3 MINUTES PARKER SPECIAL LICENSING AUTHORITY JUNE 16, 2016 Chair Dave Usechek called the meeting to order at 7:00 P. M. Authority Members present were: Chris Ray, Bryn Larsen, Richard Gibbons, and Alternate Member Kelli Narde. Member David Lettkeman and Alternate Members Steve Conner were absent. Staff members present were: Town Clerk, Carol Baumgartner, Administrative Manager Chris Vanderpool, and Authority Attorney Corey Hoffmann. PUBLIC COMMENTS There were no public comments. REPORT.OF CHANGES CORPORATE STRUCTURE BHTT Entertainment, Inc. d/b/ a Brick House Tavern + Tap Cottonwood Dr. Item 8 on the agenda was moved to the.consent Agenda and made item 3G as the required finger print results were received by the Town Clerk and there are no outstanding issues.

4 Special Licensing Authority 2 Kelly Narde moved to approve the Consent Agenda Items 3A through 3G. Richard Gibbons seconded the motion and was approved unanimously. PUBLIC HEARING. NEW APPLICATION HOTEL & RESTAURANT LIQUOR LICENSE The Gnarly Root, Inc. d/ b/ a The Gnarly Root 9355 Crown Crest Blvd. Chair Usechek opened the Public Hearing at 7:03 p.m. Owner Shelly Rosnik stated the restaurant has been open for two months. They are working to get all employees TIPS trained. Have been monitoring all employees to make sure proper identification is requested by the servers. Shelly Rosnik stated the petitioning process for this license was waived at the last Special Licensing Authority meeting due to being opened only a short time and had gone through the petitioning process with the Beer and Wine License. She provided a brief review ofthe survey result for the Authority. Chair Usechek closed the Public Hearing at 7: 06 p.m. There was no discussion by the Authority. Richard Gibbons moved to approve the new Hotel and Restaurant Liquor License for The Gnarly Root, Inc., d/ b/a The Gnarly Root, 9355 Crown Crest Boulevard. The motion was seconded by Chris Larsen and was approved unanimously. PUBLIC..HEARING NEW APPLICATION BEER 3. 2% ON/ OFF PREMISES LICENSE Location Walmart, Inc. d/ b/ a Walmart Supercenter# S. Parker Road Chair Usechek opened the Public Hearing at 7: 07 p.m. Kevin Coats, attorney for the Applicant appeared. Attorney Coats stated this application was for an On/ Off Premises 3. 2% Beer License. This category of license would allow for the delivery of beer to those customers doing online ordering ofgroceries. Attorney Coats stated Walmart has a strict operating procedure for online ordering of beer. The beer must be delivered to the person who made the online purchase. At the siteof delivery, identification must be shown and it must match the person who made the online purchase. Attorney Coats added there will be no change to the in-store process for the sales of beer. All processes will remain the same.

5 Special Licensing Authority 3 Max Scott was sworn in to testify to the petitioning process for this license. He provided an explanation and methodology for the petitioning process. Residential areas as well as business areas within the required petitioning boundaries were obtained. Authority Member Kelly Narde asked about how the survey boundaries are determined. Town Clerk Baumgartner stated the areas have been predetermined and mapped by the Town' s GIS person. Attorney Coats provided Change of Manager paperwork to the Town Clerk. He stated the manager is of good moral character: Store Manager, Matthew Burns explained that when the delivery person arrives at the door, they will ask for identification to ensure that the person who ordered the beer is the person accepting thebeer at the door. The receiver of the beer must then sign for the order. He added the drivers are between 21 and 30 years ofage. Walmart anticipates having beer deliveries within the next six months. There will be a limit to the quantity of beer that can be delivered at a time. There will be a delivery radius of 30 miles and the beer must be delivered from the store it was ordered from. Chair Usechek closed the Public Hearing at 7:48 p.m. There was no discussion by the Authority. Richard Gibbons moved to approve the 3. 2% Beer On/ Off Premises Liquor License for Walmart, Inc., d/ b/ a Walmart Supercenter# 2892, S. Parker Road. Kelly Narde seconded the motion and was approved unanimously. PUBLIC HEARING SPECIAL EVENTS PERMITS (Malt, Vinous and Spirituous) Event: American Diabetes Association 2016 Tour de Cure Colorado Salisbury Park, N. Motsenbocker Road Dates: September 24, 2016 Chair Usechek opened the Public Hearing at 7:49 p.m. Audra Fleming was present representing the American Diabetes Association for the 2016 Tour de Cure event on September 24, She asked the Authority to amend the application to include September 23, for a Champions Dinner' which would include thesale of alcohol. She reported the September 24 date had been posted on the site within the required,guidelines provided by the Town Clerk. She added the event is to raise money and awareness for diabetes. Chair Usechek asked if there was anyone in the audience who wanted to speak about this special event. There was no one present. The Public Hearing was closed at 7: 52 p.m. Bryn Larson moved to approve the Special Events Permitapplication for the American Diabetes Association' s2016 Tour de Cure Colorado, at Salisbury Park, N. Motsenbocker Road, on September 24, with condition approval for September 23. The site must be reposted with the

6 Special Licensing Authority 4 September 23 date for the ten day period. If there are no public comments, the application is considered approved at the time. Chris Ray seconded the motion and was approved unanimously.. GREATER DOWNTOWN SPECIAL PRIVATE ARTPERMITADDITIONS TO PARTICIPANTS LIST Parker Chamber of Commerce Event: Old Town Parker Wine Walks Downtown Parker Dates: June 24, 2016 September 30, 2016 July 29, 2016 October 28, 2016 August 26, 2015 The Chamber' s Representative, Stacy Rosemore, requested the list of additional participants be allowed to participate in the remaining Wine Walks for Richard Gibbons moved to approve the requestto allow the additional listed participants into the 2016 Wine Walk. Kelly Narde seconded the motion and was approved unanimously. REPORT OF CHANGES CORPORATE STRUCTURE BHTT Entertainment, Inc., d/ b/a Brick House Tavern+ Tap Cottonwood Dr. This item was moved to the Consent Agenda.as Item 3G. TRANSFER OF OWNERSHIP RETAIL LIQUOR STORE LICENSE Craft Studio Co Transferor: d/ b/a Jordan Wine and Spirits Julie Morton Enterprises, Inc. d/ b/ a Jordan Wine and Spirits 1701 Lincoln Ave., Unit G Attorney Kevin Coats appeared on the Transfer of Ownership of the Retail Liquor Store License. He stated the store has had no violations. Stacy Stillman has worked for Target Stores in the past and has dealt with alcohol. Mr. Stillman is also on the license and will be helping with the day to day operation of the store. Ms. Stillman explained to the Authority there are two long-time employees who have been with the store for two years. These employees will remain employed at the store. There is a strong team at the store who work well together. All employees are going through TIPS Training. Ms. Stillman is developing a standard operating procedures manual as well as a safety training program. They have installed a point- of-sale card reader for age verification. There was no discussion by the Authority. Chris Ray moved to approve the Transfer of Ownership of the Retail Liquor Store License by Craft Studio Co, d/ b/a Jordan Wine and Spirits, from Julie Morton Enterprises, Inc., d/ b/ a Jordon Wine and Spirits, 1701 Lincoln Ave., Unit G. Richard Gibbons seconded the motion and was approved unanimously.

7 Special Licensing Authority 5 TASTINGS PERMIT APPLICATION Craft Studio.Co d/ b/ a Jordan Wineand Spirits Lincoln Ave., Unit G The Authority reviewed the Tasting Permit Application. The Authority eliminated the four dates noted in June Chris Ray approved the Tastings Permit application for Craft Studio Co, d// b/a Jordan Wine and Spirits, Lincoln Ave., Unit G. Richard Gibbons seconded the motion and was approved unanimously. REVIEW OF CANVAS UNCORKED' S REQUIREMENT FOR PROOF OF TIPS TRAINING The Town Clerk informed the Authority that Canvas Uncorked has not provided proof of TIPS Training as required by the Authority at the May 19, 2016 meeting. The Administrative Manager for the Town Administrator' s Office stated that she had left several messageswith the owner and has not received a return phone call. After a brief discussion by the Authority, Richard Gibbons moved to imposes three days suspension for non-compliance to beserved on July 28, 29, and 30, 2016, and the Town Clerk needs to notify the owner of the actions taken. The motion was seconded by Chris Ray and was approved unanimously. REVIEW OF MT. FUJI' S REQUIREMENT FOR PROOF OF TIPS.TRAINING Chair Usechek stated that Mt Fuji has completed the TIPS Training requirement of the Stipulation Agreement and asked the Authority members to reconsider the additional five day suspension imposed at the May 19, 2016 meeting for not providing proof that training was completed by all employees and the owner. After some discussion, Chair Usechek moved to remove the five day suspension, July 27 to July 31, as all TIPS Training requirements were met. The Town Clerk will notify Mt. Fuji of the action..the motion was seconded by Chris Ray and approved unanimously.
