1 TEXAS DEPARTMENT OF TRANSPORTATION GENERAL SERVICES DIVISION SPECIFICATION NO. * BUILDING CONSTRUCTION FIELD INSPECTOR FOR TXDOT S SAFETY REST AREA PROGRAM PUBLICATION This specification is a product of the Texas Department of Transportation (TxDOT). It is the practice of TxDOT to support other entities by making this specification available through the National Institute of Governmental Purchasing (NIGP). This specification may not be sold for profit or monetary gain. If this specification is altered in any way, the header, and any and all references to TxDOT must be removed. TxDOT does not assume nor accept any liability when this specification is used in the procurement process by any other entity. 1. SCOPE: This solicitation is an Invitation for Bid (IFB) for services to provide a Building Construction Field Inspector (Inspector) for TxDOT s Safety Rest Area Program to work as TxDOT s agent on construction project(s). Services shall be limited to inspection of buildings including restroom buildings, picnic arbors, site mechanical, electrical and plumbing (MEP) utilities and MEP related to building and wastewater. Project location(s) will be identified on the Invitation for Bid (IFB). 2. RESPONDENT QUALIFICATIONS: The respondent shall: 2.1. Be a company or individual engaged in the business of providing Inspector services for a minimum of eight years within the last ten years Provide one inspector per location Be in good financial standing and current in payment of all taxes and fees such as state franchise fees. TxDOT reserves the right to request a copy of the respondent s audited or un-audited financial statement. When financial statements are requested, TxDOT will review the respondent's audited or un-audited financial statement to this solicitation in accordance with Texas Government Code, Title 10, Subtitle D, Section to evaluate the sufficiency of the respondent's financial resources and ability to perform the contract or provide the service required in the solicitation. TxDOT will be the sole judge in determining the sufficiency of the respondent's financial resources and ability to perform the contract or provide the service. Factors to be reviewed include: Balance sheets Net working capital. * This Specification Supersedes Specification No., Revised October

2 Current asset ratio Liquidity ratio Auditor(s) notes Any notes to the financial statements. 3. INSPECTOR QUALIFICATIONS: An Inspector shall meet the following qualifications: 3.1. A minimum of eight years experience within the last ten years to include each of the following: Construction administration, inspection of commercial buildings or the construction industry Reading and interpreting construction drawings and specifications for building construction Reading and interpreting construction schedules, understanding the principles involved in making adjustments to a construction schedule and understanding of lead-time and critical path items Has knowledge and experience in understanding the contractual relationships between governmental entities, the general contractor and subcontractors Has knowledge and experience in monitoring and recommending compliance of TxDOT, Federal and OSHA safety requirements for working conditions and environment Has experience using Microsoft Word, Microsoft Photo Editor or similar software and Has a driver license valid in the state of Texas Has no Driving Under Influence (DUI) or Driving While Intoxicated (DWI) incidents on driving record within the past three years Has no more than two moving violations on driving record within the past three years. 4. VENDOR REQUIREMENTS: The vendor shall: 4.1. Adhere to the TxDOT Terms and Conditions identified on the solicitation Have qualified Inspectors to provide one inspector for each location identified on the solicitation Provide the Inspector with the following items: Transportation to travel to and from the job site each working day and to tour the job site as required Cellular telephone or pager. 2-10

3 Digital camera and supply of digital camera memory cards. SPECIFICATION NO Personal computer with and Microsoft Word 2003 and Microsoft Photo Editor software All required personal protective equipment. 5. INSPECTOR REQUIREMENTS: An Inspector shall: 5.1. Be able to communicate, by written and oral means, in English Communicate directly to the TxDOT Project Manager Observe and recommend compliance through job site observation of TxDOT, Federal and OSHA safety requirements for working conditions and environment. 6. SERVICE REQUIREMENTS: The vendor shall: 6.1. REPORTING: Submit a daily electronic field observation report (construction log) to the TxDOT Project Manager (Ref. Attachment B Example of a Field Observation Report and Photo Record),which shall include but not be limited to, the following items: digit Purchase Order number Project name, number and location (Ref. Para ) General contractor s name Construction activities Subcontractors present Notations of any delays in the general contractor s work schedules Problems that arise and the solution attained Weather and site conditions Identify the date and circumstances when no work is performed for the full day or where work is only performed for a partial due to no fault of the vendor, such as rain, inclement weather or environmental issues (state what the issues are). If work is canceled due to no fault of the vendor, after the Inspector has arrived at the job site, TxDOT will pay the vendor four hours compensation. Compensation will be paid at half the daily rate. The TxDOT Project Manager will verify the reason for no work being performed and approve the four hours compensation for each date identified (Ref. Paras. 7. and 13.3.) Narrative description including photos (Ref. Attachment B Example of a Field Observation Report and Photo Record) ADDITIONAL REPORTING: Submit a computerized record, using a TxDOT provided standard format, when periodic inspections are performed at the job site by TxDOT personnel responsible for the project. 3-10

4 6.3. PHOTO RECORD: Photo record construction progress daily, using a digital camera to document change, lack of change or current items of interest or concern. The daily photo record shall be submitted via to the TxDOT Project Manager daily with the daily field observation report. The photo record shall detail critical activities, unforeseen conditions and the solutions attained. The photo record shall be maintained electronically on a computer with a backup copy on CD or DVD using Microsoft Photo Editor MEETINGS: The Inspector shall: Attend construction progress meetings held at the job site with the general contractor, subcontractors, and TxDOT personnel when scheduled Meet with TxDOT s Project Manager at the job site a minimum of once per calendar month, to discuss project status NON-CONFORMANCE WITH THE CONSTRUCTION DOCUMENTS: The Inspector shall enforce the set of standards defined within the project specifications for non-conformance with the construction documents. The Inspector shall not assist, recommend or suggest means, methods or procedures to the general contractor or subcontractor. Inspector shall: Reject work that does not conform to the conditions of the construction documents after verbal notification and gaining concurrence of the TxDOT Project Manager Immediately follow up with written documentation on major non-conforming items, such as the general contractor s refusal to alter an incorrect course, deviation from the general contractor s construction schedule or other major issues of concern Receive the monthly payment application from the general contractor to verify item of work completed by the general contractor corresponds to the payment application s request for those items. The Inspector shall advise the TxDOT Project Manager of the accuracy of the payment request, prior to any scheduled meeting with the general contractor, subcontractors or TxDOT personnel PROJECT CLOSE OUT Maintain a set of record (as-built) drawings during construction. Provide record drawings to the TxDOT Project Manager at project close out Submit a copy of all field observation reports, photo records and correspondence on a CD or DVD to the TxDOT Project Manager at the project close out. 7. WORK HOURS: The vendor shall have an inspector on-site when any work is being performed and conform to the work week of the General Contractor. This is generally a six day a week work week. TxDOT will pay a maximum of four hours for a day where work is canceled after the arrival of the Inspector at the job site due to no fault of the vendor. These days shall be identified on the invoice (Ref. Paras and 13.3.). 4-10

5 8. INSPECTOR CONTINUITY AND REPLACEMENT 8.1. TxDOT recognizes that events beyond the control of the vendor such as the death, physical or mental incapacity, long-term illness, or the voluntary termination of employment of the Inspector will require the vendor propose a replacement. In the event such a replacement is necessary, vendor agrees that the replacement Inspector shall not begin work on the project without prior written approval from TxDOT The vendor agrees that the Inspector assigned to the project shall remain available for the entirety of the project throughout the term of the purchase order as long as that individual is employed by the vendor If TxDOT determines the Inspector unable to perform in accordance with the service requirements or to communicate effectively, the vendor shall immediately remove that person Proposed replacement of a Inspector shall meet minimum qualifications and have experience comparable to the person(s) being replaced. Replacement of a Inspector shall be provided at no additional cost to TxDOT within five days from notification that the Inspector is being replaced. Resume(s) and reference(s) will be requested for the proposed replacement(s). TxDOT may reject any replacement if references or past working performance is questionable or unfavorable. TxDOT will be the sole judge of the qualifications of the proposed replacement Inspector. 9. SAFETY: The vendor shall require the Inspector to: 9.1. Observe all safety policies, rules and requirements at all times, including, but not limited to, wearing hard hats, safety vests, safety shoes, goggles, safety harnesses, etc Report any observed safety violations by the general contractor or subcontractor s to the TxDOT Project Manager Coordinate with the general contractor s construction superintendent all construction area safety equipment requirements, including but not limited to: hard hats, vests, safety shoes, goggles, safety harness and other OSHA requirements when on the highway right-of-way. This includes visitors and those individuals working in the construction areas Verbally report defective equipment and improper use of safety equipment to the general contractor s construction superintendent. If compliance or action taken toward compliance is not met within eight working hours, the Inspector shall provide written notification to the general contractor s construction superintendent with copies to the TxDOT Project Manager. 10. SUBCONTRACTING Subcontractors providing service under the purchase order shall meet the same service requirements and provide the same quality of service required of the vendor No subcontract under the purchase order shall relieve the primary vendor of responsibility for the services The vendor shall be the primary contact for TxDOT and subcontractor(s). 5-10

6 10.4. The vendor shall manage all quality and performance, project management, and schedules for subcontractors. The vendor shall be held solely responsible and accountable for the completion of all work for which the vendor has subcontracted TxDOT retains the right to check subcontractor's background and make a determination to approve or reject the use of submitted subcontractor(s). Any negative responses may result in disqualification of the subcontractor TxDOT reserves the right to request the removal of vendor s subcontractor staff deemed unsatisfactory by TxDOT Subcontracting shall be at the vendor s expense During the term of the purchase order, if the vendor determines a need for a subcontractor change, TxDOT shall be notified in writing by the vendor within 30 days of any proposed change. The vendor shall be required to provide references and work history for any proposed subcontractor to TxDOT. No change will be allowed without written authorization by TxDOT SOLICITATIONS OVER $100,000: TxDOT will make an initial determination of whether subcontracting is probable. It is the respondent s determination to choose to subcontract any of the work under this purchase order with a Texas Certified Historically Underutilized Business (HUB) or other businesses If TxDOT has determined that subcontracting opportunities are probable, the class and items in which HUBs may be registered will be noted in the solicitation The respondent shall identify all proposed HUB and other subcontractors at the time of response submittal. The required forms with video instructions can be found at the following website: HUB SUBCONTRACTING PLAN (HSP) PRIME CONTRACTOR PROGRESS ASSESSMENT REPORT: After award of the purchase order, the vendor shall report all HUB and non-hub subcontractor information using the HSP Prime Contractor Progress Assessment Report form. The report shall be submitted to the TxDOT contract manager monthly. The report shall be submitted monthly even during the months the vendor is not invoicing TxDOT. All payments made to subcontractors shall be reported. TxDOT may verify the amounts being reported as paid by requesting copies of cancelled checks paid to subcontractors. 11. TRAVEL: All travel and per diem shall be included in the unit price. 12. CONFLICT OF INTEREST: The vendor, vendor s personnel, and vendor s subcontractor(s) shall affirm not to have, nor acquire any interest during the term of the purchase order that would conflict in any manner with the performance of the vendor s obligations in regards to services authorized. 13. INVOICING INSTRUCTIONS: The vendor shall provide a comprehensive and detailed monthly invoice with reference to the basis for each item charged. Original documentation that validates the charges shall be attached. The original invoice shall be sent to the address shown on the purchase order or ed to FIN_Invoices@dot.state.tx.us to ensure timely payment and shall include the following: 6-10

7 13.1. Name of Inspector Location of service with project name, number and location (Ref. Paras and 14.3.) Calendar days worked or identified as a date when work was canceled (Ref. Paras and 7.) An invoice requiring correction shall be re-submitted with a new invoice date. 14. TxDOT RESPONSIBILITIES: TxDOT will: Provide a Project Manager Provide a TxDOT point of contact Provide the project name, number and location Provide the Inspector with critical elements of the construction Provide plans, specifications, project schedule and product submittals Provide guidance, direction and consultation to the Inspector, upon request throughout the term of the purchase order. 15. RESPONSE SUBMISSION: The following shall be submitted with the response. Failure by the respondent to submit the documentation listed below will disqualify the respondent from further consideration GENERAL FORMAT: The respondent shall submit one signed and dated original (marked Original) and three copies (marked Copy). The submission shall be in separate loose leaf binders on one sided 8-1/2 x 11 inch paper and shall be tab-indexed corresponding to the sections listed below. Plastic spine-bound or wire bound submittals are highly discouraged. Include only the information specified for each section ORIGINAL RESPONSE: The original response shall include the following: Section 1 Invitation for Bid (IFB): Original signed, dated and completed IFB. NOTE TO RESPONDENT: If addendums are generated as part of this solicitation, include the original signed and dated addendum(s) in Section Section 2 Financial Standing: The respondent shall submit a statement from the president, owner or financial officer on company letterhead certifying that the company is in good financial standing, current in payment of all taxes and fees (Ref. Para. 2.3.) Section 3 Schedule 1 - Company Qualifications and Experience: (Ref. Para. 2.) Section 4 Schedule 2 - Inspector Qualifications and References: (Ref. Para. 3.). 7-10

8 Section 5 Schedule 3 Respondent References: Respondent (a company or individual) shall submit references for all similar services, which are alike in size and scope that verify the qualifications and experience requirements for services performed for a minimum of eight years within the past ten years. References shall illustrate respondent s ability to provide the services outlined in the specification. References shall include name, point of contact, telephone number, and dates services were performed. The response will be disqualified if TxDOT is unable to verify qualification and experience requirements from the respondent s references. The response may be disqualified if TxDOT receives negative responses. TxDOT will be the sole judge of references Section 6 HUB Subcontracting Plan (if applicable) COPIES: The three reproduced copies (marked Copy) shall include only the following tab-indexed sections: Section 3 Schedule 1 - Company Qualifications and Experience Section 4 Schedule 2 - Inspector Qualifications and References Section 5 Schedule 3 Respondent References. 16. RESPONSE EVALUATION STEP 1 REVIEW OF RESPONSES BY PURCHASING: Only a complete response with the listed required submittal documents (Ref. Attachment C Minimum Response Submission and Qualification Requirements) and meeting minimum qualifications will be considered. Failure to meet the minimum qualifications and submit the required documents will result in a response being declared non-responsive STEP 2 INITIAL EVALUATION: A TxDOT evaluation committee will evaluate and score each response based on established criteria. Respondents shall not contact members of the evaluation team. Responses will be evaluated according to the respondent s ability to best satisfy TxDOT requirements Respondent qualifications and response submission information will comprise 60 percent of the evaluation total Pricing submitted for the solicitation requirements will be 40 percent of the evaluation total STEP 3 DISCUSSION MEETING: TxDOT may request that selected respondents, including Inspector, participate in a discussion meeting Discussion Meeting: The respondent and TxDOT may discuss and clarify various requirements of the solicitation, vendor response, discuss any negotiable points, further confirm proposed personnel qualifications and determine the respondent s capability to perform the service. A TxDOT evaluation committee may evaluate and score each discussion TxDOT will advise each respondent in writing of the location, date and time of the scheduled discussion meeting. A minimum of two weeks notice will be given to the respondent(s) selected for the discussion meeting phase. 8-10

AWARD SPECIFICATION NO TxDOT may provide the respondent with the proposed Inspector(s) required to attend and participate in the meeting Respondent and proposed Inspector should be prepared to address any questions that may be asked by TxDOT evaluators TxDOT reserves the right to continue discussions with selected respondent(s) TxDOT reserves the right to award a single purchase order to the most responsive, responsible respondent meeting the specification. TxDOT may award to a single vendor or split the award and award each line item to different vendors, whichever best serves the interest of TxDOT TYPES OF AWARD Single Award: One purchase order awarded to a single vendor Split Award: Award of separate line items on a single solicitation to different vendors resulting in two or more purchase orders. 18. POST AWARD MEETING: Vendor(s) may be required to attend a post award meeting in Austin, Texas or at the project location with TxDOT within 14 calendar days after the award of the purchase order. The location of the meeting shall be determined by the Project Manager. The purpose of the meeting is to discuss the terms and conditions of the purchase order and to provide additional information regarding the purchase order. 19. CONTRACT ADMINISTRATION: Administration of the purchase order is a joint responsibility of the TxDOT Contract Administrator and TxDOT Purchasing. TxDOT Purchasing staff will be responsible for administering the contractual business relationship with the vendor Any proposed changes to work to be performed, whether initiated by TxDOT or the vendor, must receive final written approval in the form of a Purchase Order Change Notice signed by the authorized TxDOT purchasing agent Upon issuance of purchase order, TxDOT will designate an individual who will serve as the Contract Manager and point of contact between the agency and the vendor. The Contract Manager does not have any express or implied authority to vary the terms of the purchase order, amend the purchase order in any way or waive strict performance of the terms or conditions of the purchase order. This individual s contract management and contract administration responsibilities include, but are not limited to: Monitoring the vendor s progress and performance and ensuring services conform to established specification requirements Managing the financial aspects of the contract including approval of payments Meeting with the vendor as needed to review progress, discuss problems, and consider necessary action Identifying a breach of contract by assessing the difference between contract performance and non-performance. 9-10
