1 Discipline and Grievance Process 1. The ERBYB Discipline and Grievance Guidelines are based upon our desire to provide a fair and competitive environment for our players, and a positive sporting experience for the coaches, referees, families, and community members in attendance. All members in attendance at ERBYB activities are required to adhere to the Code of Conduct(s) as referenced by the ERBYB Coach, Player, and Parent Codes of Conduct (respectively). 2. Failure to adhere to the Code of Conduct, or the ERBYB By-Laws, can result in loss of access to ERBYB events, up to and including disbarment from all ERBYB programs. 3. The severity of the unsportsmanlike act will determine the severity of the resulting disciplinary action. Any ERBYB Board Member has the authority to convene an on-site disciplinary assessment using their best judgment, to administer appropriate disciplinary action to any player, coach, official, host, or spectator (as outlined below). Possible disciplinary actions may include but are not limited to: censure, disqualification, suspension for a definite or indefinite period of time, or expulsion from any or all ERBYB sponsored programs. Section 1. Acts of Disbarment Include: A. Physical attack on a referee or other tournament official or ERBYB Board member during a game or immediately following a game, played under the administration of the ERBYB. B. Player, coach, manager, or sponsor threatening a referee, tournament official, or ERBYB Board member. C. Any ERBYB Board member, referee, player, coach, manager, or sponsor fighting, using unsportsmanlike conduct, abusive tactics, or derogatory or unbecoming acts that are detrimental and not in the best interest of the league and tournament play. D. Destruction of property or the abuse of property. E. Except as otherwise provided, paying or receiving compensation on consideration of participation in ERBYB sponsored competition. This shall apply to a player, team, or sponsor. F. By knowingly competing with or against ineligible or suspended players. G. By participating in or permitting a fraud to be perpetuated. H. Competing under a false name. I. Failure to show up after entering a tournament unless reasonable advance notice is given. On-site Disciplinary Actions: Any disciplinary action administered on-site shall be subject to immediate review by the ERBYB Event Protest Committee (EPC). The EPC is composed of one representative from the host organization, one representative of the attending officials organization assigned to the event,
2 and one representative from the ERBYB. If a host member is not available, nor appropriate to the venue, then a second ERBYB Board member may act as the third member of the EPC. This committee will conduct an on-site hearing to determine if the disciplinary action is appropriate. All decisions of the EPC are in effect for the remainder of that specific event. The committee does not have the authority to issue any disciplinary action that shall exceed the length of that specific event. (Exception: If the disciplinary action occurred during the offending party s last game of the event, it will carry over to the next ERBYB event.) Any decision by the EPC may be appealed to the ERBYB Review Committee at the earliest possible date, as established in the Appeals Process below. The ERBYB member convening the EPC, must document the event, facts of the matter (names, date/times, witnesses, and objective statements on the sequence of events), the members participating in the EPC, and the EPCs decision. The ERBYB Board Chair will be immediately notified of the EPC s activity, and all notes will be presented as soon as possible to the ERBYB Board, to prepare the ERBYB Board for any appeal activity. Off-site Disciplinary Actions: The ERBYB reserves the right to issue disciplinary action for off- site misconduct, depending upon the frequency and severity of the offense. Additional disciplinary action may be taken after the completion of a formal hearing by the ERBYB Review Committee. ERBYB Review Committee: The ERBYB Board Chair will assign members to the ERBYB Review Committee following an event, for the purposes of assessing claims of misconduct, and rendering a judgment on behalf of the ERBYB Board. The ERBYB Review Committee will: Convene as assigned by the Board Chair to address claims and render disciplinary actions within the guidelines and timelines established Members of the ERBYB Review Committee should be Board Members not involved directly with the issue being assessed, nor the player/coach/family involved. The Board Chair will decide if additional members need to be assigned to the Review Committee in order to establish a quorum Decisions rendered by the ERBYB Review Committee are final, but may be appealed under the Appeal Guidelines. General Disciplinary Guidelines 1.The following procedures will be taken if a potential violation occurs: A. If during an event, an Event Protest Committee will be established by the presiding ERBYB Board Member; if off-site or pre/post scheduled event, the ERBYB Board Chair will select and convene the ERBYB Review Committee
3 B. All necessary witnesses will be contacted and asked to provide written documentation of the incident (i.e. player, coach, game official, tournament director, etc.) C. Upon review of the facts, and if necessary, a letter will be sent to the player with a statement of their suspension until the date of their hearing at the next ERBYB Board meeting. D. Player will be informed that failure to comply with the suspension will result in additional penalties for the individual/team. E. Individual will be informed that failure to attend the scheduled meeting will forfeit their right to appeal any actions taken by the ERBYB Board. 2. Should the ERBYB Board choose to suspend an individual, the Board Chair, Travel/House Coordinator, Board Secretary, player, team coach, and the player s parents/guardians will be sent a copy of the suspension letter. 3. If a suspension/probation is required: A. Motion and suspension/probation letter will include Acts of Disbarment. B. Letter will include details that govern any violations of suspension/probation and the length of penalty Appeals Process Procedure Section 1. Definition of Appealable Issue: An appealable issue shall be a complaint or dispute relative to: A. Any sanction imposed against a retained official or employee/contractor in violation of the ERBYB Program By-Laws, Rule Books, Directives, and Policies. B. Any act of disbarment. C. Any other acts of a team or individual member of the ERBYB program, which may require adverse action to be taken by any exectutive member of the ERBYB Board. Section 2. Appeal Policy: A. All stages of the appeal shall be in writing on appropriate forms or formats as supplied by the ERBYB, and no substitution therefore shall be utilized. B. In such writing, the appellant must specify on the appropriate form the specific relief he/she expects to obtain through use of the procedure.
4 C. Failure by the appellant to comply with all substantial procedural requirements of the appeal process procedure without just cause will terminate the right to further appeal. D. Failure of the ERBYB, without just cause, to comply with all substantial procedural requirements of the appeal procedure will, at the option of the appellant, advance the appellant to the next step in the appeal process. E. Failure of the ERBYB, without just cause, to comply with all substantial procedural requirements of the final step of the appeal procedure shall result in a decision in favor of the appellant. F. Timeliness of Appeals: Application for appeal must be registered with the Board, within 15 days of receipt of the originally imposed penalty decision.
5 Section 3. Appeal Procedure: First Step: Managed by the Appeals Committee (3 ERBYB Board members, as assigned by the Board Chair) Within 15 days after the occurrence or condition giving rise to appeal, the person or team affected must present the appeal in writing to the ERBYB Board (in person, via mail w/ postmark prior to the 15 day deadline, or electronically if coordinated in advance). Within 10 days of such presentation the Board shall give its reply in writing to the individual or team with respect to the appeal, or shall advise the appellant that additional time for such decision is needed in which case a decision must be given the appellant within 30 days. Second Step: Board Review / Hearing If a satisfactory resolution is not reached at the first step, the appellant may so indicate on the appeal process form and submit the appeal to the ERBYB Board within 15 days. Within 10 days of such presentation, the Board shall establish a hearing date at the next available Board meeting, or depending upon the severity of the event, establish a quick response meeting to hear the appeal with an established Board quorum. Decisions by the Board during Step 2 Hearings are final.
