Sam Houston Parkway East, Houston, TX 77032, hereby applies to the Arkansas Oil and Gas Commission as follows: 1. The proposed drilling unit is an established unit as defined in paragraph (f) of Arkansas Oil and Gas Commission General Rule B-43. Applicant proposes to drill a horizontal well from a surface location in the Southeast Quarter of Section 24 to a bottom hole location in the Northeast Quarter of Section 36. The proposed well will be drilled to a total vertical depth of 3,998 feet to test the Fayetteville Shale Formation. Applicant has obtained one or more oil and gas leases covering its proposed drill site. 2. Applicant owns oil and gas leases covering a substantial part of the proposed unit. Applicant should be named as operator of the well. The person or persons to be integrated are shown in Exhibit "A" attached hereto and made a part hereof. 3. Applicant has made diligent efforts to negotiate with the non-participating leasehold working interest owners, each of said parties owning an oil and gas leasehold interest in the proposed unit, but applicant has been unable to secure an assignment of the leasehold interest on an equitable basis or to secure participation by said parties in the drilling of the proposed well. 4. Applicant states that it has made repeated efforts to negotiate with the owners of the unleased mineral interests in order to agree on a plan of development of said drilling unit; that those owners have been offered an opportunity to participate in the

2 proposed well; that they have been offered a fair and reasonable bonus consideration for the execution of an oil and gas lease covering their interests; that they have been furnished with a proposed oil and gas lease and a copy of the AAPL operating agreement form which applicant proposes to use in connection with the drilling of said well; but that all of the efforts of the applicant have produced no agreement by said parties. 5. Applicant states that it is in the best interest of conservation and the protection of correlative rights of all interested parties that the proposed unit be developed for oil and gas production without undue delay. 6. In order that applicant may proceed with the orderly development of said unit, applicant hereby requests that the Arkansas Oil and Gas Commission issue its order, in the alternative, that: (a) (b) The owners of non-consenting oil and gas leasehold working interests indicated above shall participate in the cost of drilling, testing and completion of the test well to be drilled by applicant on the captioned unit, subject to the terms of an Operating Agreement which substantially employs the terms of the AAPL Operating agreement, with a COPAS attached. All of the non-consenting oil and gas leasehold working interests within the proposed unit shall be force pooled and integrated into said unit, and a reasonable risk factor shall be established and assessed as a penalty against said integrated interest. 7. Applicant further states that due to the risks and costs inherent in the drilling of the proposed well, the Commission should fix a reasonable risk factor to be assessed as a penalty against the integrated interests within the unit. The risk factor should be applied to the proportionate cost and expense of drilling, completing and equipping the well, which would have been borne by the interest of said parties had they participated. Applicant requests that if the integrated parties do not elect within 15 days after issuance of the Commission's order as between alternatives (a) and (b), it shall be assumed that the integrated parties elected alternative (b) in lieu of the right to participate in the working interest in said unit. 8. Applicant requests that the Arkansas Oil and Gas Commission set this matter for public hearing, and after same, issue its order, in the alternative, that: (a) Each of the owners of the unleased mineral interests indicated above execute and deliver to applicant a one year oil and gas lease, on an AAPL lease form, for a bonus consideration of $ per net mineral acre to be paid as fair and reasonable compensation in lieu of the right to participate in the working interest in said unit, and that said oil and gas lease provide for a

3 1/6 royalty on oil and gas. (b) (c) (d) Each of the owners of the unleased mineral interests indicated above execute and deliver to applicant a one year oil and gas lease, on an AAPL lease form, for a bonus consideration of $40.00 per net mineral acre to be paid as fair and reasonable compensation in lieu of the right to participate in the working interest in said unit, and that said oil and gas lease provide for a 3/16 royalty on oil and gas. Each of the owners of unleased mineral interests indicated above be force pooled and integrated into the captioned unit with assessment of a reasonable risk factor penalty against their interest. The owners of unleased mineral interests shall participate in the cost of drilling, testing and completion of the test well to be drilled by applicant on the captioned unit, subject to the terms of an operating agreement which substantially employs the terms of the AAPL Operating Agreement. Applicant further requests that said mineral owners be required to elect within fifteen (15) days after issuance of the Commission's order which method will be pursued in the development of the above described unit, and, in the event no election is made, that it shall be assumed that the owner of said unleased mineral interest has elected to accept a bonus of $ per net mineral acre as compensation in lieu of the right to participate in the working interest in said unit, and with the royalty to be 1/6. 9. Applicant further states that due to the risks and costs inherent in the drilling of the proposed well, the Commission should fix a reasonable risk factor to be assessed as a penalty against the integrated interests within the unit. The risk factor should be applied to the proportionate cost and expenses of drilling, completing and equipping the well, which would have been borne by the interest of said parties had they participated. 10. Applicant further requests that this Commission's order specifically provide that any party electing either to participate or be force pooled subject to recoupment of a risk factor penalty be bound by the terms of the attached AAPL Operating Agreement for the life of commercial production within the unit so that all future unit operations might be proposed pursuant to the provisions of such agreement without the necessity of future action by this Commission. 11. Applicant also requests that said order be made applicable to any unknown spouse, heir, devisee, personal representative, successor or assign of said parties. 12. 9 George L. Babcock and Helen Babcock, and any known or unknown heirs 09/17/2014 Bryan Perry is searching for the known and unknown heirs for George L. Babcock and Helen Babcock. 10/07/2014 Eric Catlett performed an internet search at ancestry.com in hopes of obtaining any information regarding these interest owners. Eric states that he located a George Luason Babcock who was married to Helen Flatley. Eric states that he feels like this may be the persons he is searching for. Eric is continuing his efforts to attempt to locate any possible heirs for this interest. 10/14/2014 Eric Catlett located information showing that Mr. Babcock was born on July 7, 1885 in New Jersey and died in New York. He also obtained information for Ms. Babcock showing she was born on August 1, 1899 in Wisconsin and died in May 1985 in New York. At this time, Eric has been unable to locate any heirs for this interest. 10/21/2014 Eric Catlett states that after conducting more research, he is not sure that the George Babcock and Helen Babcock he has located are the individuals he is search for. Eric states that the information located seems to be the same for George L. Babcock, however, he has come across two different wives names, Helen Babcock and Ruth Babcock. 2

She stated they would not lease at the current terms and presented a counter offer. She also stated they wanted to use their lease for should they come to an agreement. 09/23/2014 Bryan Perry sent an to the Associate Prospect Manager for T. S. Dudley regarding Ms. Goetzinger s counter offer. 09/24/2014 Bryan Perry called Ms. Goetzinger to inform her that the client had declined her counter. She stated that Bandera would accept the original lease offer terms, if they could use their own lease for. Bryan sent this request to the Associate Prospect Manager for T. S. Dudley. 9/24/2014 Kirk Rogers sent lease form to the in house landman at SEECO. 09/30/2014 Bryan Perry is still awaiting a response from the client regarding the use of Bandera s lease form. 10/02/2014 Eric Catlett sent an to Ms. Goetzinger asking her to call regarding this interest. 10/02/2014 Eric Catlett received a telephone call from Ms. Goetzinger. After having a discussion about this interest, she presented another counter offer. Eric informed her that he would have to submit the counter offer for approval and would be back in touch. 10/21/2014 Eric Catlett sent an to the Associate Prospect Manager for T. S. Dudley with the counter offer for this interest. 10/21/2014 Kirk Rogers sent counteroffer to in house landman at SEECO. 11/05/2014 Eric Catlett states that he has not received a response from the client regarding the counter offer made by Bandera Minerals. 3

Bryan called the number, but did not receive an answer; nor was he able to leave a message. 09/30/2014 Bryan Perry performed an internet search and located a possible telephone number for the Blankenship Mineral Properties, LLC. Bryan called the number, but did not receive an answer; left a message. 10/09/2014 Eric Catlett located a possible telephone number for this interest via the internet. Eric called the number, but did not receive an answer. 10/14/2014 Eric Catlett spoke with Karen at Blankenship Mineral Properties, LLC. She stated that she had received a letter from Bryan Perry, but at the time, a decision had not been made as to whether they would lease this interest or not. Blankenship and Frank Holloway, Trustees for cemetery, a/k/a Thompson Cemetery 09/18/2014 Bryan Perry is search for a valid address and telephone number for this interest. 09/30/2014 Bryan Perry performed an internet search at peoplefinders.com, but all searches have proved unsuccessful in locating this interest. 09/30/2014 Bryan Perry searched at rootsweb.com and ancestry.com and was able to learn that the cemetery itself is located in Jerusalem, AR. 10/09/2014 Eric Catlett is attempting to determine if either of the people listed as trustees are still living. 10/21/2014 Eric Catlett spoke with Jimmie McGee, a grave digger for the Atkins, AR area. Mr. McGee stated that the last person buried in Thompson Cemetery was in 1915 and that it is not currently under any supervision, now would he know who to speak with regarding this interest. Mr. McGee also stated that both J. N. Blankenship and Frank Holloway are both deceased. He offered to take Eric to the cemetery if he wanted to take pictures to show that it had not been maintained in several years. 11/05/2014 Eric Catlett states that he has been unable to determine who he would need to speak with regarding this interest. He was able to obtain information from the Pope County Library giving directions to the cemetery and information regarding the six individuals that are buried there. 5

15 Lacie Hays Caughron and Brandon Caughron, purported heirs of Ila McGee 10/06/2014 Eric Catlett visited the last known address for this interest, and was able to speak with a niece of the McGee s. The niece informed Eric that both Carol McGee and Ila McGee are deceased. Eric is checking the records at the Pope County courthouse to see if a probate is filed for either party. 10/07/2014 Eric Catlett located a probate filed of record for Ms. McGee. Eric is providing a copy to the client for review so a determination can be made as to how this will affect title. 10/08/2014 Eric Catlett states that the probate for Ms. McGee has been submitted to the title attorney. 10/21/2014 Eric Catlett received a response from the title attorney regarding the rightful heirs of Ila McGee. Eric is attempting to contact the family spokesperson in order to set up a time to meet with the family. 10/23/2014 Eric Catlett met with several members of the family and was able to answer their questions regarding this interest. Eric states that from this point forward, he will deal with each individual heir of Ila McGee. 10/24/2014 Eric Catlett states that Debbie Hays was at the family meeting. She stated that her husband, Alan Hays had passed away. Eric states that he is currently working with Ms. Hayes and their four children (Mathew Hays, Jesse Hays, Tyler Hays and Lacie Hays Caughron) in order to prepare an Affidavit of Death and Heirship for Alan Hays. 11/05/2014 Eric Catlett spoke with Ms. Debbie Hays, who stated that she would be sending the executed Affiavit of Death and Heirship in the next few days. 8

He was asked to call back in ten minutes. 10/02/2014 Eric Catlett called back to speak with the branch manager, but she was assisting a customer at the time of the call. Eric left a message with the person that answered the phone and asked that a message be delivered requesting a call back. 10/02/2014 Eric Catlett received a telephone call from Pat Duvall, branch manager for Centennial Bank, formerly Bank of Atkins. Ms. Duvall requested that the lease offer be made in writing, as well as ing a support letter to her to submit to her regional manager. Ms. Duvall will be providing Eric s contact information to his regional manager so he can contact Eric directly regarding this interest. 10/03/2014 Eric Catlett spoke with Todd Meimestors, regional manager. He stated that they would not be interested in leasing their interest, but it was a possibility they would sign the support letter for the drilling of a well. 10/20/2014 Eric Catlett again spoke with Mr. Meimestors. He stated the bank is still unwilling to lease their interest. 10/23/2014 Eric Catlett received an from the client requesting the contact information for this interest, which he provided. 11/04/2014 Eric Catlett received a message that the client had spoken with the bank about their interest, but they were unwilling to execute any binding document. 9

Eric called the number and was able to speak with Ms. Childs s ex-husband. He stated he did not have any contact information for her. 10/29/2014 Eric Catlett located a telephone number for Ms. Childs. Eric called the number and was able to speak with her about the leasing process. Ms. Childs requested a lease be sent to her for execution. 11/05/2014 Eric Catlett called Ms. Childs to confirm receipt of her lease packet. Eric did not receive an answer at the time of his call. 10

Coffman and Connie Coffman 09/18/2014 Bryan Perry prepared and mailed a lease offer letter to the last known address for this interest. 09/30/2014 Bryan Perry located telephone number for Bryan Gullett, listed as the caretaker for this interest. Bryan called the number, but it was disconnected. 09/30/2014 Bryan Perry sent an to Mark Gullett, a personal acquaintance and known resident of the same town a Bryan Gullett. Bryan hopes that he can make contact with Mark Gullett to see if he is associated with Bryan Gullett or Tina Gullett. Bryan received a response from Mark Gullett stating he would relay contact information to Mr. and Ms. Gullett. 09/30/2014 Bryan Perry spoke to Bryan Gullett, who stated that he had just assigned the care for this interest to Jimmy Coffman. Bryan located telephone number for Mr. Coffman. Bryan called the number, but it was disconnected. 10/09/2014 Eric Catlett states that after reviewing correspondence from Bryan Perry regarding this interest, he is now attempting to locate any contact information for Jimmy Coffman. 10/21/2014 Eric Catlett located a telephone number for Betty Coffman, possible family member of Mr. Coffman, via the internet. Eric called the number, but the person that answered stated that Betty Coffman was of no relation to Jimmy Coffman, but it was possible they knew someone that was. The person that answered stated they would look into it and would call him back. 10/21/2014 Eric Catlett received a telephone call from Betty Coffman. She stated that Jimmy Coffman was her cousin, and he had passed the rights to oversee this interest to Roy Smith. Ms. Coffman stated that she would attempt to locate a telephone number for Mr. Smith. 11/03/2014 Eric Catlett states that up to this point, he has been attempting to contact Acts of the Apostles Fellowship and/or the person in charge of that interest. Eric was made aware that there could be a deed filed of record actually transferring ownership of this interest. Eric searched the Pope County courthouse records and located a Warranty Deed filed of record with Act of the Apostles Fellowship as the Grantor and Jimmy W. Coffman and Connie Coffman as Grantees. Eric states that from this point forward, he is attempting to contact the Coffman s regarding this interest. 11/03/2014 Eric Catlett spoke with Betty Coffman, cousin to Jimmy Coffman. She is going to attempt to locate a good telephone number for Mr. Coffman. 11
