FEE DETERMINATION 4 ATTACHMENT A: SAMPLE AGREEMENT ATTACHMENT B: QUOTATION SCHEDULE AND EXAMPLE PREFACE: This Request for Qualifications (RFQ) is to provide Litigation Guarantees, Escrow Services and Title Insurance for acquisitions related to the Right of Way for road and capital improvement projects in the County of Fresno. It is the intent of the County to contract with one firm to provide professional services as described herein. However, the County reserves the right, at its sole discretion, to terminate this RFQ process or negotiations with a selected Title Company and begin a new RFQ process. Nothing herein, or in the process, shall be construed as having obligated the County to pay for any expenses incurred by respondents to this RFQ, or to the selected firm prior to Board of Supervisors approval of an Agreement. 1

3 I. SUMMARY The Fresno County Department of Public Works and Planning (Department) is seeking a qualified Title Company to provide Litigation Guarantees, Escrow Services, and Title Insurance for parcels affected by road and capital improvement projects. It is the intent of the Department to enter into agreement with a Title Company to provide specified services for a term of five years. New reports will only be requested during the first three years of the Agreement, with the remaining two years of the Agreement to provide time to complete and close out any existing assignments. The Title Company selected will provide services as needed on a project-by-project basis. Respondents to this RFQ will be asked to provide a fee estimate. The most qualified firm able to meet the Department s needs will be selected. In the event that two or more firms are equally qualified, the firm with the lowest cost for services will be selected. Each Title Company submitting a SOQ is responsible for reviewing the attached Sample Agreement, with the understanding that the Final Agreement will be substantially the same as the Sample Agreement (Attachment A). 4 III. SERVICES REQUIRED Title Report services may include, but are not necessarily limited to, Litigation Guarantees, Title Insurance and Escrow Services. IV. SERVICES PERFORMED BY THE COUNTY Services performed by the County shall include, but are not necessarily limited to, providing location of parcels of land for which title information is requested. V. SOQ SUBMITTAL REQUIREMENTS The Department will review each SOQ to determine the competence and qualifications of the Title Company. Please provide the listed information in the following sequence: 1. Company name, address and phone number 2. Type of organization (sole-proprietorship, partnership, or corporation) 3. Firm principals who will be responsible for the project, and their educational background, credentials and experience 4. Firm qualifications 5. List the name and phone number of at least four additional client references 6. Fee schedule (use Attachment B to generate a comparable schedule - Quotation Schedule Template and Example Quotation Schedule) DO NOT SUBMIT MORE INFORMATION THAN REQUESTED IN THIS RFQ VI. EVALUATION Department staff will evaluate the provided SOQs and Fee Schedules and make a recommendation to the Fresno County Board of Supervisors on the selection of the Title Company. The Department will assess the following criteria in evaluation of the SOQs. A. Experience with an emphasis on services related to typical Public Works projects B. Quality of past performance for the County or similar agencies C. Qualifications of individual(s), within the firm s organization, directly responsible for the work 3

5 D. Adequacy of staff to perform the work within the time allowed E. Demonstrated ability to work effectively with County staff, other public agencies and related parties F Knowledge of local conditions, where appropriate G. All other things being equal, local (within Fresno County) firms are preferred over non-local firms H. All other things being equal, non-local firms who associate with a local firm for the purpose of the particular services required shall be preferred to nonlocal firms who do not so associate The County reserves the right to conduct a background inquiry of each proposer which may include collection of appropriate background history information, contractual and business associations and practices, employment histories and reputation in the business community. By submitting a SOQ to the County, the proposer consents to such an inquiry and agrees to make available to the County such books and records the County deems necessary to conduct the inquiry. VII. FEE DETERMINATION The term of the Agreement will be five years, where Litigation Guarantees may be ordered only during the first three (3) years of the Agreement. Maximum total fee will be based upon Fee Schedules submitted with bid. Total fees paid to the firm will be dependent upon the bid provided. No guarantee is made that the total fee or any fee will be received by the firm. 4
