3 SAINIK KALYAN VIBHAG : RAJASTHAN CHAPTER - 1 INTRODUCTION 1.1. Background of this hand-book ( Right to Information Act. 2005). The aim of this hand book is primarily to guide the civilian citizens/ ex-servicemen / widows and their dependents to seek information concerning them / their relations serving / retired from Armed Forces of India. Therefore it will encompass the problem of the Information Act, 2005 which reads (a) To provide for setting out the practical regime of right to information for citizens. (In context of Rajya Sainik Kalyan Vibhag it will be applicable to ex-servicemen (as per orders) widows and their direct dependents only) (b) To secure / access / information under the control of Rajya Sainik Kalyan Vibhag / Zila Sainik Kalyan Karyalayas in order to:- (i) To promote transparency in the working of Rajya Sainik Kalyan Vibhag and Zila Sainik Kalyan Karyalaya (ii) Accountability in the working of the office 1.2. Objective / purpose of this hand-book (a) To promote transparency and accountability in the working of Sainik Kalyan Vibhag and to strengthen the democratic republic (b) Contain corruption. (c) Provide information about the Sainik Kalyan Vibhag to the civilian citizen / exservicemen / widows and their dependents Who are the intended users of this hand-book? Definitions DEFINITION OF EX-SERVICEMEN 1. The eligibility of the retired Defence personnel to the status of ex-servicemen is governed by the definition as laid down by Department of Personnel and Training. The definition has been undergoing changes from time to time. The following is the broad categorisation:- (a) Those released before 01 Jul 68. Any person who had served in any rank (whether as Combatant or not) in the Armed Forces of the Union and has been released there from otherwise than by way of dismissal or discharge on account of misconduct or inefficiency. (b) Those released on or after 01 Jul 68 but before 01 Jul 79. Any person who had served in any rank (whether as a Combatant or not) in the Armed Forces of the Union for a continuous period of not less than six months after attestation and released there from otherwise than by way of dismissal or discharge on account of misconduct or inefficiency. (c ) Those released on or after 01 Jul 79 but before 01 Jul 87. Any person who had served in any rank (whether as a Combatant or not) in the Armed Forces of the Union for a continuous period of not less than six months after attestation if discharged for reasons other than at their own request or by way of dismissal or discharge on account of misconduct or inefficiency and not less than 5 years of service if discharged at own request. (d) Those released on or after 01 Jul 87. Any person who had served in any rank (whether as a Combatant or not) in the Armed Forces of the Indian Union and was released/retired with any kind of pension from Defence Budget or released on completion of specific terms of engagement with gratuity otherwise than at his own request or by way of dismissal or discharge on account of misconduct or inefficiency. (e) Govt of India, Ministry of Defence (Deptt of Ex-Servicemen Welfare) vide their Office Memorandum No. 12/1/2005/D (Res) dated 01 Feb 06 has conveyed that it has 2

5 been decided with the approval of Hon ble Raksha Mantri that such Recruits who were boarded out/released on Medical Grounds and granted Medical/Disability Pension, will also be covered under the category of Ex-Servicemen for all practical purposes. 2. The eligibility of the person to the status of ex-servicemen will be governed by the definition in vogue at the time of his discharge and will not be affected by the changes in the definition subsequent to his discharge. 3. In addition the personnel of Territorial Army (TA) of the following categories viz. pension holders for continuous embodied service; persons with disability attributable to military service; and gallantry award winners retired on or after and the personnel of the Army Postal Service (APS) who are a part of the regular Army and retired from such service, i.e. directly from the Army Postal Service itself without reversion to P&T Department with a pension or who have been released from such service on medical grounds, attributable to military service or circumstances beyond their control and awarded medical or other disability pension are also covered within the definition of ex-servicemen with effect from19 Jul 89. ARMED FORCES 4. Armed Forces of the Union means the Army, Navy and Air Force of the Indian Union including Armed Forces of the former Indian States but excludes the persons who have served in Defence Security Corps, General Reserve Engineering Force, Lok Sahayak Sena and Para Military Forces (PMF). Priority of Ex-servicemen / Widows for Assistance Priority I : Widows / wards of Defence Personnel killed in Action. Priority II : Wards of serving Personnel and ex-servicemen disabled in action Priority III : Widows / wards of Defence Personnel who died in peace time with death attributable to military service. Priority IV : Wards of Defence Personnel disabled in peace with disability attributable to military service. 6 Director General Resettlement The Director General of Resettlement (DGR) is an inter service organisation directly under the Ministry of Defence. The Director General Resettlement looks after all matters connected with resettlement and welfare of ex-servicemen (ESM) and their dependents. It compresses of employment, self employment, training, agriculture, stateless and records, publicity Directorate under it. (Web site General Resettlementindia.com) Kendriya Sainik Board Came into existence in 1919 called Indian Soldier Board aim was to advise on matters affecting the interest of serving, discharged and deceased Indian soldiers and non combatants and their dependents. In March 1951 it was renamed as Indian Soldiers' Sailors and Airmen Board. The designation of the Board was changed to Kendriya Sainik Board in The Secretariat was placed under direct administrative control of DIRECTOR GENERAL RESETTLEMENT from 18 April (Web site General Resettlementindia.com) (1) Information means any material in any form including records, documents, means, s, opinion, advances, press releases, circulars, orders, logbooks, contracts, reports papers, samples Ministry of Defenseless, data material held in any electronic form and information relating any private body which can be accessed by a public authority under any other law for the time being in force. (2) "Prescribed" means prescribed by rules made under this Act by the appropriate Government or the competent authority, as the case may be; (3) "Public Authority" means any authority or body or institution of self-government established or constituted (a) by or under the Constitution; (b) by any other law made by Parliament; (c) by any other law made by State Legislature (d) by notification issued or order made by the appropriate Government, and includes any (i) body owned, controlled or substantially financed; (ii) non- government Organisation substantially financed, directly or indirectly by funds provided by the appropriate Government; (4) "Record" includes (a) Any documents, manuscript and file. (b) Any microfilm, microfiche and facsimile copy of a document. (c) Any reproduction of image or image embodied in such microfilm (Whether enlarged or not) and (d) Any other material produced by a computer or any other device; (5) "Right to information" means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to (i) inspection of work, documents records; (ii) taking notes, extracts or certified copies of documents or records; (iii) taking certified samples of material; 4

7 (iv) obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic Ministry of Defence or through printouts where such information is stored in a computer or in any other device; (6) "State Information Commission" means the State Information Commission constituted under sub-section (1) of section 15; (7) "State Chief Information Commissioner" and "State Information Commissioner" mean the State Information Commission and the State Information Commissioner appointed under sub- section (3) of section 15; (8) "State Public Information Officer" means the state public Information Officer designed under sub-section (i) and includes a state Assistant Public Information Officer designated as such under sub-section(2) of section 5 (9) "Third party" means a person other than the citizen making a request for information and includes a public authority Contact person in case some body wants to get more information on topics covered in the hand-book as well as other information also. 8 CHAPTER-2 (MANUAL. 1) PARTICULARS OF ORGANIZATION, FUNCTIONS AND DUTIES 2.1. Objective/purpose of Sainik Kalyan Vibhag To look after the welfare of ex-servicemen / widows and their dependents to include training empowerment, providing jobs and ensuring that they get their dues due to them from State / Centre Mission / Vision Statement of the Sainik Kalyan Vibhag. To strive hard to ensure that the ex-serve men / widows / dependents in Rajasthan live a contented happy life. Their problems are addressed on and Grievances are remedeed on priority Brief history of Sainik Kalyan Vibhag in context of its formation. The Sainik Kalyan Vibhag came into existence in the year It used to be called Rajasthan Soldiers, Sailors and Airmen Board. It was located in Chomu House. It came to the present location (Secretariat building) in It was designated as Rajya Sainik Board in 1974 and came to be called Sainik Kalyan Vibhag with effect from Duties of Sainik Kalyan Vibhag WELFARE 1. To execute the instructions given by the State Administration, the Kendriya Sainik Board and Director General Resettlement Delhi and function as a bridge between the centre and the state administration on matter concerning ex-servicemen's welfare. 2. To periodically evaluate the progress made by the Department of Sainik Welfare and send progress report as required by the State Govt and Kendriya Sainik Board. 3. To get the annual performance returns (green return) from all Zila Sainik Welfare Offices under his jurisdiction by 30 Apr and forward the same to Kendriya Sainik Board duly compiled by 15 May. 4. To forward performance returns (pink return) of Deptt of Sainik Welfare by 15 may and 15 Nov to Kendriya Sainik Board with copy to the Director Resettlement Zones every year. 5. To co-ordinate the work of Zila Sainik Welfare office in the State and ensure their functioning is in accordance with policies prescribed by the Central and State Govts. Inspect the Zila Sainik Welfare Office at least once a year and render reports on their performance to the State Govt. He may also carry out surprise visits if warranted. 6. To operate the welfare funds in accordance with the prescribed budgets of the funds and according to the rules and decision of the Fund Committees. It is to be ensured that the corpus is invested in Public Sector Undertaking and Nationalised Banks judiciously for optimum yield. Further it is to be ensured that at least 15% of the income is ploughed back to the corpus every year. The amount of corpus should never (repeat) never be used for any expenditure without prior approval of Kendriya Sainik Board / Director General Resettlement. 7. To ensure that advance payment of Central share on account of maintenance of Deptt of Sainik Welfare / Zila Sainik Welfare office is claimed from The Kendriya Sainik Board in the month of May/Jun as soon as budget of the Department of Sainik Welfare of State / UT Govts is passed. The reimbursement of the balance amount will be claimed from the Kendriya Sainik Board as soon as audited account of the previous year is received from the AG. 8. Expeditious settlement of pension cases. To hold pension Adalats in co-operation with the local pension disbursing officer. 6

To arrange defence of court cases in liaison with Central Govt counsel of the State where Ministry Of Defence / Director General Resettlement/Kendriya Sainik Board is a respondent and challenge wrong rulings given any agency in regard to pay / pension employment / authorisation etc of ex-servicemen. 10. To set targets for Flag Day fund collections for each ZSWo / ASB through the Flag Day Fund Committee and guide / monitor their collection pattern. 11. To supervise all the Administrative operations of the Deptt of Sainik Welfare / Office of the Rajya Sainik Board. 12. To make agenda minutes for the annual meetings of the Deptt of Sainik Welfare and Fund Committees and monitor progress of the decisions. 13. To send to the ex-servicemen corporation all periodical reports / statistical statements required by it. 14. To organize ex-servicemen rallies at State level, to promote self employment schemes, publicise employment opportunities, settle pension cases and grievances of service personnel and ex-servicemen with civil administration. 15. to ensure that the constitution of Rajya Sainik Board and Zila Sainik Board is as per the recommendations of High Level Committee. SELF EMPLOYMENT AND EMPLOYMENT 16. To identify the problems with regard to resettlement and welfare of the ex-servicemen and their dependents residing in the State and to bring them to the notice of the state Administration and others concerned. 17. To ensure the implementation of resettlement schemes formulated by the Central Govt and State Administration by maintaining close and constant liaison with the various State Departments and financial institutions. 18. To evolve measure for the resettlement and welfare of ex-servicemen and families of the deceased personnel of the Defence forces in terms of : (a) Providing them employment in the Govt offices / State Public and Private Sector undertakings. (b) Evolving schemes for self employment and getting their approval from State authorities / proposed corporation. (c) formulating and implementing specific schemes to rehabilitate war widows and disabled defence personnel. (d) Adopting appropriate measurement to enable the ex-servicemen and their dependents to get quicker solution to their problems while they represent their cases with district / local administration. (e) Suggesting new schemes / programmes to the State Govt authorities. (f) to run, implement and execute self employment schemes. formulate favourbale loan schemes for ex-servicemen with commercial banks and State Financial Institutions. (g) To maintain close and effective liaison with local Central State Employment Exchanges, private organisations and undertakings for enhancing the scope for employment of exservicemen. Information related to employment opportunities in the State is to be disseminated to the ex-servicemen through the Deptt of Sainik Welfare / Zila Sainik Board. (h) To liaise with State Govts. State and Central Govt undertakings for implementing the reservation policy for ex-servicemen / dependents of ex-servicemen. To forward half yearly return as on 20 Jun and 31 Dec on placement of ex-servicemen with State Govts. Public Sector Undertakings. Corporations etc is fixed as per guidelines issued by the Central Govt. 7

10 Training 23. To co-ordinate and monitor the planning and conduct of training under State exservicemen resettlement training schemes. 24 To liaise with the State Technical Consultancy Service, State financial Corporations, Industries Deptt and other entrepreneurial development agencies for operating entrepreneurial development programmes Main activities/functions of Sainik Kalyan Vibhag The department of Sainik Kalyan in the state is an Apex body concerned will all matters pertaining to the welfare and resettlement of ex-servicemen in addition to being a permanent department of the Stare Government, it is an effective limit between the centre and State Government for implementing various policy directives laid down by the ministry of defence. The responsibilities of the Department encompasses all matters pertaining to employment, self employment training and welfare of ex-servicemen and their dependents.. Welfare (a) Liaison with various Depts. of Central and State Govts / UTs as well as local Services HQs on all matters concerning welfare of ex-servicemen and "families of serving / deceased personnel of the Armed Forces. Including co-ordinations of all welfare activities conducted by various agencies. Employment and Self Employment (a) Maintain close and effective liaison for the purpose of resettlement and maximizing employment of ex-servicemen with the Deptt of Industries and Commerce, Employment Exchange, Bureau of Public Enterprises, Banking organisations, Govt establishments and private bodies. (b) Formation of ex-servicemen corporations and assistance to ex-servicemen co-operatives and associations in their self employment ventures. (c) Review the implementation of reservations of jobs for ex-servicemen in Central and State Govts/ UTs and their undertakings and take necessary steps to advise them to make up the short fall. (d) Monitor implementation of various resettlement schemes for self-employment and advise financial institutions of such schemes. Training (a) Formulate policies for training of ex-servicemen and monitor the training activities conducted through State sponsored training courses. (b) Liaise with various entrepreneurial development agencies and depts. for conducting programmes for ex-servicemen and their dependents and drawing up annual schedules thereof. (f) Correspond with Army / Air Force / Navel Headquarters, record offices, concerning widows / ex-servicemen. 8

14 CHAPTER. 3 (MANUAL. 2) POWERS AND DUTIES OF OFFICERS AND EMPLOYEES 3.1 Powers and duties of officers and employees of the organization. Designation :- DIRECTOR Powers Administrative He is the Head of the department of Rajya Sainik Kalyan Vibhag Financial He is the controlling officer of all expenditure and or the collection of revenue by various Zila Sainik Kalyan Adhikaries Others He is the Secretary to Amalgamated Fund Meeting and the Rajya Sainik Board Meeting Duties Director 1. He is Head of the Department of Rajya Sainik Kalyan Karyalaya. 2. He is to monitor, supervise, control all the Zila Sainik Karyalayas located in the State 3. He is to ensure smooth running of all the Sainik Vishram Grahs in the state. 4. He is the Secretary of the Amalgamated Fund Management Committee and also Secretary of the Rajya Sainik Board. 5. Carry out all duties assigned to him by Governor and Minister of Sainik Kalyan and the Government. To ensure funds are not drawn much in advance of requirements and heavy cash balance are not kept. To ensure internal check of accounts of receipts and payments To regulate expenditure as per budget. To prepare yearly budget realistically and monitor it regularly. Sub allocate the money to various Zila Sainik Karyalaya as per budget allocation. Demand for additional money for specific purpose to ensure smooth functioning of all the Zila Sainik Kalyan Karyalayas. Obtain 50% of the share from Kendriya Sainik Board Delhi on yearly maintenance and running of Rajya Sainik Kalyan and Zila Sainik Kalyan Karyalayas. Ensure speedy settlement of all Audit objections. Ensure regular checks to ensure No audit objection is raised against the office. Monitoring of Martyrs cremation in state. Ensure state benefits are given to the widows / martyrs and the parents. Ensure monetary allowance is given to all IInd world war ex-servicemen and widows. Ensure correct distribution of Samman Bhatta to eligible persons. Execute and monitor the other financial grants/ aid received from Chief Minister / others Prepare the minutes of the Amalgamated Fund meetings and Rajya Sainik Board Meetings Monitor the complaints received from ex-servicemen / widows from Governor, Chief Minister, Ministers, Government and individuals. 12

Providing assistance for settlement of land and other disputes. Assist families of serving personnel in regard to their safely / security during absence away on duty of the serving personnel. Promote and maintain under the guidance of the State Rajya Sainik Boards, welfare measures in the district such as a rest House for ex-servicemen, old age pensioners homes, Jawans Bhavans/ Shops, Vocational and other Training facilities etc. Provide assistance for medical treatment in Military / Civil Hospitals. 13

16 (vii) maintain liaison with other welfare Organisations such as Indian Red Cross Society, etc. with a view to enlarge the field of additional sources of welfare and concessions for ex-servicemen and their families / dependents in the district. (viii) Maintain an up-to-date register of war widows and dependents of those disabled in action with a view to ensure their welfare. (b) The responsibilities of the Zila Sainik Boards in regard to resettlement of ex-servicemen etc. (i) To maintain close and effective liaison for purpose of resettlement through employment of ex-servicemen with :- (aa) Local Central / State / Private Industrial Organisations (ab) Local employment exchange particularly in States where co-sponsoring power for re-employment of ex-servicemen. (ac) Local revenue authorities in connection with schemes for resettlement of land of ex-servicemen. (ad) District Industries / Block Development Officer and assisting such of these ex-servicemen desirous of setting up small industries. (ii) (iii) Assist ex-servicemen in forming and setting up of co-operative for their selfemployment. Provide all resettlement assistance to war widows and dependents of war disabled as well as those who die / are disabled while in service due to attributable reasons. (c) Other responsibilities of the Zila Sainik Board are :- (i) (ii) Organise Flag Day and Flag Day collections and any other authorised fund raising measures in the district. Organise rallies / re-union of ex-servicemen. (iii) Explore avenues for providing educational and vocational training facilities for exservicemen and their dependents to enable them to seek and obtain employment or set up self-employment schemes. (iv) Assist the three Services whenever called upon to do so, to disseminate information within the district regarding terms and conditions of service in the Armed Forces, publicity for recruitment notices, publicity for assistance rendered by the Armed Forces in times of natural calamities, notifications of award of gallantry and other decorations, introduction of welfare schemes for service personnel and their families etc. Organisers 1. 20 Appendix "A" THE RAJASTHAN CIVIL SERVICES (ABSORPTION OF EX-SERVICEMEN) RULES, 1988 PART I GENERAL 1.Short title and commencement.- (1) These rules may be called the Rajashan Civil Services ( Absorption of Exservicemen) Rules, (2) They shall come into force from the date of their publication in the Rajasthan Rajpatra. 2.Scope Notwithstanding the provisions contained in any existing rules regulating the recruitment and promotion of persons in various services of the State or in the rules that may be framed hereinafter, the ex-servicemen shall be eligible for recruitment and appointment to the posts in all the Departments of the State Government as specified in Schedule-I Provided that (1) Such appointment shall not exceed (a) 12½ % of the posts in Ministerial and Subordinate Services; and (b) 15% of the posts in Class IV service to be filled in a year by direct recruitment.\ (2) The total number of reserved vacancies including those reserved for the candidates belonging to the Schedules Castes. Schedules Tribes and other categories taken together shall not exceed 50% of the posts to be filled in a particular year. (3) The recruitment of ex-servicemen shall be subject to the availability of vacancies after the full quota of Scheduled Castes and Scheduled Tribes exhausted to the extent of their reservation. (4) If any ex-servicemen belonging to the Scheduled Caste/Scheduled Tribes is selected against the vacancy reserved for ex-servicemen As laid down in proviso (1), the said selection shall be counted As against the overall quota of the reservation that shall be Provided for the Scheduled Castes or Scheduled Tribes in Accordance with he orders issued by the Government from time To time. (5) Where a reserve vacancy remains unfilled for non-availability of Suitable ex-servicemen, such vacancy may be filled in from other source in accordance with the rules regulating the recruitment and conditions of service for persons appointed to such post as if the vacancy was not reserved: Provided that the reserved vacancy so reserved shall be carried forward to the next recruitment year whereafter the vacancy in question shall be treated as unreserved. 3.Definitions:- (a) An ex-servicemen means a person who has served in any rank whether as a combatant or non-combatant in the Regular Army, Navy and Air Force of the Indian Union and 18

21 (i) who retired from such service after earning his / her pension; or (ii) who has been released from such service on medical grounds attributable to military or circumstances beyond his control and awarded medical or other disability pension; or (iii) who has been released, otherwise than on his own request, from such services as a result of reduction in establishment ; or (iv) who has been released from such service after completing the specific period of engagements, otherwise than at his own request or by way of dismissal or discharge on account of misconduct or inefficiency, and has been given a gratuity; and includes personnel of the Territorial Army of the following categories, namely:- (i) Pension holders for continuous embodies service; (ii) Persons with disability attributable to military service; and (iii) Gallantry award winners; (b) Administrative Department means such department or authority to whom the power of appointment to that service or post has been or may here-in-after be delegated by the Government; (c) Appointing Authority means the Heads of Deptt. Concerned and include any other person to whom such powers in this behalf have been delegated by a special or general order of the Government; (d) Commission means the Rajasthan Public Service Commission; (e) Head of Department means the officer declared as such under rule 3 of the General Finance & Accounts Rules; (f) Government means the Government of Rajasthan; (g) Post or posts means the post or posts prescribed in Schedule-I appended to these rules; (h) Schedule means the schedule appended to these rules; (i) State means the State of Rajasthan; and (j) Year means the financial year. 4. Interpretation.- Unless the context otherwise requires the Rajasthan General Clauses Act,1955(Rajasthan Act No.VIII of 1955) shall apply for the interpretation of these rules as it applies for the interpretation of a Rajasthan Act. PART II RECRUITMENT 5.Determination of vacancies Subject to the provisions of these rules, the Appointing Authority shall, in respect of the posts specified in Schedule I, determine, as soon as possible in the month of April of each year, the number of vacancies anticipated during the year according to the quota prescribed in rule 2.( As amended vide Deptt of Personnel ( A-Gr II) Notification, Jaipur, April 22, Age A candidate must not have attained the age of 50 years on the first day of January next following the last date fixed for receipt of applications:. Provided that in the case of holders of Military Cross / Vir Chakra or any other higher distinction, the upper age limit shall be relaxable by two years. 7.Character-(1) The Character of candidate must be not less than GOOD at the time of discharge from Defence ( Army, Navy, Air Force) Services as shown in his Discharge Book. (2) The character of a candidate after discharge from Defence Service must be such as to qualify him for employment. He must produce two certificates of good character written not 19

22 more than six months prior to the last date of submission of application from two responsible persons not related to him. 8. Physical Fitness.- A candidate for direct recruitment to the service, must be in a good mental and bodily health and free from any of his duties as members of the service and if selected must produce a certificate to that effect from a Medical Authority notified by the Government for the purpose: Provided that the Appointing Authority may appoint a blind or physically disabled Exservicemen to any of the posts mentioned in Schedule I, if he possesses minimum qualifications and is otherwise found suitable for the post to be filled in. 10.Canvassing No recommendation for recruitment either written or oral other than that required under the rules, shall be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature by other means may disqualify him for recruitment. 11.Inviting of application.-applications for recruitment to the posts reserved for Ex-servicemen shall be invited by the Commission / Appointing Authority, as the case may be, by advertising the vacancies in such manner as they may deem fit. (As amended vide Deptt of Personnel ( A- Gr.II) Notification Jaipur, April 22, 1996) 12.Form of applications.- The application shall be made in the form prescribed in the Schedule II, The form shall be published by the Appointing Authority/ Commission, as the case may be, in the said advertisement. (As amended vide Deptt of Personnel ( A-Gr.II) Notification Jaipur, April 22, 1996) 13.Scrutiny of Applications.-The Commission / Appointing Authority, as the case may be, shall scrutinize the applications received and prepare the list of candidates found eligible for appointment against the vacancies advertised. ( As amended vide Deptt of Personnel ( A-Gr- II) Notification Jaipour, April 22, 1996). 14.Selection Board.-For the posts falling within the purview of the Commission, the Director, Sainik Kalyan Department, Rajasthan shall be a member of the Board, The other members of the Board shall be nominated by the Commission, The Director, Sainik Kalyan Department, Rajasthan or his representative not below the rank of Sainik Kalyan Adhikari shall be a Member of the Board and the other Members of the Board shall be nominated by the Appointing Authority Concerned. ( As amended vide Deptt of Personnel ( A-Gr.II) Notification Jaipur, April 22, 1996) 15.Selection of Candidates.-The Selection Board shall prepare a list of candidates whom they consider suitable for appointment against the vacancies advertised, arranged in order of preference. The number of names in the list shall be 50% in excess of the number of such vacancies. In selecting candidates, the Selection Board may consider their academic and technical qualifications, nature of post held by them in the past and their past experience. If necessary, the Selection Board may also take test/ examination and or may call any candidate(s) for interview. 20

23 16.Recommendations.- The Commission / Appointing Authority, as the case may be, shall prepare list of candidates whom they consider suitable for appointment to the posts concerned arranged in the order of merit and forward the list to the Government/ Appointing Authority. 17.Deleted 18.Selection by the Appointing Authority- The Appointing Authority shall select the candidates in order of merit in the list prepared by the Commission/ Appointing Authority, as the case may be, under rule 16, provided that the Appointing Authority is satisfied on the basis of such enquiry as may be considered necessary that such candidates are suitable in all respects for appointment to the posts to be filled. 21

F. 5 (1) /OSD/Rev/SSB/65- Whereas, it is desirable that the State Government should recognise and reward members of the Defence Services of the Country ** [and such members of the state police including Indian Police Service Officer of Rajasthan Cadre] who have distinguished themselves by conspicuous acts of gallantry and are awarded gallantry decorations by the President of India. Now, therefore, in exercise of the power conferred by sub-section (1) of Section 101 of the Rajasthan Land Revenue Act, 1956 (Rajasthan Act 15 of 1956), read with section 261 and 90 thereof, and section 28, read with section 7, of the Rajasthan Colonisation Act, 1954 (Rajasthan Act 27 of 1954), and of all other powers enabling it in this behalf, the State Government hereby makes the following rules, namely:- THE RAJASTHAN GALLANTRY AWARDS ( CASH REWARDS AND LAND GRANTS ) RULES, Short title, extent and commencement (1) These rules may be called the Rajasthan Gallantry Awards (Cash Rewards and Land Grants) Rules, (2) They shall extend to the whole of the State of Rajasthan. (3) They shall come into force at once. 2- Definition In these rules, unless the context otherwise requires:- * [(i) Gallantry Awards means any of the following gallantry awards instituted by the President of India. (a) Param vir Chakra (b) Ashok Chakra (c) Mahavir Chakra (d) Kirti Chakra (e) Vir Chakra (f) Shaurya Chakra (g) Sena /Nao Sena/Vayu Sena Medal for Gallantry. (h) President s Police Medal for the Gallantry. (i) Police Medal for Gallantry.] (ii) (iii) Grant means a land grant made under these rules, and a grant means a person to whom such grant is made; Holder of Gallantry Award means a member of the Defence Services of the Country who has been awarded a gallantry award and who belongs to or is 22

25 domiciled in Rajasthan or who is a citizen of India and has displayed volour in the field of battle anywhere in Rajasthan and earned the gallantry award.]++ (iv) Reward means a cash rewards granted under these rules. 3- Applicability of these rules- These rules shall govern the grant of cash rewarded and lands grants to holders of gallantry award, whose gallantry award became effective on or after the first day of November, 1962 *[Provided that in the case of holders of President s Police medal for gallantry and Police medal for gallantry, the provisions of these rules shall be applicable only for those gallantry awards holders, who receive the said gallantry awards on or after the publication of the Rajasthan gallantry Awards (Cash Rewards and Land Grants) (Amendment Rules 2006, )] *[4- Scale of rewards and grants (1) The scale of rewards and grants admissible to the holder of a gallantry award shall be as follows:- (a) ParamVeer Chakra - Rs. 2,25,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (b) Ashok Chakra - Rs. 2,00,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (c) Maha Vir Chakra - Rs. 1,50,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (d) Kirti Chakra - Rs. 1,20,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (e) Vir Chakra - Rs. 70,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (f) Shaurya Chakra - Rs. 50,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. (g) (h) (i) Sena/Naosena/Vayusena medal for gallantry President s Police Medal for Gallantry - Rs. 30,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. - Rs. 1,00,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. Police Medal for Gallantry - Rs. 50,000/- in cash and 25 Bighas of irrigated land in Indira Gandhi Nahar Pariyojana Phase-II or Rs lakhs in cash in lieu of land. Provided that in case of Sena / Naosena/Vayusena, above facilities shall be provided only to those who are given medal only for Gallantry. 23

26 Provided further that the person, who received the gallantry awards prior to the publication of the Rajasthan Gallantry Awards ( Cash Rewards and Land Grant (Amendment), Rules, 2006 hereinafter referred to as the Said Amendment Rules shall be entitled to the Cash Rewards and Land Grants as per the provisions of rule 4 applicable prior to the commencement of the Said Amendment Rules. (2) The amount in lieu of land shall be given in form of tax free RBI bonds.] 5- Conditions of grant - The grant shall be subject to the following conditions:- (1) The Rajasthan Colonisation (General Colony) conditions 1955, issued under sub-section (2) of section 7 of the Rajasthan Colonisation Act, 1955 Shall, mutatis mutandis, apply to the grant. (2) No premium or reserved price shall be charged but rent shall be chargeable as under :- (a) For the first [four]+ years - No rent. from the date of allotment. (b) For the next three years. - One half of the sanctioned rent rate applicable to the land (c) After the completion - Full rent at the sanctioned [seven]+ years from the date of allotment. rent rated applicable to the land. (3) Betterment levy shall be charged from the allottee which may be applicable for the Rajasthan Canal project Area. (4) The grantee shall have no right to alienate in any manner, the whole or any part of the grant within a period of ten years from the date of allotment. (5) The grant shall be subject to good behaviour and contain loyalty to the Union of India on the part of the grantee and his heirs who may hold the grant after his death. In the case of a breach of this conditions, of which the State Government shall be the sole judge, the grant shall be liable to resumption: Provided that no order for the resumption of grant shall be made unless the person concerned is given an opportunity of being heard. 6- Posthumous awards In the case of posthumous awards, or on the death of the holder of a gallantry award before the sanction of reward and grant under these rules, the reward and grant shall be made to the heirs of the deceased in the order of succession recognized by the personnel law by which he was governed. 24

27 7- Application for reward and grant- (1) As soon as the Gallantry Award is published in the Gazette of India, the holder of the gallantry award or his heirs, as the case may be, may apply to the Collector of the District concerned in which the said holder or heirs reside or resided. (2) The applications shall be in the form at Annexure A to these Rules and shall be accompanied by a copy of the citation of the gallantry award. It should be verified by the Records office concerned. (3) On receipt of the application duly verified by the Records office, the Collector shall issue a sanction in the form given in Annexure B to these Rules and draw and disburse the amount to the applicant. (4) As for allotment of land the Collector concerned shall write either to the Colonisation Commissioner, Bikaner or S.D.O. concerned for allotment of land to the applicant as desired by him in accordance with these rules. A copy of this letter shall be endorsed to the applicant.] (5) On receipt of the intimation from the collector, the Colonisation Commissioner +[or the Sub-Divisional Officer concerned as the case may be], shall proceed to allot land to the applicant forthwith according to the scale prescribed in these rules. 8- Applications by certain categories of holders of gallantry awards:- Holders of gallantry awards whose awards become effective on or after the first day of November, 1962 but who have not received the awards in accordance with these rules may submit their applications to the Collector of the District concerned in the prescribed manner. 9- Repeals and savings- On and from the date of commencement of these rules, all rules, regulations, orders, and circulars regarding reward and grants to holders of gallantry awards shall stand superseded in so far as the matters therein contained covered by the provisions of these rules: Provided that such repeal shall not effect anything done or any action taken under the provisions of the repealed rules, regulations, orders or circulars: Provided further that nothing therein contained shall affect any rules, regulations, orders or circulars regarding grant of rewards or land grants to persons to whom British decorations such as Victoria Cross, the Military Cross etc. were made before the commencement of the Constitution of India. 29 Appendix "C" {First published in the Extraordinary Gazette, Part IV ( C ), Sub-Section I, dated } REVENUE (SOLDIERS WELFARE) DEPARTMENT NOTIFICATION Jaipur, December 27, RULES FOR THE ADMINISTRATION OF AMALGAMATED FUND FOR THE BENEFIT OF EX-SERVICEMEN. 1.G.S.R. 22- The following rules are hereby framed for the Administration of Amalgamated Fund for the benefit of Ex-servicemen created vide Government Notification No.F.2(5) Rev/Sol-Wel/ 68 dated 15 th June, Short title and commencement.-(a) these rules may be called Rules for the Administration of Amalgamated Fund for the benefit of Ex-servicemen (b) These shall come into force at once. 3. Definitions.-In these rules, unless and until the context otherwise requires:- (a) Fund means all the Funds amalgamated and mentioned in the Government of Rajasthan Notification No.F.2(5) Rev/Sol/Wel/68 dated and would include the following also:- (i) (ii) (iii) The initial sums of the Funds. Income from investments. Any other sum contributed by the Central/ State Government and receipts from other sources. (b) Ex-servicemen means any person who has been released from the Armed Forces after having served in any rank or as Non-combatant (Enrolled) for at least 5 years in peace time: Provided that in case of such of members of the Armed Forces who have been on active service on the battle front the condition of 5 years service would not be applicable. (c) Dependent means wife, non-earning sons below the age of 21 years, unmarried or widowed daughters, non-earning brothers below the age of 21 years and unmarried sister actually dependant on an Ex-servicemen and his old parents who depend for their being on such Ex-servicemen. (d) Management Committee means committee constituted by the Government vide Notification No.F.(5) Rev/Sol-Wel/ 68 dated for the administration of Amalgamated Fund for the benefit of Ex-servicemen and such changes as are made by he State Government hereafter from time to time with the prior approval of the Chairman. 27

30 (e) Sub-Committee means the Sub-Committee constituted by the Government of Rajasthan vide Order No.F.2(1) Rev/Sol-Wel/68, dated and such other changes as are made by the Government hereafter with the prior approval of the Chairman. (i) Secretary means Secretary, Rajasthan State Soldiers Sailors and Airmen s Board, Jaipur. 4. Objects of the Fund.- The objects of the Fund are :- (a) toward stipend to Ex-servicemen for technical, managerial, Vocational or Agricultural training in recognized training institutions. (b) To grant loans to individual ex-servicemen for Agricultural purposes, starting business, dairy farming, poultry, animal husbandry, purchase of vehicles, tractors and for any other purpose found genuine by the Administration Committee /Sub- Committee. (c) To sanction grants or loans to Co-operative Societies or other association of Exservicemen for schemes and projects of resettlement relating to horticulture, small scale industry and transport etc. (d) to sanction scholarships / grants to dependants of Ex-servicemen for studies in recognized educational institutions. (e) to sanction charitable grants to the widows dependants of deceased Exservicemen and disabled or old Ex-servicemen with a view to alleviate their distress. (f) to sanction grants for the medical treatment of ex-servicemen suffering from dangerous diseases. (g) to sanction grants to Ex-servicemen and their dependants for their resettlement in petty trades. (h) To sanction expenditure for the construction of new Sainik Vishram Grahs /Children Hostels and repairs and making alternations and additions in the existing Sainik Vishram Grahs. (i) to sanction expenditure on special measures of collective nature for the maintenance of old and e3stitute Ex-servicemen or widows of Ex-servicemen. (j) to take up measures for the benefit of Ex-servicemen and their dependants. (k) to sanction expenditure for the rallies / re-unions of Ex-servicemen. (l) to incur expenditure for any other purpose which in the opinion of the Committee of administration / sub-committee is deemed proper to promote measures for the benefit of ex-servicemen. 5. Management and Administration of the Fund. (a) The fund shall be vested in the managed by the Managing Committee. (b) The Management Committee shall have powers to frame such rules as are necessary for the proper discharge of its responsibilities. Its decisions as to the interpretation of such rules shall be final. A Sub Committee consisting of not more than six members of the Committee, shall be formed for running the day-to-day administration and affairs of the fund and the said Sub- Committee shall exercise all the powers delegated by the Management Committee. The powers to be delegated by the Management Committee to the Sub- Committee would be.- 28

31 (a)powers which can be exercised directly by the Sub-Committee; and (b) powers which can be exercised by the Sub-Committee with the approval of the Chairman. (c) The Sub-Committee shall conduct business before it in the same manner as prescribed for the conduct of the business by the Management Committee except that the meeting of the Sub- Committee shall be held once in a quarter and on such other occasions as the Chairman may consider necessary. 6. Conduct of business.-(a) generally the business of the Management Committee will be transacted at a meeting of the Committee. If and when this is not convenient, papers may be circulated to all members of the Committee for their opinion. (b) When papers are circulated for the opinion of the members, any members may ask for a meeting of the committee to consider the matter in issue and such a meeting shall be called if two or more members so desire. (c) When papers are circulated for opinion and no meeting is called under clause (b) above, the decision of the matter in issue shall be arrived at by the majority opinion. (d) The meeting of the Management Committee shall be held atleast twice a year and as such other occasions as the Chairman may consider necessary. (e)at least a fortnight s notice about the date and place of he meeting shall be given to the members of the Management Committee. 7.Minutes of the meeting.-a copy of minutes of the meeting shall be signed by the Chairman and thereafter recorded by the Secretary. All minutes of the meeting will be circulated to all the members of the committee. 8..Restriction on grant of loans from the fund.-no request for a grant, loan from the Fund shall be entertained from any person, Co-operative Society or any other Association of Ex-soldiers who have already received grant or loan from the fund. 9.Procedure for obtaining grants or loans.-applications for assistance from the Fund will be submitted through the District Soldiers Sailors and Airmen s Board concerned. All applications shall be made in the prescribed form. The Secretaries of District Soldiers Sailors and Airmen s shall verify the applications received by them or sent by the Secretary of the Fund to them and they shall submit the same with their recommendations within a period not exceeding 3 weeks from the date of receipt of the application. The verification by the District Soldiers Sailors and Airmen Boards shall include verification of :- (a) the rank of the applicant; (b) the financial circumstances of the applicant; (c) the annual income from all sources; 29

32 (d) the number of dependants of the applicant; (e) if application is made by a dependant of Ex-servicemen the relationship of the applicant with the Ex-servicemen; (f) the nature and value of security offered for grant of loan; and (g) educational qualifications of the applicant for grant of stipends, scholarships grants for technical managerial, vocational, agricultural training or higher studies; (h) length of service and character. The character of the applicant should not be below Good 10. Conditions of eligibility.- All past members of the Armed Forces and their dependants including members of the erstwhile State Forces will be eligible for grants/ loans from this fund. 11.Quantum of grants and loans to be sanctioned by the Managing Committee.-(a) Stipends and scholarships for training and educational purposes upto Rs. 75/- p.m. for day scholars and upto Rs.125/- p.m. for boarders. The stipend or scholarship may be given for the entire training or educational period but it will be stopped on the failure of the candidate in the annual test or examination; (b) grants and loans to Co-operative Societies or other Associations of Ex-service Personnel upto Rs. 1 lakh. (c) grants to individual ex-servicemen / their dependants upto Rs.50,000/-. (d) grants for petty trades to individuals upto Rs.5,000/-. (e) grant for relief for economic distress as under:- (i)single individual Rs.50/- p.m. plus Rs. 10/- per additional family members subject to the maximum of Rs. 100/- p.m. (ii) Grant to the disabled soldiers for medical treatment; provision of appliances such as artificial limbs; hearing aid etc., amount up to the maximum of Rs. 100/-p.m. or a lump sum up to Rs. 1000/- subject to verification by a competent Medical Authority. (iii)grant of Sewing Machines to widows upto Rs.500/- each. (iv)repairs of building of Sainik Vishram Grah Rs.25,000/- (v)construction of new Sainik Vishram Grah Rs. 2 lakhs. (vi) Purchase of articles / furnitures etc. upto maximum limit of Rs. 10,000/ Conditions for grants and loans.-(a) The money sanctioned as loan shall be used for the purpose for which it is sanctioned; (b) Monthly grants to widows of deceased soldiers / disabled soldiers will be sanctioned for life and will be renewed yearly on receipt of life certificates. The payment of the monthly grants will be made half yearly. (c) In making monthly grants the applicants income will be taken invariably into consideration. (d) The fund shall not normally be used to finance any scheme or purpose the provision of which is clearly the responsibility of the Government of India or of the Rajasthan Government or of other bodied, such as, the Indian Red Cross Society, the Tuberculosis Associations of India etc. (e) Ample facilities for inspections of loan papers and the object for which loan is taken shall be accorded by he loanee to the Secretary, District S.S. & A s Board concerned. 30

33 13.Security for loan.- All loans shall be granted against the security of immovable property only. The value of security shall not be less than double the value of the amount of the loan. 14. Instalments and mode of recovery of loans.-(a) Loans below Rs-500/- may be given in such installments as may be considered expedient by the President, District S.S & A s Board concerned in each individual case. Bigger loans would ordinarily be advanced in two or more instalments, the second or later instalments not being advanced till expenditure of the amount of the previous instalment has been incurred and provided justified. (a) The recovery of loans shall be made in equal yearly instalments, the amount of instalments being so fixed that the entire amount is recovered in not more than 10 years. The repayment together with interest shall commence after one year from the date of payment ot the amount or its instalment. 15. Recovery of loans in default of instalments.- If any instalments or part thereof the amount of the loan along with the interest accrued thereof the amount of the loan along with the interest accrued thereon, remains unpaid after the due date, such amount with cost, if any, shall be recovered as an arrear of land revenue. 16. Recovery of loans utilized for purpose for which it was not granted- (a) It shall be the responsibility of the Secretary, District Soldiers Sailors and Airmen s Board concrerned to see that all loans disbursed under these bye-laws are expanded for the purposes for which they were granted within such period as may be fixed by the authority granting such loans. The said Secretary will also see that the necessary certificate of having utilised the loan within the time fixed is obtained from the loanees and forwarded to the Secretary, State S.S & A,s Board. (b) If it is found that the loan is not being utilised for the purpose for which it was granted, the Sub-Committee may on its own motion or on the recommendation of the Secretary, Rajasthan State S.S & A s Board, take action for the recovery of the entire loan or balance thereof and all money outstanding against the borrower by way of interest in one lump sum and such amount may be recoverable as an arrear of land revenue. 17. Disbursement of loans (a) After a loan has been sanctioned, the Secretary, State Soldiers, Sailors, and Airmen s Board shall arranged disbursement of the amount to the borrower after the later has executed the mortgage deed and other necessary documents and has got such documents registered, if necessary. The Secretary shall arrange to maintain a loan register. (b) The rate of interest for loans shall be the rate fixed by the State Government each year in respect of loans/advances sanctioned for State Government employees from the State Revenues. 18. Quorum for the meetings of the Managing committee- A Quorum for the meeting of the Management Committee shall consist of not less than half the members of the total strength. 19. Deposit and investment of money- The money of the fund may be invested in the (trusted) securities and in the scheduled Banks as considered appropriate. However some money will be kept in liquid cash for day- to-day requirements and deposit such 31

34 moneys in one or more accounts at the scheduled Banks. The Secretary will make the payment of the sanctioned grants/loans. 20. Statement of accounts- An annual statement of accounts shall be placed before the management Committee of administration by the Chairman of the Sub-Committee after each financial year. 21. Audit of accounts- The accounts shall be audited annually by a firm of Chartered Accountants appointed by the Sub-Committee or by the Government Audit Department. 22. Financial Sources of income Interest accrued on the money of the fund shall be source of income and hence the expenditure from this fund except advances / loans may be restricted to the income f annual interest only. 23. Power of expenditure- Expenditure from the fund may be incurred by the following officers and authorities:- (a) The Secretary, Rajasthan State S.S.A s Board may incur expenditure:- (i) For temporary relief at a rate not exceeding Rs. 50/- per month in each individual case, for a period not exceeding one year in each individual case. (ii) In emergent cases upto an amount of Rs, 500/- for each individual case. (b) The Chairman (Governor), Amalgamated Fund for the benefit of Ex-servicemen may sanction expenditure not exceeding Rs. 5000/- in emergent cases. (c) Expenditure not covered by clauses (a) and (b) above may be incurred only with the sanction of the Management Committee or the Sub-Committee as the case may be. 24. 52 GOVERNMENT OF RAJASTHAN URBAN DEVELOPMENT DEPARTMENT Appendix "F" NO- F.9(63)UD/3/8/PL Jaipur, dated : 13 th April,2001 NOTIFICATION In exercise of the powers conferred by section 74 read with sections 43 and 60 of the Rajasthan Urban Improvement Act, 1959(Act No. 35 of 1959 ) the State Government hereby makes the following rules further to amend the Rajasthan Urban Improvement Trust (Disposal of Urban Land) Rules, 1974 and orders with reference to proviso to sub-section (2) of section 74 of the said Act that the previous publication of these rules is dispended with, as the state Government consider that in the public interest, they should be brought into force at once, namely:- 1. Short title and commencement (1) These rules may be called the Rajasthan Urban Improvement Trust (Disposal of Urban Land) (second Amendment Rules), 2001 (ii) They shall come into force with immediate effect. 2. Inserted of rule 15 B- after the existing rule 15-A of the Rajasthan Urban Improvement Trust (Disposal of Urban Land) rules, 1974 hereinafter referred to as the said rules, the following new rule 15-B shall be inserted, namely; "15-B Notwithstanding anything contained in these rules, land may be allotted with the prior approval of the state Government for infrastructure, projects which includes power-plant, telecommunication, transport facilities, tourism units, public utilities, information technology, water supply, technical educational institutions, waste disposal project on such terms and conditions and at such rates as may determined by the State Government from time to time." 3. Amendment of rule 17 in rule 17 of the aid rules; (i) (ii) (iii) (iv) In clause (d) sub rule (2) after the existing expression "ex-servicemen and their families, the expression "and Border Security Force, Central Industrial Security Force and Central Reserve Police force Personnel shall be inserted. In clause (b) of sub rule (3), after the existing expression "ex-serviceman and their families", the expression "and Border Security Force, Central Industrial Security Force and Central Reserve Police force Personnel shall be inserted. In sub clause (I) of clause (b) sub rule (3), after the existing expression "border of the country", the expression "and Border Security Force, Central Industrial Security Force and Central Reserve Police force Personnel shall be inserted. In sub clause (II) and ((III) of clause (b) of sub rule (3), after the existing expression "army and personnel", the expression "and Border Security Force, Central Industrial Security Force and Central Reserve Police force Personnel shall be inserted. 50

53 (v) (vi) (vii) In the existing proviso to sub rule (5), the existing expression "30 days" shall be substituted by the expression "60 days" In clause (b) of the sub rule (5), the existing expression "19% " shall be substituted by the expression "10" After the existing clause (ii) of sub rule (5), a new clause (iii) shall be inserted as follows: "(iii) if the trust in its interest refers the case to the State Government for such regularization or an allotted applies to the Government stating the facts in detail for such regularisation, the State Government may permit such regularisation on payment by the allottee the cost of land and expenses, if any, plus interest and penalty, as provided in clause (i) above." (viii) In proviso the clause (a) of sub- rule (6) the existing "2.5%" shall be substituted by the expression "5%" (ix) After the existing sub rule (6), a new sub rule (7) shall be inserted : (7) (i) If a person who purchases the land through public auction for residential or commercial purposes, has not constructed a building within three years from the date of execution of the lease deed, he shall pay levy at the rate of 2.5% per year of the present prevailing reserve price to the concerned trust upto ten years and if building has still not been constructed, the allotment of the land shall stand cancelled. (ii) The land purchased through auction shall not be transferred without giving information of such transfer to the trust and after making full payment of the lease rent and penalty otherwise the trust shall not recognise the transfer." 4. Insertion of new rule 17-A and 17-B After the existing rule 17 of the said rules, following new rules 17-A and 17-B shall be inserted namely :- 17A Notwithstanding anything contained in rule 17, the plots may be allotted to freedom fighter, gallantry award holders national / international players, Arjun award holders and President awardee teachers on the following confessional rates :- 1- Freedom Fighters upto 220 Sqr Mtrs. 50% of the reserve price 2- Gallantry Award Holders: (i) Paramveer Chakra 220 Sq. Amendment of rule 18 In the existing proviso of sub-rule (I) of rule 18 of the said rules, the expression "that land for allotted on payment of 50% of the sanctioned reserve price" shall be substituted by the expression "that land for public and charitable institutions may be allotted by the trust on payment of residential reserve price." 6. Amendment of rule 19 In clause (3) of rule 19 of the said rules, the existing expression "on the serve price" shall be substituted by the following expression "On the residential reserve price plus 25% of such reserve price or at such rate as decided by the State Government in each case." (a) These rules may be called the Ex-servicemen (Re-employment in Central Civil Service and Posts)Amendment Rules, (b) They shall come into force on the date of their publication in the Official Gazette. 2. In rule 2 of the Ex-Servicemen (Re-employment in Central Civil Service and Posts) Rules, 1979 for clause (c) the following clause shall be substituted, namely :- (d) Ex-Servicemen means a person, who has served in any rank (whether as a combatant or as a non-combatant) in the Regular Army, Navy and Air Force of the Indian Union but does not include a person who has served in the Defence Security Corps, the General Reserve Engineering Force, the Lok Sahayak Sena and the Para Military Forces; and (i) who has retired from such service after earning his/her pension; or (ii) who has been released from such service on medical grounds attributable to military service or circumstances beyond his control and awarded, medical or other disability pension; or (iii) who has been released, otherwise than on his own request, from such service as a result of reduction in establishment; or (iv) who has been released from such service after completing the specific period of engagement otherwise than at his own request or by way of dismissal or discharge on account of misconduct or inefficiency, and has been given a gratuity; and includes the personnel of the Territorial Army of the following categories, namely :- (i) pension holders for continuous (embodied) service; (ii) persons with disability attributable to military service; and (iii) gallantry award winners. Explanation : The persons serving in the Armed Forces of the Union, who on retirement from service would come under the category of ex-servicemen may be permitted to apply for re-employment one year before the completion of the specified terms of engagement and avail themselves of all concessions available to ex-servicemen but shall not be permitted to leave the uniform until they complete the specified term of engagement in the Armed Forces of the Union. Coal Transportation Scheme (a) Scheme only for ex-service officers Those have register with the DGR within two years of retirement/release (b) Operate transport companies with coal subsidiaries in Orissa, Jharkhand, Chhattisgarh, Madhya Pradesh, Maharashtra and Damodar Valley Corporation. (c) Companies are sponsored against specific requisition. (d) Duration of sponsorship initially is for five years, extendable upto nine years subject to receipt of satisfactory performance certificate from coal subsidiary. (e) Minimum three officers form a private limited company. 3. Tipper Truck Scheme. This scheme envisages the attachment of one tipper truck to an ex-servicemen coal transport company. (a) Widows/Disabled ex-servicemen released from service with disability pension deposit Rs. 85,000/- with ex-servicemen coal Transport Company nominated by DGR for purchase of a tipper truck in their name. (b) Coal company pays Rs. 3000/- per month for five years. (c) Rs.85,000/- capital re-imbursed to the Widows/Disabled ex-servicemen after 5 years/renewed for another five years. Oil Product Agency (a) Eight percent Defence Quota. The oil products except for kerosene and naphtha remain controlled. Under this scheme, Ministry of Petroleum and Natural Gas (P&NG) have reserved 8% of the retail outlets of Petroleum & LPG for War Widows/dependents/disabled soldiers as per the following priority:- Priority-I. Widows/Dependants of posthumous gallantry award winners. Priority-II. Widows/Dependants of servicemen killed in war. Priority-III. Disabled in War Priority-IV. Widows/dependants of those died in harness with causes attributable to service. Priority-V. Disabled in peace with disability attributable to military service. (b) The eligible candidates apply to DGR for issue of eligibility certificate based on the advertisement in leading newspapers by the various oil companies. They then apply to Ministry of P&NG for specific retail outlets. Ministries of 61

64 P&NG scrutinize each application. A dealer selection board appointed by Ministry of P&NG then interviews the applicants, under defence quota. A letter of Intent (LOI) is then issued to those selected. (c) Special Scheme. 500 petroleum/lpg outlets were released by Govt for widows/nok of personnel killed in OP VIJAY in KARGIL Sector. A case has been taken up with Ministry of P&NG to allot 50 of these outlets to disabled soldiers boarded out of service during Kargil War. Army Surplus Class VB Vehicle (a) ESM can apply within five years of retirement. Widows can also avail of the scheme. (b) 35 types of vehicles presently available. 68 PENSIONARY BENEFITS ADMISSIBLE TO THE ARMED FORCES PERSONNEL AND THEIR FAMILIES Appendix "L" General 1. To maintain operational efficiency, the Armed Forces are required to maintain a youthful profile necessitating retirement of approximately 55,000 to 60,000 personnel every year. The Armed Forces personnel are granted pension since they are retired early at a younger age. The Government also recognizes their social, domestic and personal commitments at the comparatively young age of their retirement. In recognition to their needs, the Government takes a number of measures to rehabilitate them in civil life by providing re-employment as well as self-employment opportunities. Central Government has also undertaken various steps for the welfare of ex-servicemen and their families. 2. Pensionary Benefits. The Armed Forces Personnel are granted retiring/service pension on normal retirement/release from service on completion of the prescribed tenure. In cases of disablement in non-battle casualty cases, disability pension is sanctioned on the recommendation of the appropriate medical authority. Personnel injured/wounded during war or war like operations are granted a special pension known as War Injury Pension. The rates, terms and conditions for grant of these pensions are detailed in the following paragraphs. 3. Retiring/Service Pension (a) Officers (i) Eligibility Minimum qualifying service required for earning retiring pension is 20 years(without weightage). (ii)weightage (iii)pension Formula 9 years for Captains to 3 years for Generals is added to the qualifying service for the purpose of pension. It is calculated at 50 % of the average emoluments drawn during the last 10 months' for 33 years qualifying service. For service less than 33 years, pension is proportionately reduced. The maximum limit of Retiring Pension is 50% of the highest pay applicable to the Armed Forces personnel. (iv)commutation of 43% of the pension sanctioned is allowed to be commuted. Pension (v)dearness Relief (vi)retiring Gratuity As admissible from time to time The minimum period of qualifying service required for earning retiring gratuity is 10 years (without weightage). It 66

69 (b) PBORs (vii)leave encashment Upto 300 days is calculated at the rate of 1/2 a month's reckonable emoluments for each completed six months' period of qualifying service subject to a maximum of Rs. 3.5 lakhs. For calculating gratuity, a uniform weightage of 5 years of added service is given to all ranks. (i) Eligibility (ii) Weightage (iii) Pension Formula (iv)commutation (v)dearness Relief Minimum qualifying service required for earning Service pension is 15 years (without weightage) (20 years in the case of NCs(E). Weightage of 5 added years of service is given for calculation of pension. Pension is calculated at 50 % of the reckonable emoluments for 33 years of qualifying service to be reduced proportionately for lesser period of qualifying service. Pension is calculated with reference to the maximum pay held for 10 months preceding retirement. The minimum amount of service pension admissible w.e.f is Rs. 1275/- per month. 50% of the pension sanctioned is allowed to be commuted. As admissible from time to time. (vi)service Gratuity (vii)leave encashment The minimum period of qualifying service required for earning service gratuity is 5 years (without weightage). Admissible at a uniform rate of half months reckonable emoluments for each completed 6 months period of qualifying service subject to a maximum of Rs. 3.5 lakhs. Up to 300 days 3. Benefits Admissible in Cases of Invalidment/Retirement on Account of injuries sustained in war or war like situations. Personnel who sustain injuries in war or war like operations/counter-insurgency operations etc. are entitled to War Injury Pension and in cases of disablement on account of war injuries, the Armed Forces personnel are eligible to receive the pensionary benefits as under:- (a)invalidment on account of war injury: War Injury Pension consisting of service element and war injury element as under:- 67

70 (i) Service element - equal to retiring/serving pension to which the individual would have been entitled on the basis of his/her pay on the date of invalidment but counting service upto the date on which he/she would have retired in that rank in the normal course including weightage as admissible. There is no condition of minimum qualifying service for earning this element. (ii) War injury element - equal to reckonable emoluments last drawn for 100% disablement. However, in no case the aggregate of service element and war injury element is to exceed last pay drawn. For lower percentage, war injury element is proportionately reduced. (b) Streamlining the procedure to be followed by Medical Boards: The 5 th Central Pay Commission vide para had recommended that system of periodical review by the Resurvey Medical Board be abolished and the recommendation of the Medical Board be treated as final unless the individual himself asks for a review. The recommendation has been accepted in respect of injury cases. In respect of disease cases disabilities not of permanent nature there will be only one review of the percentage of disability by a Reassessment Board whose assessment will be final and for life unless the individual asks for a review. The review will be carried out by a Review Medical Board constituted by DGAFMS. The percentage of disability assessed by the Review Medical Board will be final. Necessary orders have been issued in this regard. (i) Calculation of war injury element. The extent of disability or functional incapacity is determined as under for the purpose of computing war injury element in the cases of invalidment:- (aa) Disability less than 50% -50% (ab) Disability between 50% and 75% -75% (ac) Disability between 76% and 100% -100% (ii) Constant Atendance Allowance (CAA):- Rs.600/- per month for 100% disablement on the recommendations of the Medical Board (iii) Retirement Gratuity. Subject to a maximum of Rs.3.5 lakhs. It is calculated on the basis of reckonable emoluments on the date of invalidment but counting service upto the date on which the individual would have normally retired in that rank plus weightage as applicable (total not exceeding 33 years) (c) In cases of retention in service despite war injury and subsequent retirement. Armed Forces personnel who are retained in service despite disability have an option either to draw lump-sum compensation in lieu of war injury element foregoing war injury element at the time of subsequent retirement/ discharge or to draw war injury element at the time of retirement in addition to retiring/serving pension admissible on retirement/discharge. 68

71 Those who opt for lump-sum compensation are eligible to pensionary benefits as under:- (i) (ii) Serving/Retiring Pension Lump-sum compensation in lieu of war injury element for disablement of 20% or more for life, at the following rates (in cases arising on or after ):- Category Commissioned Officers JCOs & equivalents Other Ranks Rates for 100% disability to be reduced proportionately for lower %age Rs. 5200/- per month Rs.3800/-per month Rs. 3100/- per month Once the compensation for war injury element has been paid, there is no further entitlement on account of such a disability at the time of retirement/discharge. Those who opt for war injury element on subsequent retirement are eligible to receive war injury element on monthly basis at the rates mentioned above. No war injury element is payable for disability less than 20%. (iii) Constant Attendance Allowance (CCA) - Rs. 600/- per month for 100% disablement on the recommendations of the Medical Board. (iv) Retirement Gratuity: - Subject to a maximum of Rs. 3.5 lakhs. It is calculated on the basis of reckonable emoluments on the date of invalidment but counting service upto the date on which the individual would have retired in the normal course in that rank plus weightage of 5 years ( but not exceeding 33 years). Note: W.e.f , Armed Forces personnel sustaining disability due to acts of violence/attack by terrorists, anti-social elements, bomb blasts in public places or transport, indiscriminate shooting incidents etc. are entitled to the same pensionary benefits (i. e. service element and retirement gratuity) as admissible to war injury cases on invalidment/retirement/discharge including lump-sum compensation in lieu of disability, as mentioned above, except that on invalidment they would be entitled to disability element instead of war injury element. For lower percentage of disablement, this amount is proportionately reduced. However, in no case aggregate of service element and disability element shall be less than 80% of reckon able emoluments last drawn. 69

72 4. Benefits in cases of returement/invalidment with disability attributable to/aggravated by military service (non-battle casualty cases). The disability pension is admissible subject to the condition that the disability on account which Armed Forces Personnel is invalided out is accepted as having occurred/aggravated by conditions of military service. (a) (In case of invalidment on account of disability attributable to or aggravated by military service, the individual is entitled to the pensionary benefits as under:- (i) Normal Retiring/Serving Pension - for the length of service actually rendered plus the full weightage appropriate to the rank held at the time of invalidment. There is no condition of minimum qualifying service having been rendered for earning this element of pension, if otherwise due. (ii) Disability element - at the following rates (for 100% disability to be reduced proportionately for lower percentage:- Commissioned officers JCOs & equivalents Other Ranks - Rs. 2600/- per month - Rs. 1900/-per month - Rs. 1550/-per month Where permanent disability is not less than 60%, the disability pension (total of service element plus disability element) is not to be less than 60% of reckonable emoluments last drawn. (iii) The extent of disability or functional incapacity is determinable as under for the purpose of computing the disability element in cases of invalidment:- Disability less than 50% - 50% Disability between 50% and 75% - 75% Disability between 76% and 100% -100% (iv) Constant Attendance Allowance (CAA): - Rs. 600/-p.m. on the recommendations of the medical board. (v) Leave encashment :- Upto 300 days (b) Where an Armed Forces personnel is retained in service despite disability and retires/discharged on attaining the age of retirement or on completion of tenure. w.e.f he/she is entitled to receive the following pensionarv benefits:- (i) Retiring/Serving pension - to be calculated at 50% of the average reckonable emoluments. The benefit of added years of service (weightage) which ranges from 9 years for Captain and below to 3 years for General is also given 70

73 for calculating qualifying service. PBORs are given the benefit of 5 added years of service for determining qualifying service. (ii) Retirement/Service Gratuity - depending on the length of service subject to the maximum of Rs. 3.5 lakhs. For calculating gratuity a uniform weightage of 5 years is given to all ranks (total not exceeding 33 years) (iii) Other benefits - Leave encashment upto 300 days. (iv) Disability element - at the following rates effective from (for 100% disability to be reduced proportionately for lesser degree of disability upto 20%):- Commissioned officers - Rs. 2600/- per month JCOs & equivalents - Rs. 1900/-per month Other Ranks - Rs. 1550/- per month Disability element is payable for disability actually assessed/accepted. No disability is payable for disability less than 20%. (c) Lump-sum compensation in lieu of disability element Where an individual is found to have a disability which is accepted at 20% or more for life but the individual is retained in service despite disability, he is paid a lump- sum compensation in lieu of disability element equal to the capitalized value of disability element on the basis of disability actually assessed (and not the disability computable in cases of invalidment). The rates of disability element for calculating capitalized value in cases arising on or after are as under:- Commissioned officers JCOs & equivalents Other Ranks - Rs. 2600/- per month - Rs. 1900/-per month - Rs. 1550/-per month Once such compensation has been paid in lieu of disability element, there is no further entitlement on this count at the time of retirement. 5. Benefits in the event of invalidment on account of disability neither attributable to nor aggravated by military service (invalid pension) (a) Eligibility Conditions - Invalid Pension is admissible where an individual is invalided out of Military service with a disability neither attributable to nor aggravated by military service, if the service actually rendered is 10 years or more. Invalid gratuity is paid when the service rendered is less than 10 years. (b) Rates (i) Invalid Pension:- Amount equal to the service element of disability pension that would have been admissible in case the causes were attributable to or aggravated by military service. 71

74 (ii) Invalid Gratuity: - ½ a month's reckonable emoluments for each six monthly period of qualifying service 6. Family Pensions The families of the Armed Forces personnel are granted family pension on the death of a Service personnel/pensioner. Family pensions are of three kinds, namely, Liberalized Family Pension, Special Family Pension and Ordinary Family Pension. The eligibility and conditions under which these pensions are granted are mentioned below:- (a) Liberalized family Pension (LFP) (i) Eligibility: The families of the Armed Forces personnel killed in war or war like operations, counter insurgency operations or in an encounter with or in incident involving armed hostiles, terrorists/ extremists, anti-social elements etc, are entitled to the Liberalized Family Pension. Presently, it is admissible as under:- (ii) Widow: Liberalized Family Pension equal to the reckonable emoluments last drawn by the deceased is payable to the widow in the case of officers and to the nominated heir in the case of PBORs until death or disqualification. Wef in case of remarriage of the widow, full liberalized family pension continues to be admissible to her if she continues to support the children or has no children. If she does not support children after remarriage, ordinary family pension at 30% to widow and special family pension at 60% to eligible children are admissible. (iii) Children: If the personnel is not survived by widow but is survived by child/children only, all children together are eligible to liberalized family pension at the rate equal to 60% of reckonable emoluments last drawn by the deceased. LFP is paid to the senior most eligible child till he/she attains the age of 25 years or upto the date of his/her marriage whichever is earlier and thereafter the LFP is passed on to the next eligible child w.e.f , in the case of eligible child is physically or mentally handicapped and unable to earn livelihood, LFP is admissible for life. Widowed/divorced daughters upto the age of 25 years or marriage whichever is earlier has been included in the definition of family for the purpose of Liberalized Family Pension. (iv) Parents: Where an officer dies as a bachelor or as a widower without children, dependent pension is admissible to parents without reference to their pecuniary circumstances at the rate of 75% of the LFP for both parents 60% for a single parent. (b) Special Family Pension (SFP) (i) Eligibility. Admissible in case of death of a personnel on account of causes attributable to or aggravated by military service (ii) Rate. Special Family Pension is admissible at the uniform rate of 60% of reckonable emoluments last drawn by the deceased, subject to a minimum of Rs. 2,550/- irrespective whether widow has children or not (in cases arising on or 72

75 after ). W.e.f , in case the eligible child is physically or mentally handicapped and unable to earn livelihood, SFP is admissible for life. Widowed/divorced daughters upto the age of 25 years or marriage whichever is earlier has been included in the definition of family for the purpose of Special Family Pension. Families of SSCOs and ECOs who die under circumstances attributable to military service shall also be entitled to special family pension. (c) Special Family Pension on Remarriage of Widow:- Special Family Pension on remarriage of widow, is regulated as follows:- Commissioned Officers (i) If she has child (ren): - (aa) If she continues to support Full Special Family children after remarriage Pension to continue to widow. (ab) If she does not support Ordinary Family (OFP) children after remarriage qual to 30% of emoluments last drawn to the re- married widow; 50% of the Special Family Pension to the eligible children. (ii) If widow has no children PBOR Full Special Family Pension to continue to widow. (i) If Special Family Pension is sanctioned to the Widow: Same provisions as applicable to officers. (ii) Where first life award is sanctioned to parents: (aa) If widow continues to 50% of SFP to parents support child(ren) after 50% of SFP to widow remarriage or has no issues (ab) If widow does not support Full SFP to parents children after re-marriage Ordinary Family Pension but the children are to widow supported by the parents (ac) If children are not 50% of SFP to parents supported either by the 50% SFP to eligible re-married widow or the children. parents Ordinary Family Pension to widow 73

(ii) Rate of Pension: With effect from OFP is admissible at a uniform rate of 30% of reckonable emoluments last drawn subject to a maximum of 30% of the highest pay applicable to Armed Forces Personnel. The minimum amount of Family Pension is Rs.1275/- per month. (i) Past family pensioners are entitled to get at least 30% of the minimum of the revised pay scale introduced w.e.f for the rank in the case of Officers and rank and group in the case of PBORs. (ii) If the deceased personnel had rendered 7 years or more service, the family is given OFP at the double the rate for the first 7 years or upto the time when the deceased would have reached the age of 67 years whichever is earlier. The amount of enhanced family pension is not to exceed 50% of the emoluments or the Retiring pension if the death takes place after retirement but before 67 years of age. (iii) With effect from , OFP is admissible also to (i) parents who were wholly dependant on the Armed Forces personnel provided the deceased had left behind neither a widow nor a child and (ii) widowed/divorced daughter till she attains the age of 25 years or up to the date of her re-marriage whichever is earlier. The income criteria is that their earning should not be more than Rs.2550/- per month. This benefit is 74

77 admissible w.e.f also in cases where death of Armed Forces personnel occurred prior to Ex-Gratia Award in the Event of Death While Performing Mitailry Duty In addition to Liberalized Family Pension/Special Family Pension, ex-gratia payment to the family of a deceased Armed Forces personnel is admissible as under in the event of death occurring on or after :- (a) Death occurring due to accidents in the - Rs.5.00 lakhs. course of performance of duties (b) Death occurring in the course of - Rs.5.00 lakhs performance of duties attributable to acts of violence by terrorists, anti-social elements etc. (c) Death occurring during (i) border - Rs.7.50 lakhs skirmishes and (ii) action against militants, terrorists, extremists etc. (d) Death occurring during enemy action in - Earlier Rs lakhs Revision of Pension international war or such like engagements which are specifica11y notified by the MOD. 75 increased to Rs.10 lakhs W.e.f (a) Revision of Pension of Pre Pensioners/Family Pensioners The Fifth Central Pay Commission recommended that total parity may be brought between the pre and post retirees, by notional fixation of pay of pre retires in the post scales of pay and refixing of pension of all pre retirees on basis of their notional fixation of pay. This recommendation of Fifth Central Pay Commission has been implemented by the Government and total parity has been achieved between pre retirees and those, who retired between and The Government have also accepted the concept of 'Modified Parity which stipulates that the consolidated pension shall not be less than 50% of the minimum of the new pay scale, as revised by Government, based on Fifth Central Pay Commission. This will be with reference to the post held by the pensioner, at the time of retirement. (b) Revision of Disability Pension/Special Family Pension/Liberalised Family Pension/War Injury Pension etc. in respect of Pre-1996 Armed Forces Pensioners The 5th Central Pay Commission though recommended the consolidation and revision of Ordinary Family pension in respect of past family pensioners, it is silent about the revision of Special/Liberalized Family Pension. The issue of revision of Disability Pension/War Injury Pension/Special Family Pension/Liberalized Family Pension etc. in respect of pre Armed Forces Pensioners was considered in consultation with Deptt. of Pension and Pensioners Welfare and Ministry of Finance and orders were issued by Ministry of Defence for revision of Disability Pension/Special Family Pension/Liberalized Family Pension /War Injury Pension etc. in respect of pre-

78 1996 Armed Forces pensioners vide letter No. PC 1(2)/97/D(Pen-C), dated In accordance with the provisions contained in the letter dated , while for the widows who were in receipt of Liberalized Family Pension (LFP), irrespective of the date of award, the consolidated pension shall be not less than the reckonable emoluments calculated on the minimum pay in the revised scale of pay introduced w.ef of the rank, rank and group(in the case of PBORs) held by the deceased personnel at the time of death, for the special family pensioners, the consolidated pension, shall not be less than 60% of the minimum pay in the revised scale of pay introduced w.e.f of the rank, rank and group (in the case of PBORs) held by the deceased personnel at the time of death, subject to a minimum of Rs. 2550/- p.m. The rates of Disability Pension, War Injury Pension (except invalidment cases), Constant Attendant Allowance as applicable to post 96 pensioners have also been extended to pre 96 pensioners in receipt of Disability Pension, War Injury Pension, Constant Attendant Allowance etc. w.ef Grant of ex-gratia to reservists. On the recommendations of 5 th CPC, Government order has been issued on for grant of ex-gratia to reservists. As per the Govt. letter ex-gratia of Rs. 600/- per month plus dearness relief applicable from time to time has been granted to the reservists who were discharged prior to and fulfilling other laid down conditions. The ex-gratia will be payable w.e.f Double Family Pension. With effect from 27 th July, 2001 family pension admissible under the employees Pension Scheme 1995 and the Family Pension Scheme 1971 has been allowed in addition to the family pension to the Armed Forces personnel under the relevant Pension Regulations. 11. Dearness Relief to Ex-servicemen on Re-employment. Payable on full pension including commuted portion if any as per the rates notified by the Govt from time to time. The details of various categories are given as under:- (a) PSU Absorbees: - Dearness Relief is payable at par with other pensioners. (b) Re-employed pensioners: - (i) Payable w.e.f provided pay on reemployment is fixed at the minimum of the pay of the post in which re-employed and full military pension was ignored for fixation of re-employed pay and was not re-employed in group A post. (ii) Re-employed Group A pensioners are also not entitled to Dearness Relief. (c) Family Pensioners: - Payable from irrespective of employment. 12. Retirement Gratuity (a) (b) Eligibility. Minimum qualifying service is 5 years for all. Weightage in qualifying service. 5 years in voluntary 5 years in all cases of Commissioned retirement cases. officers & PBORs. 76

79 (c) Formula for Retirement Gratuity. Payable in 1/4 th of emoluments for every six monthly period of service subject to maximum of 16.5 time of emoluments and further subject to maximum ceiling of 10 lakhs. IMPROVEMENT IN THE PENSION OF PERSONNEL BELOW OFFICER RANK (PBOR) 12. Government of India, Ministry of Defence (Deptt of Ex-Servicemen Welfare) vide letter No. 14(3)/2004-D (Pen/Sers) Vol.III dated 01 Feb 06 have conveyed that Group of Ministers (GOM) was constituted by the Government in January 2005 to look into the issue of One Rank One Pension. After detailed deliberations on the various aspects, GOM felt that the demand for One Rank One Pension cannot be agreed to, there is a justification for improving the pensionary benefits of the PBOR, particularly the three lowest ranks. 13. Finally, GOM unanimously recommended that the pension of pre retiree PBOR may be revised with reference to the maximum of post pay scales. In addition, the weightage of Sepoy, Naik and Havildar ranks for past as well as future retirees be increased to 10, 8 and 6 years respectively subject to a maximum qualifying service of 30 years. The benefit would be given only in respect of service pension. These orders are effective from No arrears are to be given. The following have been added to previous pension orders :- (a) With effect from , the weightage for the purpose of calculations of Pension for past as well as future retirees PBOR of Sepoy, Naik and Havildar ranks and their equivalent ranks in the Navy and Air Force, will be given weightage of 10 years, 8 years and 6 years respectively, subject to maximum qualifying service of 30 years. However, in case a person is already getting more than 30 years qualifying service with the existing weightage of 5 years, he would continue getting that and there will be no enhancement of weigtage in his case. The pension of past retirees would be recalculated accordingly. (b) With effect from , pension of pre retirees in all ranks of PBOR in Army, Navy and Air Force for 33 years of qualifying service shall not be less than 50% of the maximum pay in the revised scales of pay introduced with effect from including 50% of highest classification allowance, if any, of the rank and group held continuously for 10 months preceding retirement subject to a minimum pension of Rs. 1913/- per month. Such pension shall be reduced pro-rata where the pensioner has less than the maximum qualifying service for full pension that is 33 years. 77

80 Appendix "M" Supply of Motorised Tricycles to Ex-servicemen Paraplegics Kendriya Sainik Board provides motorised tricycles to disabled ex-servicemen. The following guidelines for submission of application and delivery of the motorised tricycle are issued:- (i) The application from the individual should be duly recommended by the Secretary of the concerned Rajya / Zila Welfare Officers. (ii) A certificate from the nearest Military Hospital to the effect that the applicant can move effectively only with the help of motorised tricycles should be enclosed with the application. (iii) Application found complete in all respects, Kendriya Sainik Board will provide motorised tricycle fabricated by 515 Army base Workshop through respective RSB/ZSB Grant for treatment of ex-servicemen and their dependents suffering from serious diseases Kendriya Sainik Board provides financial assistance in respect of following diseases on the basis of expenditure in General Wards of Govt Hospitals or other Hospitals:- (i) By-Pass Surgery (including preliminary tests like 60% of total angiography) expenditure (ii) Open Heart Surgery (iii) Angiography (iv) Pace Maker implant (v) Kidney / Rental Transplantation (vi) Cancer / Spastic Paraplegic (vii) Coronary Aftery Surgery (viii) Dialysis 75000/- For claiming the financial assistance the individual may apply to the Secretary, Kendriya Sainik Board through his Rajya Sainik Board with the following information's / documents :- (i) Original cash receipt in support of medicines purchased for the treatment / operation duly countersigned by the Hospital authorities. (ii) Photocopy of Hospital's Discharge Slip / Prescription Slip. (iii) Whether the case was referred by Military Hospital? If so, a copy of the letter referring the case to Civil Hospital. Details of financial assistance received from other sources, if any. 78

81 TYPES OF FINANCIAL ASSISTANCE PROVIDED BY THE KSB THROUGH AFFDF/RMDF/DMACP Appendix "N" Financial Assistance From Armed Forces Flag Day Fund Health Care: For serious ailments financial assistance of up to 90% for PBOR and 75% for officers is still being provided by KSB. Rs.75000/- per year was provided for dialysis and cancer. Ex-servicemen and families could take treatment for serious disease at empanelled leading civil hospitals. The ECHS will cater for the Health Care of defence pensioners who as per estimates are 60% of the ex-servicemen and widows registered with the ZSWO/ZSBs. The remainder non-pensioner ex-servicemen and families, World War II veterans will continue to be provided financial support for medical treatment by KSB through AFFD Fund. Details are as follows: - (a) All ex-servicemen suffering from serious diseases are being given financial assistance for treatment in civil hospitals in case they cannot be treated in Military Hospitals and have not availed similar assistance from any other source. The serious diseases for treatment of which financial assistance is provided are: - (i) Bypass surgery, angiography, angioplasty, open heart surgery, valve replacement, pace maker implant, kidney/renal transplant. (ii) Stroke, arterial surgery, prostate surgery and total joint replacement. 90% and 75% of the authorised expenditure in case of JCOs/OR and Officers Respectively upto Rs /- -do- (iii) Cancer/spastic paraplegic, dialysis Maximum of Rs.75, 000 per year in civil hospitals the praclic has been stopped due to ECHS. (ii) The financial help from KSB would be limited to the non pension holders for the following serious diseases:- (a) (b) (c) (d) (e) (f) (g) (h) Brain Tumor Spinal injury Electrophysiology Studies (EPS) towards Heart Treatment Radio frequency Ablation (RFA) towards Heart Treatment Road or other accidents requiring emergency treatment for life saving. 82 Notes (i) Those ex-servicemen who have been members of AGI/AFGI Medical Benefit Scheme and have already availed financial benefits from them are considered for financial assistance from KSB if they go in for subsequent treatment of serious disease and are not eligible for availing AGI/AFGI benefits for any further financial assistance. (ii) As and when ECHS facilities are in position, all ex-servicemen and widows eligible to join ECHS will not be entitled to finance from AFFD Fund. Non-pensioner exservicemen continue to receive financial assistance from AFFD Fund as hitherto fore. All pensioner ex-servicemen and family pensioners are therefore, advised to join ECHS. Disabilities. There are quite a few ESM who become disabled during action or due to accidents and other causes and are invalided out from service. These ESM are provided special medical care and trained to become self-reliant. The care and rehabilitation is undertaken in specialized institutions supported financially by KSB. These are:- (a) Queen Mary s Technical Institute, Pune (i) The Queen Mary s Technical Institute (QMTI) for disabled soldiers, Range Hills, Pune was established in It is a private Charitable Institution. It conducts ITI recognized vocational trades training courses for disabled servicemen, ex-servicemen and their dependents. The Institute received the recognition from the National Council for Training, Ministry of Labour, Government of India, in (ii) Prior to 1996, the Institute imparted training in low technology trades such as dyeing and printing. In 1996, some new courses were added to provide a wider scope for training and placement. Presently, the Insitution conducts courses in handloom weaving and leather goods marketing, fitter, electrician, mechanic diesel, mechanic radio, TV repair, stenography, etc. (b) Paraplegic Rehabilitation Centres (PRC) at Kirkee and Mohali (i) Paraplegic Rehabilitation Centres at Kirkee and Mohali with a capacity of 80 and 30 beds respectively are being run for rehabilitation of Paraplegic and Tetraplegic ex-servicemen. The institutes are autonomous in their functioning and all decisions regarding pay and allowances of the staff, management of the establishment and expenditure on inmates are taken by Board of Trustees/Managing Committee. (ii) A lump sum annual grant of Rs 9,60,750/-for PPH Kirkee and Rs 4,34,375/- for PPH Mohali is being granted for upkeep of the establishment by KSB and also provides 14,600/- p.a per inmates (No of actual inmates housed during the quarter). 80

83 (c) St Dunstan s After Care Organisation. St Dunstan s Organisation was formed to provide psychological support to overcome the devastating shock of blindness as well as to impart vocational training to the blinded ex-servicemen, to enable them to find a place in the society and to set them up in their homes and also after care services. The administration is looked after by the After Care Organisation under the overall control of the Sub Committee at Dehradun. Sub Area Commander, Dehradun is its Chairman. Presently Rs 12 lac is provided as annual budget from KSB. (a) Cheshire Homes. Cheshire Homes look after leprosy patients, mentally handicapped patients, and chronic spastic/paraplegic and TB patients. KSB is providing grants to Cheshire Homes/Raphael Ryder International Centre as follows: - (i) Cheshire Home, Delhi - Rs 4,000/- p.a. per inmate (ii) Raphael Ryder International - Rs 9,000/- p.a. per inmate Cheshire Home, Dehradun (iii) Cheshire Home, Lucknow - Rs 6,000/- p.a. per inmate (iv) Cheshire Home, Thiruvananthapuram Rs 4,140/- p.a. per inmate (v) Cheshire Home, Vellore - Rs 3,000/- p.a. per inmate (e) Indian Red Cross Society. KSB pays to Indian Red Cross Society for welfare Services provided by the Society to sick and wounded servicemen/ ex-servicemen in the Armed Forces Hospitals. An annual grant of Rs 6.5 lakh is given to the Society. Supply of Motorised Tricycles to ESM Paraplegics. KSB gives financial assistance to disabled ex-servicemen for expenditure incurred on transportation charges of Motorised Tricycle issued from 515 Army Base Workshop. Tool Kit for ex-servicemen Technicians. kits are provided, amount not exceeding Rs.2,000/-. Out of Armed Forces Flag Day Fund, tool Reimbursement of Interest by way of subsidy on loan taken from Bank for construction of House to war bereaved, war disabled and attributable peacetime casualties and their dependents. There is a scheme for re-imbursement of interest as subsidy on loan taken from Banks by war bereaved, war disabled, attributable peace time casualties and their dependents for construction of houses. Purchase of medicines for Gorkha Ex-servicemen in Nepal. An annual grant of Rs,1,00,000/- is being provided to the Indian Defence Attache in Nepal for local purchase of medicines for the Gorkha ESMs/dependents of Indian Armed Forces who have settled in Nepal. Duty free import of Therapeutic gadgets for paraplegic ex-servicemen patients. (a) Under Custom Notification No.208/81-Cus dated 22 Sep 1981, items required by the disabled and other categories of physically handicapped are permitted to be imported duty-free by any person. A perusal of the notification shows that it specifically covers the following items:- 81

84 Instruments and implants including self curing acrylic Bone Cement for replacement and bonding of hips, knee and other joints for severely crippled and handicapped. (b) The following items required by spinal patients and other categories of physically handicapped people are covered: - (i) Wheel & other chairs: - (aa) Folding wheel chairs with detachable arms and foot rests. (ab) Special light wheel chairs for easy handling. (ac) Motorised wheel chairs. (ad) Special purpose chairs for stairs climbing for tetraplegic and paraplegic workers. (ii) Aids for disabled namely, folding walking frames. (iii) Aids to extend reach to pick up small items (with small magnet pick up). (iv) Specialised fixtures for orthopaedic and spastic tetraplegic for manoeuvring and providing dexterity to fingers and wrist. (v) Turning beds for prevention of pressure sores. (vi) Emulsion cushions for tetraplegic and paraplegics to avoid pressure sores. (c) Further, under the same notification any other drug, medicine or equipment which is certified by the DGHS/DDGHS/ADGHS to be a life-saving drug, medicine, equipment, etc., can also be imported duty-free by any person. (d) Similarly, under notification No.63/88-Cus and 64/88-Cus dated 01 Jan 88, Government hospitals and certain categories of charitable hospitals are permitted to import their requirements duty-free. Grant to Training-cum-Productions Centres in Military Hospitals and other places. Annual grants are given to hospitals and other places for rehabilitation and training of exservicemen. Grant for construction/repair of Houses. 50 per cent of the grant, paid to war widows, war disabled by the State Govts for construction/repair of houses is reimbursed by the KSB subject to a maximum of Rs.10,000/-(KSB letter No.105-SB(7)/EC/91/ KSB/D dated 16 Nov 92. Grant for marriage of daughters of war widow/war disabled. KSB gives a grant of Rs.8,000/- for the marriage of daughters of a war widow or war disabled ex-servicemen whose disability is more than 50 per cent. 82

85 Miscellaneous Financial Assistance from KSB. All India Gorkha Ex-servicemen Welfare Organisation, Dehradun. The All India Gorkha Ex-servicemen Welfare Association (AIGEWA) was established in 1915 by the British to collect funds for the rehabilitation of soldiers who were to be demobilized after the end of the war. The Fund of AIGEWA was amalgamated with Armed Forces Flag Day Fund on 13 Apr Presently, the said Association is being provided an annual grant of Rs. 5 lakh per year from Armed Forces Flag Day Fund. War Memorial Hostels. The War Memorial Hostels were constructed with a view to provide shelter to the children of War widows, war-disabled, attributable cases. Location of War Memorial Hostels in States/UTs is detailed at Appendix 'D. Each Regt. Centre has provided non-recurring grant for construction and furnishing of WMH. Recurring grants are provided to the WMH for wards of Defence Rs.900/- p.m. and Rs.450/- p.m. for attributable and non-attributable cases respectively. Admission to WMH is open to the wards of all Defence personnel including those of Navy and Air Force in the following priority. (a) Wards of War Widows (b) Wards of War Rs. 900/- Wards of attributable cases (b) Wards of non attributable cases (death in service due to Rs.450/- Sharing cost of construction of Sainik Rest Houses. The basic aim of constructing a Sainik Rest House is to provide suitable & cheap accommodation to the ex-servicemen during their short visit to the State Capital/Distt HQs for settlement of their pension cases and other matter like availing the facilities of CSD Canteens, hospital etc. KSB shares with the State Govts 50% of the cost of construction of Sainik Rest Houses. State governemnet also learn the maintenance cost, at present there are 243 Sainik Rest Houses in the country. Location of these is given at Appx F. Expenditure in installing FAX machines in RSBs. KSB provide funds to the tune of 50% for the cost of a Fax Machine, for each States Department of Sainik Welfare, provided the respective State Govt also share 50% of the cost. Expenditure in installing computers/printers in RSBs. KSB provide funds to the tune of 50% for the cost of a personal Computer and Printer for each Department of Sainik Welfare provided the respective State Govt also share 50% of the cost. Financial Assistance from Raksha Mantri s Discretionary Fund (RMDF). A portion of the AFFD Fund is budgetted towards RMDF to provide financial support to the needy and poor ESM in penury and widows for various purposes as follows: (a) Marriage Grant Rs.8000/- (for upto two daughters) (b) House Repair Grant Rs.10, 000/- (c) Education Grant Rs.100/- p.m. per child (for three children upto XII standard) (d) Medical Grant Rs.15, 000/- (max- non pensioner only) (e) Monthly Grant Rs.1, 000/- p.m. (for two years) 83

86 (f) For any other purpose at the Rs.15, 000/- discretion of Hon ble Raksha Mantri Note: The cases for assistance from RMDF are submitted by concerned RSB/ZSB to KSB after verification. Defence Minister s Appellate Committee On Pensions (DMACP). Cases where family pension claims have been rejected or where disability is neither attributable nor aggravated by military service are given the following types of grants by the DMACP: - (a) Educational allowance Rs 25/-p.m. upto three children of ex-servicemen who were enrolled prior to 01 Jan 85. For personnel enrolled on or after 01 Jan 85, the grant is admissible to only two children. The maximum amount of educational grant is, however, restricted to Rs. 3,000/-. (b) A lump-sum grant upto Rs. 2,000/- to aged parents of the deceased exservicemen. (c) Cost of sewing machine to the wife of deceased/ disabled ex-servicemen. (d) A one time grant of Rs-1, 000/- for daughter's marriage. Appeals for financial assistance on rejection of pension claims should be made to the Defence Minister's Appellate Committee on pension within six months of rejection of the claim. The appeals are considered by the Committee based on merits of each case and the financial assistance granted which is, subsequently, paid by the Kendriya Sainik Board through the concerned Rajya/Zila Sainik Board. NOTE Details of the above schemes are held in the Kendriya Sainik Board. 84

87 PRIME MINISTER S MERIT SCHOLARSHIP SCHEME Appendix "O" 1. Introduction. 1.1 To encourage higher technical and professional education for the wards of widows and ex-servicemen of Armed Forces, it has been decided to introduce a new scholarship scheme known as the Prime Minister s Scholarship Scheme from the Academic year Eligibility 1.1 Persons eligible for the scholarship (a) (b) (c) (d) Wards of ex-servicemen and their widows (below officer rank) Wards of widows of ex-servicemen died in harness due to causes attributed to military service. Widows of ex-servicemen died in harness The scheme is open only for widows and unmarried wards of ESM/ widows. However, marriage/re-marriage at a subsequent date would not disqualify the awardee. 1.2 Courses eligible for the Scholarship First professional degree programme in engineering, medicine, dental, veterinary, MBA, MCA, Pharma, Nursing etc. duly recognised by the respective government regulatory bodies, such as All India Council for Technical Education, Medical Council of India etc. The scheme is open for courses mentioned above in recognised institutions irrespective of its location in the country vis-à-vis the residence/domicile of the wards of the ESM/widows. 1.3 Academic Requirement At least 60% marks at the 10+2 level for the initial sanction. For renewal in subsequent years, 50% marks each year. 3. Duration Of The Scholalrship Two to five years as approved by the concerned regulatory body for that programme. 4. Amount Of Scholarship The amount of scholarship would be as follows: (i) (ii) Rs.1250/- per month for boys. (Paid Annually) Rs. 1500/- per month for girls. (Paid Annually) 85

88 The payment of scholarship will be granted after the successful completion of each academic year, as per the percentages mentioned in the academic requirement. Note: The amount of scholarship including any other scholarship or financial assistance from any other source will not exceed the total amount of scholarship available under this scheme. 5. Renewal Of Scholarship Once the scholarship is awarded, the candidate is required to apply for renewal of scholarship for the subsequent year in the prescribed proforma, (attached with brochure) alongwith a certificate from the College/Institute indicating that the candidate continues to study in the subject course and State of Marks indicating the percentage. 86

89 ARMED FORCES FLAG DAY FUND Appendix "P" 1. Kendriya Sainik Board administratively controls the Welfare Funds for the welfare and rehabilitation of ex-servicemen, war widows/disabled and their dependents. With the issue of Govt of India, Ministry of Defence Notification No. SRO-7E dated 13 Apr 93, the following funds have been amalgamated into one fund named as "Armed Forces Flag Day Fund":- (a) Amalgamated Special Fund for war bereaved, war disabled and other exservicemen/serving personnel, (b) Flag Day Fund, (c) St.Dunstan's (India) and Kendriya Sainik Board Fund, and; (d) Indian Gorkha Ex-servicemen's Welfare Fund. 2. The management and administration of the Armed Forces Flag Day Fund rests with the Managing Committee with Hon ble Raksha Mantri as its Chairman. Flag Day and it's Significance 3. The Flag Day is commemorated on 07 Dec every year. The Day is intended to honour the valiant and dead, to salute the veterans and brave and to enhance the traditional bonds that exist between citizens of the country and the Armed Forces. 4. The Day is named as Armed Forces Flag Day as decided by the Defence Committee of Cabinet in Jul The Day has now become an old and honoured annual feature of our national life. It is on this day the services rendered by personnel of Army, Navy and Air Force are remembered. 5. We observe this day to enlist the public co-operation and support for three basic purposes - rehabilitation of families of battle casualties, welfare of serving personnel and their families and resettlement and welfare of ex-servicemen and their families, in general. 6. On this Day citizens and volunteer organisation collect donations in exchange of token flags and car stickers throughout the country. Token flags and car flags in red, navy blue and light blue colours representing the three Services are distributed to the public through Rajya, Zila Sainik Boards and the National Cadet Corps throughout the country by the Kendriya Sainik Board in return for donations. 7. A concerted effort is made on this Day to raise collection from the public. The significance of the Day is brought home to the potential donors in a variety of ways. The Flag Day messages are displayed through media to step up collections. At some places, Armed Forces Formations and Units also arrange variety of shows, carnivals, dramas and other entertainment programme. 8. Collections made on 7 th December are pooled into one fund known as Armed Forces Flag Day Fund and Amalgamated Special Fund at the Centre and States respectively. The Fund is operated by a Managing Committee presided over by the Hon ble Raksha Mantri at the Centre and by the Governor/Lt Governor of States/UTs. The Committee lays down the general policy and decides about the allocation of funds for various measures connected with the welfare of ex-servicemen and their families. These funds are properly managed, audited and accounted for. Donations are exempt from Income Tax in the hands of the donar. 9. It is pertinent to mention that the Centre is given only a very small share of the Flag Day Fund collections made by each State/UT. The Centre's share is only one paisa per individual of the population of each State/UT. This is forwarded by RSB to KSB on 1 Jan each year. 87

(ii) (iii) Death cum retirement gratuity based on length of service. Special family pension (60% of last pay drawn by the deceased). (iv) Ex-gratia grant of Rs 30,000/- to NOK of deceased soldiers from ACWF(Auth Army HQ letter No B/45401/AG/R&W dt 29 Mar 2001). (v) Govt married accommodation for 2 years which is extendable to 3 years in exceptional cases. (b) Terminal Benefits when Death is Not Attributable to Military Service. Benefits provided to Physical Casualties when death is not attributable to Military Service are as under :- (i) (ix). Benefits as mentioned at Para 3 (a) to (d), (f),(g) and Para 6(a) (ii), (iv) to (ii) Ordinary family pension as per rules. Eligibility of Soldiers/NOK of Soldiers Boarded Out due to Injury Sustained between 15 Aug 1947 to 30 Apr 1999 for Grant Out of Army Central Welfare Fund (ACWF) 5. Soldiers who were boarded out of service due to injury sustained during various military operations between 15 Aug 1947 to 30 Apr 1999 are eligible for one time grant of Rs. One lakh each from the Army Central Welfare Fund. In case the soldier is not alive, the grant will be paid to the nominated NOK of the deceased disabled soldier. The grant will not be payable to other legal heirs/family members. Payment of One Time Grant Out of ACWF to Disabled Soldiers Invalided/Boarded Out of Service in Low Medical Category without Completing their Terms of Engagement due to Injuries Sustained in Military Operations w.e.f. 01 May The disabled soldiers (Battle Casualties) who were either boarded/invalided out of service in low medical category without completing their terms of engagement due to injuries sustained in various military operations wef 01 May 1999 (other than OP VIJAY KARGIL) will be eligible for a one time grant of Rs. One lakh out of ACWF. Those soldiers 91

94 boarded/invalided out who have already received a grant of ACWF based on their disability percentage will receive a grant equal to the difference between Rs. One lakh and the grant already paid to them. 7. The disabled soldiers (Battle Casualties) who sustained injuries in various Military Operations after 01 May 1999 and are retained in service will continue to get a grant out of ACWF based on their disability percentage, as per the existing policy. Ex-Gratia Compensation to the Soldiers Invalided Out of Service due to Battle Injury in Op Vijay (Kargil) 8. Ex-Gratia amount for the soldiers, who are invalided/boarded out of service due to battle injury without completing terms and condition of service and not on own request, will be paid following ex-gratia amount based on percentage of disability :- Percentage of Disability Amount of Ex-Gratia (a) 50% or less Rs. 3 lakhs (b) 75% or less out but more than 50% Rs. 4.5 Lakhs (c) More than 75% Rs. 6 Lakhs Payment of One Time Grant Out of ACWF to NOK of All Personnel who Die in Harness after 01 Apr NOK of all personnel who die in harness after 01 Apr 2001 will be paid a one time grant of Rs.30000/- from ACWF. Members of regular Defence Forces, whether on or off duty are exempted from paying toll tax. A complaint in this regard was filed before Punjab Human Rights Commission at Chandigarh that under Indian Tolls (Army and Air Force) Act, 1901, serving Defence personnel cannot be charged toll tax whether he is on duty or not. The complaint was referred to Ministry of Law & Justice, which indicated that Indian Toll (Army and Air Force) Act, 1901 is a special Act which overrides general Acts such as National Highways Acts, 1956 and all Govt as well as private vehicles of the Officers, Soldiers and Airman of regular Defence Forces are exempted from paying toll tax irrespective of whether they are on duty or not.
