2 A MESSAGE FROM THE TRUSTEES The charity for which we are trustees is known as Ceredigion and Mid Wales NHS Trust General Fund Charity.We produce an Annual Report and Accounts each year, as part of our duty of public accountability and stewardship.the Trustees Annual Report includes a summary of the annual accounts and also explains the charity s objectives, structure, activities and achievements.we hope it will enable you to gain a full and proper understanding of the charity s financial transactions during the year, and the position of its funds at the end of the year. We would like to express our thanks to all those who helped Ceredigion and Mid Wales NHS Trust to improve facilities for patient care during the year.your generosity and support is unfailing and is always appreciated. Charitable Funds NHS Charitable Funds are principally funded by voluntary donations from the general public. In most cases, the Trust Board members of an NHS organisation are also trustees of the charitable funds held by that organisation and this is the case for Ceredigion and Mid Wales NHS Trust. Statutory Instrument Number formally transferred the NHS Charitable Funds relating to Ceredigion from the control of Dyfed Health Authority to the Trust on 1st April The statutory instrument was made by order of the Secretary of State for Wales and Ceredigion and Mid Wales NHS Trust Board members became trustees for the funds. These funds have been registered by the Trust with the Charities Commission (registration number ) and are operated in accordance with charity law. Charity law is not specific to the NHS, but deals with all charities. The four main Acts are: 5 Trustee Investment Act 1961 (as amended) 5 Charities Act Charities Act Charities (Accounts and Reports) Regulation Act 1995 The trusteeship of NHS Charitable Funds is provided for in the following legislation: 5 NHS Reorganisation Act 1973, Section 29 5 NHS Act 1977, sections 90, 92, 95(2) and 96(A) 5 NHS and Community Care Act 1990, Sections 11, 16(c), Schedule 2 Part II. Section 90 of the NHS Act 1977 states that A Health Authority has power to accept, hold and administer any property on trust for all or any purpose relating to the NHS. The NHS and Community Care Act 1990 conferred the same power on NHS Trusts. In Ceredigion, the appropriate hospital authority is the NHS Trust acting through its directors (the charity trustees), as determined by the NHS and Community Care Act The Trust Instrument referred to in the 1990 Act is the deed of trust or will. ORGANISATIONAL STRUCTURE The Trust s Charitable Funds Committee is responsible for the co-ordination of charitable activities. Applications to set up new charitable funds must be submitted to the Charitable Funds Committee, stating their purpose clearly in charitable terms. The Charitable Funds Committee determines the Trust s investment policies and has a key role in the management of Charitable Funds, as the Trustees are accountable to the Charities Commission and to the general public for the expenditure of donated monies. INVESTMENT POLICY The Charitable Trust s investment policy is to hold an element of its overall funds in cash deposits for operational commitments, whilst also employing Investment Managers to manage a discretionary portfolio on behalf of the charity, within the parameters set by the Charitable Funds Committee. They balance the requirement to generate income for charitable purposes against low risk investments, consistent with the charity s aims. Investment in the tobacco industry is not permitted. MAJOR RISKS The major risks to which the charity is exposed, as identified by the trustees, have been reviewed and reasonable systems have been established to mitigate those risks. HOW IS YOUR MONEY USED? Charitable funds are used for the purchase of equipment for patients, staff amenities and for research and education. They make a valuable contribution to the Trust s primary charitable purpose, which is for the relief of those who are ill or handicapped in Ceredigion, and must be of public benefit, not limited to a single beneficiary. Within the General Fund Charity are five subsidiary registered deeds of trust, which define elements of the charity as being for particular sites and services: 5 Bronglais Hospital 5 Cardigan Hospital 5 Aberaeron Hospital 5 Tregaron Hospital 5 Ceredigion Community Services. Some of the money is held for the general charitable purposes of each of the above, but within these five special trusts are many designated restricted funds used for TRUSTEES ANNUAL REPORT 2004/2005 3

4 CHARITABLE FUNDS During 2004/2005, the Trust received donations and legacies to the value of 383,000. In total, the Trustees approved expenditure of 548,000 during the year to improve patient care, examples of which are shown in the following list. Board members and other senior staff take decisions both on Charity and Exchequer matters but endeavour to keep the interests of each discrete and do not seek to benefit personally from such decisions. Declarations of personal interest have been made in both capacities and are available to be inspected by the public. During 2004/05, the Charitable Trust has made revenue and capital payments to the Ceredigion and Mid Wales NHS Trust and details of these transactions are recorded in the annual accounts, which are available from the Director of Finance.
