3 ITEM 5 FUEL SURCHARGE ONT will apply a fuel surcharge to the linehaul freight charge(s), based on the monthly average price of U.S. No. 2 Diesel Retail Sales by all sellers (cents per Gallon) Highway Diesel Fuel (HDF). In no case will freight charge(s) be reduced below the Base Freight Charge(s) as a result of the application of this tariff, nor will application or removal of the fuel surcharge be retroactive. ITEM 10 SOURCE FOR PRICE OF HIGHWAY DIESEL FUEL The source for the price of OHD is the U.S. Department of Energy s, Energy Information (DOE- EIA) Retail On-Highway Diesel Prices Report, whose monthly average price is available under 2-M Diesel Prices All Types. The referenced DOE-EIA publication can be currently found at: In the event that the DOE-EIA ceases publication of the above information, ONT will employ a suitable substitute source of price or measure. ITEM 15 FUEL COST ADJUSTMENT FACTOR When the monthly average price of HDF equals or exceeds $2.12 in the second calendar month prior to the month in which the fuel surcharge is applied, the fuel surcharge rate per mile as shown in the HDF Fuel Surcharge Table as presented in Item 40 will be applied to the linehaul freight charge. ITEM 20 RAIL MILEAGE CALCULATION Rail mileage will be calculated using the most recent version of 3 rd party software PC*Miler/Rail (ALK Technologies) on each linehaul movement. Where the rail miles are not available through PC*Miler/Rail, ONT will calculate and publish the mileage independently.

4 ITEM 25 EXCHANGE RATE For customers who are invoiced in Canadian Dollars, the U.S. Highway Diesel Fuel surcharge will be converted to Canadian currency. The exchange rate will be based on the Bank of Canada monthly average rate of exchange for U.S. funds in the second calendar month prior to the month in which the fuel surcharge is applied. The average monthly exchange rate is available at: In the event that the Bank of Canada ceases publication of the above information, ONT will employ a suitable substitute source of price or measure. ITEM 30 DATE OF HDF FUEL SURCHARGE & EXCHANGE RATE APPLICATION The date of surcharge and exchange rate application shall be applied as follows: HDF Average Price & Bank of Canada Exchange Rate (for invoices in Canadian Funds) During the Calendar Month is used to calculate the surcharge on: January March 1 February April 1 March May 1 April June 1 May July 1 June August 1 July September 1 August October 1 September November 1 October December 1 November January 1 December February 1 ITEM 35 IMPLEMENTATION This fuel surcharge applies to all publications that directly reference Tariff 2000-B. All contracts referencing other fuel surcharges will continue to apply until they expire

5 ITEM 40 HDF FUEL SURCHARGE TABLE Notification of any fuel surcharge changes will be available a minimum of 20 days prior to the beginning of each calendar month and forms part of this tariff.
