1 BETWEEN: THE TRUSTEES OF THE ALBERTA SCHOOL EMPLOYEE BENEFIT PLAN (hereinafter referred to as "ASEBP") - and - (hereinafter referred to as the Employer") - and - (hereinafter referred to as the Employee") OUTSIDE CANADA (AUSTRALIA) TEACHER EXCHANGE/SECONDMENT AGREEMENT WHEREAS the Employer is a Participating Employer under an Agreement between the Employer and ASEBP pursuant to which ASEBP provides or facilitates the provision of employee benefits, including coverage under Life Insurance, Accidental Death & Dismemberment Insurance, Extended Disability Benefits, Extended Health Care, Dental Care or Vision Care; AND WHEREAS the Employee resides in or near, Alberta (herein referred to as the "Normal Residence") and is employed by the Employer and has been covered by some or all of the above coverage; ASEBP 065A (10/17) Page 1 of 6
2 AND WHEREAS pursuant to an Agreement made between the Employer and another academic institution, the Employee will temporarily teach at a location operated by another academic institution outside of the province of Alberta on an exchange or secondment basis for the period from to, but will remain as an Employee of the Employer; AND WHEREAS ASEBP is prepared to continue providing or facilitating such insurance and other benefits coverage notwithstanding the temporary residence of the Employee outside of Alberta subject to the terms of this Agreement. The parties agree as follows: 1.0 For the purpose of this Agreement the following definitions shall apply: 1.1 Exchange/Secondment Agreement is any agreement between the Employer and the Exchange Secondment Institution pursuant to which the Employee will be teaching on a temporary basis at the Exchange/Secondment Location; 1.2 Exchange/Secondment Institution shall be the school or school system, college, municipality, government or other entity which operates the academic institution at which the Employee will teach on a temporary basis; 1.3 The Exchange/Secondment Location shall be. 1.4 Temporary Exchange/Secondment Coverage means coverage under any life insurance, accidental death & dismemberment insurance, disability benefits, extended health care, dental care or vision care benefit plans (similar to any such coverage provided by ASEBP) which the Employee is obliged or elects to obtain while teaching at the Exchange/Secondment Location or which is provided to the Employee pursuant to any law which is applicable to the Employee at the Exchange/Secondment Location. 3 2.0 The Exchange/Secondment Location may be changed provided that written notice of such change is provided to ASEBP beforehand. Notwithstanding anything contained in this Agreement, ASEBP reserves the right to cancel this Agreement and any insurance or benefit coverage provided if in its opinion such alternate Exchange/Secondment Location presents an excessive risk bearing in the mind the nature and extent of insurance and other benefits coverage provided. 3.0 Notwithstanding the content of any insurance policy or plan wording for any other benefit coverage provided to the Employee or dependants of the Employee through or by ASEBP, the Employee and any dependants shall be deemed to have met any residency requirements if the Employee or dependent has his or her principal residence in Canada or in the Exchange/Secondment Location, and during the continuance of such residence coverage shall continue in accordance with the respective ASEBP benefit plan documents, except as otherwise expressly stated herein. 4.0 For the purpose of all insurance programs and benefit plans provided, the Employee shall be regarded as continuing in the service of the Employer for so long as the Employee continues to teach at the Exchange/Secondment Location for the Exchange/Secondment Institution. 5.0 Notwithstanding anything contained to the contrary in any agreement between ASEBP and the Employer, or in any insurance policy or benefit plan document affording coverage to the Employee by ASEBP, this Agreement shall constitute an additional part of the entire contract but only insofar as it applies to the Employee and the Employee's dependants. 6.0 If the Employee is covered under the ASEBP Extended Disability Benefits Plan, it is understood and agreed that the provisions of the Extended Disability Benefits Plan shall be amended in the following respects: 6.1 The Trustees shall be entitled to offset against any benefits otherwise payable under this Plan the amount of any disability benefits received or payable under any temporary exchange/secondment coverage; ASEBP 065A (10/17) Page 3 of 6
4 6.2 Unless the Employee resumes residence at his/her Normal Residence within 90 days from the commencement of any total disability, payment of benefits will be limited to 24 months from the 91st day from the date which the Employee became totally disabled. 7.0 If the Employee is covered by the ASEBP Extended Health Care Plan, such plan is amended with respect to the Employee and Employee's dependants as follows: 7.1 Notwithstanding anything contained in the Extended Health Care Plan, excluded as a dependant is (1) any child who is not recognized as a dependant of the Employee if the Employee was insured under the Alberta Health Care Insurance Plan or under the Hospitals Act, (2) a dependant who is neither a resident in Canada or at the Exchange/Secondment Location, or (3) a dependant who is on active duty in any military, naval or air force of any country or peacekeeping force. 7.2 The ASEBP Outside Canada Emergency Travel Benefit is amended as follows: (a) (b) Covered expenses shall be limited to covered expenses incurred outside Canada and the Exchange/Secondment Location; The covered expense for medical evacuation shall be limited to the cost of such medical evacuation from outside the country of the Exchange/Location to the Exchange/Secondment Location, or on one occasion only with respect to any hospitalization outside of the country of the Exchange/Secondment Location, the cost of one way medical evacuation from outside the country of the Exchange/Secondment Location to the Employee s Normal Residence, if requested by the Employee. 7.3 Provisions describing Generally Excluded Expenses are amended by adding as a Generally Excluded Expenses, the following: (a) To the extent to which such a service or supply is provided partially or wholly to the Employee or Employee s dependants pursuant to any ASEBP 065A (10/17) Page 4 of 6
5 Temporary Exchange/Secondment Coverage; and 7.4 Provisions describing Description of Extended Health Care Coverage are amended by adding as Covered Expenses, the following: (a) The difference between the actual charged and the amount paid by Alberta Health Case for any services or supplies which would have been covered under Alberta Health Care Insurance Act (including surgical, medical and physician s charges), provided that written proof of the expense incurred is received by the Trustees within 9 months after the date the expenses was incurred. 8.0 If the Employee is covered by the ASEBP Dental Care and Vision Care plans, such plans are amended with respect to the section entitled "Generally Excluded Expenses" by adding thereto the following as additional services and supplies not covered, namely: 8.1 To the extent to which such service or supply is provided partially or wholly to the Employee or Employee's dependants pursuant to any Temporary Exchange/Secondment Coverage. 9.0 The coordination of benefits provisions contained in the ASEBP Extended Health Care, Dental Care and Vision Care Plans are inapplicable with respect to any benefits payable to the Employee or dependants of the Employee pursuant to any Temporary Exchange/Secondment Coverage. The Temporary Exchange/Secondment Coverage shall become first payer with respect to any benefits payable pursuant to same Within ninety (90) days after the commencement by the Employee of teaching duties at the Exchange/Secondment Location, the Employer and the Employee shall provide ASEBP with full particulars (including policy or plan wordings where possible) of any Temporary Exchange/Secondment Coverage. The Employee agrees to promptly apply for and maintain any such Temporary Exchange/Secondment Coverage for which he or she is eligible during the term of the exchange/secondment. Should the Employee be eligible for Temporary ASEBP 065A (10/17) Page 5 of 6
6 Exchange/Secondment Coverage but fail to apply for same, coverage under the equivalent ASEBP benefit plan shall automatically terminate upon the later of 90 days from the commencement by the Employee of teaching duties at the Exchange/Secondment Location or the deadline for applying for such Temporary Exchange/Secondment Coverage. Should the Employee obtain Temporary Exchange/Secondment Coverage but fail to maintain such coverage, coverage under the equivalent ASEBP benefit plan, or insurance policy shall automatically terminate as of the date of termination of such Temporary Exchange/Secondment Coverage The Employer will continue to remain responsible for payment of all premiums and other charges to ASEBP for coverage under any ASEBP benefit plan or insurance policy continued by the Employee during the term of the exchange/secondment.
