4 TERMS & CONDITIONS FOR NGIV TRADE DAY The NGIV has in place a Risk Management Framework for all events managed by the organisation. The Risk Framework has identified specific responsibilities for all persons attending these events. These terms and conditions govern Nursery and Garden Industry of Victoria (NGIV) ABN and each Trade Day Buyer that has applied to or/currently buys at NGIV s Trade Day. 1. TRADE DAY BUYERS APPLICATION 1.1. In the interests of NGIV and its member stand holders, NGIV reserves the right to deny a buyer s application, if the applicant is not considered a legitimate business or trading within the industry, and if applicable, is not registered to trade in Victoria. In order to serve its members, the following terms and conditions will apply to all Buyers Under Victorian legislation, unless a business is trading as a sole trader under his/her name only, all trading businesses must be registered to trade in Victoria, either through ASIC (if they are an constitutional corporation) or through the Office of Fair Trading (if they are a sole trader or partnership) Trade Day Buyer Application forms should be accompanied by 3 trade referees and a current Certificate of Registration, if applicable. 2. FINANCE/INVOICING 2.1 Annual renewals for NGIV Membership, Trade Day Buyers and Premium Trade day Buyer memberships are invoiced at the start of the new financial year. 2.2 Non payment of your Trade Day Buyer and Premium Trade Day Buyer invoices within 30 days, will result in your trade day cards being invalid, you will not be able to gain access to future Trade Days and you will be in default of your membership. 3. TRADE ENTRY & BY-LAWS 3.1 Entry to the Trade Day site can only be gained by wearing your current Member or Buyer Card. 3.2 Trade Day Cards must been worn by all attending Trade Day, for the duration of market. The cards remain the property of NGIV. If a business ceases to trade, or staff members leave employment, NGIV must be notified in writing and the cards destroyed immediately. If a member/stand holder loses a card, a replacement fee may be charged. 3.3 It is a condition of entry for all Buyers and their employees that closed footwear is worn at all times during Trade Day. 3.4 It is a condition of entry for all Buyers to have available for inspection their Buyer credentials at all times. 3.5 It is a condition of entry that all Buyers adhere to the commencement and cessation times for Buying. 3.6 All Buyers are expected to advise NGIV officials immediately of an injury, chemical spill or soil spill. 3.7 Failure to abide by any of these by-laws may result in the cancellation of your right to attend NGIV Trade Days.

5 4. PRIVACY 4.1 The information we collect about Buyers is used to facilitate application for Trade Day. Buyers contact details are not disseminated to any party not connected to this event. 4.2 Buyers names may be included on a delegate list only name, title and company will be displayed. 4.3 Photographs taken at any NGIV program or event may be used for promotional purposes on the NGIV website and in NGIV publications.
