Sub: Discrepancies in JAO LICE against 40% quota held on Ref: This Union's letter No. BTEU(BSNL)/JAO Moderation/2016 Dated *** Respected Sir, A kind reference is invited to this Union's letter dated wherein we have brought to your kind notice the discrepancies that have taken place in the matter of valuation of the JAO 40% LICE vis-a-vis paper setting and availability of key etc.(copy of the letter is enclosed herewith for your kind reference). In this connectino we would like to bring to your kind notice the following issues for taking further necessary action in the matter please. Due to the discrepancies as stated in our letter dated several deserving candidates have not qualified in this exam with very less margin. We feel extremely about the way the entire issue has been handled without correction in the Question Paper and Answer sheet. It is, therefore, requested to consider the discrepancies (as listed below) and order immediate appropriate action. In this connection, we humbly request the management to review Paper-1 & Paper-2 on the basis of discrepancies cited by us. Management will appreciate the concern of the candidates that evaluation of answer sheets of the candidates on the basis of wrong answer keys may substantially alter the result of the above said examination. It may result into distortion of the merit list or even leaving out some deserving candidate altogether; thereby defeating the very purpose of conducting the LICE to give fast track promotions to the meritorious employees. In such circumstances, we shall look forward to the principles laid down by the apex court which say that merit shall not be allowed to be the casualty of wrong question and answer key and the correct answers shall not be sacrificed. It is, therefore, requested to kindly consider

2 the discrepancies listed in Annexure-I and order immediate appropriate actions for removal of the same before evaluation of answer sheets. As the issue is linked to the career of a numbers of candidates, no amount of mistake should be compromised. Sir, we would request you to kindly constitute an expert committee immediagtely to get to the bottom of the issue and see that justice is done to the officials who could not clear the examination. Sub: Discrepancies in JAO LICE against 40% quota held on Reg Respected Sir, It is to bring to your kind notice that discrepancies have taken place in the JAO LICE 40% quota exam which was held on 17/07/2016. It was stated under the instructions in hall ticket issued to the candidates that the OMR answer sheet and Question paper of the candiate will be sent to their registered IDs for cross verification with the key issued by the BSNL recruitment section. But to the surprise of the candidates, the question paper and the answer key in question are neither forwarded to candidates individual mail ids nor displayed in intranet. Further, aggrieved candidates applied through RTI for supply of OMR answer sheet and key. Even after a lapse of more than one month, no reply has been received from RTI section by any of the candidates. We have obtained question paper and key and observed the following discrepancies and found the apprehensions of the candidates are quite genuine. Question NO: 72 of part B of paper-i is as follows. Which are negotiable instrument? (a) Money Order, Postal Order, Share certificates (b) Promissory note, bill of exchange, cheque (c) Bill of lending Railway receipt, share certificates (d) Postal orders, share certificates, railway receipts. It is understood that marks are awarded to the candidates who gave the answer as option A.But the correct answer as per the reference book prescribed by the BSNLCO,ND for the examination is option B.

8 -2- Question No:80 EPF Contribution under EPF act must be paid in.. days from.. the (a) 12, beginning, excise commissioner (b) 15, close, provident fund commissioner (c) 10, close, provident fund commissioner (d) 15, close, provident fund commissioner There are two answers both (b) & (d) were given same as, so marks must be awarded to the candidates who gave the answer either (b) or (d), but it is learnt that marks are awarded to the candidates those who furnished the answer as (b). Question NO: 100 One of the following is not exempted from service tax? (a) Infrastructure charges (b) Free telephone at airports or Hospitals where no bills issued (c) IUC (d) NONE Both (b) & (c) are not exempted from service tax. But the marks are learnt to have been given to the candidates who gave the answer (b). Question NO: 30 of part A of paper II. Present Rate of service Tax with Education and Swatbharat Cess is? (a) 12.5% (b) 14% (c) 14.50% (d) 10% The correct answer is ( C). But the candidates were given marks for (b). PAPER II Part-B Question NO: 77. 9 Question No Amount of Cyclone Advance: In the key, it was given as Rs.5000 whereas in BSNL it is Rs.2500/-. Note: Prior to 6 th CPC the amount was Rs.2500/-. As BSNL was formed after 5 th CPC, though it was revised as Rs.5000/- in 6 th CPC, in BSNL, the prevailing Rs.2500/- slab has not been changed. Hence, for E1 to E2 training material issued by RTTC, it was clearly stated under loans & advance, for flood/drought/cyclone advance as Rs.2500/- recoverable in 25 equal installments. Your kind consideration of the above points will bring solace to a large number of candidates. It may not be out of place to state that there are more than 1500 vacancies in BSNL left unfilled after the aforesaid examination.
