19 Terms and Conditions If an advertising agency is the contractor, the contract shall be established with the agency, not with the agency's client. If a third party (the client of the agency) shall become contractor of Finance Media, the former shall be named explicitly by the agency. The client's contract with the agency has to be proven. The minimum scope of an order is 2,000 after discounts and after the agency's fees. For orders placed via an advertising or media agency an agency fee of 15% on the client's net amount is allowed, if and if only it is disclosed on the offer or the order. The client's net amount is the bill's total sum exclusive of VAT and after deduction of all discounts. The contractor shall deliver the advertising media at least two working days before the start of the campaign. They have to correspond to the current available technical specifications of Finance Media. Any deviations have to be agreed on by Finance Media GmbH. Finance Media has the right to mark any advertising that is not discernible as such with an indication Advertisement or Advert. The client covenants that the media delivered by him or her are free of any malware. It is the client's duty to inform Finance Media immediately about any anomalies in the advertising media delivered. Generally, the conditions of payment of Finance Media GmbH shall apply. Special agreements that are explicitly stated in the confirmation of the order will apply. The invoice amount is payable without delay and is falling due within 10 days on an account of Finance Media. New clients and clients outside the European Union shall pay in advance. Any termination of advertising contracts has to take place in written form. Up to two weeks before the begin of campaign, advertising contracts can be terminated by the client free of charge. In case of a termination less than two weeks before the begin, a cancellation fee of 30 % will be charged. In case of a termination after the start of the campaign, 50% of the value of the order which is still open at the termination of the publication will be charged. Any services that Finance Media will provide until the end of the contract have to be paid for. The terms and conditions apply to all offers and services of Finance Media in the area of marketing of advertising space.
