1 STATEMENT OF PARTICULARS NB: ILLUSTRATIVE EXAMPLE ONLY Ecclesiastical Offices (Terms of Service) Regulations 2009 Statement of Particulars of Office for the Revd James Smith as Priest in charge of St Mary s, Anyplace This Statement is issued under Regulation 3(1) of the Ecclesiastical Offices (Terms of Service) Regulations 2009 ( the Regulations ). 2 SECTION ONE Appointment and office 1 This statement is issued by the Archdeacon of Oxford, the officer of the diocese nominated for this purpose under Regulation 3 by the Bishop of Oxford It relates to your terms of service and is issued alongside the Role Description/ Working Agreement put together locally 2 Your appointment took effect on 29 September You hold office under common tenure from 31January You hold the Bishop s licence and office in accordance with 5.1 The Canons of the Church of England 5.2 The Ecclesiastical Offices (Terms of Service) Measure The Ecclesiastical Offices (Terms of Service) Regulations Copies of the Ecclesiastical Offices (Terms of Service) Measure and Regulations 2009 are available at or in the diocesan clergy handbook at website link. 7 Other material relevant to your office of which you should be aware includes: 7.1 Guidelines for the Professional Conduct of Clergy 7.2 The Ordinal 7.3 The Diocesan clergy handbook at website link (available from 01 February 2011) SECTION TWO Termination of appointment 1 Your term of office may be terminated only in accordance with the circumstances set out at Section 3 of the Measure. 2 Copies of the Ecclesiastical Offices (Terms of Service) Measure and Regulations 2009 are available at or in the diocesan clergy handbook at website link. In particular, Section 3 permits the bishop to terminate the licence of a priest in charge when the vacancy comes to an end on the appointment of an incumbent of the benefice. Your entitlement to compensation in these circumstances is governed by Regulation 30(6). P Shajko 2
3 3 You are required to give at least 3 months notice before resigning your appointment. This period may be waived by agreement between you and the Bishop of Oxford SECTION THREE Stipend, grants, pension and other benefits 1 The office you hold is a full-time stipendiary post. 2 Under Regulation 11, you are entitled to a stipend of at least the National Minimum Stipend specified by the Central Stipends Authority. 3 Your Stipend is paid at the incumbent rate The amount of your stipend is 23,395 per annum (effective from 01 April 2010) as approved by the Diocesan Synod, payable by BACS transfer on the last working day of the month. 4 You will receive each month an itemised statement of stipend from Payroll Services, who will also notify you of any change in the amount of stipend payable. 5 The body responsible for the payment of the stipend is the Oxford Diocesan Board of Finance (ODBF). 6 For further details of how your stipend is calculated, see your monthly itemised statement of stipend or your diocesan clergy handbook at website link. 7 For details of grants made by the ODBF (for example those for first appointment, resettlement, removal and retirement), see your diocesan clergy handbook at website link. 8 You must give details to the diocesan office of any additional income you receive arising from your office. Pension 9 Your service is pensionable within the terms of the Church of England Funded Pensions Scheme. 10 There is no contracting-out certificate in force stating that the office is contracted-out employment for the purposes of Chapter 1 of Part III of the Pensions Schemes Act P Shajko 3
4 SECTION FOUR Parochial and other fees 1 You have no legal entitlement to receive fees in accordance with the current Parochial Fees Order made under the Ecclesiastical Fees Measure You must report, as required, all fees received by you to the Oxford Diocesan Board of Finance. If you do not assign your fees, the amount you receive in fees will be taken into account in calculating your stipend. 3 You are entitled to the reimbursement of expenses reasonably incurred in connection with the exercise of your office. Reimbursement is the responsibility of the parochial church council(s) of the parish/es) in which you serve. SECTION FIVE Housing 1 You are entitled under Section 4(1) of the Measure to be provided with a house of residence. 2 Your relevant housing provider is the Diocesan Parsonages Board. 3 The address of the house provided for the better performance of your duties is 21, Anyplace, AB1 2CD 4 The house you occupy is owned by Diocesan Parsonages Board 5 The duties of your designated housing provider are set out at Regulation Your duties in respect of your accommodation are set out at Regulation This legislation can be obtained at or from your diocesan office. SECTION SIX Ministerial development reviews 1 Under Regulation 18 (i) the Bishop of Oxford is required to make and keep under review, a scheme for Ministerial Development Review, and you are required by Regulation 18 (3) to co-operate in any ministerial development review undertaken under that regulation. 5 2 Every three years, your review will be with your area bishop or archdeacon. In the intervening years, your review will be with a trained bishop s reviewer. 3 Further details can be found at the diocesan clergy handbook at website link or the following link w&gid=175&itemid=74. SECTION SEVEN Continuing ministerial education 1 The Bishop of Oxford will make and keep under review a scheme for CMD across the diocese, and you are required by Regulation 19 to participate in arrangements approved by the diocesan bishop for your continuing ministerial education. 2 Further details can be found at the diocesan clergy handbook at website link SECTION EIGHT Leave Rest periods 1 You should follow the arrangements set out in your diocesan clergy handbook at website link for reporting leave and covering absence. 2 You are entitled to an uninterrupted rest period of [24 hours] in each period of seven days. 3 Your weekly rest period may not be taken on (delete, amend or add as appropriate): a Sunday; 4 any of the Principal Feasts of the Church of England as set out in the Canons and Common Worship; Ash Wednesday; Good Friday; The Parish s Patronal Festival.] Annual leave 5 For annual leave purposes the year runs from 01 January to 31 December each year. 6 6 You are entitled to 36 days annual leave including four Sundays for this calendar year and thereafter 36 days annual leave in each leave year. 7 In addition, you are entitled to: the following bank holidays(or time off in lieu) : 6 Your days of annual leave may not be taken: More than four Sundays a year any of the Principal Feasts of the Church of England as set out in Canon B6 paragraph 2 Ash Wednesday Good Friday The Parish s Annual Retreat Special Leave 7 The Bishop may grant you an additional period of special leave in particular circumstances. Maternity, paternity, parental and adoption leave and time off work to care for dependants 8 You are entitled as appropriate to maternity, paternity, parental and adoption leave, all as specified in Regulation 23 and the Ecclesiastical Offices (Terms of Service) Directions [2010] and time off to receive ante-natal care as specified in Regulation You are entitled to request time off, or adjustments to the duties of the office, to care for dependants in accordance with the Ecclesiastical Offices (Terms of Service) Directions [2010]. Time off for public duties 10 You are entitled to spend time on public duties, as specified in Regulations 24 and You shall not suffer any reduction in stipend for time spent on public duties unless specified otherwise below. 12 For further information on leave in your diocese, see the diocesan clergy handbook at website link P Shajko 6
7 SECTION NINE Sickness; arrangements; pay and conditions 1 Your obligations and rights if you are unable to perform your duties because of sickness are set out in Regulations 27 and You are required to inform the Archdeacon of Oxford, the officer of the diocese designated for this purpose, if you are unable to perform the duties of your office because of illness. This is in order to comply with the rules of the statutory sick pay scheme. SECTION TEN Capability procedure 1 The Archbishops Council has issued a Code of Practice under Regulation 31. Diocesan Bishops are required to have regard to this Code if they have grounds for concern about the performance of an office holder and institute an inquiry into his or her capability. 2 Should your performance while carrying out the duties and responsibilities of your office be considered to fall below an acceptable standard, you will be notified by the Bishop of Oxford that you may become subject to the Capability procedures as set out within the Ecclesiastical Offices (Terms of Service) Regulations A copy of this Code and the supporting advice issued alongside it - can be found in the diocesan clergy handbook at website link or from SECTION ELEVEN Grievance procedure 1 The Archbishops Council has issued a Code of Practice under Regulation 32 containing a procedure for enabling an office holder to seek redress for grievances. 2 If you have a grievance, you may seek redress by using that procedure, which, together with the supporting advice issued alongside it, can be found in the diocesan clergy handbook at website link or from 3 If you have a grievance, you are encouraged to take it up informally in the first instance, and, if appropriate, consider mediation. This will not affect your right to require formal consideration of your grievance under the procedure. P Shajko 7
8 SECTION TWELVE Disciplinary Procedure 1 The disciplinary rules and procedures applicable to your office are contained in the Clergy Discipline Measure 2003 and the Ecclesiastical Jurisdiction Measure 1963 that can be accessed at SECTION THIRTEEN Respondent in employment tribunal proceedings 1 The body to be treated for the purpose of the Regulations as the respondent in any proceedings you might bring before an Employment Tribunal is The Diocesan Board of Finance of the Diocese of Oxford SECTION FOURTEEN Data Protection 1 All information provided in this document will be stored on the Diocesan electronic database in accordance with the Data Protection Act No information provided here will be passed to third parties.
