The AccountantGeneral effects recovery ofthe amount from pensionary benefits in cases where the retirees have drawn excess salary. This is causing undue financial hardships to such employees. In orderto obviate the difficulties so faced, instructions were issued by Finance Department vide Circular No A/60(78)-194 dated to all the Departments to issue necessary instructions to the HoDs/Drawing and Disbursing Officers subord inate to them to get the pay fixation of the employees checked/verified by the Audit parties of Accountant General/Director.General, Audit and Inspections by providing Service Books and related records and have verification certificate to this effect recorded on the service book of each employee. 2. It was also impressed upon that the priority be accorded tothecases of those employees who are to retire within next three to four years. In case audit ofthe office is not expected in near future, the service records (Service Books) of such employees were advised to be sent to Audit office for verification so that excess amount if drawn, is recovered before the superannuation of the employee. 3. It was also made known that in case, the Accountant General points out recovery of any amount during the course of assessing the pension, the concerned Head of the Office/Drawing and Disbursing Officer shall be responsible and pay drawn in excess be recovered from the defaulter. 4. The biggest drawback in th is regard brought into the notice by the Accountant General is, that, instead of the person committing the mistake, the pensioner suffers. The departmental authorities actually responsible for incorrect fixation of pay are not held accountable, despite the above clearcut instructions which call for action againstthe erring Government servants. Such approach in the matter makes employees especially (Class IV and Non-Gazetted), to suffer by way of huge recoveries.

11 6... The basic pol icy of the Government is to ensure, that a pensioner gets nsion as soon as he retires. In order to achieve this objective, it is once enjoined upon the Administrative Secretaries of the departments to s upon all the Drawing &. Disbursing Officers under their control to - retothecircular instructions issued from timetotime in letter and spirit ensure that pension papers are sent to the Accountant General six ths before the month of retirement of an employee. 26 21 GOVERNMENT OF JAMMU AND KASHMIR CIVIL SECRETARIAT-FINANCE DEPARTMENT Notification Jammu, the 25th Apri I, SRO-138.-In exercise of the powers conferred by proviso to Section 124 of the Constitution of Jammu and Kashmir, the Governor is pleased to direct that the following amendment shall be made in the Jammu and Kashmir Civil Service Regulations, 1956, namely:- (A) After Article 240-A (vii), the following shall be inserted as Article 240-A (viii)- "240-A (viii) Elderly pensioners shall be paid additional pension at the age of 80, 85, 90, 95 and 100 years in relation to the basic pension at these ages as per following rates :- Age of pensioner From 80 years to less than 85 years From 85 years to less than 90 years From 90 years to less than 95 years From 95 years to less than 100 years Additional quantum of pension 20% of basic pension 30% of basic pension 40% of basic pension 50% of basic pension 100 years or more 100 % of basic pension Note :- The payment of additional pension shall be regulated as under- (I) Additional pension shall be payable from the first of the month in which the pensioner attains the prescribed age and shall be recorded distinctly in the pension payment order by the. Pension DisbursingAuthority. Dearness Reliefshall also be payable on additional pension.

27 22 (2) Whenever the age of pensioner is available on the Pension Payment Order, the additional pension may also be paid by the Pension Disbursing Authorities without any further authorization from the Accountant General. (3) In case the exact date of birth of old pensioner is not available either in the P. P. O. or in the office records but an indication regarding the age of pensioner is available in the office record, the additional pension shall be paid from I st January of the year following the year in which the pensioner has completed the age of 80 years, 85 years etc. based on PPO/office records. In case neither the exact date of birth nor the age is available either in the PPO or in the office records, the Pension Disbursing Authority/Bank wi II send an intimation to the pensioner about the non-availability of the information regarding date of birth/age and request him to submit four copies of any of the following documents duly attested by a Gazetted Officer to the Pension Disbursing Authority :- I. PAN Card ; II. Matriculation Certificate (containing the information regarding date of birth) ; III. Passport; IV. Driving license (If it contains date of birth) ; V. Voter's ID Card. (4) If the pensioner submits document which contains the information regarding exact date of birth, the additional pension will be payable from the I st day of the month in which his date of birth falls. In case the exact date of birth is not available on the document submitted by the pensioner but an indication regarding the age of pensioner is available therein, the additional pension shall be paid from the I st January of the year following the year in which the pensioner has completed the age of 80 years, 85 years etc. based on the document submitted by the pensioner. For example, if the copy of Election ID Card submitted by the

28 23 pensioner indicates that his/her age on I st December, 2016 is 80 years, he/she shall be allowed additional pension from I st January, (5) The Pension Disbursing Authority/Bank will make payment of additional pension in the above manner, on provisional basis, up to a period of three months from the month in which the proof of age/date of birth is submitted by the pensioner. In such cases, the Pension Disbursing Authority/Bank will immediately send one copy each of the document submitted by the pensioner to the Accountant General for formal authorization of the additional pension. The Pension DisbursingAuthority/Bank will make a payment of additional pension beyond a period of three months only on receipt of such an authorization from the Accountant General. (6) In case the pensioner is unable to submit any of the documents mentioned above but claims additional pension based on some other documentary evidence, such cases will be submitted to the Administrative Department concerned. If the Administrative Department is satisfied about the claim of the pensioner, it wi II authorize additional pension with the agreement of Finance Department accordingly. The decision of the Finance Department will be final." (B) In Schedule XV of J&K CSR, Vol-II, after the proviso to clause 'c' below Note 4 of Rule 20 of Family Pension-cum-Gratuity Rules, 1964, the following proviso shal'l be added as proviso 2nd :- Elderly family pensioners shall be paid additional family pension at the age of80, 85,90,95 and 100 years in relation of the basic pension at these ages as per following rates :- Age of pensioner Additional quantum of pension From 80 years to less than 85 years From 85 years to less than 90 years 20% of basic pension 30% of basic pension

The amount of additional farni Iy pension shall be shown distinctly in the pension payment order. Dearness Relief shall also be payable on additional family pension. (2) Whenever the age of family pensioner is available on the Pension Payment Order, the additional family pension may also be paid by the Pension Disbursing Authorities without any further authorization from the Accountant General. (4) If the family pensioner submits document which contains the information regarding exact date of birth, the additional family pension will be payable from the I st day of the month in which his date of birth falls. In case the exact date of birth is not available on the document submitted by the family pensioner but an indication regarding the age of family pensioner is available therein, the additional family pension shall be paid from the I st January of the year following the year in which the family pensioner has completed the age of 80 years, 85 years etc. based on the document submitted by the family pensioner. For example, if the copy of Election ID Card submitted by the family pensioner indicates that his/her age on 1 st December, 2016 is 80 years, he/she shall be allowed additional family pension from I st January, (5) The Pension Disbursing Authority/Bank will make payment of additional family pension in the above manner, on provisional basis, up to a period of three months from the month in which the proof of age/date of birth is submitted by the family pensioner. In such cases, the Pension Disbursing Authority/Bank will immediately send one copy each of the document submitted by the family pensioner to the Accountant General for formal authorization of the additional family pension. The Pension Disbursing Authority/Bank will make a payment of additional family pension beyond a period of three months only on receipt of such an authorization from the Accountant General. (6) In case the family pensioner is unable to submit any of the documents mentioned above but claims additional family pension based on some other documentary evidence, such

31 26 cases will be submitted to the Administrative Department concerned. If the Administrative Department is satisfied about the claim of the family pensioner, it will 'authorize additional family pension with the agreement of Finance Department accordingly.
