N o.l I C cation [Leal Notice No. 16] CUSTOMS AN]) EXCISE ACT (CA1. 121) CUSTOMS AND EXCISE (MSG TRADE AGREEMENT DUTIES) ORDER 2011 IN exercise of the powers conferred upon me by section 7 of the Act, I make this Order to implement the Trade Agreement among the MSG Countries - and 1. This Order may be cited as the Customs and Excise (MSG Trade commencement Agreement Duties) Order 2011, and commences on the date of publication in the Gazette. Definition 2. In this Order, unless the context otherwise requires - "Agreement" means the Revised Trade Agreement (2005) among the Melanesian Spearhead Group Countries; "MSG Country" means Fiji, Papua New Guinea, Solomon Islands or Vanuatu. Application 3. This Order applies only to eoods imported into Solomon Islands from another MSG country and gives efect to Article 5 and Article 9 of the Agreement. Goods and 4. (1) The rate of import duties in respect of goods that are duties imported into Solomon Islands from another MSG country shall be amended by deleting existing rates and replacing with 'free', except for those goods rates of which are set out in the Schedule to this Order which gives effect to Article 9 of the Agreement and the following goods which are excluded from the Agreement: (a) (b) (c) all items of Chapter 22 (Beverages, Spirits and Vinegar) except items described in HS Tariff Code 2201, 2202 and 2209; all items of Chapter 24 (Tobacco and manufactured tobacco substitutes); all items of Chapter 27 (Mineral fuels, mineral oils and products of their distillation; bituminous mineral waxes), (d) Cane sugar. ITS code (2) The rates of import duties shall he replaced with'free' immediately unless otherwise specified in columns 3 to 9 of the Schedule to this Order or excluded from the Agreement according to Article 9. (3) The First Schedule to the Act is amended accordingly in respect of goods to which this Order applies.
