Direct Staff to publish Notice of Business Licensing and Regulation Bylaw 2643, 2014 for a two week period prior to final adoption; OR D. Other. I I CHIEF ADMINISTRATIVE OFFICER S COMMENTS: PURPOSE: To bring forward for Council consideration, a business licensing and regulation bylaw that is intended to update and simplify language, make the content easier to interpret, educate, enforce and adjust fees based on the Consumer Price Index. The proposed bylaw will have specific and transparent regulations to promote responsible business operation #115072v1

2 Business Licensing & Regulation Bylaw Page 2 BACKGROUND: The existing Business Licensing Bylaw 1670, 1995 (Attachment A ) and Business Regulation Bylaw No. 2126, 2003 (Attachment B ), lacks clarity for several occupations and phrases. The proposed bylaw will provide additional definitions and further clarity for a number of businesses. DISCUSSION: The proposed bylaw includes revised definitions and licensing categories. This will enable staff to better track and communicate the type of resident and non resident businesses with a business licence in the City of Pitt Meadows. This information is helpful to both Development Services and Economic Development for tracking purposes, and is beneficial to Economic Development Staff when assisting businesses seeking to locate or expand within Pitt Meadows. Operating Without a Business Licence The current bylaw does not provide for an offence, to a property owner, for allowing a person to carry on, maintain or operate a business without a valid and subsisting licence. The proposed Business Licensing and Regulation Bylaw No. 2643, 2014 (Attachment C ) Section (b) no person shall suffer, permit or allow a person to carry on, maintain or operate a business without a valid and subsisting Licence, will enable staff to address not only the business owner but the property owner, in the event a business licence application is not forthcoming after all reasonable efforts have been exhausted. Consumer Price Index Adiustment The current bylaw does not include an annual adjustment to the licence fee based on the Consumer Price Index as established by Statistics Canada. The Consumer Price Index (CPI) is an indicator of changes in consumer prices experienced by Canadians. It is obtained by comparing over time, the cost of a fixed basket of goods and services purchased by consumers. Since the basket contains goods and services of unchanging or equivalent quantity and quality, the index reflects only pure price change. The propose bylaw, section does include this annual adjustment. Licence Fee Reduction Date Staff is routinely asked by customers why August 1st is the designated date for a fifty percent (50%) reduction of licence fee. Section of the proposed bylaw reduces the business licence fee by fifty percent after the day of June in any calendar year. This would reduce the negative feedback and resistance to the licence fee payment. th #115072v1

3 Business Licensing & Regulation Bylaw Page 3 Licence Suspension Existing licensing does not allow the applicant to challenge the refusal, suspension or cancellation of a business Licence. The proposed Section gives the applicant ten (10) business days to challenge the refusal, suspension or cancellation by notifying the Licence Inspector. The subsequent Section outlines the Licence Inspectors role to refer the matter to Council. Prenatal Alcohol Exposure Warning The existing bylaw does not include a requirement to post signs warning of prenatal alcohol exposure. The proposed bylaw Section requires all licenced premises and u-brews to post signs, (Schedule D ) warning of prenatal alcohol exposure visible from all locations where the sale or dispensing of alcoholic beverage takes place; signs conspicuously displayed in both the male and female washrooms located within the premise and on all menus. Shark Fin Ban At the December 18, 2012 Regular Meeting, Council directed Staff to ban the sale of shark fins and associated products. The proposed bylaw Section 4.15 includes the ban of the possession, trade, sell or distribution by any means, of shark fins or their derivative products. In 2012, a number of B.C. cities adopted bylaws prohibiting shark fin. Examples include Port Moody, City of North Vancouver, Maple Ridge, Coquitlam, New Westminster, White Rock, Abbotsford and Nanaimo. North American Industry Classification System Staff consulted with and received input from Economic Development and the Finance Department in the creation of this bylaw. Economic Development has suggested licensing categories and to incorporate the North American Industry Classification System (NAICS) Codes to classify the types of businesses. NAICS codes are used by BC Statistics, Statistics Canada and are also used in a variety of business databases to allow for the easy comparison of business data. (ie. community to community, province to province). The current system used by the department to classify business types does not support the sub category requirements of the NAICS codes, so while Staff supports this initiative in the future, Staff cannot implement these codes at this time. Public Notification Prior to final adoption of the proposed bylaw, Council may direct staff to place an advertisement in the local newspaper advising that anyone affected by the proposed Business Licensing and Regulation Bylaw No. 2643, 2014 may provide comments to the City as per Section 59(2) of the Community Charter (Attachment E ) #115072v1

4 Business Licensinci & Reciulation Bylaw Pacie4 SUMMARY/CONCLUSION: Staff is recommending that Council give first, second and third readings to the proposed Business Licensing and Regulation Bylaw No. 2643, 2014 and the proposed Bylaw Notice Enforcement Amendment Bylaw No. 2644, Implementation of the proposed bylaw will improve the application of business licensing regulations and provide greater clarity with respect to licensing and enforcement requirements. The amending bylaws have been consolidated with the original bylaws for convenience only. 6 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No. and amendments A Bylaw to Licence and Regulate the Carrying on of Businesses and to Fix, Impose and Provide for the Collection of Licence Fees and the Granting, Issuing and Transferring of Licences. WHEREAS Division 1 of Part 11 of the MunicipalAct, R.S.B.C. 1979, c.290, empowers Council to require an owner or operator of a business to hold a valid and subsisting licence for the carrying on of such business, to fix and impose licence fees for licences, and provide for the collection of licence fees and the granting, issuing and transferring of licences; NOW THEREFORE the Council of The Corporation of the City of Pitt Meadows, in open meeting assembled, ENACTS AS FOLLOWS: 1. This Bylaw may be cited as the Business Licence Bylaw No. 1670, Repeal 2. Bylaw No. 1655, cited as the Business Licence Bylaw is hereby repealed. Definitions 3. In this Bylaw Act means the Municipal Act; business means carrying on a commercial or industrial undertaking of any kind or nature, or the providing of professional, personal or other services for the purpose of gain or profit, but does not include an activity carried on by the government, its agencies, or governmentowned corporations; Council means the Municipal Council of the City of Pitt Meadows; City means the City of Pitt Meadows; (Bylaw 2401, 2008) licence holder means a person who holds a valid licence issued under this Bylaw; Licence Inspector means the person from time to time duly appointed by resolution of Council as Licence Inspector of the City for the time being, and includes any acting or Assistant Inspector or Inspector under the jurisdiction of the Licence Inspector; Medical Health Officer means the person appointed under the Health Act as such and includes a Public Health Inspector; for the City non-resident business means a business, other than a resident business, carried on in the City or with respect to which any work or services is performed in the City; person includes a Corporation, Partnership or Party v5#26673v6

Exemptions resident business means a business carried on, in or from premises within the City uspecial event means all outdoor events or gatherings where attendance is likely to exceed 200 people, or events proposed to use public properties such as parks or roads, including but not limited to airport events, parades, fairs or concerts. (Bylaw 2401, 2008) 4. (1) A licence is not required under this Bylaw (a) according to section 499 of the Act for the following non-resident businesses: (i) commercial travellers offering for sale or selling merchandise to merchants for resale by them in the ordinary course of their businesses; (ii) owners or operators of carriers other than taxi cabs who either pick up passengers or chattels in the City for discharging or delivery outside the City, or discharge or deliver in the City passengers or chattels picked up outside the City, or both, unless the City forms part of a trading area designed for carriers under section 511 of the Act; (iii) (iv) (v) (vi) owners or operators of taxi cabs who only discharge passengers in the City unless the City forms part of a trading area designated for taxicabs under section 511 of the Act; owners or operators of retail businesses who only deliver commodities sold by them in the ordinary course of business and pick up commodities being returned or exchanged; a wholesaler, manufacturer or processor who is only in the business of offering for sale or selling his own merchandise and delivering it in his own vehicle to merchants for resale by them in the ordinary course of their businesses; and a person practicing a profession governed by a special Act unless that person regularly and generally carries on business in the City; (b) according to section 512 of the Act, for (i) (ii) a performance, concert, exhibition or entertainment the entire proceeds of which, above actual expenses, are devoted to a charitable purpose; a performance, concert, exhibition, entertainment or concession which is held in a licensed theatre or other licensed place; (iii) the business of letting or renting rooms where not more than two (2) rooms are available for letting or renting in rooming houses or boarding houses; v5#26673v6

(c) (d) according to section 408 of the Act, for the business of a telephone, electric light, electric power, water, gas or closed-circuit television service situated within the City. for a special event that is a community event sponsored by the City, the School District No. 42, the Pitt Meadows Historical Society or the Ridge Meadows Parks and Recreation Commission. (Bylaw 2401, 2008) Licences (2) No provisions of this Bylaw shall be construed so as to provide any exemptions other than those set out in section 4(1) and in particular, any business that is not otherwise exempt from the requirement for a business licence under this Bylaw shall not be exempt by reason only that it provides services to a non-profit organization or society. 5. (1) No person shall carry on any business within the City unless a valid and subsisting licence, including a full licence, a conditional licence, or a special events licence, has been issued for that business or event pursuant to the provisions of this bylaw; (Bylaw 2401, 2008) (2) A full licence holder shall renew the licence prior to the beginning of each licensing period as long as such business is being carried out; (Bylaw 2401, 2008) (3) A conditional licence holder may only continue to hold or apply for a full licence in accordance with the terms and conditions stated in the conditional licence; (Bylaw 2401, 2008) (4) No person shall carry on any special event within the City unless a valid and subsisting special event licence has been issued for that special event pursuant to the provisions of this bylaw. (Bylaw 2401, 2008) 6. (1) Businesses in the City are classified in accordance with Schedule A to this Bylaw. (2) Subject to an appeal to Council, the Licence Inspector shall determine the classification applicable to any business. 7. For the purpose of this Bylaw, where business is carried on, in or from more than one premise in the City, the business carried on, in or from each premise shall be deemed to be a separate business. 8. Where more than one business, as classified in Schedule A is carried on at one premise, each business shall be deemed a separate business and a business licence shall be required for each business. 9. The Director of Operations and Development Services or their designate may establish an application form for the collection of business information and fees. An applicant for issuance of a business licence shall make application to the Licence Inspector on the prescribed form. The application form shall be signed by the owner/operator of the business or their duly authorized agent provided, however in the case of partnerships or multiple owners, any one of such partners or owners may apply and such partner or owner applying shall be deemed the duly authorized agent of all the partners or owners. Every applicant for a licence shall pay to the City at the time of application thereof the proper licence fee as set out in Schedule A and no licence shall be issued until payment of such fee is made. 11. Upon receipt of an application for a licence, the Licence Inspector shall, where applicable, obtain recommendations regarding its approval from the Building Inspector, Fire and Health Departments, the R.C.M.P., and the Council. For the purposes of public safety, and upon the recommendation of the R.C.M.P., certain business licence applicants may be required to provide to the R.C.M.P. a Criminal Record Search, the fee for which shall be borne by the applicant for such business licence. (Bylaw No. 1768) 12. The Licence Inspector is hereby delegated power to grant a licence when satisfied that the applicant has complied with the requirements of the Bylaws of the City regulating buildings, roads (2401, 2008), zoning, health, sanitation and business. In cases where the Licence Inspector is not satisfied that the applicant has complied with the requirements of the aforementioned Bylaws, the Licence Inspector may refuse to grant a licence. (Bylaw 2401, 2008) 13. Every licence issued pursuant to the provisions of this Bylaw shall be made out in duplicate, with additional copies as required. One copy of such licence shall be given to the person licensed and such person shall post the same and keep the same posted in a conspicuous place on the premises stipulated therein, or on the thing or article in respect to which the licence was issued. 14. The Council may, upon the affirmative vote of at least two-thirds of all the members, refuse in any particular case to grant the request of an applicant for licence, but the granting or renewal of a licence shall not be unreasonably refused. 15. The Licence Inspector, or any Peace Officer or Medical Health Officer is hereby authorized to enter at any reasonable time or times, any house, place, premises, vehicle or other place in respect of which a licence has been granted pursuant to the provisions of this Bylaw to ascertain whether the provisions of this Bylaw are being obeyed. 16. The operation of every towing with storage business, every salvage yard or junk yard business and every used auto and truck parts business and/or the dismantling of motor vehicles, with or without sale of second-hand parts shall be subject to the following requirements: (a) (b) (c) all such premises shall be kept and maintained in a clean, orderly, uncluttered and unobstructed condition; any fence on the premises shall be kept painted and in good and sufficient repair; no by-products or materials or waste of such business shall be burned on the premises except within a furnace or incinerator designed to trap fly ash and to contain the whole of the fire; advertising or illustrating in the form of words, pictures, signs or by any other means whatsoever is prohibited on such fence. 17. The operation of every second-hand dealer shall be subject to the following requirements: (a) all business operations shall be carried on within an enclosed building; v5#26673v6-22 -

10 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No and amendments Page 5 (b) all goods, wares, merchandise, materials and chattels of the business shall be stored and displayed within such enclosed building and no such materials shall be kept, stored or displayed outside of such building. Licences Cont d. 18. The operations of every automotive towing and storage business shall be subject to the following requirements: (a) (b) (c) (d) no vehicle shall be dismantled, wrecked, parts removed therefrom, or repaired on the premises; (Bylaw No. 2143) no retail sale of vehicles or of any part or parts thereof shall be permitted on the premises; not more than one hundred (100) vehicles shall be permitted on the premises at any one time; no advertising or illustrating on the fences or walls of buildings. The operations of every agri-tourism business shall be subject to the requirements of the Agricultural Land Commission s and the City of Pitt Meadows Agri-tourism policies and applicable land use regulations: 1. The underlying purpose of allowing any development of agri-tourism facilities and operations is to contribute to the preservation of the agricultural character of the farming area of Pitt Meadows contained in the ALR; 2. Where required by the Chief Financial Officer prior to the issuance of a business license, proponents may be required to undertake a public neighbourhood consultation process to identify issues and concerns related to impacts on adjacent agricultural lands, farming operations and family lifestyle. A minimum radius for consultation is 300m; 3. Proponents of agri-tourism related projects may be required by the Municipality to carry out appropriate technical studies to indicate that the site is physically and aesthetically appropriate for such use and is subject to review of the impacts on surrounding farm uses; 4. Agri-tourism operations that provide and promote educational programs about agricultural pursuits and agri-enterprises are supported. Farm tours that encourage and assist in the development of educational tours for the general public to learn about various aspects of farming are supported; 5. Direct agricultural sales such as u-pick, roadside stands and farmers markets are supported; 6. Hospitality food, beverage, meetings, fairs, events, tours, groups that are accessory to and promote farm products grown on the farm such as summer farm gate stands, food concessions, municipally licenced roadside stands located on private property and in portable vendors and tents are considered acceptable provided that adequate restroom facilities, waste receptacles, etc. are available for visitors to use during their stay at the farm; 7. Agri-tourism businesses that develop a parking area must provide landscape screening of the parking area from adjacent properties in accordance with the LRC s requirements v5#26673v6

11 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No. J.ZQ and amendments Page 6 Provisions of off-street parking shall be in accordance with Land Use Bylaw No standards; Licences Cont d. 8. Applicants must coordinate with other agencies i.e.: Health, Water, Land & Air Protection, Fisheries, and Waste Management etc.; 9. Examples of agri-tourism activities that are considered appropriate under this section of the regulation, provided all conditions are met, include, but are not limited to: Agricultural heritage exhibit; Bed & Breakfast operations; Farm tours and farm demonstrations; Direct farm sales of products grown on the farm; Horse riding including cattle drive activities; Horse or other livestock shows; Hay, tractor and sleight rides; Farm picnics; Farm related educational activities including cooking classes using farm products from the farm; Seasonal promotional events (e.g. harvest and Christmas fairs and activities); Special promotional events (e.g. private or public special occasion events for the promotion of farm products; Charity fund-raising events where farm products from the farm are offered for sale or by contribution and the majority of proceeds are donated to a registered charity; Catered food and beverage service special events where farm products from the farm are promoted, but not a service requiring the use of a permanent commercial kitchen; Corn mazes; Fishing (stocked pond); Garden tours; Cattle penning v5#26673v6

12 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No. and amendments Page 7 Note: Nothing in this Policy is to be interpreted as relieving an owner, an applicant or an Approving Officer from complying with any other enactment, bylaw or decision of a responsible authority that may apply, include zoning, subdivision and any other legislation. Agricultural Land Commission Regulations: Notwithstanding any other provisions of this Policy, all land within the Agricultural Land Reserve, except that are exempted under the Agricultural Land Commission Act, is subject to the provisions of the Agricultural Land Commission regulations thereto, and orders of the Agricultural Land Commission thereby not permitting the subdivision of land and the development of new non-farm uses unless approved by the Agricultural Land Reserve. REFERENCE: Agricultural Land Reserve Use, Subdivision and Procedure Regulation (BC Reg.171/2002), the Regulation. Section 2(2)(e) and Section 1(1) Section 2(2) The following activities are designated as farm use for the purposes of the Act and may be regulated but must not be prohibited by any local government bylaw except a bylaw under Section 917 of the Local Government Act: (e) agri-tourism activities, other than accommodation, on land that is classified as a farm under the Assessment Ac1 if the use is temporary and seasonal, and promotes or markets farm products grown, raised or processed on the farm Section 1(1) agri-tourism means a tourist activity; seivice or facility accessory to land that is classified as a farm under the Assessment Act; INTERPRETATION: farm product means a commodity that is produced from a farm use as defined in the Act or designated by this regulation Subject to the conditions in Section 2(2)(e) of the Regulation, agri-tourism activities, (other than agri-tourism accommodation) are designated by this regulation as farm uses, and as such, may not be prohibited by a local government bylaw, except a farm bylaw approved by the Minister of Agricultural, Food and Fisheries under Section 917 of the Local Government Act. This permitted farm activity is in addition to general farm uses permitted under the Act. The Regulation permits temporary and seasonal agri-tourism activities in the ALR provided the land is assessed as farm under the Assessment Act and provided the activity promotes or markets farm products produced on that farm. These activities are accessory and, at the same time, related to the principle use of the farm or ranch and must promote or market farm products from the farm or ranch. This use is permitted only if the property is assessed as farm and if the assessment changes, this use is no longer permitted. The farm may be comprised of one or several parcels of land owned or operated by a farmer as a farm business. This section does not include agri-tourism accommodation which is regulated under Section 3(1)(a) of the Regulation and may be prohibited by a local bylaw. 13 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No. J.ZQ and amendments Page 8 There is no building threshold area stipulated for these uses in the Regulation. A local government may regulate these uses, for example by setting hours of operation, a maximum building area or maximum site coverage, but may not prohibit the uses as they are designated farm uses under the Act. The local bylaws may further define temporary and seasonal and additional local government requirements must also be met. However in all cases the regulation of the use by local government must be reasonable and not prohibitive. Farm retail sales are regulated separately under Section 2(2)(a) of the Regulation and may be permitted if the specified conditions are met. See Commission Policy Activities Designated as Farm Use: Farm Retail Sales in the ALR. Agri-tourism uses that do not meet the conditions established in the regulation, for example, uses that are not taking place on land assessed as farm are not temporary and seasonal, and do not promote or market farm products from the farm require application to and approval from the Commission. TERMS: Temporary means a use or activity in a facility or area that is established and used on a limited time basis for agri-tourism activities. If a building or structure is required for this use, temporary use of the building or structure means a use for agri-tourism for less than 12 months of the year. The building or structure may be used for other permitted uses during the course of, or for the remainder of the year. Seasonal means a use or activity in a facility or area for less than 12 months of the year and must be related to a growing season or production cycle. i.e. summer and fall or any combination of two seasons of the year - additional portions may be permitted. 19. (1) For the purpose of this Subsection, operator shall mean any person who is a proprietor, lessee, manager, or employee, or other person who otherwise carries on the business of keeping a billiard hall. (2) No person shall be the operator of a billiard hall unless he/she is 19 years of age or older. (3) An operator of a billiard hall shall not employ any person under the age of 16 years old to work in a billiard hall, provided that any person employed under the age of 19 years of age shall not be involved in the preparing or serving of alcoholic beverages. (4) A billiard hall shall have an operator on duty at all times while the billiard hail is open for business and the operator shall supervise, control and be responsible for the activities on the premises. (5) An operator of a billiard hall shall not permit or suffer to permit any person to remain in such billiard hail between the hours of 12:01 a.m. and 7:00 am., Sunday through Friday, or between the hours of 2:00 a.m. and 7:00 am., Saturday and Sunday. (6) An operator shall not permit or suffer to permit anyone under 18 years of age to remain in the billiard hall from 8:00 am. to 3:00 p.m., Monday through Friday, on regular school days, unless accompanied by a parent or guardian. (7) An operator of a billiard hail shall not permit or suffer to permit v5#26673v6

14 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No and amendments Page 9 (a) (b) an intoxicated person on the premises; the consumption of alcoholic beverages on the premises when the premises are not licensed for consumption pursuant to the Liquor Control and Licensing Act; (c) contraventions of the Criminal Code and the Narcotics Control Act and amendments thereto; (d) swearing, or the use of offensive language, or any indecent or immoral act. (8) For the purposes of this Subsection, an operator of a billiard hall shall be deemed to have permitted or suffered to permit any of the activities in subsection (7) if they occur and the operator does not take immediate remedial action. (9) An operator may request any person found on the premises and contravening this subsection to immediately leave the premises. (10) Every operator of a billiard hall shall keep the premises well lit and clean and shall keep the windows uncovered in a manner so as to present a clear view of the interior of the premises. (11) Every operator of a billiard hail shall post, in a conspicuous place near the pool tables, at least two legible copies of a summary of the rules of conduct for customers and spectators, including those rules contained in this Bylaw. (12) An operator shall not permit or suffer to permit (a) any gambling game whatsoever, or any other game or device of chance to be played for money, cheques or devices representing money; or (b) have, keep or operate any amusement machine, as defined in the Arcade Prohibition Bylaw, or any machine or device for gambling or for playing for money, tokens or prizes, or results of any nature or kind whatsoever. 20. No holder of a licence shall conduct his/her business in a manner, perform a service in a manner, or sell, offer for sale or display for sale or distribute to a person actually or apparently under the age of 16 years anything that may be harmful or dangerous to the health or safety of a person actually or apparently under the age of 16 years. Rates and Licence Periods 21. (1) All licences granted under this Bylaw shall be for one year and terminate on the 31st day of December in any year. (2) Licence fees prescribed in Schedule A shall be reduced by one-half in respect of a person who becomes liable to be licensed after the 31st day of July in any one year. (3) An administrative fee in the amount of 25% of the applicable licence fees to a maximum of $50.00 shall be applied to the renewal of all business licences paid on or after March 1st of the year. (Bylaw 2401, 2008 and 2436, 2009) (4) The period for a licence for a circus, menagerie, horse/pony show, dog show, itinerant, show or entertainment when held elsewhere than in a licensed theatre or other licensed place, shall be for 1 (one) day v5#26673v6

(6) Any business not otherwise provided for in Schedule UAfl shall be categorized as not enumerated and shall pay an annual fee of $ (2404, 2008) Security 22. No licence shall be granted to any person for the purpose of holding or exhibiting any circus or menagerie, or holding any show or carnival using Ferris-wheels, merry-go-rounds or other similar devices until such person has provided and shown proof of insurance to the satisfaction of the Chief Financial Officer or their designate in the amount of Ten Million Dollars ($10,000,000.00) all inclusive for bodily injury or property damage per occurrence, and has furnished to the Chief Financial Officer or their designate, a certificate that such insurance indemnifies the City against all claims whatsoever which may at any time thereafter be made against the City by holding or exhibiting of such circus, menagerie, show or carnival. Change in Business 23. (1) Any business with a valid business licence may, at any time during a licence year, and for each occurrence, apply to: (a) (b) relocate from one location to another location within the City upon applying for, paying for and meeting any requirements for having a new business licence issued by the City, (2436, 2009) change the name of the business upon payment of a $30.00 administration fee, provided that, for corporations, a true copy of the name change certificate issued by the Company Office (Victoria) must accompany the name change request. (2404, 2009) (2) No person to whom a licence has been granted under the provisions of this Bylaw shall change the location of the premises in which he carried on the business without first having applied to the Licence Inspector in writing to have the licence altered in respect to the location of the premises set out therein, and any person carrying on business at premises other than the premises specified in the licence, commits an offense. Suspension 24. The Licence Inspector may suspend, for such period as he may determine, any licence if the holder of the licence (a) (b) is convicted of an offense indictable in Canada; is convicted of an offense under a Municipal Bylaw or Statute of the Province in respect of the business for which they are licensed or with respect to the premises named in their licence; v5#26673v6-28 -

16 BUSINESS LICENCE BYLAW Consolidated Copy - Bylaw No. J.ZQ and amendments Page 11 (c) (d) has, in the opinion of the Licence Inspector, been guilty of such gross misconduct in respect of the business or with respect to the premises named in their licence as to warrant the suspension of their licence; has ceased to meet the lawful requirements to carry on the business for which they are licensed or with respect to the premises named in their licence; (e) has, in the opinion of the Licence Inspector, conducted their business in a manner, performed a service in a manner, or sold, offered for sale, displayed for sale or distributed to a person actually or apparently under the age of 16 years anything, that may be harmful or dangerous to the health or safety of a person actually or apparently under the age of 16 years. 25. Any person whose licence has been suspended under section 24 of this Bylaw may appeal to the Council and upon such appeal the Council may confirm or may set aside such suspensions on such terms it thinks fit. 26. The Council may revoke a licence for reasonable cause after giving notice to the licensee and after giving the licensee an opportunity to be heard, but such notice and opportunity to be heard is not required in respect of the licensee who by reasonable efforts cannot be found. Door-to-Door Sales 27. (1) Except for representatives approved by Council as charitable organizations, no person in the City shall call at any residence between the hours of 6:00 P.M. and 8:00 A.M. for the purpose of selling, soliciting or taking orders for goods, materials, publications or services of any kind unless a previous appointment has been made for such call. Remedies (2) No person shall sell, or offer for sale, any book, magazine, or other periodical other than a newspaper on any street in the City. This restriction shall not apply to the operator of any news stand. (3) If applicable under Part 1.1 of the Consumer Protection Act, direct sellers must register with the Registrar of Direct Sellers and show proof of Licence. 28. Notwithstanding anything herein and before contained, the amount of every licence fee payable by any person under the provisions of this Bylaw shall be a debt due by such person to the City of Pitt Meadows, recoverable with costs in any court of competent jurisdiction. 29. Any person contravening any provisions of this Bylaw commits an offense and is punishable in accordance with the Offence Act, R.S.B.C c v5#26673v6

In this Bylaw, Cabaret Business means the operation of an entertainment business comprising the serving of alcoholic beverages and the provision of live or recorded music for dancing, in premises licensed under the Liquor Control and Licensing Act; 3. The operator of every cabaret business shall comply with the following regulations: a. The seating capacity of a cabaret business shall not exceed 350 seats; b. A dance floor comprising at least 20 per cent of the gross floor area of the cabaret premises, shall be provided for patrons of the business; (Bylaw No. 2535) c. Live or recorded musical entertainment shall be provided at all times that the cabaret premises are open for business; (Bylaw No. 2535) d. The price of alcoholic beverages served in a cabaret business shall not be changed more than once in any calendar month; f. 25 CITY OF PITT MEADOWS ATTACHMENT C BUSINESS LICENSING AND REGULATION BYLAW NO. 2643, 2014 A Bylaw Respecting the Granting of Licences and Regulating of Businesses within the City of Pitt Meadows. WHEREAS Council may, pursuant to the provisions contained in the Community Charter, regulate in relation to business; AND WHEREAS Council in regulating under the Community Charter, Council may provide for a system of licences, permits or approvals; AND WHEREAS Council may, pursuant to the Community Charter, delegate its powers, duties and functions to an officer or employee of the City, which delegation may in the authority to suspend a business licence; AND WHEREAS Council considers it in the public interest to regulate and licence businesses within the City; AND WHEREAS Council has given notice of its intention to adopt this bylaw by placing advertisements in the local newspaper, and has provided an opportunity for persons who consider they are affected to make representations to Council; NOW, THEREFORE, Council of the City of Pitt Meadows in open meeting assembled enacts as follows: PART I - CITATION 1.1 The Bylaw may be cited as City of Pitt Meadows Business Licensing and Regulation Bylaw No. 2643, PART 2-INTERPRETATION 2.1 In this bylaw the following words, terms, and phrases, wherever they occur in this bylaw, have the following meanings assigned to them: ACUPUNCTURIST means a person who pierces any part of a client s body with needles as a means of treating disease or pain, and who holds a valid licence issued by the College of Traditional Chinese Medicine Practitioners and Acupuncturists of British Columbia. AMUSEMENT ARCADE means the use of a building or portion of a building for the operation of amusement machines, for which a coin or token must be inserted, or an entry fee or membership fee is charged #115073v1

BUY includes purchase, barter, deal in, take in receive on consignment. exchange, take in part payment, or CABARET means the operation of an entertainment business comprising the serving of alcoholic beverages and the provision of live or recorded music for dancing, in premises licenced under the Liquor Control and Licensing Act. CARNIVAL means an itinerant exhibition, show or production temporarily located in the City, which offers to the public amusement rides, circus performances, games of skill or chance, or other similar entertainment. CANVASSER means any person who canvasses or solicits business within the City from cards or samples, or in any other manner whatsoever, takes orders for works or services or for the sale of any goods or any article or thing for immediate or future delivery, or for the purpose of promoting any business. CITY means the lands within the municipal boundaries of the City of Pitt Meadows, or the Corporation of the City of Pitt Meadows, as the context requires. COMMUNITY CARE means a business licensed or required to be licensed under the Community Care and Assisted Living Act. CONTRACTOR includes any person who undertakes to do or perform any construction, building, carpentry, plastering, lathing, shingling, or concrete work, or any other construction work or service for a fee, except where a licence fee for other work or service is specifically imposed elsewhere in the bylaw shall not include a land developer. CONVENIENCE STORE means a use devoted to the retail sale of groceries, perishable items, household items, domestic supplies, convenience goods, and related accessory uses. COUNCIL means the Municipal Council of the City. DAYCARE means the provision of care of children in a home environment, licences for this use in accordance with the Community Care and Assisted Living Act, and includes group childcare, family childcare, in-home multi-age childcare and preschool as defined under the Child Care Licensing Regulation, and not to exceed a maximum of eight (8) children in care O73v1

DOG means any dog of the canine species. DOG DAYCARE means premises for the provision of services to dogs such as canine daycare for all or part of a day, obedience classes, training, grooming, and behaviour counselling, but not overnight boarding of dogs. FARM PRODUCE means berries, fruits, vegetables, honey, eggs, fresh cut flowers, live fowl, live poultry, bedding plants, seeds, and trees commonly known as Christmas Trees sold only during the Christmas Season, bulbs and similar products, live shrubs or trees grown or produced from seed, seedlings, or cuttings on the individual farm on which the sale is taking place; but excluding dressed fowl or poultry and butchered meat. FARMERS MARKET means the carrying on of a business that organizes a group of vendors to gather in a temporary, open-air market located outdoors for the purpose of selling to the public. FINANCIAL INSTITUTIONS means a bank, credit union, trust company or other similar business that, among other things, accepts deposits, invests money, or lends money. FITNESS CENTRE means any premises that provide patrons the opportunity to perform physical activity for a fee and includes recreational clubs, fitness centres, hand ball courts, squash courts, health clubs, rock climbing facilities, batting cages and gymnasiums. FOOD PRIMARY LICENCE means a Food Primary Licence issued pursuant to the Liquor Control and Licensing Act. HOME OCCUPATION means a business accessory to the use of a dwelling unit or to the residential use of a lot occupied by a dwelling. LICENCE means a business licence requirement pursuant to this bylaw. LICENSEE means a person to whom a current licence has been issued under this bylaw. LICENCE INSPECTOR means the person from time to time duly appointed by resolution of Council as licence Inspector of the City. LICENSED PREMISES means any premises licensed under the provisions of the Liquor Control and Licensing Act and includes restaurants #115073v1

MANUFACTURING means carrying on the business of assembling, fabricating, processing, altering or finishing any goods. MEDICAL HEALTH OFFICER means a medical health officer designated under Section 71 of the Public Health Act. MOBILE FOOD VENDOR means a person who sells or offers to sell food items from a cart or vehicle. MOBILE ICE CREAM VENDOR means a person who sells or offers to sell frozen novelty products such as ice cream bars, popsicles, or yogurt bars from a cart or vehicle located on a public highway. NON-PROFIT SOCIETY means a registered charitable society that is: (a) incorporated and in good standing under the Society Act; and (b) registered as such under the Income Tax Act (Canada) and qualified to issue tax receipts to its donors. OUTDOOR RECREATION means such activities as paintball, zip lining, horseback riding academies, go-carting, mountain biking, rock climbing and similar activities but does not include the private us of municipal parks or facilities without the express written permission of the Director of Parks and Open Spaces for the city. PEDDLER means a person who sells or offers for sale goods or food items by going from place to place or house to hours, or by appointment and demonstration, whether such person is acting on that person s own behalf or as an employee of another excludes a solicitor for Charity. PERSONAL SERVICES means a business that is associated with the grooming or health of persons, or the maintenance or repair of personal wardrobe articles and accessories. PET STORE means a retail store where domesticated animals are offered for sale or sold to the public, but excludes an animal shelter. PREMISES includes but is not limited to stores, offices, warehouses, factory buildings, houses, enclosures and yards. PRENATAL ALCOHOL EXPOSURE means the consumption of any alcoholic substance (beer, wine, and spirits) which has detrimental effects on the growing fetus, including implications for mental, learning, physical and behavioural development #115073v1

PROFESSIONAL includes persons engaged in the professional business of offering any of the following services in accordance with a federal or provincial licence or standard including but not limited to: accountant, agrologist, architect, chiropractor, dentist, ecologist, engineer, financial consultant, forester, land surveyor, lawyer, naturopathic physician, notary public, optometrist, orthodontist, osteopath, pharmacist, physician, physiotherapist, podiatrist, psychiatrist, psychologist, radiologist, registered psychiatric nurse, surgeon and undertaker. PROFESSIONAL DOG WALKER means an individual whose business or employment is walking dogs owned by other persons. PROPERTY MANAGER means a person or a business that rents or leases or offers for rent or lease a dwelling unit or dwelling units to other persons or businesses. RESTAURANT means an establishment where food and beverages are sold to the public and where provision is made for consumption on or off the premises. The establishment may be licenced as Food Primary under the Liquor Control and Licensing Act. RETAIL BUSINESS means a business selling goods for final consumption, in contrast to a sale for further sale or processing, and includes accessory manufacturing or assembly of the goods for sale. SECOND HAND ARTICLES means any used goods offered for sale including but not limited to the following: (a) used clothing, furniture, costume, jewellery, footwear, and house ware items such as dishes, pots, pans, cooking utensils and cutlery; and (b) used books, paper, magazines, vinyl records and long play records. SECOND HAND DEALER means a person carrying on the business of buying, selling, procuring or offering for sale second hand articles and includes the following person, stores, or transaction: (a) a person who is licenced by the Province of British Columbia to deal in used motor vehicles; (b) a person who deals only in antiques; (c) a person who only purchases, sells or collects recyclable materials for the sole purpose of recycling. Recyclable materials shall include bottles, cans, plastics, glass, cardboard, paper or other recyclable materials but shall not include scrap metal that is not part of a can or food container; #115073v1

30 CITY OF PlU MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 6 of 33 (d) (e) (f) a thrift store or charity store which receives second hand articles by donation; transactions involving second hand articles purchased at a consignment store where the seller s name and address is recorded in the records of the consignment store; and transactions involving and exchange or trade of second hand articles for another second hand article where no money is given by the dealer to the person form whom the second hand article was received. SECONDARY SUITE means a suite as defined in City of Pitt Meadows Zoning Bylaw No. 2505, SOLICITOR FOR CHARITY means a person who engages in the business of collecting or receiving money or goods, with or without the disposal or sale of goods, and includes the sale of tickets for any form of entertainment or drawing or other disposition of any prize, where some or all of the money collected or the proceeds of the disposal or sale are, directly or indirectly, given to a non profit society. TEMPORARY means thirty (30) consecutive days in a twelve (12) month period. THEATRE means premises primarily used for the provision of live performances or for the projection or display of motion pictures to the public for a fee. TOBACCO means tobacco and tobacco products in any form in which they may be consumed, by a consumer, and includes snuff and raw leaf tobacco. TOBACCO PRODUCT means tobacco products and accessories as defined under the Tobacco Tax Act. U-BREW means any premises where supplies, prepackaged ingredients or equipment are sold which contributes towards the making of wine, beer or other alcoholic beverages. UNIT means any structure or building that is zoned and or used for residential, industrial or commercial purposes. WAREHOUSE means premises used for keeping or storing goods, to which the general public does not have access, and which may include facilities for distribution of commercial or industrial goods. WHOLESALE DEALER means any person who carries on the business of selling any goods to retail businesses, to other wholesale dealers, or to contractors or manufacturers for use in their businesses, but excludes an owner of a warehouse that does not employ a representative, other than the warehouse owner or operator, to solicit orders for, to handle or to distribute goods O73v1

31 PART 3 GENERAL LICENCE REQUIREMENTS 3.1 Licence Requirements CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 7 of Except as otherwise provided in this bylaw: (a) no person shall carry on, maintain, own or operate a business in the City without holding a valid and subsisting licence; and (b) no person shall suffer, permit or allow a person to carry on, maintain or operate a business without a valid and subsisting licence A licence is not required for a property manager that rents or leases or offers to rent or lease not more than one unit in the City Every person who operates a business from more than one premise in the City shall apply for and maintain a separate licence in the respect of each premise pursuant to section Every person who operates more than one business at one premise shall apply for and maintain a separate licence in respect of each business Any person operating or carrying on a business that is regulated, controlled, permitted, or licensed by any other bylaw or Provincial or Federal enactment shall obtain the necessary approvals from the appropriate authority prior to applying for a licence A licence is not to be deemed to be a representation by the City to the Licensee that the business or proposed business complies with any or all applicable bylaws or other enactments. 3.2 Licence Application All applications for a licence pursuant to this bylaw shall: (a) be made in the form provided by the licence inspector for that purpose; (b) be signed by the owner or operator of the business or an agent authorized in writing by the owner or operator; and (c) contain a true and accurate description of the following information: (i) the nature of the business (ii) the premises, including the civic address, from which the business is conducted; (iii) any other information the licence inspector may require with respect to the operation of the business and its location; and (iv) not be altered in any manner #115073v1

32 CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 8 of The licence inspector may review the application to verify general compliance with this bylaw and other applicable enactments. Any errors or omissions in the information provided by the applicant on the application will be the sole responsibility of the applicant All premises in or upon which the applicant proposes to carry on business or all vehicles used in connection therewith shall, before any such licence is grated for such premises or for such vehicle, first be approved by the licence inspector who may in his discretion also require such premises or vehicles to be approved by Federal, Provincial or City officials, as the Licence Inspector deems necessary. 3.3 Licence Fees Every applicant shall, at the time of making the application, pay to the City the licence fee set out for his business in Schedule A to this bylaw. No Licence shall be issued until the payment of the fee is made Notwithstanding Section 3.3.1, the licence fee prescribed in Schedule A may be reduced by one-half in respect of a business for which a licence is issued after the 30 day of June in any calendar year. th No reduction or refund of the annual licence fee paid pursuant to this bylaw shall be made by the City due to any Licensee ceasing to own or operate the business for which the licence was issued The fees set out in Schedule A of this bylaw shall be adjusted annually and implemented on the 1st day of January in the following year. This annual adjustment shall be based on the Consumer Price Index (CPI) as established by Statistics Canada based on the previous 12 month period ending December. 3.4 Variable Licence Fees Where the licence fee for a business is based on the floor area, ground area, number of professionals regularly employed, number of machines, appliances, rental units or other factors used in the carrying on of the business, and applicant who changes the factors upon which the licence fee is based shall immediately notify the licence inspector in writing, and pay an additional licence fee which may be payable under Schedule A as a result of the change. 3.5 Licence Period Licences shall be issued for a period no greater than one calendar year and shall commence on the 211(1 day of January and expire on the 31 day of December of each year, unless otherwise indicated on the licence. st #115073v1

33 CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 9 of Licence Renewal Every Licencee shall renew the licence prior to the beginning of each licensing period as long as the business for which the licence was issued is operating or being carried on within the City. 3.7 Licence Changes Every Licensee shall notify the licence inspector in writing within forty (48) hours of the termination of operation of the business No Licensee shall make a change to a business, including but not limited to a change: (a) in location of the business premises; (b) the business name; (c) to any term or condition on which the licence was issued; or (d) that would increase the licence fee prescribed for the business in Schedule A without first applying to the licence inspector to have the licence changed The powers, conditions, requirements and procedures relating to the granting or refusal of a licence shall apply to all such applications for a licence change A person applying for a licence change shall, at the time of making the application, pay to the city the amount by which the licence fee under Schedule A will increase In addition to the fee set out in Schedule A, a Licensee applying for a change of location of the premises in which the business is carried on shall pay the City a transfer fee of $ A person applying for a name change for a corporation shall, at the time of application, supply a true copy of the name change certificate issued by the Corporate Registry (Victoria). 3.8 Licence Posting Every Licensee shall post the licence in a conspicuous place on the premises or on the thing or article in respect of which the licence is issued and, in the case where the holder thereof has no business premises in the City, such licence shall be carried upon his person at all times when he is engaged in the business for which the licence was issued #115073v1

34 3.9 Licence Inspector s Powers and Duties CITY OF Pin MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 10 of On receipt of an application and before issuing any licence or authorizing a change with respect to an existing licence, a licence inspector may: (a) at a reasonable time and in a reasonable manner, inspect the premises for which the licence or the change to an existing licence is sought; and (b) require the applicant to provide proof of any certification, approval, or qualification which may be required by a federal, provincial or municipal authority with respect to the business A licence is issued on terms or conditions imposed in respect of that business by this bylaw or in any other enactment Subject to section 16 of the Community Charter, S.B.C. 2003, c.26 a licence inspector may enter the premises at a reasonable time to inspect and determine whether the regulations and requirements of the bylaw are being met Refusal of Licence An application may be refused by the licence inspector in any specific case, provided that: (a) the application shall not be unreasonably refused; and (b) the licence inspector shall give written reasons for the refusal If the licence inspector refuses to grant a licence, the applicant who is subject to the decision is entitled to have Council reconsider the matter Terms and Conditions of a Licence Council or the licence inspector may impose terms and conditions with respect to a licence granted under this bylaw. The terms and conditions imposed on a licence may include any one or more of the following requirements that the Licensee: (a) comply with a particular provision of a Municipal Bylaw or any other Provincial or Federal enactment within a specified period of time; and (b) provide to the licence inspector within a specified period of time evidence satisfactory to the licence inspector of compliance with a particular provision of a Municipal bylaw or other Provincial or Federal enactment with respect to the business Suspension and Cancellation of a Licence A licence may be suspended or cancelled by the licence inspector for reasonable cause #115073v1

35 CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 11 of Without limiting what constitutes reasonable cause, any one or more of the following circumstances may constitute reasonable cause: (a) the Licensee fails to comply with this bylaw or a term or a term or condition of the licence; (b) the Licensee is convicted of an indictable offence in Canada, which offence, in the opinion of Council or the licence inspector, directly relates to the business; (c) the Licensee is convicted of an offence under any Municipal bylaw or Provincial or Federal enactment in respect of the business for which the Licensee is licensed or with respect to the premises for which the licence was issued; (d) the Licensee has ceased to meet the lawful requirements to carry on the business for which the Licensee is licensed or with respect to the premises for which the licence was issued An applicant or licence holder who wishes Council to reconsider a Licence Inspector s decision to refuse, suspend or cancel a licence shall, within ten (10) days of the date of the refusal, suspension or cancellation, deliver to the Licence Inspector a written request stating the grounds upon which the request is based The Licence Inspector shall refer to Council a request made under Section and notify the applicant or licence holder of the time and place at which Council will reconsider the Licence Inspector s decision. PART 4 SPECIFIC REGULATIONS 4.1 Amusement Arcade and Billiard Halls The operation of an amusement arcade or billiard hall as a principal use is not permitted Every owner or operator of amusement arcade or billiard hall shall: (a) post and keep posted at all times at every entrance to the premises a clearly visible and legible sign, not less than centimetres (8.5 inches) by centimetres (11 inches) in dimension, containing the words No Loitering, (b) ensure loitering does not take place; (c) post and keep posted at all times in a conspicuous place, near any amusement machines or billiard tables a summary of the rules of conduct for customers, including the regulations set out in this section; (d) ensure the premises are well lit and clean; (e) not cover any window in a manner that would prevent a clear view of the interior of the premises from the exterior of the premises; #115073v1

36 4.2 Bed and Breakfast CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 12 of 33 (f) ensure that the owner or not less than one employee of the business is present at the premises at all times that the premises are open to the public; (g) not permit any patron to be at the premises between the hours of 12:00 midnight and 7:00 a.m.; and (h) not allow any person apparently or actually under the age of eighteen (18) years, unless such person is accompanied by his parent or guardian, to use play, operate or loiter about amusement machine or be present in a billiard hail: (i) between the hours of 9:00 a.m. and 3:00 p.m. Monday to Friday inclusive unless such day is a school holiday; or (ii) between the hours of 10:00 p.m. and 12:00 midnight Sunday to Thursday inclusive unless the day immediately following is a school holiday; and (iii) where reasonable doubt exists as to the age of a person desiring to play an amusement machine or be present in a billiard hall, the owner or operator of those premises shall not permit any person who is unable to provide documented proof of age indicating that person is eighteen (18) years of age or older to remain at the premises Every owner or operator of a bed and breakfast shall: (a) supply the licence inspector with the number of bedrooms intended for the operation and the daily rate of charge; (b) keep the records of all patrons, including dates of arrival and departure; and (c) post the daily rate of charge at an easily visible location in the premises No owner or operator of a bed and breakfast shall provide more than three sleeping units to a maximum of two guests per sleeping unit, with the exception of the A-i and A-2 zones where a maximum of four sleeping units are permitted, and each sleeping unit shall be used solely for guest accommodation and have a maximum area of 25 sq. m. 4.3 Cabaret The operator of every cabaret shall comply with the following regulations: (a) the seating capacity of a cabaret shall not exceed 350 seats; (b) the dance floor comprising at least 20 percent of the gross floor area of the cabaret premises, shall be provided for patrons of the business; (c) live or recorded musical entertainment shall be provided at all times that the cabaret premises are open for business; #115073v1

37 4.4 Dog Daycare CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 13 of 33 (d) no entertainment facilities other than a dance floor and live or recorded music, pool tables, shuffleboard tables and dartboards shall be provided in the cabaret premises, and no other entertainment activities shall be permitted by the operator; (e) the price of alcoholic beverages served in a cabaret shall not be changed more than once in any calendar month. (f) no cabaret shall be open to patrons between the hours of 12:00 a.m. and 4:00 p.m. on Sunday; (g) no cabaret shall be open to patrons between the hours of 2:00 a.m. and 4:00 p.m. on any Monday, Tuesday, Wednesday, Thursday, Friday and Saturday Requirements and restrictions are subject to conformance with the City of Pitt Meadows Zoning Bylaw 2505, 2011 as amended from time to time A dog daycare facility shall be located on a parcel which is zoned as regulated by the City of Pitt Meadows Zoning Bylaw as amended from time to time Operator Obligations Hours of Operation, Maximum Number of Dogs and Noise Control. (a) The operator of a dog daycare facility: (i) shall not care for more than twenty(20) dogs at any time; (ii) may only operate between the hours of 7:00 a.m. and 7:00 p.m., Monday to Saturday inclusive; and (iii) shall not discharge or emit odorous, noxious or toxic matter or vapours, heat, glare, noise or radiation, or recurrently generated ground vibrations. 4.5 Farm Produce Retail No owner or operator of a farm business shall carry on a retail business on land that is zoned for agricultural use under the Pitt Meadows zoning bylaw as amended from time to time, unless fifty percent (50%) of the goods offered for sale are produced on the land at which the retail business is located. 4.6 Farmers Market Every Farmers Market applicant shall: (a) provide evidence of permission by the owner to use the land for the purpose of a farmers market if the operation is on land other than land owned by the applicant; #115073v1

38 CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 14 of 33 (b) permit only the display and sale of any of the following: (i) fruit, vegetables, nuts honey, syrups, dairy products, eggs, poultry, meat, flowers, herbs, and any products derived there from, that are produced n the Province of British Columbia and prepared for market in accordance with applicable laws; (ii) artwork or handcrafted items that are designed, created, produced and assembled in the Province of British Columbia; and (iii) baked or hand make foods produced in British Columbia; (c) provide evidence that all vendors intending to sell food products have been granted a health permit for that purpose before allowing the sale of any goods mentioned in paragraph (b); and (d) satisfy the Licence Inspector that the farmers market shall not create a traffic hazard or result in obstruction or other nuisance on municipal streets, sidewalks, or access routes Despite of this bylaw, a vendor who is permitted by a person holding a current and valid licence for a farmers market to display or sell goods at that farmers market is not required to obtain a separate licence for that purpose A person holding a licence for a farmers market must: (a) ensure that health permits are displayed at any space where food products are sold; (b) comply, and ensure compliance among vendors with any conditions, restrictions or requirements of the medical health officer, the Fire Chief or a deputy acting in the place of either; and (c) ensure that the market area is operated and maintained in a safe, orderly, clean and sanitary condition, and that the area is left in such condition after the market closes. 4.7 Insurance No licence shall be granted for the operation of a spectator or sports function, or any public entertainment, including without limitation any exhibition, circus, carnival, automobile or motorcycle races, car rallies, public animal rides, or other similar function or the operation of a ferris wheel, merry-go-round or other similar device until the applicant has deposited proof in a form and amount satisfactory to the City that the applicant has comprehensive general liability insurance, which includes a cross-liability clause and specifies the City as an additional insured. The applicant shall supply to the City a copy of the current certification from the Elevation Devices Branch showing all rides have been inspected and are approved for use #115073v1

39 CITY OF PITT MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 15 of Licensed Premises and U-Brews A business owner shall post signs warning of prenatal alcohol exposure which shall be located in the following premises and in the following locations: (a) for any licensed premises which are permitted to sell alcoholic beverages for off-premises consumption, there shall be at least one sign, located so it is clearly visible from all locations where the sale or dispensing of the alcoholic beverage takes place; (b) for any licensed premises which permits the consumption of alcoholic beverages on the premise, there shall be one sign conspicuously displayed in both the male and female washrooms located within the premise, and at least one sign located so it is clearly visible from all locations where the sale or dispensing of the alcoholic beverage takes place; (c) for any u-brew premises, there shall be at least one sign, located so it is clearly visible from all locations where the sale of the supplies, prepackaged ingredients or equipment takes place; (d) for any licensed premises, there shall be a prenatal alcohol exposure warning place on all menus; and (e) for sign specifications see Schedule B which is attached to and forms a part of this bylaw. 4.9 Mobile Ice Cream Vender No mobile ice cream vendor shall carry on business in contravention of the Motor Vehicle Act, the Highway Scenic Improvement Act, of any other Municipal Bylaw or Provincial enactment with respect to traffic and the use of highways in the City Every mobile ice cream vendor shall: (a) obtain written approval from the provincial agency responsible for health and the safe handling of food products; (b) provide a garbage container immediately next to the vehicle and shall pickup all garbage and debris which results from the mobile ice cream vendor s business; (c) not operate before 8:00 or after 9:00 p.m. (d) not sell from a fixed location in excess of twenty (20) minutes; (e) not return to the same location or hundred block within one (1) hours; and (f) not operate on a property designated park land unless written approval from the City has been obtained. am, The amplified sound from a mobile ice cream vendor s vehicles shall: (a) not be played at a higher level than sixty(60) dba measured at a distance of fifty (50) feet from the vehicles; (b) be shut off when the vehicle is not in motion #115073v1

40 CITY OF PlU MEADOWS BUSINESS LICENSING BYLAW Bylaw No. 2643, 2014 Page 16 of A mobile ice cream vendor shall only stop its vehicle in the course of business while actively engaged in making a sale and shall move to another location after all customers have been served No member of the general public shall be permitted inside a mobile ice cream vendor s vehicle Non-Profit AgencieslOrganizations Every non profit society shall hold a valid and subsisting licence as per Schedule A. There is no fee for such licence Tobacco Sales No person carrying on the business of tobacco sales shall: (a) sell tobacco or tobacco products unless the business is licensed by the Province to sell such products; (b) permit tobacco or tobacco products to be displayed in the retail business premised so that the tobacco or tobacco products are visible to the public if young persons are permitted access to those premises; and (c) sell any tobacco or tobacco products to anyone under the age on nineteen (19) years old Shark Fin Products No person or business entity shall: (a) possess, trade, sell or distribute by any means, shark fins or their derivative products with the exception of possession for educational bona fide research purposes. PART 5 OFFENCES AND PENALTIES 5.1 Offences Every person who violates any of the provisions of this bylaw or who suffers or permits any act or thing to be done in contravention of any of such provisions or who neglects to do or refrains from doing anything required to be done by any of the provisions of this bylaw shall be deemed to be guilty of an offence against this bylaw and is liable to affine not exceeding $10, Every infraction shall be deemed to be a continuing, new and separate offence, for each day during which the same shall continue #115073v1

62 ATTACHMENT E Division 9 Business Regulation Powers to require and prohibit 59 (1)A council may, by bylaw, do one or more of the following: (a) require operators of premises in which rooms or suites are let for living purposes to maintain, in accordance with the bylaw, a register of persons living there; (b) in relation to persons engaged in the business activity of purchasing, taking in barter or receiving used or second hand goods, (i) require such persons, after purchasing, taking in or receiving used or second hand goods, to notify the chief constable who has jurisdiction in the municipality within the time period established by the bylaw, and (ii) prohibit such persons from altering the form of, selling, exchanging or otherwise disposing of those goods during the time period established by the bylaw; (c) require manufacturers and processors to dispose of the waste from their plants in the manner directed by the bylaw; (d) prohibit the operation of a public show, exhibition, carnival or performance of any kind or in any particular location; (e) prohibit the operation of places of amusement to which the public has access, including halls and other buildings where public events are held; (f) prohibit professional boxing, professional wrestling and other professional athletic contests. (2)Before adopting a bylaw under subsection (1) or section 8 (6) (business regulationj, a council must (a) give notice of its intention in accordance with subsection (3), and (b) provide an opportunity for persons who consider they are affected by the bylaw to make representations to council.
