Road, Faridabad - i21003 PETITIONER AFFIDAVIT ON BEHALF OF THE PETITIONER IN TERMS OF THE ORDER DATED PASSED BY THE HON'BLE TRIBUNAL I, Anil Jindal, aged about 53 years, S/o Sh. Girraj Singh occupation business, R/o H. No. 538, Sector-14, Faridabad do hereby solemnly affirm and declare as under: 1. That the present petition has been filed by the petitioner Company under Section 74 of the Companies Act, 2013 for seeking extension of time for repayment of its deposits. 2. That the honorable Tribunal of New Delhi had allowed the extension of time for the repayment of deposits by the petitioner Company on certain terms & conditions vide its orders dated - 20 th October, 2016 and 2 nd February, 2017 and passed the following directions for repayment of deposits: - All FDs which have matured upto 30 th September, 2016 shall be repaid together with the interest in the following manner: a. 30% in six months' time i. e. from October, 2016 to April, 2017 b. 30% within the next six months. c. Balance 40% within three months thereafter. With respect to the FDs maturing from 1 st October, 2016 onwards time is granted as under:- a. 10% on maturity b. 10% after six months of maturity

2 c. 15% after one year of maturity d. 15% after 1.5 years of maturity e. 25% after two years of maturity f. Balance 25% after 2.5 years of maturity 3. That the Petitioner Company due to difficult financial conditions because of the effects of demonetization, implementation of GST, imposition of excise duty on jewellery business and wavering business conditions could not repay the deposits as per the scheduled time prescribed by the honorable Tribunal of New Delhi in its orders dated 28 th October, 2016 and 2 nd February, That the present matter was previously listed before the honorable Tribunal on 22 nd August, The Petitioner Company had explained its difficult financial condition and reason for non-payment of deposits as per prescribed period before the honorable Tribunal. 5. That the honorable Tribunal had directed the petitioner Company to make the due payments of deposits upto the principal amount of Rs.l lac to the depositors present in the court. Further, to pay 10% of the Principal amount to senior citizens aged above 70 years, present in the court. 6. That the petitioner Company has complied with the directions passed by the honorable Tribunal and the documents have been uploaded on the website of the Company i.e. The documents referring the disbursement of the said payment is enclosed herewith as "Annexure-Al, A2 & A3". 7. That the petitioner Company has also made payments to the depositors present in the hon'ble Tribunal on 22 nd August, 2017 in addition to the directions passed by the hon'ble Tribunal. The details of the said payments are enclosed herewith as "Annexure-B". 8. That the petitioner Company hereby wants to make the following requests before the honorable Tribunal: - a) To allow further extension of 2 years for the amounts due but not paid as on 31 st August, 2017 i.e. the amount of deposits due as per the order of NCLT, New Delhi upto 31 st August, 2017 to be paid by 31 st August, 2019;

3 b) For the deposits payable from 1 st September, 2017 onwards - To allow further extension of 2 years from the date the deposits/installments became repayable as per the orders dated 20 th October, 2016 passed by the Hon'ble Tribunal of New Delhi; c) To allow to make repayment of deposits and interest in any mode by cheque/demand drafts/pay order which shall be sent by registered post / couriers /speed post to the respective depositors or personally to the deposit-holders or by crediting the amount in their account as NEFT/RTGS; d) To allow the Company to pay interest half yearly; e) To direct the depositors to stop the litigations u/s 138 of the Negotiable Instruments Act, 1881 by the Depositors whose payments are made regularly as per the Scheme approved by NCLT, New Delhi or as may be approved by this hon'ble tribunal; f) The personal appearance of deponent on each date of hearing to be exempted considering his frequent travelling for business purposes. However, the Deponent undertakes to be present on the date of hearing, if required by the hon'ble Tribunal. The present affidavit has.been filed bona-fide and in the interest of justice.
