1 WIN A SOLAR PHOTOVOLTAIC SYSTEM AND BATTERY COMPETITION TERMS AND CONDITIONS OF ENTRY Important notes: Pursuant to clause 21, the Promoter updated these terms on 3 April The changes have enlarged the prize pool and added Zones as specified in clause 3. For further details, see here: This document, together with the additional information set out on Horizon Power s website, form the terms and conditions ( Terms and Conditions ) for the Win A Solar Photovoltaic System and Battery Competition ( Promotion ). Entry into this Promotion is deemed acceptance of these Terms and Conditions. To be eligible to accept a Prize, an Entrant must meet the eligibility criteria (clause 4), own and occupy an eligible premises (clause 5) and be willing to meet the Prize acceptance criteria (clause 16). This includes the condition that each Prize winner enter into a Customer Contract as specified in clause 16. Do not enter this Promotion if you do not accept or cannot comply with these Terms and Conditions. 1. Promoter: The promoter of this Promotion is Regional Power Corporation ABN of Stovehill Road, Karratha, Western Australia trading as Horizon Power ( Horizon Power or Promoter ). 2. Promotion Period: The Promotion commences 12:01am (Australian Western Standard Time) on Wednesday, 7 March 2018 and ends at 5:00pm (Australian Western Standard Time) on Friday, 13 April 2018 ( Promotion Period ). 3. Zones: For the purpose of allocating Prizes to Entrants the Promotion is separated into the following zones: a) Zone 1 is the city of Carnarvon excluding Zone 2 ( Zone 1 ); and b) Zone 2 is the area marked on the map attached to these Terms and Conditions as Zone 2 ( Zone 2 ) and is further divided into 3 sections which are referred to in clause 12 as Section 1, Section 2 and Section Eligibility criteria: Subject to clauses 6 and 7, entry is open to entrants ( Entrants ) who: a) are permanent Carnarvon residents; b) are aged 18 years or over; c) both own and occupy a premises in Zone 1 or Zone 2 that meets the criteria set out in clause 5 ( Entered Premises ); and d) are able and willing to meet the prize acceptance criteria set out in clause 16 if they win the Promotion.

Eligible premises: An Entered Premises must: a) have either a residential account with the Promoter on the A2 tariff or a business account with the Promotor on any tariff other than the N2 tariff; b) have a Horizon Power Advanced meter; and c) not already have any rooftop solar photovoltaic system installed. 6. Excluded entrants: You are ineligible to enter this Promotion if you: a) do not satisfy all of the eligibility criteria set out in clause 4 above; b) are a director, manager, employee or agent of the Promoter, its related bodies corporate or any agency associated with this Promotion; or c) are an immediate family member of a director, manager, employee or agent of the Promoter, its related bodies corporate or any agency associated with this Promotion. 7. Maximum number of entries: a) Only one entry into the Promotion is permitted for any one premises, regardless of the number of owners or occupiers of that premises or the number of accounts with the Promoter in respect of that premises. b) Subject to clause 7(a), an Entrant is permitted to complete and submit only: (i) (ii) (iii) one entry for an Entered Premises with a residential account with the Promoter; one entry for an Entered Premises with a business account with the Promoter; and a maximum of two entries in total if the Entrant submits one entry for two separate Entered Premises, one having a residential account and the other a business account, regardless of the number of premises the Entrant owns or occupies, whether those premises are in Zone 1, Zone 2 or both zones and the number of residential or business accounts the Entrant has with the Promoter. c) In no circumstances will a single Entrant be permitted to win two Prizes, notwithstanding that the Entrant may have submitted two entries in accordance with clause 7(b). d) The Promoter has the right to remove any entries that appear to be duplicates or multiple entries from the same Entrant (other than in accordance with clause 7(b)) or in respect of the same premises. 8. Entry process: To enter the Promotion, you must follow this process prior to the end of the Promotion Period: a) access the Horizon Power corporate website page at and open the link to the Promotion; b) enter your details and complete the entry form as prompted in the link to the Promotion; c) click on the relevant box to confirm you are aged 18 years or over, meet the other eligibility criteria and have read and agree to these Terms and Conditions; and

3 d) answer the following question in the space provided: [In 50 words or less, why do you think renewable energy is good for Carnarvon s energy future?] 9. Invalid entries: The Promoter accepts no responsibility for incomplete, incorrectly submitted, delayed or misdirected entries. 10. Judging: a) The winners of this Promotion will be determined by a panel of judges at 1:30pm (Australian Western Standard Time) on Tuesday 17 April 2018 at 18 Brodie Hall Drive, Bentley WA b) The results of the judging are final and no correspondence will be entered into. c) The Promoter reserves the right to determine the ranking of as many entries as it sees fit, so as to enable the awarding of Prizes to replacement Prize winners, without re-judging, if a Prize is deemed to be forfeit in accordance with clause 17. d) The Promoter reserves the right to re-judge the Promotion if a Prize is deemed to be forfeit in accordance with clause 17, and adequate entries have not been ranked to determine a replacement Prize winner. In these circumstances, the Promoter may re-judge the Promotion at midday on 15 May 2018 at 18 Brodie Hall Drive, Bentley WA 6102, subject to any written direction given by applicable law. 11. Judging criteria: The winners of this Promotion will be decided on the basis of the accuracy and creativity of their answer submitted as party of their entry. On this basis, this Promotion is a game of skill and not a game of chance. 12. Allocation of Prizes: a) The Promoter will allocate a total prize pool of 10 Prizes as set out in this clause 12. b) In Zone 1, the Promoter will allocate: (i) (ii) 2 Prizes to Entrants with an Entered Premises in Zone 1 that has a business account with the Promotor (on any tariff other than the N2 tariff); and 3 Prizes to Entrants with an Entered Premises in Zone 1 that has a residential account with the Promotor on the A2 tariff. c) In Zone 2, the Promoter will allocate: (iii) (iv) (v) 2 Prizes to Entrants with an Entered Premises in Section 1 of Zone 2 that has an account with the Promoter on any tariff; 2 Prizes to Entrants with an Entered Premises in Section 2 of Zone 2 that has an account with the Promoter on any tariff; and 1 Prize to Entrants with an Entered Premises in Section 3 of Zone 2 that has an account with the Promoter on any tariff. d) If an Entrant has submitted two entries in accordance with clause 7(b), that Entrant will not be permitted to win two Prizes. If the judging results in two entries from a single Entrant being judged as Prize winners, the Promoter will allocate one of those Prizes, in its absolute discretion, to a replacement winner. 13. Prizes: Each of the 10 prizes (each a Prize ) will be, at a minimum, a 3kW rooftop solar photovoltaic package as selected by the Promoter, in its absolute discretion, as the best fit for the winner s residence and the best to fulfil the Promotor s objectives in running the Carnarvon Distributed Energy Resources trial. Each Prize will be valued at $18,000 or more, inclusive of

4 GST. The package may include, as selected by the Promoter in its absolute discretion, a photovoltaic inverter, battery, battery inverter and other components. 14. No transfer of Prizes: The Prize must be taken as stated, is not transferable to another person or exchangeable for other goods and services, and cannot be taken as cash. 15. Notification of winners: The Prize winners will be notified by mail sent within 5 business days of the judging. 16. Prize acceptance criteria: To accept a prize, a Prize winner must: a) allow a Horizon Power site assessment of the Entered Premises; b) have both adequate and appropriate roof space and suitable property for the Prize as determined by the Promoter, in its absolute discretion, following its site assessment of the Entered Premises; c) have a continuously connected internet connection at the Entered Premises that is adequate to enable participation in the Horizon Power 3 year Distributed Energy Resources trial ( DER Trial ) as determined by the Promoter, in its absolute discretion; d) agree to the terms of the DER Trial as outlined in the Customer Contract (available at: and enter into a contract on those terms with Horizon Power in respect of the Entered Premises. 17. Forfeiture of Prizes: If a Prize winner has not complied with these Terms and Conditions, does not claim their Prize within five days of being notified as a Prize winner or is found not to meet the Prize acceptance criteria set out in clause 16, the Promoter may deem that Prize winner s Prize to be forfeit and may award that Prize to another Entrant. Any Prize winner awarded a forfeited Prize will be subject to the same provisions of these Terms and Conditions as an originally awarded Prize winner. 18. Announcement: Following the Promoter s determination that 10 Prize winners have met the Prize acceptance criteria set out in clause 16, the Prize winners will be: a) announced on the Horizon Power website and corporate Facebook page; and b) announced in an edition of the Promoter s customer magazine, On the Horizon. 19. Additional documentation: As a condition of accepting the Prize, the Prize winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form. 20. Breach of terms: If the Promoter finds that the Prize winner has breached these Terms and Conditions, then the Prize winner must promptly return their Prize to the Promoter upon receiving a request to do so. 21. Reservation of rights: The Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend this Promotion at any time. 22. Limit of liability: The Promoter and others associated with this Promotion and their respective related bodies corporate, officers, employees, contractors, and agents will not be held liable for any loss, damage, injury or death whatsoever which is suffered or sustained (including but not limited to direct, indirect and consequential loss and including but not limited to any loss, damage, injury or death arising from any person s negligence) in connection with this Promotion, the promotion of this Promotion, the installation or any use of any Prize, except for any liability which cannot be excluded by law (in which case the liability is limited to the minimum allowable by law).

Force majeure: If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter or which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. 24. Intellectual property: Any Win a Solar Photovoltaic System and Battery Competition description or entry which is submitted as part of the Promotion becomes the property of the Promoter. By submitting an entry, you warrant that you own the intellectual property in the entry you submitted. 25. Personal information: This clause 25sets out the basis on which the Promoter may use an Entrant s personal information, such as their name and age ( Personal Information ): a) Entrants warrant that any Personal Information that they provide to the Promoter is accurate; b) Entrants irrevocably consent to the Promoter using any Personal Information which they submit in connection with this Promotion on an on-going basis for any purposes connected with the Promoter s business, including the conduct of the Promotion and publication of Prize winners; c) the Promoter s use of an Entrant s Personal Information in accordance with this clause 25 may involve: (i) (ii) publication in any media (including our websites, in print and on television); and disclosure to third parties (including State and Territory lottery departments and the Promoter s contractors) in connection with the Promoter s business; d) Entrants will not be entitled to receive any remuneration or notice in relation to the Promoter s use of their Personal Information in accordance with this clause 25; and e) the Promoter complies with the Australian Privacy Principles in the Privacy Act 1988 (Cth) ( Privacy Act ). The Promoter also has a Privacy Policy, which is available on request or on the Promoter s website at ( Privacy Policy ). The Promoter will use any Entrant s Personal Information in accordance with the Privacy Act and its Privacy Policy. 26. Governing law: These Terms and Conditions are governed by the laws of Western Australia.
