1 Clause No. 14 in Report No. 1 of Committee of te Wole was adopted, witout amendment, by te Council of Te Regional Municipality of York at its meeting eld on January 23, DEFERRAL 2 TO AMENDMENT NO. 168 (CORNELL SECONDARY PLAN) CITY OF MARKHAM Committee of te Wole recommends adoption of te following recommendations contained in te report dated December 11, 2013 from te Commissioner of Transportation and Community Planning: 1. RECOMMENDATION It is recommended tat: 1. Te deadline for Deferral 2 to te Official Plan Amendment No. 168, based on a request from te City of Markam, be extended until suc time as te revised Cornell Secondary Plan is approved and in effect. 2. PURPOSE Tis report recommends extending te deferral (non-decision) of te land use designations and policies for te Deferral 2 area witin te Cornell Secondary Plan (OPA 168) during wic time te City of Markam will complete te Cornell Centre Precinct Plan study and revise te Cornell Secondary Plan. 3. BACKGROUND Te Cornell Secondary Planning Area covers approximately 694 a (1,715 acres) of land nort of Higway 407 and east of Nint Line extending over to Donald Cousens Parkway and Reesor Road, as illustrated on Attacment 1. Te original Secondary Plan for Cornell (OPA 20) was adopted by Markam in 1994 and approved by te Region in An updated Secondary Plan for Cornell (OPA 168) was adopted by Markam in January 2008 and approved by te Region in June 2008, subject to modifications and deferrals.
2 Clause No. 14, Report No. 1 2 Committee of te Wole Tere are two deferral areas witin te Cornell Secondary Plan Deferral 1 applies to lands located on te east and west side of Reesor Road sout of Higway 7, and on te west side of Reesor Road nort of Higway 7 (sown as Deferral 1 on Attacment 1). At te time te Secondary Plan was approved by Markam Council, tese lands were not witin te Regional Official Plan s Urban Area designation. Te lands are designated Urban Area in te new Regional Official Plan ( 2010 ROP ), but are awaiting Ontario Municipal Board approval. Deferral 1 can be lifted wen te relevant portion of te 2010 ROP is approved by te Board. Tis report deals wit Deferral 2, wic applies to lands located on te nort side of Higway 7, between Nint Line and Bur Oak Avenue, extending to te Markam Stouffville Hospital (sown as Deferral 2 on Attacment 1). Regional Council as extended te deadline for a decision on Deferral 2 for te past five consecutive years. Te Region s Notice of Decision for OPA 168 issued in June 2008 states te following for Deferral 2 lands: Te land use designations and policies of Amendment No. 168 applying to te lands located on te nort side of Higway 7, between Nint Line and Bur Oak Avenue, extending to te Markam Stouffville Hospital, (as lands identified in Scedule AA, Deferral 2) are ereby deferred until January 2009 to allow te applicants opportunity for furter discussions wit te Town of Markam. Since January 2009, Regional staff as reported annually to Council recommending a one- year extension to Deferral 2. Te purpose of deferring te land use designations and policies for tis portion of te Secondary Plan was to allow te landowners to engage in furter discussions wit City of Markam staff for a revised development proposal on te lands, and more recently, to complete te Cornell Precinct Plan Study and revisions to te Secondary Plan. Te City of Markam as not yet completed tis process and as indicated te Deferral requires a furter one year extension to a February 2015 deadline. 4. ANALYSIS AND OPTIONS A revised development proposal for te subject lands is being contemplated by te landowners pending te outcome of te ongoing Cornell Precinct Plan study, in ligt of te lands strategic location and surrounding land use context. Noted below is a description of te area, te status of te development proposal and planning study for te area, and te position of Markam staff.
3 Clause No. 14, Report No. 1 3 Committee of te Wole Cornell Secondary Plan (OPA 168) supports te evolving context of te area for a iger density mixed-use centre wit a retail core Te Cornell Secondary Plan anticipates a total population of 40,000 persons, 11,300 jobs and approximately 16,000 residential units. Te majority of te population and ousing units are planned along, or in te vicinity of, te Higway 7 corridor. Te Higway 7 corridor, witin Markam and extending troug Cornell, constitutes an intensification corridor wit a regional transitway and a iger mixed-use district, Cornell Centre, wic is designated to accommodate future growt in te form of intensified urban development. Cornell Centre (as illustrated on Attacment 1) is a planned, mixed-use district functioning as a Regional Key Development Area, and integrating a balance and diversity of employment and ousing at transit-supportive densities witin a regional transit corridor. Te district is planned to function as a regional employment node, building on te Markam Stouffville Hospital and community facilities and on te opportunity to locate a igly accessible, regional scale concentration of employment activity at te intersection of major road and transit networks. Immediately to te nort of te Deferral 2 lands is te existing Markam Stouffville Hospital and Community Centre lands, wic is identified as a Community Facilities and Healt Care Campus witin te Secondary Plan. Te Region s rapid transit service will operate along Higway 7 and a regional transit terminal is planned on te sout side of Higway 7 witin te secondary plan area, just east of te deferral area. Te Cornell Secondary Plan area supports te evolving context of te area and plays an important role in city building and intensification along a regional corridor tat includes iger order transit infrastructure witin te City of Markam. Landowners are working on a revised development proposal Te participating landowners witin te deferral area are in te process of defining a revised development proposal for te site. Te landowners previously retained a market and design consultant to assess te current and future market conditions and to propose a design vision and land use plan. Te results of teir work to date ave been presented to te City of Markam staff to obtain preliminary feedback and furter direction. Te landowners ave been meeting wit Markam staff on a revised development proposal, and tey are working towards te preparation of te necessary documents for development application submission.
4 Clause No. 14, Report No. 1 4 Committee of te Wole Te City of Markam initiated a Cornell Precinct Plan Study in te spring of 2011 to provide greater planning and design direction for growt and evolution of Cornell Centre Te City of Markam is currently undertaking a study of Cornell Centre, entitled Cornell Precinct Plan Study, wic is intended to provide a development framework and design guidelines to elp guide te growt and evolution of Cornell Centre. Te Study is not yet complete, but as of te date of tis report, Markam staff anticipates tat te Study will be substantially complete in te sort term. Te Region s planned transit terminal is proposed in tis Deferral Area Te Study proposes a location for te Region s planned transit terminal on te nort side of Higway 7 to enance te integration of te Markam Stouffville Hospital wit te surrounding community nort of Higway 7. Tis will be reflected in te final Precinct Plan. Markam staff intends to revise te Cornell Secondary Plan Te Cornell Precinct Plan work is expected to result in revisions to te Secondary Plan (OPA 168), and Markam planning staff anticipates tat te deferred land use policies will likely need to be revised as a result of te Precinct Plan work. As of te date of writing of tis report, te work program for revising te Cornell Secondary Plan is being targeted for te November 5, 2013 Development Services Committee. Te landowners will likely appeal if an extension to te Deferral is not granted Sould te Region decide not to extend te Deferral, a Notice of Decision to furter approve te deferred portion of OPA 168 would need to be issued by Community Planning, followed by a 20-day appeal period. Markam staff anticipates tat if te Region moves to approve te deferred sections at tis time, te landowners will likely appeal te decision to te Ontario Municipal Board. Markam staff prefers tat a Regional approval, and any subsequent appeals, be considered in te context of a completed Precinct Plan, and local review and endorsement of any revisions to te Secondary Plan. Te City of Markam recommends te deferral be extended for one year to complete te necessary planning work In te staff report to te January 24, 2013 Planning and Economic Development Committee on te Deferral 2 lands, Regional staff recommended te fift, and final, extension to te time orizon of te deferral be granted. Prior to preparing tis report, te Region ad consulted wit Markam on te status of te Deferral lands.
5 Clause No. 14, Report No. 1 5 Committee of te Wole As indicated in a letter dated October 10, 2013 (Attacment 2), staff from te City of Markam acknowledges tat tere ave been five consecutive extensions to te time orizon for te Deferral 2 lands. However, Markam staff recommends an additional one-year extension to te deferral to allow for te necessary completion of te Cornell Precinct Plan Study, and te anticipated revisions to te Secondary Plan. Regional staff anticipates additional time will be required to process and approve a revised Secondary Plan Markam staff is establising a work program to revise te Cornell Secondary Plan, wic will generally include policy formulation, agency and public consultation, and adoption of te revised Secondary Plan by Markam Council. Te Region is te approval autority for local Secondary Plans. Once te Secondary Plan is adopted and sent to te Region for approval, Regional staff will be required to review te Plan and report to te Committee of te Wole wit a recommendation, followed by issuance of a Notice of Decision. Regional staff anticipates tis entire process will take one to two years. An appeal of te Plan to te Ontario Municipal Board would prolong te process. Once te revised Cornell Secondary Plan as final approval, te land use policies and designations for te subject lands will be in effect, and no furter extension of te Deferral (non-decision) on te subject lands will be required. Link to key Council-approved plans Te extension of te Deferral will allow for te completion of te Cornell Precinct Plan Study, revisions to te Secondary Plan, and development plans to proceed to support te objectives in te Focus Growt along Regional Centres and Corridors section of te Strategic Plan, including increasing te intensified mixed-use development, maximizing te economic development potential and optimizing te transportation capacity and services in Regional Centres and Corridors. 5. FINANCIAL IMPLICATIONS Tere are no direct financial implications associated wit tis report. 6. LOCAL MUNICIPAL IMPACT Te recommendation in tis report is consistent wit te request from te City of Markam s request to extend te time period of te Deferral.

CONCLUSION Since te approval of te updated Secondary Plan for Cornell in June 2008, te landowners witin Deferral 2 continue to work wit te City of Markam on a compreensive, mixed-use development concept for teir lands. Te preliminary concept plan is intended to complement, and promote, te integration of adjacent Markam Stouffville Hospital and community facilities. Te City of Markam staff recommends tat te Deferral be extended to allow for te completion of te Cornell Precinct Plan Study, and associated revisions to te Secondary Plan, wic wen completed, will provide greater planning and design direction for development witin Cornell Centre. City of Markam staff supports extending te Deferral (non-decision) for an additional 12 monts. Regional staff anticipates approval of a revised Secondary Plan could be upwards of two years, but once in effect, no furter extensions of te deferral (non-decision) on te subject lands will be required. Terefore, it is recommended tat te Deferral be extended until suc time as te revised Cornell Secondary Plan is approved and in effect.
