1 NHS Circular: PCA(M)(2001)26 abcdefghijklm Health Department Primary Care Unit Dear Colleague EXTRA RESOURCES PACKAGE FOR IMPROVING GP RECRUITMENT AND RETENTION Summary 1. This circular provides details of the agreement which has been reached between the Scottish Executive Health Department and the Scottish General Practitioners Committee (SGPC) over the introduction of a package of measures aimed at improving recruitment and retention in Scottish general practice. The circular also provides details of an amendment to the Statement of Fees and Allowances (SFA) which takes account of the agreement reached. Background 2. The package includes: A Golden Hello payment of 5,000 to every GP who joins NHSScotland. An extra Golden Hello payment averaging 5,000 where the new GP joins the NHS in a deprived or a remote and rural area. GPs who provide General Medical Services (GMS) or Personal Medical Services (PMS) are able to qualify for payments under the scheme. NHS Boards/Primary Care Trusts (PCTs) which contain PMS pilot practices should ensure that abcde abc a

The scheme is effective from 1 April Detailed guidance on how these new measures will operate is provided at Annex A. 4. A determination of the changes to the SFA and a copy of the amendment is included in this circular at Annex B. Also, the SFA on the Scottish Health on the Web site will be amended as soon as possible. Action 5. For additional payments under the deprivation element of the scheme, PCTs/Island NHS Boards will receive a list of those practices giving details of the payment each practice will attract. They should ensure that when vacancies arise, details of the amount of additional payment the vacancy will attract are passed to the practice to enable them to inform applicants. Practices should also ensure that such details are received. 6. Applications for payment under this scheme should be completed using the claim forms provided at Annexes C, D and E. Completed forms should be passed to the PCT/Island NHS Board for authorisation and onward transmission to Practitioner Services Division. 7. Individual GPs who qualify for payment should advise their GMS general practice or PMS provider of their claim. General practices (GMS) and PMS pilot providers must ensure that the full amount of the payment (less any deductions for National Insurance or superannuation) is paid to the qualifying GP. 8. PCTs/Island NHS Boards are requested to bring this Circular to the attention of the GP practices in their area and to their Area Medical Committee for the attention of the Secretary of the GP Sub-Committee. 3 Introduction Annex A 1. Scottish Ministers announced on 9 November 2001 the introduction of a GP Recruitment and Retention scheme effective from 1 April This guidance explains how the scheme is to operate for qualifying GPs under both GMS and PMS arrangements. Eligibility for Golden Hello Payments 2. The scheme applies to Scotland only although a similar package has also been introduced in England. A GP who qualifies for payment (a qualifying GP ) is any GP who: works under either GMS or PMS arrangements; and either takes up a first GMS or PMS post as an assistant or a salaried GP or an Associate GP or as a principal (or the PMS equivalents) (an eligible post ); or takes up an eligible post after leaving the GP retainer scheme; and in either case commences or commenced the eligible post on or after 1 April A qualifying GP includes any GP who possesses a JCPGPT but who has not practised in an eligible post (or the equivalent elsewhere in the UK). A qualifying GP also includes any with an acquired right to practise but who has not so far exercised that right. 4. The scheme does not apply to: Payments doctors taking up work as a GP locum (who may qualify for payment if and when they move to an eligible post): or GPs employed on a fixed term contract for two years or less. doctors with a commitment of less than 25% of full-time 5. From 1 April 2001 every newly qualified GP taking up an eligible post will be paid a 5,000 golden hello. Eligibility for Additional Payments Remote and Rural Practices 6. A supplementary golden hello of 5,000 will be paid to every newly qualified GP taking up an eligible post in a remote and rural area. For these purposes, remote

4 and rural is defined as practices with an out of hours rota of 1:3 or worse, or practices in the area of an Island NHS Board. For out of hours cases, this payment will be available only where the Primary Care Trust/Island NHS Board, in consultation with the GP Sub-Committee, confirms that the reason for the heavy out of hours commitment is the practice s location and lack of feasible options for joining an out of hours co-operative or extended rota. Relocation Costs 7. Where a GP (whether newly qualified or not) takes up a substantive post in a practice as defined at paragraph 6, support for relocation costs are available as follows: Subject to the submission of three competitive tenders where practicable, GPs will be eligible to claim up to the first 2,000 of relocation costs, assessed against the lowest tender. Where the money is being paid for relocation costs which have taken place between 1 April 2001 and the date of this guidance, and where 3 competitive tenders cannot therefore be produced, then payments will be made on receipt of relevant details of actual costs incurred. Recruitment Costs 8. Subject to submission of appropriate receipts, practices in remote and rural areas are eligible to claim up to the first 2,000 of recruitment costs including, in exceptional circumstances, the cost of locum cover where there were difficulties and delays in finding a replacement partner and the basic practice allowance was not payable. Deprived Practices 9. A supplementary golden hello averaging 5,000 will be payable to every newly qualified GP taking up a substantive post in one of the 40% most deprived practices in Scotland. These practices have been defined using information held centrally which shows the level of deprivation payments paid to each practice per 1,000 patients. Payments will be made on a sliding scale with increases at a linear rate between 2,500 and 7,500 with those practices in the most deprived areas receiving the highest payment. Details of the 40% most deprived practices will be reviewed and amended as necessary or on an annual basis and will be passed to Primary Care Trusts/Island NHS Boards to ensure that any new GP applying for a post knows in advance whether the post attracts a supplementary payment of this nature and if it does, the level of such payment. 10. Where a practice meets both the remote and rural and the deprivation criteria, the GP will be eligible for one supplementary golden hello only, whichever is the more favourable. In addition, if, within 2 years, the GP moves to another practice/pms provider which is not within the categories defined under paragraphs 6 and 9, payments will be reclaimed in the same way as for the golden hello under paragraph 5 (see paragraph 25).

5 Retention Measures 11. Reimbursement of expenses incurred of up to 1,000 per annum will be payable to GPs, who on 1 April each year are aged 55 and over, for undertaking at least one of the following clinical/organisational activities: Providing mentoring/additional support to young GPs; Additional work on clinical governance; Relieving clinical pressure by providing additional GP sessions; Enhanced professional development; or Paying for out of hours cover. 12. Such reimbursements can be used to reduce workload pressure on older GPs who for payment purposes should inform their PCT/Island NHS Board, at the time of claiming payment, of the activities they have chosen to undertake. Claims for payment should also be accompanied by the relevant receipts. Any other activity not listed at paragraph 10 would require the prior agreement of the PCT/Island NHS Board. 13 These amounts will be reviewed for future years. Part-time GPs 14. The standard payment and additional payments are each specified by reference to a full time GP. Those GPs whose time commitment is less than full time qualify for a proportionate payment: the full standard payment ( 5,000 for ) is payable to part timers with a commitment of 50% or more those qualifying GPs with at least 25% but less than 50% qualify for a payment set at 60% of the amount payable to a GP with a commitment of 50% or more. (ie 3,000 for ) those GPs with commitments below 25% (eg an assistant employed for 1 day/2 sessions a week) do not qualify for a payment under this scheme. job sharers are eligible individually so that one or more parties to a jobshare may be eligible for a payment e.g Two job sharers each with a 50% commitment are each eligible for a payment of 5,000 Method of Payment 15. Payments for qualifying GMS GPs will be paid by Practitioner Services Division in accordance with the determination at Annex B and charged against GMS

6 non cash-limited budgets. Also attached at Annex B is an amendment to the Statement of Fees and Allowances. 16. A form for new GPs to use to claim a Golden Hello payment is attached at Annex C. The payments represent extra personal income for the qualifying GPs over and above and unrelated to any salary or partnership share or sole practitioner income they would otherwise have been paid. General Practices and PMS providers are therefore required to pay the full amount of the golden hello payment to the qualifying doctor, also as a lump sum. 17. A form for practices/qualifying GPs to claim recruitment and relocation costs, under the terms of paragraphs 7 and 8, is attached at Annex D. 18. A form is attached at Annex E for GPs aged 55 and over, who wish to claim up to 1,000 under the terms at paragraph 10. Superannuation and tax. 19. Both the initial Golden Hello payments and the additional payments to qualifying GPs are taxable and superannuable.however, payments made under the elements covering recruitment and relocation costs and retention measures are reimbursement of expenses and as such are not superannuable. Inducement Practitioners 20. Initial Golden Hello payments; additional payments; recruitment and relocation costs; and retention payments will be made to Inducement Practitioners where they are eligible to receive them and will be paid outwith the inducement payment yardstick. Extra Payments due to change in circumstances 21. Where, within 2 years of entering general practice a qualifying GP increases eligible commitment (whether within post, by starting a different post or by taking a second post) she or he may be eligible for extra payments. This means that a doctor who moves to an area attracting an additional payment with an increased commitment may be eligible to apply for extra payments both for an increased commitment and for working in an area attracting additional payments. A doctor who moves to an area attracting additional payments but without an increase in commitment may be eligible only for extra payments for working in an area attracting additional payments. 23. A doctor in receipt of a standard payment will not receive an additional payment if the area in which they practice is subsequently designated as remote and rural or deprived or if they move to another post within the same area, which at the time of moving has become designated as remote and rural or deprived. 24. For extra payments due to a GP taking a second additional post the commitment level for the individual GP would be the combined total commitment of the individual posts. It is expected that the general practice or PMS provider to whom the qualifying GP makes the greatest time commitment will accept responsibility for the full payment. Otherwise, for instance when the first post is in GMS and the second post in PMS or vice versa, financial responsibility should be shared between the qualifying GP s practices or PMS providers in proportion to the time commitment the GP makes to each. Clawback 25. Where a GP in receipt of a payment leaves general practice within 2 years of 1 April 2001 or a subsequent start date, she or he will be required to repay some or all of the payment. Where a GP has received more than one payment e.g. due to a change in circumstances and leaves general practice within 2 years of the initial payment, she or he will be required to repay some or all of the payments. The refundable amount is proportional to the actual length of service in general practice:

8 Length of Service Clawback less than 6 months- 100% 6 months - 2 years 50% More than 2 years 0% 26. These arrangements apply both to the standard golden hello payment and to the additional payment. In addition, the additional payment is separately refundable if, within 2 years the GP moves to another practice/pms provider which, at the time of the move, is not in a remote and rural or deprived area. The refundable amount is proportional to the actual length of service in an area attracting the additional payment: Length of Service Clawback Less than 6months- 100% 6 months - 2 years 50% More than 2 years 0% 27. These clawback provisions will not apply where: the area in which the GP practices ceases to be designated as a remote and rural area or deprived area. the GP moves to another post within the same area which was designated as attracting additional payments when she/he took up the first post but has subsequently ceased to be either a remote and rural or deprived area. 28. These clawback provisions will not apply where the PCT/Island NHS Board is satisfied that the GP s departure or career move is due to: death; enforced early retirement from general practice due to illness or injury exceptional personal circumstances and with the approval of the PCT/Board maternity (or other extended parenting leave agreed by the PCT/Board) provided the GP gives an undertaking (s)he will return to practise and does so within a reasonable period, to be considered case-by-case by the PCT or Board. (As a minimum absences of up to two years will normally be considered reasonable, but requests for any longer periods should be considered sympathetically by the PCT or Board). transfer to a GMS or PMS post elsewhere in the UK. 29. In all cases where repayment is required PCTs/Island NHS Boards will be expected to agree repayment over a reasonable period.

9 Duration 30. The operation of the scheme will be kept under review. Appeals 31. Existing GMS and PMS appeal arrangements apply. GPs (or their general practices) who provide or assist the provision of GMS may appeal to Scottish Ministers under paragraph 80 of the SFA. Separate arrangements apply under PMS. Monitoring 32. The operation of the scheme will be monitored. This data will be used to inform: Quarterly Monitoring; review of the scheme itself; and the existing GMS pay system. 33. Quarterly monitoring returns will be amended for this purpose from quarter 3 of this financial year onwards.

10 ANNEX B AMENDMENT TO THE STATEMENT OF FEES AND ALLOWANCES DETERMINATION Scottish Ministers, pursuant to regulation 35(1) of the National Health Service (General Medical Services) (Scotland) Regulations 1995, hereby determines that paragraph 15 of the Statement of Fees and Allowances as set out in the attached Annex C shall take effect from 1 April 2001.

12 AMENDMENTS TO THE STATEMENT OF FEES AND ALLOWANCES Recruitment and Retention Incentive Payments to GPs Golden Hello Payments 15.1 Practitioners starting a first post within the UK, or taking up their first post following employment as a GP retainee (see paragraphs ), will be eligible for payment as set out in schedule 1/paragraph 1 provided the conditions specified in paragraphs are met All qualifying practitioners are eligible for a standard lump sum payment related to their time commitment Applications for payment under this scheme will only be considered if made within the appropriate time limits as set out below. Before 1 April 2002 From 1 April 2002 within 18 months of starting an eligible post within 12 months of starting an eligible post 15.4 Eligibility for payment under this paragraph will be calculated according to the circumstances of the practitioner and post on the date the position commenced. Eligibility for Golden Hello Payments 15.5 The scheme will apply to all qualifying practitioners starting a first eligible post, or taking up their first post following employment as a retainee, in GMS on or after April 2001 provided they have never: i. been included on the medical list of any PCT/Island NHS Board; or ii. been employed by a principal to assist in the provision of general medical services under paragraphs 18, 19, or 52; or iii. been engaged in the performance of PMS as either a provider or an employee of a PMS provider except where that contract is a fixed term contract of 2 years or less. A qualifying practitioner is any GP who: works under either GMS or PMS arrangements; and either takes up a first GMS or PMS post as an assistant or a salaried GP or an Associate GP or as a principal (or the PMS equivalents) (an eligible post ); or takes up an eligible post after leaving the GP retainer scheme; and in either case commences or commenced the eligible post on or after 1 April 2001.

13 any GP who possesses a JCPGPT but who has not practised in an eligible post (or the equivalent elsewhere in the UK). A qualifying GP also includes any with an acquired right to practise but who has not so far exercised that right For the purposes of paragraph 15.5.i a doctor appointed under regulations 24(2) or 24(7) of the NHS (General Medical Services) (Scotland) Regulations 1995 to provide unrestricted general medical services will not be regarded as having been included on the list of a PCT/Island NHS Board. Payments for practitioners in areas attracting additional payments 15.7 In addition to the standard payment, eligible practitioners taking a first post in a practice within an area attracting additional payments on the first date in post will be eligible to receive a further payment as specified in Paragraph1/Schedule1. Criteria for payment shall be the same as for standard payments to doctors taking a first post as set out in paragraphs The criteria may be reviewed by Scottish Ministers from time to time. 14 Job Sharers 15.8 Each partner in a job-sharing arrangement will be eligible individually for payment under paragraphs 15.1 and 15.7 if he or she satisfies the appropriate conditions The amount of money payable will be dependent on the time commitment of the job-sharer as specified in paragraph1/schedule1. Doctors with a commitment of less than 25% of the aggregated minimum hours of both job-sharers, as specified in regulation 15 of the NHS (General Medical Services)(Scotland) Regulations 1995, as amended, will not be eligible for payment. Changes in Circumstances Extra payments These paragraphs are intended to ensure that if a practitioner has a change in circumstances involving an increase in time commitment and/or a move to or increase in time commitment in an area that attracts additional payments within two years of the first appointment she or he will be entitled to make a second claim based on these new circumstances. An increase in commitment and/or move to an area that attracts additional payments under paragraphs may occur within post, by starting a different post or by taking a second post An eligible practitioner who within six months of joining general practice increases his or her commitment (in an eligible position as specified in ) to such a level as would have attracted a higher payment had the position been the first held will receive the standard payment for their new commitment less any payment they have previously been awarded under this paragraph An eligible practitioner who between six months and two years of joining general practice increases his or her commitment (in an eligible position as specified in ) to such a level as would have attracted a higher payment had the position been the first held, will receive half of the difference between the full payment for their current commitment and the payment for their previous commitment as awarded under this paragraph Practitioners whose changes in circumstances involve a move to an area attracting additional payments, at the time of that change, will be eligible for extra additional payments. These payments will be calculated as in paragraphs An increase in commitment will not be necessary to attract payments under this paragraph Where payment under is due to a practitioner taking a second post, payments should be based only on the practitioner's percentage commitment in the area attracting additional payments Practitioners who move to another post within the same area which attracted additional payments when she/he took up the first post but has subsequently ceased to

15 attract additional payments and increases his/her commitment (in an eligible post as calculated in ) to such a level as would have attracted a higher payment had the position been the first held, will be eligible for extra additional payments. These will be calculated as in paragraphs A doctor in receipt of a standard payment does not receive an additional payment where: the area in which they practice is subsequently designated as attracting an additional payment she/he moves to a post within the same area which was not included in the list of those areas attracting an additional payment at the time she/he took up the first post but has subsequently been designated as an area attracting additional payments. Return of Payment Where, within two years, a practitioner in receipt of payments under paragraph 15.1 or 15.7 and stops providing or assisting in the provision of general medical services or performing PMS as: a GP principal on the medical list of a PCT/Island NHS Board an employee of a principal assisting in the provision of general medical services under paragraphs 18, 19, or 52 of this Statement. a PMS performer she or he will be required to return some or all of the payment received as specified in paragraph The proportion of the payment returnable will be dependent on the amount of time spent in general practice as shown below: i less than 6 months 100% ii from 6 months to 2 years 50% The provisions for the return of payments will not apply where the PCT/Island NHS Board is satisfied that the practitioner has ceased to work in this capacity due to: i. death ii. enforced early retirement from general practice due to illness or injury iii. exceptional personal circumstances and with the approval of the PCT/Island NHS Board iv. maternity (or other extended parenting leave agreed by the PCT/Island NHS Board) provided the GP gives an undertaking that (s)he will return to practise and does so within a reasonable period, to be considered case-bycase by the PCT or Island NHS Board. (As a minimum absences of up to two

16 years will normally be considered reasonable, but requests for any longer periods should be considered sympathetically by the PCT or Island NHS Board). v. transfer to a post under GMS or PMS arrangements elsewhere in the UK Periods of absence under iii and iv shall not be included in the computation of periods of time for the purposes of paragraphs and Practitioners in receipt of an additional payment shall be liable to return some or all of the sum received if they move to an area, which at the time of the move does not attract an additional payment, within two years of receiving it. The criteria for return of the money will be the same as set out in paragraphs and Practitioners in receipt of an additional payment shall not be liable to return the sum received if: the area in which she/he practices ceases to attract additional payments she/he moves to another post within the same area which attracted additional payments when she/he took up the first post but has subsequently ceased to attract additional payments Payments for non-principal Doctors new to Primary Care A practitioner employing a doctor under paragraphs 18, 19 or 52 of the SFA on a fixed term contract of more than two years will be eligible for payments under this scheme as shown in paragraph1/schedule1 provided the doctor being employed satisfies the eligibility criteria set out in paragraphs Payments will follow paragraphs The amount of money payable will be dependent on the commitment of the qualifying doctor, as agreed with the local PCT/Island NHS Board and based on the normal contracted hours within the local area of the doctor being employed. Doctors with a commitment of less than 25% will not be eligible for payment Where the doctor is employed under paragraph 19 of the SFA additional payments will be based on the percentage time commitment, as agreed with the local PCT/Island NHS Board, in an area attracting additional payments Doctors may attract extra payments if their circumstances change within two years of taking a first post. Paragraphs will apply Where a doctor becomes eligible for extra payments due to taking a second post payments should be paid to the employing practitioner with whom the doctor has the largest percentage time commitment or in such other way as agreed by the doctor, practices and PCT/Island NHS Board.

17 15.28 General practices should ensure that the full amount of the payment (less any deductions for tax, National Insurance or superannuation) is paid to the qualifying practitioner Some or all of the payments made under paragraph may be liable to be returned if within two years the doctor ceases to be employed within primary care or moves to a post in a PCT/Island NHS Board not at the time of the move attracting an additional payment. Paragraphs shall be used to determine the sum to be returned. Payments for former retainees returning to General Practice Former retainees returning to General Practice as: a GP principal on the medical list of a PCT/Island NHS Board an employee of a principal assisting in the provision of general medical services under paragraphs 18, 19, or 52 of this book. a PMS performer either as a provider/performer or directly employed by the provider(s). Will attract payment(s) under this scheme as shown in paragraphs below Payments will follow paragraphs 15.5 to except that the exclusion criteria of 15.5i iii will not apply Retainees who have worked in primary care in a position specified in 15.5i iii prior to 1 April 2001 and after having left the retainer scheme will not be eligible for payments Retainees who have already received a payment under this scheme will not be eligible for a payment unless they are applying for extra payments under Relocation Costs Where a GP (whether newly qualified or not) takes up a substantive post in a remote and rural area (as defined at paragraph 1/Sch 1), support for relocation costs is available as follows: Subject to the submission of three competitive tenders where practicable, GPs are eligible to claim up to the first 2,000 of relocation costs, assessed against the lowest tender. Recruitment Costs Subject to submission of appropriate receipts, practices are eligible to claim up to the first 2,000 of recruitment costs, including, in exceptional circumstances, the cost of locum cover where there were difficulties and delays in finding a replacement partner and the basic practice allowance is not payable.

18 Retention Incentives Reimbursement of expenses incurred of up to 1,000 per annum will be payable to GPs aged 55 and over for undertaking at least one of the following clinical/organisational activities: Providing mentoring/additional support to young GPs; Additional work on clinical governance; Relieving clinical pressure by providing additional GP sessions; Enhanced professional development; or Paying for out of hours cover Such reimbursements can be used to reduce workload pressure on older GPs. In order to secure the 1,000 payment a GP should inform their PCT/Island NHS Board, at the time of claiming payment, of the activities they have chosen to undertake. Claims for payment should also be accompanied by the relevant receipts. Any other activity not listed at paragraph would require, for payment purposes, the agreement of the PCT/Island NHS Board Applications for payment should be made using the attached forms. 28 ANNEX D APPLICATION FOR REIMBURSEMENT OF RECRUITMENT AND RELOCATION COSTS FOR GPs TAKING UP POSTS IN REMOTE AND RURAL PRACTICES This form is required for all GPs, performing general medical services, who may be eligible to receive reimbursement of recruitment and relocation costs when taking up post in a remote and rural area. Details of who qualifies under the scheme are set out in paragraph 15 of the Statement of Fees and Allowances (SFA). Where a GP (whether newly qualified or not) takes up a substantive post in a remote and rural practice, support for recruitment and relocation costs is available. For these purposes, remote and rural is defined as practices with an out of hours rotas of 1:3 or worse, or practices in the area of an Island Board. For out of hours cases, this payment will be available only where the Primary Care Trust/Island NHS Board, in consultation with the GP Sub-Committee, confirms that the reason for the heavy out of hours commitment is the practice s location and lack of feasible options for joining an out of hours co-operative or extended rota had been explored by the practice. Subject to submission of appropriate receipts, practices are eligible to claim up to the first 2,000 of recruitment costs including, in exceptional circumstances, the cost of locum cover where there were difficulties and delays in finding a replacement partner and the basic practice allowance was not payable. In addition, subject to the submission of three competitive tenders where practicable, GPs will be eligible to claim up to the first 2,000 of relocation costs, assessed against the lowest tender. Qualifying practices that wish to apply for reimbursement of recruitment costs should complete section A of this form. GPs who seek reimbursement of relocation costs when taking up posts in remote and rural areas should complete section B.
