1 Not Protectively Marked AGENDA NO: 7 ETHICS AND APPEALS COMMITTEE 31 JANUARY 2019 PCC DECLARATION OF INTERESTS AND OPCC GIFTS AND HOSPITALITY REGISTER REPORT BY THE CHIEF EXECUTIVE PURPOSE OF THE REPORT To provide members with the Police and Crime Commissioner s updated notification of disclosable interests and declarations of gifts and hospitality by the Commissioner and wider OPCC staff team. 1. INTRODUCTION 1.1 Following the introduction of Police and Crime Commissioners (the Commissioner) from November 2012, a Code of Conduct had been developed for elected Commissioners. This report provides members with updated information in relation to the Code of Conduct adopted by the Commissioner for Dorset and some of its associated requirements. 1.2 It is intended that any variations to the register of disclosable interests or gifts and hospitality registers will be reported to members for their information at the next available meeting of the Ethics and Appeals Committee following the variation. 2. CODE OF CONDUCT 2.1 A full copy of the Code of Conduct has previously been circulated to members of this Committee. 2.2 In line with the Code, and the requirements of the Elected Local Policing Bodies (Specified Information) Order 2011, the Commissioner is required to record and publish a register of disclosable interests. A copy of the Commissioner s disclosure, which was last reviewed and updated in December 2018, is attached at Appendix A. Where any variation to the disclosure is required this will be made as soon as is practicable. 2.4 The Commissioner and staff of the Office of the Police and Crime Commissioner (OPCC) are also required to record and publish a register of any gifts and hospitality received and/or declined during the course of their duties. Details of the updated gifts and hospitality received and/or declined by Mr Underhill and the OPCC Staff in the last quarter is attached at Appendix B. 1
2 Not Protectively Marked 2.5 The Code of Conduct, register of disclosable interests, and gifts and hospitality register are all published on the OPCC Dorset website and therefore publicly available for scrutiny. 3. REPORTING TO ETHICS AND APPEALS COMMITTEE 3.1 It is intended that any variations to the register of disclosable interests or gifts and hospitality registers will continue to be reported to members for their information at the next available meeting of the Ethics and Appeals Committee following the variation. 4. CONCLUSION 4.1 The Oath of Office and Code of Conduct are important documents for setting out the underlying principles for the Commissioner to abide by in undertaking his role and responsibilities. The Commissioner is determined to operate transparently and to abide by all of the requirements to publish information. This report updates the Committee on the details that will be published following the meeting. 5. RISK/THREAT ASSESSMENT Financial/Resource/Value for Money Implications 5.1 No specific risks identified. Legal Implications 5.2 The PCC has statutory responsibilities with regard to the disclosure and publication of disclosable interests and gifts and hospitality. Implications for Policing Outcomes 5.3 The Code of Conduct sets out clear standards to ensure that all aspects of the Commissioner s role, including any decisions taken, are carried out in an open and transparent manner and with integrity. Equality 5.4 No specific risks identified. 6. RECOMMENDATIONS 6.1 Members are RECOMMENDED to note the report. 3 Appendix A CODE OF CONDUCT NOTIFICATION OF DISCLOSABLE INTERESTS [Pecuniary and Non-Pecuniary] In this notification of disclosable interests: POLICE AND CRIME COMMISSIONER body in which the relevant person has a beneficial interest means a firm in which the relevant person is a partner or a body corporate of which the relevant person is a director, or in the securities of which the relevant person has a beneficial interest; director includes a member of the committee of management of an industrial and provident society; land includes an easement, servitude, interest or right in or over land which does not carry with it a right for the relevant person (alone or jointly with another) to occupy the land or to receive income; elected local policing body means the elected Local Policing Body to which the relevant person has been elected; relevant period means the period of 12 months ending with the day on which the relevant person makes an entry, amendment or deletion to the register of disclosable interest; relevant person means the person (s) who is/are elected/appointed Police and Crime Commissioner who is making the notification of disclosable interest set out below: securities means shares, debentures, debenture stock, loan stock, bonds, units of a collective investment scheme within the meaning of the Financial Services and Markets Act 2000 and other securities of any description, other than money deposited with a building society.
