Joash Nyamoko) in the chair] PRAYERS COMMUNICATION FROM THE CHAIR BOUNDARY DISPUTE The Speaker (Hon.Nyamoko): Hon. Members I have a communication to make. One, we have a flare of chaos in one of our towns which is Keroka. This is the dispute between the boundary of Nyamira County and Kisii County. I got this information a few minutes ago. Our Member of County Assembly (MCA) Hon. Sironga is in it and the information we are getting form the ground is that this may turn chaotic. For those of us who are here, in case we are able to go through this, if you make time, please try and see whether we are able to intervene in so many ways and we also get to understand what exactly is transpiring in that part of the county. I understand one of the Member of county Assembly (MCAs) of Kisii County Assembly has been hurt in those skirmishes and it could be prudent in a way of showing solidarity, if we can make a way to that part of the town. I do not have very clear details on the same. But I think as the time goes by, we should be able to understand what is happening. PAPER LAID REPORT ON REGULATIONS OF WARD DEVELOPMENT FUND 2015 Hon. I want to Table the Paper on the Regulations on Ward Development Fund 2015 (Hon. Nyameino laid the Paper on the Table) NOTICE OF MOTION IMPLEMENTATION OF REGULATIONS OF WARD DEVELOPMENT FUND 2015 Hon. Nyameino: Thank you Hon. Speaker Sir, I beg to give a Notice of Motion to implement the Ward Development Fund Regulations MOTION REGULATIONS OF WARD DEVELOPMENT FUND 2015 Hon. Nyameino: Thank you, Mr. Speaker Sir, Once again, I want to Table a Motion before this House. A Motion approving the regulations of the implementation of the Ward Development Fund Act 2015, to enable operationalize the Fund and enhance the lives and the livelihoods of the people of Nyamira County by devolving relevant services. Aware that, this hon. House passed a Bill in a form of Act in 2014 in the name of Ward Development Fund which was assented by the Governor and became law. Since then, as the Assembly we have not enacted regulations to govern this Bill. However, this Bill has not been operationalized. Today, I want to bring before you that I have been ordered to apply, operationalize and implement the Nyamira County Ward Development Fund Act This is meant to empower the community economically at the Ward level. The key indicators and paramount sections of these regulations are as follows:- One, Establishment and Administration of the Fund - I want to give a summary of what is in the regulations that are before you this afternoon. There shall be an established Fund to be known as The Ward Development Fund which shall be administered by the officer administering the fund under the direction of the County Management Board. The fund shall consist an amount of 8 per cent of the total revenue both equitable shares from the National Government and local revenue resources of the Nyamira County in every financial year. Two, any monies accruing to, donated, rent or received by the Fund from any other lawful sources. Disclaimer: The electronic version of the Hansard Report is for

3 JANUARY 14 th, 2016 COUNTY ASSEMBLY OF NYAMIRA DEBAT 3 Three, the amount referred to in Section 2(a) in the regulations shall be calculated on the basis of the most recent budgetary revenues approved by the Controller of Budget as it is in the Public Finance Management Act. Number two, in these regulations, the County Management Board is to be formed. To operationalize and to run the fund, there shall be established a board to be known as County Management Board. The County Management Board shall consist of:- One, The Chief Officer in-charge of the County department responsible for matters relating to Finance and Economic Planning or a designated alternate not below the rank of a director and shall be the chair; Two, The officer in-charge of education, his or her designated alternates not below the level of a director; Three, One representative appointed from each of the sub-counties in consultation with the County Executive Committee (CEC) Finance and Economic Planning. This shall be done within the parameters of the Constitution of Kenya especially in regards to the representation of the Youth Representative, Women Representative and Representative of the disabled. The County Executive Member (CEC) Member for Finance and Economic Planning shall appoint an officer not below the level of Director from the department of Finance and Economic Planning to administer the Fund and shall be the Secretary to the County Management Board as provided for under section 116(2) of the Public Finance Management Act (PFMA) This in total gives us a Board of seven members, two of them being ex- officio of the department of Finance and Education. Mr. Speaker, Sir; the Financial provisions have been allocated to the fund through;- One, The Member of the County Executive Committee for Finance and Economic Planning with the concurrence of the County Management Board shall for each financial year allocate funds to each ward in accordance with Section 26 of this regulation; Two, once funds are allocated for a particular project, they shall remain allocated for that project until the end of the Financial Year; Three, if for any reason a particular project is cancelled or discontinued during the financial year; funds allocated for such a project shall be retained until the Community Empowerment Fund Ward Committee decides otherwise. Four, unspent funds shall be allocated to any eligible project and such project may be new or ongoing at the end of the financial year. Five, for the avoidance of doubt, a return- as set out in the second schedule- shall be made for the current financial year and every previous financial year on which some funds remain unspent. 1. (i) All receipts, saving and accruals to the fund and the balance of the fund at the end of each financial year shall be carried forward to next financial year as pending balances for the fund. (ii) All funds allocated to a Ward shall be cumulative and shall be carried forward from one financial year to the next or funds which are not utilized for whatever reasons. 2. (i) A bank account of the Fund known as the County Management Board Fund Account shall be opened and maintained by the County Treasury at the County Level. (ii) An equivalent of five percent of the section 4 (a) shall be set aside to take care of the Disclaimer: The electronic version of the Hansard Report is for

4 JANUARY 14 th, 2016 COUNTY ASSEMBLY OF NYAMIRA DEBAT 4 county and community empowerment fund ward committees allowances, operational costs, monitoring and evaluation costs and other over heads in the committees and the Board. (iii) The signatories to the account of the Fund maintained in accordance with subsection(1) shall be the Officer Administering the Fund under section 8 (i), the Head of Accounting and one other person appointed by the County Management Board from amongst its members of the community for the purposes of the operating the account. (iv) the signing instructions shall be such that the signature of the Officer Administering the Fund shall be mandatory on all payment vouchers or instruments intended for actual release of money from the Fund, the head of accountant and the authorizing accounting officer of the implementing department who shall counter sign the voucher or instrument intended to release the money for the purposes of funding or implementing the projects as allocated in schedule 2 of this regulation. (v) The officer administering the funds under section 8(1) shall hold the authority to incur expenditure of the funds at the County Treasury. (vi) Funds from the accounts shall be withdrawn as disbursements for a particular project in accordance with the provisions of section 11 of the Regulations and for other incidental expenses relevant to the fund in accordance with these Regulations. Mr. Speaker, Sir, the budget ceiling, for each Ward shall be:- (a) eighty five percent of the amount specified in section 4(2) (a) divided equally among all Wards; (b) Fifteen per cent of the amount specified in section 4(ii) (a) shall be divided equitably as follows; by the population in the county multiplied by the number of inhabitants in that ward as per the last national population census. (c) The allocation of the Fund in Ward shall allocate in such a way that 45 per cent to fund bursaries, 45 per cent infrastructure and 10 per cent emergency. Mr. Speaker Sir, the control of projects that a Ward should be: One, handle during its financial period will be through the projects submission form specified in the Third Schedule shall be a minimum of three and a maximum of six for every ward spread evenly within the ward in each financial year. (i) No single project should be allocated more than half of the total Ward allocation. (ii) Wards with unspent funds at the end of the financial year shall submit new proposals to the County Management Board for approval. (iii) Project activities of a similar nature in a particular Ward may be combined and considered as one project for purposes of subsection (1) provided that the subprojects are listed in the Second Schedule. (iv)wards may pool resources for joint projects provided that the decision for such joint projects shall first be approved by the Community Empowerment Fund ward of each of the participating wards and shall be reflected on the projects listed for each of the participating wards. (v) Where wards have joint projects, the two committees of wards which intend to do a joint project should sit and make resolutions. (vi)where the two community empowerment fund wards committees meet; members shall nominate one between the two chairpersons to chair the joint meeting. The secretary of that meeting shall come from the other ward committee whose chairperson has not been nominated. Mr. Speaker Sir, the establishments of community empowerment fund ward committee and its composition there shall be a committee known as community empowerment fund ward committee for every ward in the county. (b) A representative of the youths in the ward; (c) A representative of women in the ward; (d) One representative of professional body in the war. (e) One representative of faith based organizations in the ward; (f) One member representing the disabled in the ward; (g) One representative of the village administrator (h) The Ward Administrator who shall be the secretary to the committee; that gives us nine members as a committee. Two, the four persons referred to in sub-sections (1) (a), (b), and (c), shall be nominated through the following procedure: (i)within seven days after the approval of these regulations, the ward administrator shall cause a public gathering at a location generally known to host such a meeting following which members of the public shall propose direct persons to the Community Empowerment Fund Ward Committee. Mr. Speaker, Sir, the minimum education level for any member of the Community Empowerment Fund Committee, shall be a holder of Kenya Certificate of Secondary Education (KCSE), except the Village Administrator who shall have a minimum of diploma level. The role of the County Assembly shall be to provide the necessary oversight and legislative role by providing for the County Assembly Select Committee of the Fund or replace it with the appropriate Committee of the House. (ii) The Assembly shall ensure that there is a public participation in identifying the projects in the Ward in reference to the County Integrated Development Plan for the County as provided in section 9(2)(a) of the County Government Act, Before I move, I want to beg this hon. House that it is long overdue that we need a Bill. This House passed a Bill. Our people have been informed and have been told in various gatherings the forums that they are about to receive support in form of either bursaries or projects that are ward-based. Since we have been lacking a regulation that will govern the fund that is being set aside, today I want to beg this House to pass this regulation and enable operationalize the fund and enhance the lives and livelihoods of our people in Nyamira County by devolving relevant services through this fund to our people so that they can feel the impact on the ground. At this juncture, I call upon Hon. Omanga to second. Hon. Omanga: Thank you, Mr. Speaker, Sir. Hon Members, this Bill is long overdue, and it is now upon us to kick-start the process of assisting the poor within the County. We have been talking about assisting the needy cases in our wards for quite too long and we do not have really much time not to pass this important Bill as moved by Hon. Nyameino. While seconding this Development Bill, I want to urge the House to look at that poor child in the village whom you have tried to assist in vain. The amount of money we get here is not enough to assist all those needy people in our wards, and this is the best thing to have ever happened to the poor child of Nyamira County. I want to seek the support of the Members that without much ado, we do agree with the proposals, which the Committee went through with the support of the legal team, that we pass Disclaimer: The electronic version of the Hansard Report is for

6 JANUARY 14 th, 2016 COUNTY ASSEMBLY OF NYAMIRA DEBAT 6 this regulation. However, I have one request to make. For immediate implementation of this regulation, there is need, hon. Members, to have accountants who will help us handle this matter. We have passed previous motions in this Assembly but implementation by the Executive becomes a challenge. Because of time, I want to suggest and seek your support that we do ask the County Public Service Board to employ at least 1 accountant in each sub-county to help us implement this noble idea. Besides helping us handle this matter, those accountants will also be helping us monitor revenue collection and ensure all the monies collected out there, anything related to money, is also controlled at sub-county level. If allowed, those people will then be answerable to the Board at the County level. I am afraid we can pass this very good regulation, but having it implemented immediately; the Executive will say they have run short of staff to help us implement it. It is long overdue for us to support the children we have in mind. We need to at least to kick-start so that we do not have grounds on which people can hold it back and say they be given time to go and employ more people to implement the Bill or the Fund which we like to pass today. With those few remarks, I do second. (Question proposed) Hon. Ombori: Thank you, Mr. Speaker, Sir, for the chance to also contribute on this very important agenda before this House. I want to say we are three-years old in this House the time in which we ought to have used this money to help our people. To be very brief, I want to say we have one working year. My feeling as a Member of County Assembly (MCA) representing Bosamaro is that we would like even this money to be lumped up in one year so that it takes a lot of those poor children that we want to support. Like my colleague Hon.Omanga has said, many are the times when we pass Motions and Bills in this House, but implementation becomes a major problem. I am proposing that, besides having Hon. Nyameino as the man behind this move, we have a follow-up Committee that will ensure that this particular motion is implemented as early as yesterday. Many of our children in the Wards sleep under the roofs of our houses and want help. You understand how much we earn as MCAs. Our money is so meager that once you help one child, ten of them follow the next day and when you are unable to assist the other ten, the one that you helped becomes useless because you are not felt anywhere. I want to say, that the office good office of the clerk in this Assembly should ensure that immediately this Motion is passed, it is across and implemented. Once, this people receive our Bills and Motions, we want them to reply to this House to ensure that they have received this and are about to implement the same. I also want to add that it is good that we have started this thing. Let us not be a laughing stock. As MCAs, let us be out there and make sure that this particular scheme as the brainchild of the elected MCAs is felt there lest it becomes a laughing stock as the Disclaimer: The electronic version of the Hansard Report is for

7 JANUARY 14 th, 2016 COUNTY ASSEMBLY OF NYAMIRA DEBAT 7 Constituency Development Fund (CDF). Let us seal all ways to avoid the abuse of this particular fund. I wish to support. Hon. Sabwengi: Thank you, Hon. Speaker; I also take this opportunity to thank the mover of this Motion, more sincerely for having brought these regulations to the House. You all remember very well, this House passed Ward Development Act one year ago but it could not be operationalized because the Controller of Budget raised queries that there was conflict, that the role of MCAs, which is oversight, was not clearly spelt out and in a way we were involved in running the Ward Development Fund. These regulations, clearly spell out our roles as MCAs. I am saying there is money in the budget; we are not going to look for money. We are going to ensure this money is used in this fund to enable our people on the ground get services. It is important that we devolve funds to the grassroots. This is one way of devolving funds to the grassroots. Hon. Nyanchama: Thank you Mr. Speaker, Sir; I also want to thank our hon. Members for attending this very important sitting. When I came from Itibo ward the message they gave me is that when I can here, I should support the motion so that they get the bursary. From the onset before I make any other comment, this is a very wonderful program, I support it. This reminds me of a classical economist called Nasik who said poor countries are poor because they are poor. Our people are poor because we are poor. The richer countries are rich because they have rolled a lot of programs to their families. Once we roll this kind of program, it will uplift the standards of our children and they will all have an opportunity to go to school. I want us to know that there is no poverty in the intelligence of our people. Intelligence is evenly distributed in the world, what is unevenly distributed are the opportunities. On account of that statement, once we raise this kind of program, our opportunities and those of our children will be increased. I want to remind this House that this morning I met the Manager of Equity Bank. They were going to vet the number of children they are going to support on the 'Wings to Fly'. This reminded me that we also need to give our children wings. If we cannot give those wings, we are going to give them legs to walk. On that account, I support this and make this observation, that if the staff will be a limitation, this House also approves that a few members of staff within the county are also dispatched to implement this. I want to say that we shall hit back with fullest force at whoever will stand in the way of this program. With all those remarks I support this move and let this walk start now not today. Hon. Osoro: Thank you, Mr. Speaker, for according me this chance and before I give my contribution, I wish the members a Happy New Year and one full of blessings. This Ward Fund has been waited for a very long time. I wish it was brought as early as three years ago. Why do I say so? Considering a vast area that an MCA covers, it is not possible for him or her to meet the educational needs of his people or the people he represents notwithstanding the needs like food, sickness and others. Given a chance with this Ward Development Fund, we are going to see a lot of changes because now we are going to have an educated mass. An educated mass makes the society healthy and rich. We are going to have very healthy enlightened people and less trouble in the society. Most of the children who do not proceed with education become destitute or they end up engaging in very unbecoming behavior in society and they end up engaging negatively which causes more trouble in society than if they were engaged in school. This fund is going to assist our youth to engage positively and therefore we shall have fewer problems in the society. I stand to say that this fund should be utilized as soon as possible once we pass this. I am also requesting the members to, first of all, to check on needy cases before checking on your relatives and friends who may be better than those people out there. The Speaker (Hon. Nyamoko): Hon. Atati, you are closer to the microphone then after that Hon. Menge. Hon. Atati: Thank you, Mr. Speaker, Sir, for also according me this chance to contribute to this noble Motion. I wanted to correct Hon. Ombori who said it is only meant for the elected members. I remember making several errands to Nairobi, meeting Controller of Budget (COB) members to contribute on this matter. The Chairman knows and he is aware of this. We want to support this because it is not meant for a particular member or class of people in this County. It involves and benefits every family in Nyamira. When we talk of poverty and when we want to eradicate poverty, we give children education. So this noble Motion has come at the right time and given that we have made several errands to Nairobi spending money. I don t expect any obstacles from the Executive to implement this because this act was approved long ago only that we had not met to approve this in the Assembly. With this few remarks, I echo and support the Motion and hope it will be implemented immediately. Hon. Menge: Thank you, Mr. Speaker, Sir, for according me the opportunity. From the look of things, as you are aware, we are in recess mood. Because of the importance of this Motion, we had to come from recess for us to come and pass this motion so that our people will get services. As other hon. Members have already spoken, I want to also throw my weight behind this Motion by saying that this is the best gift we are giving Nyamirans this year since it is a very New Year, having not gone far. As all Members are aware, this affects or cuts across all of us as Hon. Atati has said because in the morning and in the evening, ordinary mwananchi down there comes to our doors; the Kwambokas and the Mokeiras do not know that some of us are nominated and others are elected. What they are asking is that Mheshimiwa, can you assist us? This has come at the right time because our children are going to get bursaries. Our youths are going to get projects that will improve their livelihoods. I stand to support this motion and I want to emphasize the issue Hon. Omanga said that for speedy operationalization of this Bill. (Laughter) We need or the Executive needs to employ Accountants in every Sub-County so that the kitty can be processed quickly. The likes of Machuki and others are overwhelmed. If we will not create a leeway for them to employ other accountants who will be based at the sub-counties, we Disclaimer: The electronic version of the Hansard Report is for

9 JANUARY 14 th, 2016 COUNTY ASSEMBLY OF NYAMIRA DEBAT 9 will not get good monitoring of these funds because as we have said, one of the sources of this Community Empowerment Fund is revenues. Unless, we also collect good revenue, this fund may be impaired in one way or the other. Mr. Speaker, thank you very much and I want to thank the brainchild, who is Hon. Nyameino. I know he is the one who came up with the issue, of course in consultation with other elected members and I want to tell him that this has added two votes in his Gesima Ward (Laughter) If it is going to be rolled down by the elected members who had lost some votes, I think they will start getting some two or three votes and they will start smiling all the way. Thank you, Mr. Speaker for according me this opportunity. Hon Onsando: Thank you, Mr. Speaker, Sir; this is a land mark in our Nyamira County because this is what our people expect us to do. This regulation is not meant for any particular cadre. It is a regulation of Nyamira County as a Government. As a Government, if we follow this regulation closely as the Hon. Member was reading them, there should be no problem at all.there should be no discrimination of saying that one is a poor child, the other is rich, this is nominated this is elected. Children of Nyamira belong to Nyamira families regardless of your status. I therefore agree that this is a landmark of this day and is the best New Year greetings that we have given to our people in Nyamira echo the sentiments of our hon. Members that we must have someone following this implementation very closely. Otherwise, it might take another six months before it is implemented and this being elections year because we are all going out to campaign, elected members and some of us who will be contesting seats, this is a weapon for you to use. Therefore, if properly implemented like one member said, it will be a weapon for you to win both.but if poorly implemented by segreting other students or pupils from poor communities or from other wards, then it will bring us down to losing our electorate votes. I therefore congratulate the mover and I support knowing that it will be effectively implemented and followed closely to the letter to make sure that no fund is lost because this is public fund. Thank you Mr. Speaker, I support the Motion. Hon. Nyaanga: Thank you, Mr. Speaker, Sir, for this chance. Mine is also to one, congratulate the committee which compiled all this to the hon. House Whereby I am the Vice Chair of this Committee. Two,when we look at page eighteen, it recognizes all the youth, a woman, a man and even disabled people in this Community Empowering fund.this committee recognizes this people whereby there is none who is going to complain about it. Three, we know in this Nyamira County, we have got scarcity of employment opportunity whereby our young and old parents have pupils in school.this is going to help our poor parents at home.we need to educate our pupils so they prosper to be leaders as we are. This is where our people were getting school fees, now they are going to enjoy in getting some little school fees from this Empowering Fund. I support the Motion. Hon. Nyamache: Thank you, Mr. Speaker, for this opportunity to comment on this Empowerment Committee Bill. This Bill is good as our children who were going to drop out of school are going to gain. We want to give this opportunity to poor children, as we know some parents are so poor and those children who luck school fees are going to gain as they are going to get school fees to proceed with schooling or their education. You find that in some communities, when a vacancy has been advertised, we do not have these students to apply because they are school drop outs, they do not have papers so that they can also get that job. I also support this Bill to pass. Hon. Mating a : Thank you, Mr. Speaker, Sir, I also rise to support this regulation Mr. Speaker, this has been long overdue because we passed the Ward Development Fund Act long time ago, we have been waiting for such a noble regulation to make it start operating. The intent and spirit of the Constitution that was promulgated in 2010 particularly in forming counties was to develop functions back to the grassroots and this is exactly what we are going to do, so that our people are to feel what devolution means right at the grass roots. This regulation has also or is going to save us from the scorn and abuses from outside as Nyamira County because other surrounding counties have similar activities of supporting the needy and working on minor development activities which we have not. As from today, we are going to leave this House as happy people because this is to going to pronounce to the electorate that we have started working. Therefore, if this is going to happen then as elected or as MCAs from Nyamira we are going to stand tall and our county too in terms of development. Therefore, I stand to support this regulation. Number one listening to the Mover and Seconder and those of you that have contributed to the this Motion do find that there are quite a number that have a number of loose ends that need to be tied.this is between the regulations act and Ward Development Fund Act 2015 there is something that is emerging that is called the Community Empowerment Fund, that I want to believe is not catered for in the Ward Development Fund 2015 and I want to direct that for to operationalise, for us to have this implemented, it is very crucial and pertinent for us to harmonize the two documents so that they are in consonant, so that they are congruent and in harmony. I am therefore giving 14 days to the relevant committees which have been working on this to ensure that this further work is done on especially the act. So that then we are able to have this act and the regulations in harmony so that they can be useful for actually to ensure that actually implementation has been done. Otherwise, I want to also give my congratulations to the team which has been working on these regulations, it is a milestone and something which will go a long way in ensuring that there are people in this county who are able to enjoy the benefits and feel the benefits of this devolution.
