1 2017 AMENDMENTS TO THE CERTIFIED EMPLOYEE S MASTER CONTRACT BETWEEN THE ANDERSON FEDERATION OF TEACHERS AND THE ANDERSON SCHOOL BOARD
2 2017 AMENDMENTS TO THE CERTIFIED EMPLOYEES' COLLECTIVE BARGAINING AGREEMENT Article I General Provisions A. Since none of these amendments are in any manner effective prior to July 1, 2017 and, therefore, these amendments do not overlap the state biennium budget. B. These amendments are effective at the start of the school year. A. Starting Salary. Article II Performance Based Compensation Plan The starting salary for teachers in their first year of employment with the School Corporation or reemployment are set forth in the Starting Salary Grid which is attached to these amendments as Appendix A. The starting salary for teachers hired after the start of the school year and whose first day of work will be at the start of or after the start of the school year are set forth in the Starting Salary Grid, which is attached to these amendments as Appendix B. Teachers working in their first year of employment/reemployment are being compensated pursuant to the starting salary and therefore do not receive a base salary increase. B School Year. 1. Base Salary Increase Teachers will be eligible for a salary base increase based on the two (2) statutory eligibility criteria of (1) Evaluation and (2) Experience. Evaluation is defined as those teachers who have received a evaluation rating of either effective or highly effective. Experience is defined as a teacher who either worked or was paid for one hundred twenty (120) days for the school year. 1
3 The salary base increase will be based on ninety percent (90%) for Evaluation and ten percent (10%) for Experience. The eligibility is based on the information for the school year but the base increase is for those teachers working in the school year. Each eligible teacher will receive a base salary increase of three percent (3%). The base increase will be retroactive to the start of the school year. Those teachers who retire after the start of the school year will receive the appropriate portion of retroactive pay. However, those teachers who resign without retiring after the start of the school year will not receive retroactive pay. The Salary Range without raises for the school year ranges from the beginning salary of $37, to a maximum salary of $65, The Salary Range with raises for the school year ranges from the beginning salary of $38, to a maximum salary of $67, Stipend a. Stipend 1. This stipend is a one-time stipend of One Thousand Five Hundred Dollars ($1,500.00) to be paid for those teachers employed on December 1, 2017 and to be paid on December 15, This provision will be applied so that only one (1) teacher is eligible for this stipend for any existing position. This stipend will be paid for teachers who were ranked effective or highly effective for the school year. b. Stipend 2. This stipend is a one-time stipend of Five Hundred Dollars ($500.00) to be paid for those teachers employed on December 1, 2017 and to be paid on December 15, This provision will be applied so that only one (1) teacher is eligible for this stipend for any existing position. 3. General Provisions This section will be applicable to any raise or increase provided to teachers after his/her initial year of employment on a regular teacher s contract. The Performance Based Compensation statutory criteria of Evaluation and Experience will be utilized. 2
4 Teachers who receive a evaluation ranking of needs improvement or ineffective are ineligible for any raise, increase, or stipend for the school year, except if that teacher qualifies for the exception of IC (d) and in such a case that teacher will be eligible. That statutory exception provides that teachers in their first two (2) full years of instructing students are exempt from the evaluation rating eligibility requirement and are eligible for a salary increase regardless of their evaluation rating in the prior school year. Teachers who met the criteria for a salary base increase in the previous school year but are on leave for the entire current school year will receive this school year s increase in their base salary when the teacher returns to active at-work status. Based on anticipated evaluation results, the parties believe that all funds will be distributed and that no redistribution will be necessary. However in the event that there are funds that were otherwise allocated for teachers rated in ineffective or improvement necessary, those funds will be distributed to eligible teachers in the form of a stipend. The school year is a transition year and pursuant to the 2017 Compliance RUBRIC of the Indiana Education Employment Relations Board flexibility has been provided to the parties with compliance with the statutory requirements of IC This transition flexibility has been utilized by the parties. Article III Hourly Rate for Working Outside the Contracted Day Section 16 Hourly Rate for Working Outside the Contracted Day All staff who are paid on the teachers salary schedule will be compensated at the rate of fifteen dollars and seventy-five cents ($15.75) Seventeen Dollars ($17.00) per hour for work outside the regular school day or work year which is to be additionally compensated by this agreement. Work with students outside the contracted day in connection with (1) Homebound, (2) Summer School, and (3) IREAD-3 Remediation will be compensated at the rate of Twenty-five Dollars ($25.00) per hour. These rate increases will be effective the date of ratification of these 2017 Amendments by the Board. Any claim submitted after this date will be compensated pursuant to the increased rate. This additional compensation provided by this section does not include that work which is covered by the stipends set forth in appendix b, extra-curricular stipends. 3
5 Article IV Extra-Curricular Compensation The following are changes to the Extra-Curricular Salary: 1. Add High School Choral Assistant Director High School Choral Assistant Director 2. Add CNA Director: INDEX AMOUNT.07 $2, CNA Director AMOUNT $3, annually This additional compensation is effective at the start of the second semester and will include after that date any time spent on clinicals. Since this amount is effective the second semester, the annual amount will be prorated. ARTICLE V LEAVES Add the following to the Collective Bargaining Agreement: ARTICLE XII LEAVES OF ABSENCE (UNPAID AND SABBATICAL) SECTION 12 Section 12 Unpaid Leave Employees who are absent from work without being on (1) Family Medical Leave Act provided leave, (2) a doctor s statement of illness, however, in those situations where the School Corporation has an objective reasonable basis to conclude that there is a question as to the legitimacy of the doctor s note the employee, at the expense of the School Corporation, will be required to provide additional medical verification, (3) paid status pursuant to state law, (4) paid status pursuant to this Agreement, or (5) Board approve leave, shall be considered to be in neglect of their duty, are subject to termination of their employment. 4
6 ARTICLE VI RATIFICATION OF AMENDMENTS This Agreement may be executed in several counterparts, each of which shall constitute an original, and all of which, when taken together, shall constitute one agreement. The Parties agree that signatures transmitted by facsimile, pdf, , or other electronic means are fully acceptable as much as original signatures for the execution of this Agreement.
