroecuador: Development of Regulatory Framework on natural gas (2012). Petroleum Law Since 2009, we have provided consultancy services to several operators of oil areas for their setup procedures in the country, for negotiating contracts with the State and for assisting them in matters pertaining to legal requirements at the public and private levels. Oil Services Between 2004 and 2013 we have provided legal services to major oil service companies for the structuring of projects and business alliances, either through companies or other corporate figures, participation in processes with the Ecuadorian government, intellectual property protection, and resolution of corporate, contractual and tax disputes. Commercial Projects Between 2010 and 2013 we have provided legal consultancy services (contractual, corporate and tax) to various business groups regarding the process of installation and expansion of their infrastructure.
