3 Article 1 Complement 1.1 For the purpose of this Collective Agreement the Secretariat includes: Director, Curriculum and Assessment Director, Pension and Economic Affairs Director, Policy and Public Affairs Director, Professional Affairs Article 2 Recognition 2.1 OTF recognizes the OTF Secretariat Association as the sole and exclusive bargaining agent authorized to negotiate and participate in the administration of this Collective Agreement on behalf of all members of the OTF Secretariat. 2.2 The OTF Secretariat Association recognizes the OTF Personnel Committee as the sole and exclusive bargaining agent authorized to negotiate and participate in the administration of this Collective Agreement on behalf of the OTF Executive. Article 3 Application 3.1 This collective agreement is in effect from July 1, 2015 to June 30, The conditions of Employment set out in this Collective Agreement shall continue until a new agreement is ratified. 3.3 Negotiations for a new collective agreement shall begin ninety (90) days prior to the expiration of the agreement, by notice of either party. 3.4 The party, having given notice to negotiate revisions, shall present a proposal in writing within 30 days of having provided notice to negotiate. 3.5 The terms of this Collective Agreement may be modified during the period of application of the agreement by mutual consent of the parties. Article 4 Just Cause 4.1 No member of the Secretariat shall be disciplined, demoted or discharged without just cause. 3

4 Article 5 Grievance Procedure 5.1 A member or members of the Secretariat, or the Secretariat as a matter of policy, may grieve any interpretation, application, administration or alleged violation of this agreement. 5.2 An individual, group or policy grievance shall be reduced to writing within fifteen (15) working days following the day that the cause of the grievance became known, or reasonably ought to have become known, and shall be forwarded to the Chairperson of the OTF Secretariat Association Negotiation Committee, the Secretary-Treasurer and the President. 5.3 The Secretary-Treasurer shall, within five (5) working days of receiving an individual, group or policy grievance hold a meeting with the grievor(s) and the representative of the grievor(s), as the case may be, in order to discuss and attempt settlement of the grievance. 5.4 The grievor(s), as the case may be, shall inform the President within five (5) working days of the meeting with the Secretary Treasurer if the grievance is to proceed. 5.5 The President shall, within ten (10) working days of receiving an individual, group or policy grievance, hold a meeting with the grievor(s) and the representative of the grievor(s), as the case may be, in order to discuss and attempt settlement of the grievance. 5.6 If the grievance is not resolved within ten (10) working days of the meeting held pursuant to Section 5.5, then the Secretariat shall advise the President, within five (5) working days, whether or not it intends to proceed to arbitration. In the case where the grievance is not supported by the Secretariat, the grievor(s) shall advise the President, within five (5) working days, whether or not the grievance will be referred to arbitration. 5.7 Where the grievor(s), as the case may be, wish to refer to arbitration a grievance relating to the interpretation, application, administration or alleged violation of this agreement, including any question as to whether or not a matter is arbitrable, it may, after the grievance procedure established hereunder has been complied with, notify the Executive, through the President, of its desire to submit the grievance to arbitration. The notice shall contain the name of the griever or the griever's nominee, as the case may be, to arbitration. All grievances shall be referred to a single arbitrator unless one of the parties requests an arbitration board to hear the grievance. 4

5 5.8 Single Arbitrator The parties shall submit the names of arbitrators to hear the grievance within five (5) working days of receiving written notice of intent to submit the grievance to arbitration. Either party may request the services of an arbitrator acceptable to both parties. In the event that the parties can not agree on an Arbitrator, the appointment shall be made by the Minister of Labour upon the request of either party. The arbitrator shall hear and determine the grievance and shall issue a decision, and the decision shall be final and binding upon the parties. 5.9 Board of Arbitration If one of the parties requests an Arbitration Board to hear the grievance, each party shall submit its nominee within five (5) working days of receiving written notice of intent to submit the grievance to arbitration. The two (2) nominees so appointed shall, within ten (10) working days, or within such future time as mutually agreed upon, appoint a third person who shall be the chairperson. If either party fails to appoint a nominee or the nominees fail to agree upon a chairperson within the time limit, the appointment shall be made by the Ontario Labour Relations Board/Ministry of Labour upon request of either party. The Executive, through the President, shall within five (5) working days of notification, advise the grievor(s), as the case may be, of the Executive's nominee to the arbitration board. The arbitration board shall hear and determine the grievance and shall issue a decision, and the decision shall be final and binding upon the parties. The decision of a majority shall be the decision of the arbitration board, but if there is no majority the decision of the chairperson shall govern Notwithstanding Sections 5.2, 5.3, 5.4, 5.5, 5.6, 5,7, 5.8 and 5.9 above, timelines may be established by mutual consent of the parties. Article 6 Sabbatical Leave 6.1 Definition Sabbatical leave shall mean a leave of absence with monetary consideration, granted by the Executive of the Ontario Teachers' 5

6 Federation on application by a Secretariat staff member for purposes of study, research and/or professional improvement. 6.2 Eligibility After three years of continuous experience with the Ontario Teachers' Federation, a member of the Secretariat shall be eligible for sabbatical leave. 6.3 The Executive may grant one month of sabbatical leave for each of the first three years of service and three months for each subsequent year of service. 6.4 Conditions (a) (b) (c) (d) The Executive shall decide to grant a sabbatical leave at its discretion. Application shall be made to the President of the Federation in adequate time for the completion of all necessary arrangements. No single sabbatical leave period shall exceed 12 months. The staff member shall submit an outline of his/her program. 6.5 The staff member shall be paid eight-five (85) per cent of salary and one hundred (100) per cent of benefits during the period of sabbatical leave. 6.6 Time spent on sabbatical leave shall be considered "experience" for salary purposes At the conclusion of sabbatical leave, the staff member shall return to duty with all ordinary rights and privileges. Article 7 Compensating Time 7.1 The Secretariat is employed on a five (5) day week basis. Time worked in addition to this is compensated for by an equal amount of time off during the year. 6

7 Article 8 Expenses Child I Dependant Care Expenses 8.1 Subject to the approval of the Secretary-Treasurer, child/dependent care expenses shall be reimbursed at the Federation rate for those extraordinary circumstances in which child care or care for a dependent must be provided by a person outside of the immediate family and where the member is assigned by the Secretary-Treasurer to perform a duty outside of the normal working week. 8.2 For the purposes of this Article, child care expenses will apply to children up to and including 12 years of age for day care, up to 15 years of age for overnight care, and dependent adults who reside with the member, where paid care is required in the absence of the member. Overnight care is applicable when there is no adult in the home. Travel I Work-Related Expenses 8.3 The Federation shall pay for approved, receipted expenses for Secretariat members for travel, accommodation, meals, parking and incidentals while on Federation business, in accordance with the Federation Expenses Guidelines. 8.4 The Federation shall reimburse mileage for Secretariat members for work-related travel at the rate in effect in the Federation Expense Guidelines. 8.5 The Federation shall provide parking, or provide reimbursement for parking, for Secretariat members who drive to work to the annual maximum cost of a leased parking space at 1300 Yonge Street. Article 9 Maternity/Parental/ Adoption Leaves OTF Supplemental Employment Insurance Benefits (SEIB) Plan An OTF Supplemental Employment Insurance Benefits (SEIB) plan will be in effect for a Secretariat member who has been employed by OTF for at least one (1) year as follows: (a) During the mandatory two-week waiting period for Employment Insurance Benefits, the OTF shall pay ninety-five (95) percent of the salary earned by the employee at the date the leave commenced. 7

8 (b) In the case of Pregnancy Leave, for the following fifteen (15) weeks, the employee shall receive benefits so applicable, plus the OTF supplement to bring the combined income of the employee up to ninety-five (95) percent of the salary entitlement of the employee at the date the leave commenced. (c) (d) An employee exercising her/his right to take Parental Leave shall receive SEIB plan payments for the period she/he is receiving Employment Insurance Benefits to bring the combined income of the employee up to ninety-five (95) percent of the salary entitlement of the employee at the date the leave commenced. In accordance with the requirements of the Canada Employment and Immigration Commission for the administration of Supplemental Employment Insurance Benefits (SEIB) plans: (i) (ii) (iii) (iv) (v) (vi) (vii) OTF will pay the benefits under its SEIB plan only after receipt of certification that the employee has applied and qualifies for Employment Insurance Benefits. OTF will verify this information by requesting a computer report from the Canada Employment and Immigration Commission. The employee does not have a right to SEIB plan payments except for supplementation of Employment Insurance Benefits during the seventeen (17) weeks of Pregnancy Leave plus ten (10) weeks of Parental Leave which may be extended to fifteen (15) weeks in certain circumstances. OTF will finance the SEIB payments from the General Fund Account and will keep separate accounts for those payments. The Plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan. OTF will inform the Canada Employment and Immigration Commission of any changes in the plan within thirty (30) days of the effective date of the change. OTF shall have no obligation in respect of a repayment of insurance benefits that is required of an employee. For any further period of leave, the employee shall not be paid. 8

9 Article 10 Leaves - Bereavement, Compassionate Care 10.1 Bereavement Leave Bereavement Leave of up to five (5) days with pay will be granted to Members of the Secretariat Association upon the death of spouse, children, brothers and sisters, or parents/parents-in-law. Additional leave may be granted, subject to the discretion of the Secretary-Treasurer Compassionate Care Leave A Secretariat member is entitled to a Compassionate Care Leave, as defined by the Employment Insurance and Employment Standards Acts. Article 11 Annual Vacation 11.1 Annual vacation for each Secretariat member is six(6) weeks during the first (5) years and seven (7) weeks thereafter Upon written request and subject to the approval of the Secretary Treasurer two weeks of a vacation period from one year may be deferred to the next year's vacation period for up to six months beyond the anniversary date of a member of the Secretariat Association being employed by the Ontario Teachers' Federation Secretariat members are entitled to the following holidays with pay: Canada Day Civic Holiday Labour Day Thanksgiving Family Day Good Friday Easter Monday Victoria Day 11.4 Each employee shall be guaranteed a minimum of fourteen (14) consecutive days for the Festive Season Break Religious Observance Days Pursuant to the Ontario Human Rights Code members of the Secretariat may take up to three (3) religious observance days 9

10 with pay for the purpose of observing religious days which are not covered by a) The absence is for the purpose of observing a religious holiday that is not recognized in Article 11; and b) The request for leave shall be submitted in writing to the Secretary-Treasurer by July 1 of each year, and shall specify the name and date, if possible, of the religious holiday which the employee will observe. Article 12 Pension Plan and Retirement Savings 12.1 Secretariat members, who are certificated teachers in Ontario, must participate in the Ontario Teachers' Pension Plan A Secretariat member who is not a certificated teacher, and who commences employment before January 1, 2012, must participate in the Staff Pension Plan A Secretariat member who is not a certificated teacher in Ontario, and commences employment on or after January 1, 2012, must participate in OMERS Canada Pension Plan 12.6 Each Secretariat member shall contribute to the statutory rate prescribed for employees to the Canada Pension Plan, OTF to contribute to the Canada Pension Plan at the statutory rate prescribed for employers OTF shall provide each member with the option of regular deductions of Registered Retirement Savings Plan (RRSP) contributions from salary. The amount, up to the member's annual contribution limit, shall be specified by the member. Contributions shall be forwarded immediately by OTF to the RRSP of the member's choice. Article 13 Cumulative Sick Leave Plan, Retirement Gratuity Plan and Separation Allowance 13.1 Cumulative Sick Leave Plan That there be 24 days sick leave allowed per year based on a fiveday week. 10

11 Cumulative sick leave credits from former employment may be transferred from a properly accredited plan at the discretion of the Secretary-Treasurer That the unused portion of the sick leave accumulates up to a maximum of 240 days for gratuity purposes That the use of sick leave for reasons other than illness be left to the discretion of the Secretary-Treasurer Retirement or Death Gratuity Plan In order to be eligible for the retirement or death gratuity plan, a Secretariat member must have been employed for two (2) years of continuous service at OTF A member of the Secretariat upon retirement on pension or death shall receive a gratuity based upon years of service with OTF and in teaching, as specified in and and accumulated sick leave credits To be eligible for the maximum gratuity leave the Secretariat member shall have an accumulation of 240 days sick leave credits The gratuity for a Secretariat member with less than 240 days accumulated sick leave shall be pro-rated as a fraction of The amount of gratuity paid to an eligible member of the Secretariat shall not exceed the amount of credit standing to the member's account in the cumulative sick leave plan, and in any case shall not exceed six (6) months' salary The gratuity for retirement on pension or death shall, subject to the limitations in and above, be calculated in the following manner: 2.5 per cent of salary at the time of retirement or death for each year of eligible service For purposes of section a Secretariat member shall be able to count as eligible service one point five (1.5) year of service in teaching prior to employment at OTF for each year of employment at OTF to a maximum of twelve years of previous experience. 11

12 13.3 Separation Allowance In order to be eligible for the separation allowance, a Secretariat member must have been employed for two years of continuous service at OTF Upon termination of employment with OTF, proper notice of termination in accordance with the terms and contract of employment having been given, a Secretariat member shall be entitled to a separation allowance The separation allowance shall be calculated on the basis of years of service with OTF and accumulated sick leave For calculation purposes, the maximum accumulated allowed for the purposes of separation allowance is 240 days The separation allowance for a Secretariat member with less than 240 days accumulated sick leave shall be pro-rated as a fraction of The separation allowance shall be calculated as follows: Years of Service with OTF Percentage of Year's Annual Salary Duplication of Gratuity No Secretariat member shall receive both a retirement or death gratuity, in accordance with Article 13.2 and a separation allowance, in accordance with Article 13.3 Article 14 Life Insurance 14.1 OTF pays one hundred per cent (100%) of the premium for life insurance based on the greater of three (3) times salary and 12

13 $250,000, and a like amount of accidental death and dismemberment coverage for each member of the Secretariat OTF to provide optional spousal life insurance of up to $200,000. OTF to pay zero per cent (0%) of benefit cost OTF to provide optional life insurance for dependants in the amount of $10,000 for the spouse and $5,000 for each dependent child as defined by the Income Tax Act. OTF to pay zero per cent (0%) of benefit cost OTF to provide life insurance coverage (as per agreement) to retired Secretariat members to age 65. The retired Secretariat member to pay cost of such coverage if taken In the event of the death of a member of the Secretariat, OTF pays one month's salary to the individual's estate. Article 15 Insured Benefits 15.1 OTF pays one hundred per cent (100%) of the cost of Green Shield Extended Health Plan (T-4, with Audio Plan H-1, Drug Plan 7, $2.00 co-pay, Vision Plan 7 ($300/12 months or $600/24 months - may be accumulated over 24 months), Medex Deluxe Out-Of-Canada) and Semi-Private Coverage, or equivalent OTF to provide Extended Health Care (as per preceding clause) and Semi-Private Coverage, to retired Secretariat members to age 65. The retired member to pay the cost of coverage if taken OTF to pay one hundred per cent (100%) of employee's premium (single or family) as required for Green Shield Dental Plan 49, or equivalent, based on current Ontario Dental Association's suggested Fee Guide for General Practitioners with a $2,000 lifetime Orthodontic maximum (75% co-insurance) and major restorative with an annual maximum of $4,000 (75% coinsurance.) 15.4 OTF to provide dental coverage (as per preceding clauses) to retired Secretariat members to age 65. The retired member to pay the cost of such coverage if taken. Article 16 Employment Insurance 16.1 All employees are required by law to contribute to the Employment Insurance Fund. OTF also is required to contribute to the fund. 13

14 16.2 The OTF Secretariat Association agrees that any Employment Insurance rebate will be retained by the Federation. Article 17 Redundancy 17.1 Any employee terminated as a result of redundancy: (a) is entitled to three months' notice in addition to the notice feature in the individual contract (three months); and (b) is to receive redundancy feature in the amount of two (2) months' salary per year of service to a maximum of twelve (12) months' salary The dissolution of OTF is considered to be included in the definition of redundancy. Article 18 Personal Professional Growth Personal Professional Growth includes those activities and purchases which, in the opinion of the Secretariat member, would lead to the development of current programs, to the development of new programs or to increased effectiveness of the Secretariat member Timing of the Personal Professional Growth activity shall be determined with the consultation and approval of the Secretary Treasurer Members shall be reimbursed for properly receipted annual professional fees, specifically OCT or law society dues Each Secretariat member shall be credited with $3,500 on a prorated basis for Personal Professional Growth as follows: (a) (b) (c) (d) Tuition or fees, or both, upon successful completion of a course; Conferences; Work-related expenditures; The above are subject to the approval of the Secretary Treasurer. 14

15 18.5 Any unexpended portion of the annual Personal Professional Growth allotment shall be deferred for one year only and added to the subsequent year's allotment Any deferral beyond that allowed in 18.5 shall be subject to the prior approval of the Personnel Committee Within 30 days of the completion of a Personal Professional Growth Activity, the Secretariat member shall file a report through the Secretary-Treasurer to the Personnel Committee. Article 19 Part-Time Employment, Secondments and Temporary Staff Part-time Employment 19.1 A Secretariat member may apply through the Secretary-Treasurer to the Executive to work on a part-time basis for a specified period of time Provided that the administrative arrangements can be made that are satisfactory to both the Secretary-Treasurer and the applicant, the Executive may approve the application of the Secretariat member to work on a part-time basis for a specified period of time The Secretariat member working on an approved part-time plan shall receive salary and benefits proportional to the time worked The Secretariat member shall continue to accumulate experience for salary as if on a full-time basis. Temporary Staff and Secondments 19.5 In the event an existing position(s) becomes vacant due to an authorized or statutory leave, and the Executive determines to fill the position(s), the position(s) shall be advertised as a temporary position stating qualifications required Such positions may be filled by secondment Subject to article 19.5, the OTF Executive may hire/ second temporary staff for: any leave of absence of longer than three (3) months where the leave is known prior to granting the leave, or any leave of absence longer than five (5) months where the length is not known. 15

16 19.8 Bargaining unit work is defined as work that is ordinarily performed or has been ordinarily performed, by members of the OTF Secretariat Association Temporary I Seconded staff shall be appointed by the OTF Executive through the Personnel Committee Secondments shall be for a maximum of one (1) year but may be subject to renewal by the approval of the OTF Executive through the Personnel Committee Temporary I Seconded staff who are employed for a minimum of six (6) months shall receive a progress report after initial secondment and six (6) months after renewal where the OTF Executive has granted renewal in accordance with Should a seconded member elect to maintain benefits coverage with their permanent employer, OTF shall pay the costs of such benefits in lieu of benefits under the Collective Agreement Temporary I Seconded staff shall be subject to the provisions of this Collective Agreement with the following exceptions: Article 1 (Complement), Article 6 (Sabbatical Leave), Article 13 (Cumulative Sick Leave Plan, Retirement Gratuity and Separation Allowance), Article 19 (Part-time Employment provisions), Article 23 (Secretariat Assessment for Professional Growth) The following provisions of this Collective Agreement shall apply on a pro-rated basis (pro-rated to the length of temporary employment): Article 11 (Vacation), Article 18 (Personal Professional Growth) Temporary I Seconded staff shall be entitled to two (2) sick days per month and shall commence accumulation upon date of hire. No credit shall be granted for accumulated sick leave with previous employer(s) Temporary I Seconded staff shall have no entitlement to benefit provisions in retirement Where a Temporary I Seconded employee elects LTD benefit coverage provided by OTF, any obligations to the employee with respect to LTD benefit coverage, continuation of salary or benefits by OTF, shall cease on the last date of employment of the temporary position Where a Temporary I Seconded employee is not a member of the Ontario Teachers' Pension Plan, the OTF will make contributions (in lieu of employer contributions to the OTPP) to a registered 16

17 retirement savings plan for the employee for the period of temporary employment Temporary I Seconded staff shall pay dues as may be in effect from time to time to the OTF Secretariat Association. Article 20 Long Term Disability Salary Continuance 20.1 OTF pays 100% of the cost of the premium for OTIP Salary Continuance, or equivalent of 66 2/3% salary continuance + OTPP contributions (as in effect from time to time) at the time salary continuance payments commence, with an elimination period of 60 working days integrated with sick leave and with an increase of the lesser of 5% or the actual increase in the All Canada Consumer Price Index for the period from October 1 to September 30 of the prior year as determined by Statistics Canada. If such period is less than 12 months, the maximum adjustment will be 1/12'h of the increase determined above for each full calendar month for which a benefit was paid The rate of sick leave payout after the 60 day elimination period is 33.1 /3% of current salary, or a lesser rate if so directed by the member Payment of salary continuance under article 22.1 is to OTF and OTF pays the integrated salary continuance and sick leave benefit to the member and the member's contribution on the escalated benefit to the member's pension OTF pays one hundred per cent (100%) of premium for insured benefits as set out in Articles 14.1, 15.1, and 15.3 of the OTF Secretariat Collective Agreement to a Secretariat member on Salary Continuance as set out in Article A member who is eligible for an unreduced pension or who is 65 years of age, or who is within the elimination period of being eligible for an unreduced pension or of age 65, may instruct the Federation to redirect premiums payable to the employer under Article 20.1 to prepay insured benefits available under Articles 14.4, 15.2 or Article 21 Pay Period 21.1 The pay period shall be every two weeks. 17

18 Article 22 Salary Schedule 22.1 Secretariat Experience Schedule: Effective July1, 2015 Grid Step Salary 0 153, , , , ,741 Article 23 Secretariat Assessment for Professional Growth 23.1 Rationale (a) (b) The performance assessment process is developed in relation to the Federation goals and the ethical standards of the teaching profession. The performance assessment process is designed to encourage a creative work climate and the pursuit of excellence by promoting professionalism, fostering good communications and providing for accountability Procedure (a) The Secretary-Treasurer, in conjunction with each Secretariat member, shall conduct an annual assessment of the Secretariat member for professional growth. (b) (c) The Secretary-Treasurer shall provide the member with a signed copy of the member's assessment. The member shall have the opportunity to respond, in writing, to the assessment, or any portion thereof. ( d) A copy of the assessment, and any written response shall be placed in the member's personnel file. 18

19 Article 24 Assessment for Demotion or Dismissal 24.1 Any assessment that might lead to demotion or dismissal shall be separate and distinct from the annual assessment for professional growth Any assessment for demotion or dismissal shall be initiated by a letter from the Secretary-Treasurer indicating the following: (a) (b) (c) (d) purpose of the assessment; concerns which have led to the assessment; assessment procedures; and duration of the assessment The Secretary-Treasurer may recommend, to the Personnel Committee, the demotion or dismissal of a Secretariat member whose work or attitude is unsatisfactory but only after warning the member in writing, giving the member assistance and allowing the member a reasonable time to improve The Secretary-Treasurer shall provide the member with a signed written report of the results, including recommendations, at the conclusion of the assessment The member shall have the opportunity to respond, in writing, to the assessment or any portion thereof A copy of the assessment and any written response shall be placed in the member's personnel file. Article 25 Personnel File 25.1 A Secretariat member shall have the right to examine the contents of his/her personnel file and to respond, in writing, to any document in the file Any written response to a document in a member's personnel file shall be retained in the file Access to the member's file shall be limited to the member and the Secretary-Treasurer. 23 Memorandum of Settlement Between The Ontario Teachers' Federation And The OTF Secretariat Association The parties agree to the following: 1. The terms in the attached collective agreement shall be retroactive to July 1, During the term of this collective agreement, members of the Secretariat Association have the option, by written election to the Secretary-Treasurer, to have up to one week of their unused vacation allotment per year taken as pay, rather than vacation. Such payment, if elected, is not considered pensionable salary unless permitted by the respective pension plan. 3. The salary schedule in the attached collective agreement reflects the agreed to salary grid which includes a 1.5% increase applied to a restructured grid as agreed. 4.
