1 Hong Kong Science & Technology Parks Corporation Request for Quotation (RFQ) on Internet Connectivity Service for HKSTP ( ) Hong Kong Science & Technology Parks Corporation (HKSTP) would like to invite vendors to submit price quotation for the following:- Provide Internet Connectivity Service for HKSTP ( ) Vendors are requested to bid on complete scope and submit the fixed price for the total solution; and no partial solution or alternation of price afterwards will be considered or accepted. Accuracy of RFQ Prices Vendors should make certain that the prices quoted are accurate and properly include all the products and services (shipment, delivery, un-pack, installation, integration, customization and configuration, wiring & cabling patching, etc) included in this project per HKSTP request before submitting its quotation. Under no circumstances will HKSTP accept any request for price adjustment on the ground that a mistake has been made in the RFQ pricing. Scope of Work: The details scope of works should be reference to Appendix I. Validity of RFQ Vendor is requested to submit its offers in Hong Kong Currency with precise breakdown. All quotations shall be valid for a period of 3 months. Formation of Contract Unless and until the original Purchase Order has been issued by the HKSTP in related to this RFQ, there is no contract between HKSTP and any vendors who submit the proposals. Purchase Order Terms & Conditions The HKSTP s Purchase Order Terms and Conditions version dated 4 March 2016 which is available in our Corporation s website refers. Payment Terms Monthly payment upon satisfactory completion of service work, receipt of invoice and supporting documents. Page 1 of 23

3 Interested Vendor notification Interested vendor should to to indicate their interest to submit proposal, such that if there is any addendum to the RFQ, we can notify the vendor. Interested vendor should also visit our Corporation s website from time to time to check if there is any addendum to the RFQ. Assessment: The assessment will be based on price element only. Vendor acknowledges that HKSTP has sole discretion whether or not to accept any or all of vendor s proposal irrespective of its prices. Anti-collusion: The tenderer shall not communicate to any person other than HKSTP the amount of any tender, adjust the amount of any tender by arrangement with any other person, make any arrangement with any other person about whether or not he or that other person should or should not tender or otherwise collude with any other person in any manner whatsoever in the tendering process until the tenderer is notified by HKSTP of the outcome of the tender exercise. Any breach of or non-compliance with this clause by the tenderer shall, without affecting the tenderer s liability for such breach of rules and laws or non-compliance, invalidate his tender. This clause shall have no application to the tenderer s communications in strict confidence with his own insurers or brokers to obtain an insurance quotation for computation of tender price and communications in strict confidence with his consultants / sub-contractors to solicit their assistance in preparation of tender submission. Declaration: HKSTP will evaluate proposals in strict confidentiality. The corporation is not bound by accepting any proposal it may receive. It shall be noted that the corporation would not be responsible for the reimbursement of any cost incurred by vendor for the preparation of the submission. If the vendor fails to deliver the services to the satisfaction of HKSTP, HKSTP may terminate the services by giving 1 month prior written notice to the vendor and the vendor refund will be subjected to the extent of the work in progress as determined by HKSTP. By submitting the quotation to us, the vendor agreed the terms and conditions stated in this Request for Quotation. Page 3 of 23

4 Buy HK SME Innovation Preferred To show HKSTP s support for the Hong Kong innovation & technology SME community, for any SME Vendor who could show their proposed solution contains HK Innovation, their quotation will be eligible for a 10% favourable comparison advantage. The vendor needs to furnish the relevant information to HKSTP in this RFQ response in order to be eligible for the preferential scoring. Eligible HK SME Innovation quotations will receive 10% deduction in price comparison with a predetermined ceiling of deduction amount. In the process of determining the successful vendor, an amount of 10% will be nominally deducted from the qualified local vendor s quotation for the purpose of price comparison. For example : a) Proposal A is not a HK Innovation and its price is $100. b) Proposal B is a HK Innovation and its price is $111. c) After applying the preferential 10% deduction (i.e ), Proposal B s price becomes $99.9 and hence Proposal B will win. d) The Corporation may award the contract to Proposal B at $111. A HK SME Innovation is any product/technology designed, researched or developed in Hong Kong by a Hong Kong SME company. HKSTP s judgment will be final in determining whether a vendor s proposal contain HK Innovation and to what extent. The vendor warrants that the content of HK innovation nominated in its quotation / tender will be met in full. Failure to achieve this will render the termination of the goods / service by HKSTP at its sole discretion with no compensation to the vendor. Page 4 of 23

Transfer or Assigning Contract The contractor is prohibited from transferring or assigning, directly or indirectly, any parts of the Contract, whatsoever. The Contractor shall submit the names of all Sub-Contractors to the HKSTP for approval. 3. Sub-Contractor & Agent The Contractor shall remain responsible for the acts and omission of all his Sub-Contractors, their agents, servants and workmen as fully as if they were the acts and omissions of the Contractor, his agents, servants and workmen. 4. Variations 4.1 The IT Manager shall have the power to vary the quantity of bandwidth requirement by one month written notice to upgrade or downsize the service. 4.2 No payment shall be made to the Contractor in respect of any variation of the contract, unless he receives a written order from the IT Manager prior to the commencement of the work involved in such variation. Notices and Instruction Any notice or instruction to be given to the contractor under this Contract may be served by sending:- 5.1 The same by registered post or by leaving the same at the Contractor s registered office. 5.2 All notices and instructions by post shall be deemed to have been duly served two days after posting. 5.3 Any notice to be given to the HKSTP under this Contract may be served by sending the same by post to or by leaving the same at the HKSTP s registered office. 6. Provision of Labour during the connection work 6.1 The Contractor shall provide skilled technicians and a competent engineer whilst carrying out the works detailed in this contract. 6.2 Such men will comply with all reasonable instructions or directions given to them by the IT Manager whilst working on or in the building. 6.3 All works carried out by such men shall be performed to the highest technical standards and to the satisfaction of the IT Manager. 7. Protection The Contractor is to provide adequate protection and all temporary measures necessary to protect the occupants and visitors to the building during the connection works if necessary and to protect all existing structures. 8. Equipment Contractor is to provide all necessary tools and equipment to complete the works and to protect the building occupants, visitors and existing finishes and fittings. 9. Publicity The Contractor will not be permitted to publicize any aspect of the contract without the prior written approval of the IT Manager. Page 6 of 23

7 10. Working Hours The Contractor will be granted access to the site at all times but all technical staff must follow the rules and regulations as stipulated by the Facility Management. Works which cause disturbance to other occupants may be restricted during normal office hours. 11. Materials and Debris The Contractor is to remove daily all accumulated debris and to ensure that all debris, materials and plants are removed on completion. No storage of materials and debris will be permitted at the IT Room, ELV Duct Rooms or any where at ground floor areas of the Building unless otherwise permitted by the Facility Management. 12. Cleaning Upon completion, the contractor is to maintain the IT Rooms, ELV Duct Rooms and or other areas in clean and tidy condition. 13. Notice Board No signs advertising the Contractor or presence of works will be permitted at site area. 14. Security The need for security at the premises is emphasized and all personnel will be required to carry appropriate identification. 15. Access Access to the site of works shall be through designated routes as agreed with the Management. 16. Government Regulations It is the Contractor s responsibility to comply with all Government Regulations. In particular the Contractors attention is drawn to the Construction Sites (Safety) Regulations and Confined Space issued under the Factories and Industrial Undertakings Ordinance. 17. Transportation All transportation incurred by the Contractor in connection with the Contractor or parts, thereof, shall be borne by the Contractor. Page 7 of 23

Compliance with Statutory Rules and Regulations The Contractor shall carry out all work within this Contract in strict accordance with the Laws, Ordinances, Regulations Orders and By-Laws having the force of law applying, within Special Administrative Area - Hong Kong which has a bearing upon the Contractor s performance and duties under this Contract. 19. Contractor to Visit the Site The Contractor is advised to visit the site and inspect the equipment. No extra claim will be entertained in this respect due to the Contractor s negligence of this aspect. 20. Ownership of the Contract / Equipment / Service / License Hong Kong Science & Technology Parks Corporation is the owner of the equipment and entitled to sign the contract or assign the management agent to act on behalf to manage the relevant consultant / contractor on the execution of the Contract signed. Any incorporated license and service should be named under Hong Kong Science and Technology Parks Corporation. Page 8 of 23

9 22. Minimum Wages Policy The Service Provider shall observe and follow the relevant minimum wages guideline laid down by the HKSAR Government within the terms of providing the maintenance and repair service at HKSP. 23. Insurance The Contractor shall be responsible for all insurances as required by HKSTP at its own expense from the commencement date of the service contract effect and maintain for the benefit and in the joint names of the contractor, Urban Property Management Limited and Hong Kong Science and Technology Parks Corporation. Such insurances as are necessary throughout the Term to cover its liability in respect of personal injury, death, loss and damage to Property, real or personal arising out of or being caused by the carrying out of this contract by the contractor, its employees or agents 24. Tests 23.1 Contractor All Risks Policy The Contractor shall keep insured a contractor all risk policy in the sum of HK$10,000, per claim to insure against any damages / claims due to accidents such as fire or other hidden hazards. The said insurance policy should contain cross liability clause and indemnity to principal clause, the contractor should submit the name of the insurance company through which the said insurance policy is insured to the HKSTP/Principal for approval Public Liability Insurance The policy required shall be taken out for a limit of HK$10,000, for any one accident and unlimited in amount for the period of insurance. It shall contain a Cross- Liability clause as between the HKSTP and the Contractor and it shall cover the whole Contract Period. The policy shall be extended if the Contract Period is extended. If the Contractor considers the above-mentioned limit of indemnity for any one accident is inadequate to cover his contractual obligations, he is at liberty to take out a policy with an increased limit of indemnity but any additional or differential in premium shall be at his own expense. All tests so called for will be in accordance with the relevant code of commissioning practice as defined by the relevant Government Authority. Page 9 of 23

10 25. Basis of Acceptance 25.1 Contractor should note that their submitted quotation sum is a lump sum fixed priced basis". Incomplete tender will not be considered Contractor should comply with all technical requirements before HKSTP will then consider the submitted quotation sum The HKSTP is not bound to accept the lowest tender it may receive. In addition, the HKSTP may reject bids which are considered to have been priced unreasonably low. 26. Contract Unit Rates with Provisional Quantities For those Schedule of Rates items described as Provisional, the quantities of such items are subject to re-measurement upon completion of works. The Contract Sum shall be adjusted accordingly. The works which are subject to the provisional quantities will be measured as delivered and supplied and paid for at the rates contained in these schedule of rates and all amounts against the provisional items in the schedules will be deducted in full from the Contract Sum. No claim for loss of profit, overheads, etc. being permitted to the Contractor. Page 10 of 23

11 1. Proposal SECTION II : GENERAL DESCRIPTION OF WORK The related proposal, work program and routing etc, shall be submitted by Contractor for IT Manager s consideration and approval. 2. Commencement Date of the Service Contract The commencement date of the contract is tentatively set in early of January The IT Manager reserves the right to defer or early start the commencement date at his own discretion. Prior notice will be given to the contractor upon the confirmation of the date and to start the maintenance contract accordingly. 3. Approvals Throughout the contract period, the HKSTP shall give his approval or agreement to the Contractor s detailed specification, drawings, samples, Contractor Work as executed, etc. Such approval or agreement shall not in any way imply or be construed as a relief or abatement of the Contractor s responsibilities to comply with the requirements of this document. 4. Building Provision The contractor shall be responsible to check and ensure that these provisions are properly provided for the ease of maintenance. 5. Standards All details of the equipment, materials and installations standard shall comply with the current standards and regulations. Page 11 of 23

12 6. Materials and Workmanship Materials and workmanship shall be of highest standard and the Contract Works shall be carried out to the satisfaction of the IT Manager. The Contractor shall be responsible for all materials and components supplied or manufactured on his / her behalf under the condition for this Specification. Where codes and standards are not defined specifically, the appropriate market standard / practice shall be deemed to apply. In the event of conflict between any referenced code or standard and this Specification, the more stringent requirement shall have preference. Changes to and / or confirmation of the Specification or the standards of materials and workmanship shall be agreed on the basis of samples. 7. Results of Tests If the test results show that the equipment is not functioning in a satisfactory manner or providing the requirements of this Specification, the IT Manager shall decide whether this is due to incorrectness of faulty work by the contractor and if this be the case, the contractor shall, when called upon, carry out at his / her own expense such alterations, replacements and adjustments as may be required, to the IT Manager complete satisfaction. The IT Manager decision as to what constitutes a satisfactory test shall be final. Page 12 of 23

13 SECTION III: SPECIFICATION AND SCOPE OF WORK 1. Location The Hong Kong Science Park at Pak Shek Kok, N.T., Hong Kong. 2. Date of Ready For Service On or before 1 st January Contract Term calendar months contract ( ) 4. Bandwidth a. Primary link to be provided by the ISP shall be initially at 80 Mbps and upgradeable to 100Mbps in the future upon requested by the HKSTP. b. Secondary link to be provided by the ISP shall be initially at 70 Mbps and upgradeable to 100Mbps in the future upon requested by the HKSTP. c. Both links shall be symmetrical. Both Local HKIX and International traffic should be able to reach the subscribed bandwidth limit. (i.e. When we subscribe 60M, for each of the link, local HKIX traffic can reach 60M and International traffic can reach 60M.) 5. Scalability a. The bandwidth of those connections shall be made scalable within the range from 1Mbps to 100Mbps on per 5Mbps step. b. Provisioning lead-time for upgrade shall not affect Hong Kong Science Park s services during normal operation hours and should also have no major changes in technology and/or hardware upgrade. c. The HKSTP may request the contractor to upgrade or downgrade the bandwidth from time to time. Contractor should advise the service lead-time in a separated proposal. 6. Technology upgrade Other options for technology upgrade of the ISP links to 1Gbps or above should be available. IPv6 or Internet 2 connectivity service should also be available. 7. Internet address block Hong Kong Science Park has its own public Class C address blocks and AS number, ISP shall provide address announcement service. Page 13 of 23

14 8. Service Resilience a. The Internet connectivity service shall be provided by two completely separated links to offer service resilience, which shall be backed up each other upon service interruption. The incoming links shall be fed from two Internet exchange service/data centers that are geographically apart from each other and located at different district of Hong Kong. b. Site visit of the two Internet exchange service/data centres shall be arranged before award of the contract upon request by the Manager. 9. Routing arrangement a. Hong Kong Science Park equipped with two separate routers for connection to the ISP. Each router will have a Fast Ethernet port for the connections. These ports might be shared by other Virtual Circuits / VLAN for other WAN services. The two routers will be connected to the same internal LAN segment. The two Internet connections should be configured to back up each other. b. In case of a single link failure or single router failure, the remaining connection should be able to take up the routing for both address sub-blocks and should be transparent to the user. c. The ISP shall provide connection to each of the Science Park router for international and local HKIX Internet traffic. As the Science Park has its own autonomous system and address block, BGP4 shall be running among the routers of the Science Park and the ISP for load sharing and resiliency. Science Park s router will announce its own AS number to the ISP. Upon BGP4 session establishment, the ISP shall announce the Science Park address block to Internet such that international and local Internet traffic can be routed through the ISP Internet gateway for Hong Kong Science Park. Hong Kong Science Park routers links connected to the ISP will be configured to announce the Science Park address block under its own AS number through BGP4 and receive only default route from the ISP. g. The ISP shall ensure that the proposed links/circuits will not be shared by other networks as well as broadcast domain(s) other than that for Hong Kong Science Park. In other words, the proposed links/circuits shall be dedicated for carrying Science Park s traffic. h. The ISP s border router shall announce Hong Kong Science Park address block to the HKIX and international peers. The Science Park routers will be configured to be interior BGP peers to each other for exchanging received routes. i. The ISP shall allow Hong Kong Science Park to modify the internet routes announcement at any time. Page 16 of 23

17 10. Service Level and Network Availability a. The Mean Time To Recovery (MTTR) for the connectivity service shall not be more than 4 hours. b. The ISP shall ensure that Network Availability during a calendar month is equal to or greater than 99.9% (Network Availability Service Level ) c. The Network Availability shall be calculated as follows: 100% x (Total number of hours of the month Total Outage Hours of the month*) (Total number of hours in the month) Note: * Total Outage Hours means the number of hours that the customer was unable to access the Internet in a month using the Internet Connectivity Service due to a fault or error in the network equipment in the backbone under the direct control of the ISP. d. The ISP shall have International Private Leased Circuit (IPLC) to US of minimum STM-1 (155Mbps). It shall also have other link(s) with aggregate bandwidth of 4 Mbps or above to other counties for regional traffic and backup purpose. e. The ISP shall have resilience architecture in Gigabit Ethernet connection to HKIX. f. Schedule Maintenance means periodic maintenance or other scheduled interruptions to the Internet connectivity service. g. The ISP shall notify the customer of any Scheduled Maintenance 7 calendar days in advance in any manner ISP deems to be appropriate. h. The expected RFS date for these connections shall be continuous with the previous service contract. The ISP shall negotiate directly with the existing service provider PCCW for the Metro-Ethernet and related services for a smooth service transfer. 11. Customer Service Hotline a. General Enquiries A Customer Service Hotline shall be available for general customer inquiries including billing inquiries and service inquiries from 9:00 am to 9:00 pm 7 days a week including public holidays. b. Fault Reporting A Fault Reporting Hotline shall be available for customer to report any service fault 24hours a day, 7 days a week including public holidays. Page 17 of 23

18 12. Limitation of Liability a. The ISP shall provide a credit towards the account of the Science Park in accordance with this clause if ISP does not comply with the Network Availability Service Level. b. If the ISP fails to comply with the Network Availability Service Level within calendar month, ISP sole liability to the customer shall be to credit to the customer s account an amount ( Availability Rebate ) calculated as: Total Outage Hours of the month x Monthly Subscription Charge** x Hours # Note ** In relation to the subscription of Internet Connectivity Service # 30 days x 24 hours = 720 hours 13. Change of Subscription Bandwidth The ISP shall allow Hong Kong Science Park to upgrade or downgrade the Internet bandwidth. Should there be additional administration charge on this service, it shall be stated clearly in the tender proposal submission. 14. Fiber Connection Work The contractor is responsible for laying the necessary fiber network from external site to connect with Hong Kong Science Park s network at IT Room and the related work should be completed within ten (10) days upon the date of confirmation of contract. 15. Termination Early termination of the service shall be allowed by a 30 days prior notice after 5 months service with no penalty incurred. Page 18 of 23

19 16. Validity of Offer Vendor is requested to state clearly the period for which their offers are valid. In any case, it shall not be less than 90 days from the closing date of this tender. Page 19 of 23

The awarded contractor shall submit a detailed survey report including equipment list of the existing IT Infrastructure / installation inside the building concerned. 2. All Vendors are required to attend a site inspection before submission of tender. 3. The contractor is required to arrive on site and report to HKSTP management office within 2 hours upon receipt emergency services call. 4. The Client/HKSTP is not bound to employ contractor for any repair of the IT infrastructure / installation inside the building. 5. Vendor should complete the attached schedule of rate at the time of tender submission; failure to do so may lead to rejection of whole tender. 6. The HKSTP is not bound to accept the lowest tender.
